NO:NO:勞動合同LABORCONTRACT甲方:PartyA:公司地址:上海市閘北區(qū)江場三路138號RegisteredAddress:NO.138,JiangChangSanRoad,ZhabeiDistrict,Shanghai,China乙方:PartyB:身份證號碼:IDNumber:家庭地址:HomeAddress:根據(jù)《中華人民共和國勞動合同法》及有關(guān)法律和法規(guī)的規(guī)定,甲乙雙方在平等自愿、協(xié)商一致的基礎(chǔ)上簽訂本合同。AccordingtotheLaborContractLawofPRCandrelevantlawsandregulations,PartyAandPartyBsignthiscontractonthebasisofequality,freeandmutualconsultation.工作內(nèi)容1、WorkingContents甲方因生產(chǎn)需要,同意聘用乙方為本公司員工,職位為。乙方同意接受該安排,遵守勞動紀律和職業(yè)道德,執(zhí)行勞動安全規(guī)程,提高職業(yè)技能,完成生產(chǎn)(工作)任務(wù)。Tomeettheproductiondemand,PartyAagreestoemployPartyBas.PartyBagreestoacceptthearrangement,observethelabordisciplineandprofessionalethics,carryoutrulesofsafeoperation,improveprofessionalskillsandaccomplishesproductiontasks.甲方可根據(jù)生產(chǎn)經(jīng)營需要依法調(diào)整乙方的工作崗位或職位。PartyAmaylegitimatelyadjustParty B'spostaccordingtobusinessrequirements.合同期限2、TermofContract本合同自年月日至年月日,其中試用期為個月(自年月日至年月日)。勞動合同的期限屆滿或約定的終止條件出現(xiàn),勞動合同即終止執(zhí)行。經(jīng)雙方協(xié)商一致的,可以解除或續(xù)訂勞動合同。Thiscontractwillbeeffectfrom(date,month,year)to(date,month,year),duringwhichtheprobationperiodismonths(from(date,month,year)to(date,month,year)).Thecontractwillbeterminatedwhenthecontractisatitsexpiryoragreedterminationconditionsareoccured.Bothparties mayrescindorrenewthecontract viamutualconsultation.工作時間3、WorkingHours甲方實行每周工作40小時和2天休息日的標準工時制度。PartyAcarriesoutstandardworkinghoursystemof40hoursperweekandtworestdays(maybetheyarenotSaturday,Sunday).甲方因工作需要,在乙方愿意的前提下,可依法安排乙方超時工作或公休日加班。PartyAmaylegitimatearrangePartyBtoworkovertimeorworkongeneralholidaysduetobusinessrequirementsonconditionthatPartyBiswillingtodoso.甲方由于工作需要更改工時制度,經(jīng)政府有關(guān)部門批準后,乙方應(yīng)密切配合執(zhí)行。PartyAmaychangeworkinghourssystemforbusinessrequirementafterapprovalbyrelevantgovernmentauthoritiesandPartyBshallexecuteitofhisownwill.四、薪酬4、Remuneration甲方支付乙方的每月基本工資為人民幣元。上述薪酬不包括甲方按公司補貼規(guī)定按月向乙方支付的所有補貼。PartyApaysRMBtoPartyBasbasicwagepermonth.TheaforesaidremunerationexcludesallsubsidiespaidtoPartyBpursuanttoPartyAsstipulation.甲方嚴格執(zhí)行國家有關(guān)最低工資的規(guī)定和標準。PartyAshallstrictlyimplementrelevantregulationsandstandardperthelowestwage.甲方的發(fā)薪日期為每月15日。PartyAshallpaythewageonthe15dayeverymonth.勞動保護與勞動條件 一LaborProtectionandLaborConditions甲方須對乙方進行勞動安全、業(yè)務(wù)技術(shù)及勞動紀律等方面的教育和培訓(xùn),并根據(jù)國家對勞動保護、安全生產(chǎn)的要求,為乙方提供必要的生產(chǎn)(工作)條件,保障乙方的安全健康。PartyAshallgivePartyBeducationandtrainingprogramsrelatingtolaborsafety,professionalskillsandlabordisciplinesetc.Accordingtotherequirementsofstatelaborprotectionandsafe-production,PartyAshallprovidenecessaryworkingconditiontoensurePartyB'ssafetyandhealth.社會保險和福利SocialInsuranceandWelfare甲方依法替乙方辦理各項社會保險并繳納保險費用。但依法規(guī)定之分攤比例,屬于乙方須自行負擔之各項社會保險金,由甲方于每月發(fā)薪時,從乙方薪資中代扣代繳。PartyAshalltransactsocialinsuranceandpaythemforPartyB.PartyAshallwithholdthesocialsecurity contribution legallyundertookbyPartyBwhenpayingtheremunerationeverymonth.乙方享有國家規(guī)定的所有法定假日。PartyBwilltakeallstatutoryholidaysstipulatedbytheState.甲方實行年休假制度,乙方連續(xù)工作滿一年以上的可享受有薪年假,申請享受辦法按甲方制定的年假規(guī)定執(zhí)行。PartyAcarriesoutannualvocationsystem,PartyBcantakepaidannualvocationaftercontinuouslyworkingfor1yearandtheapplyingprocedureforannualvocationshallbedonepursuanttoPartyA’sstipulation.乙方責任7PartyB’s Responsibility乙方必須認真工作和勞動,保質(zhì)保量地完成自己的生產(chǎn)任務(wù)。PartyBmustworkearnestlyandaccomplishitsowntaskswithqualityandquantity.乙方必須如實匯報工作,積極配合和協(xié)助上級的工作。PartyBmustreportitsjobaccordingtothefactsandshallcooperatewithitsuppersandassisttheirjobs.乙方應(yīng)嚴格履行甲方依法制定的規(guī)章制度和《員工手冊》 。PartyBshallstrictlyimplementtherulesandregulationsandHandbooklegallystipulatedbyPartyA.乙方應(yīng)愛護甲方的財物,對由于本人責任造成的直接經(jīng)濟損失,必須予以賠償并接受甲方的處罰。PartyBshalltakegoodcareofPartyA’s propertyandhe/shemustindemnifydirectdamageduetohis/herliabilityandacceptsPartyA’s punishment.乙方在勞動合同有效期內(nèi)未經(jīng)甲方事先書面同意,不得為另一家雇主工作。PartyBcannotworkforanotheremployerwithoutPartyA’s writtenconsentinthedurationofLaborContract.乙方應(yīng)嚴格保守甲方的商業(yè)秘密,不得向任何第三方泄露。PartyBshallstrictlykeepPartyA’s tradesecretandcannotdivulgetoanythirdparty7.7如實陳述履歷和學(xué)歷。PartyBshallstatehis/hercurriculumvitaeandeducationalbackgroundaccordingtothefacts.如甲方委派乙方培訓(xùn)(包括海外培訓(xùn)) ,乙方必須遵守甲方的培訓(xùn)條規(guī)和承諾。PartyBshallobservePartyA’s trainingrulesandundertakingwhenPartyAassignsPartyBtobetrained.甲方無償解除合同8CancellationoftheContractwithoutCompensationbyPartyA若符合下列情況之一的,甲方可以隨時解除合同,而不必給予乙方任何經(jīng)濟補償:PartyAmaycanceltheContractatanytimewithoutcompensationtoPartyBunderthefollowingcircumstances:當乙方在試用期內(nèi)不符合甲方的職工錄用條件,甲方無須給予乙方解除的原因。WhenPartyBisproventobeunqualifiedforPartyA’s employmentconditionsduringprobationperiod,PartyAneednotgivePartyBthereasonforcancellation.8.2乙方嚴重違反甲方依法制定的規(guī)章制度和勞動紀律。PartyBseriouslyviolatesrulesandregulations,labordisciplinelegallystipulatedbyPartyA.乙方嚴重失職,營私舞弊,給甲方利益造成重大損失。PartyBseriouslyneglectshis/herdutyandgraftsresultinginPartyA’s greatloss.乙方違反中國法律,受到司法處罰或追究刑事責任。PartyBviolatesthelawsofPRCandgainsjudicialpunishmentorisfoundaguilty.甲方有償解除合同CancellationoftheContractwithCompensationbyPartyA有下列情形之一的,甲方可以解除勞動合同,但是應(yīng)當提前 30天以書面形式通知乙方或支付一個月基本工資代替,并依法支付乙方經(jīng)濟補償金或補助費。Underthefollowingcircumstances,PartyAmaycanceltheContractwith30dayspriorwrittennoticetoPartyBorpayingonemonthbasicwageinsteadandlegallypayeconomiccompensationorsubsidytoPartyB.乙方患病或非因工受傷,醫(yī)療期滿后仍不能從事原工作或由甲方另行安排的工作的。PartyBisillornon-work-relatedinjured,andunabletodotheformerjoborotherjobassignedbyPartyAaftermedicaltreatment.乙方不能勝任工作,經(jīng)過培訓(xùn)或調(diào)整工作崗位,仍不能勝任的。PartyBisnotcompetentforthejobandstillremainssoaftertrainingoradjustmentofthepost.本合同訂立時所依據(jù)的客觀情況發(fā)生重大變化,致使本合同無法履行,甲乙雙方不能就變更本合同達成協(xié)議的。Thebasisfortheconclusionofthecontracthasgreatlychangedsothatthecontractcannolongerbecarriedout,whilebothpartiescannotreachanagreementonmodifyingthecontractbymutualnegotiation.甲方瀕臨破產(chǎn),進入法定整頓期間或者生產(chǎn)經(jīng)營狀況發(fā)生嚴重困難,達到當?shù)厝嗣裾?guī)定的嚴重困難企 業(yè)標準,確須裁減人員,并按法定程序解除勞動合同的。PartyAisclosetobankruptcyandentersintolegalrectificationperiodoritisinaseveredifficultytomeetthestandardofseveredifficultenterprisestipulatedbythelocalgovernmentandtheretrenchmentisneeded,andthenPartyAcancelsthecontractaccordingtolegalprocedure.十、乙方要求解除合同CancellationoftheContractatPartyB’s request乙方要求解除勞動合同,應(yīng)當提前三十天以書面形式通知甲方,但必須依照 11.2條款賠償甲方。PartyBshallgive30dayspriorwrittennoticetoPartyAwhenrequestingtocanceltheContract,buthe/sheshallindemnifyPartyAaccordingtoArticle11.2.10.2乙方在下列情況下,可隨時通知甲方解除勞動合同。Underthefollowingcircumstances,PartyBmayinformPartyAtoterminatetheContractatanytime.在試用期內(nèi)。Beinprobationperiod.甲方不按照勞動合同支付勞動報酬或者提供勞動條件的。PartyAdidn’tpaytheremunerationorprovideworkingconditionsaccordingtotheContact.甲方以暴力威脅或者非法限制人身自由的方法強迫乙方工作的。PartyAforcesPartyBtoworkbymeansofforce,threatorillegalrestrictionofpersonalfreedom.十一、違約責任Liability forBreachofContract甲方依第 9條提前解除合同,應(yīng)按法律規(guī)定向乙方支付經(jīng)濟補償金。PartyAshalllegallypayeconomiccompensationtoPartyBwhencancelingtheContractpursuanttoArticleNight.乙方違約不履行合同,應(yīng)按《培訓(xùn)合同》的約定及法律法規(guī)的規(guī)定賠償甲方的經(jīng)濟損失。PartyBshallindemnifyPartyAforitseconomiclossaccordingtolawsandregulationsandTrainingAgreementwhenhe/shebreachestheContract.十二、合同附件AnnexesoftheContract本合同的附件為本合同不可分割的組成部分,與本合同具有相等的法律效力。TheAnnexesareindivisiblepartsofthiscontractandtheyhavethesameeffectasthiscontract.甲方依法制定的《員工手冊》及各項規(guī)章制度是本合同的附件。HandbookandotherrulesandregulationslegallystipulatedbyPartyAareannexesofthisContract.十三、勞動爭議LaborDispute甲乙雙方若發(fā)生勞動爭議,應(yīng)通過友好協(xié)商解決;若不能解決,可以向當?shù)赜泄茌牂?quán)的勞動爭議仲裁委員會申請仲裁;對仲裁不服的,可向人民法院起訴。提出仲裁的一方應(yīng)當在勞動爭議發(fā)生之日起 60天內(nèi)向勞動爭議仲裁委員會提出書面申請;當事人對仲裁裁決不服的,可以在收到仲裁裁決書之日起 15天內(nèi)向人民法院起訴。Iflabordisputeoccurs,bothpartiesshallresolveitthroughconsultation.Incaseoffailingtoreachanagreement,eachpartymaysubmitthedisputetoLaborDisputeArbitrationCommitteehavingjurisdiction.Ifrejectingtheaward,eachpartycantakeaproceeding. Thepartyapplyingforarbitration shallsubmitthearbitrationapplicationtoLaborDisputeArbitrationCommitteewithin60dayswhenthelabordisputearises.Ifrejectingtheaward,thepartycansuetothecourtwithin15daysafterreceiptoftheaward.十四、合同生效EffectivenessoftheContract本合同自甲、乙雙方簽訂后生效。Thiscontract
