ErectionAllRisksInsurancetocovertheentireWorks(permanentand/ortemporary)fromanyandallkindsofdamageswhichitisstandardinternationalpracticeforacontractortoinsureundersuchapolicy;“安裝一切險”：范圍含全部工程保險（永久和/或臨時性工程保險），即承包商依照保險單規(guī)定按標(biāo)準(zhǔn)國際慣例投保的所有損害保險；(b) "Third-PartyLiabilityInsurance"tocoverinjuryordeathtopersonsordamagestopropertycausedbytheWorksorbytheContractor'svehicles,toolsand/orequipmentorpersonnel;“第三方責(zé)任險”：范圍包括由于工程施工或承包商的車輛、工具和/或設(shè)備或工作人員造成的人員傷亡或財產(chǎn)損害；(c) "Workman'sCompensationInsurance".ThistypeofinsuranceisrequiredunderVietnameseLawtobesecuredbytheContractorforhisemployees.TheContractorshall,therefore,faithfullycomplywiththerequirementsofsaidlaw.依照某國的法律規(guī)定，承包商須保證為其雇員提供“職工賠償保險”。因此，承包商應(yīng)如實遵照上述法律要求為其雇員投保職工賠償保險。(d) AutomobileLiabilityInsurance“機動車責(zé)任保險”： CoveringuseofallvehiclesusedbytheContractororitsSubcontractors(whetherornotownedbythem)inconnectionwiththeexecutionoftheWorks.“機動車責(zé)任保險”：范圍包括承包商或其分包商為執(zhí)行施工使用的所有機動車輛(無論所述機動車輛是否屬于承包商或其分包商所有)的責(zé)任保險。TheContractorhastheresponsibilitytoensuretheinsurancesasmentionedabovebythewaytoemployatrustyInsuranceCompanywhichisacceptabletoYY.TheseinsuranceswillbeeffectivetoFinalAcceptanceCertificateissuedbyOwnerspecifiedinContractAgreement.承包商負(fù)責(zé)確保提供上述所有保險，并投保守信可靠的、YY集團(tuán)接受的保險公司。上述保險的有效期至業(yè)主發(fā)出合同協(xié)議規(guī)定的最終驗收證書之日。Beforecommencingthesoilinvestigationworksatsite,theContractorshallsubmittheaboveInsurancePoliciestogetherwiththeofficialreceiptsevidencingpremiumpayments.在現(xiàn)場進(jìn)行土地勘察工作之前，承包商應(yīng)連同正式收據(jù)一起提交上述保險單，以證明其已經(jīng)支付保險金。BeneficiaryforErectionAllRisksshallbetheContractorwithinthePlantfence,andYYoutofthePlantfence;BeneficiaryforThirdPartyLiabilityRiskshallbeYY.安裝一切險受益人為電廠圍墻內(nèi)的承包商，以及電廠圍墻外的YY集團(tuán)；第三者責(zé)任險受益人為YY集團(tuán)。DeductibleslimitforErectionAllRisks:安裝一切險的免賠額限制如下：USD200,000.00A.O.AforLossorDamageduetoActsofGod由于自然災(zāi)害造成的任何一次事故的損失或損害扣除金額為200,000.00美元；USD200,000.00A.O.AforLossorDamageduetoCommissioning/TestingandMaintenancecausedbyTurbine由于汽輪機的調(diào)試/測試和維修期間發(fā)生造成的任何一次事故的損失或損害扣除金額為200,000.00美元；USD100,000.00A.O.AforLossorDamageduetoCommissioning/TestingandMaintenancecausedbyotherreasons.USD100,000.00A.O.AforLossorDamageduetoothercauses(subjecttoberevisedaccordingtotheconfirmationofInsurancePolicy).DeductiblelimitforThirdPartyLiabilitiesapplicableforpropertydamage:USD5000.00A.O.A適用于財產(chǎn)損害的第三方責(zé)任險的免賠額限制為：一次事故5000.00美元。DeductiblelimitforThirdPartyLiabilitiesapplicableforpersonalinjury:Nil適用于人員傷害險的第三方責(zé)任險的免賠額限制為：零美元。BeforePAC,theOwnershallbearthedeductiblesforthelossand/ordamagewhichiscausedbyreasonoftheOwner(includinghisemployeeandconsultant);Ifthelossand/ordamageiscausedbyanythirdparty,theContractorshallbearthedeductiblesforthelossand/ordamagewhichcannotbeclaimedfromtheinsurer;TheContractorshallbearthedeductiblesforthelossand/ordamagewhichiscausedbyotherreason(excludingForceMajeure)；FromPACtoFAC,theContractorshallbearthedeductiblesforthelossand/ordamagewhichiscausedbytheContractor.YYshallbearthedeductiblesforthelossand/ordamagewhichiscausedbyotherreasons.臨時驗收之前，業(yè)主須承擔(dān)由于其(包括業(yè)主雇員和顧問人員)造成的損失和/損害的免賠額；若上述損失和/損害由于任何第三方造成，承包商須承擔(dān)造成的損失和/損害的免賠額（該部分保險金不能由保險公司賠付）。承包商還須承擔(dān)由于任何其他原因（不含不可抗力因素）造成的損失和/損害的免賠額；臨時驗收到最終驗收期間，承包商須承擔(dān)其自己造成的損失和/損害的免賠額。由于其他原因造成的損失和/損害的免賠額則由YY集團(tuán)承擔(dān)。TheContractorshallindemnifyYYagainstallactions,suits,claims,demands,costorexpensesarisingfromorinconnectionwithanyaccident,illnessordeath(otherthansuchasmaybeattributabletoYY,itsagentsorservants)topersonsemployedbytheContractororhisSubcontractoratSite.承包商應(yīng)確保業(yè)主免于任何由于承包商或分包商的現(xiàn)場人員的所有事故、疾病或死亡引起或與事故、疾病或死亡有關(guān)的（不是由于YY集團(tuán)、其代理商或雇員引起）所有訴訟、訟案、索賠、要求、成本或費用。TheContractorshallindemnifyYYagainstalllossand/ordamagearisingfromitsimproperdesignfortheWorks.承包商須向由于其工程設(shè)計不當(dāng)對YY集團(tuán)造成的所有損失和/損害提供賠償。TheContractorshallinitiateandsuccessfullyobtainsecuritypaymentscoveringlossesand/ordamagesarisingoutoftheContract.FailuretoinitiateorsettletheclaimwithinareasonableperiodoftimeshallconstitutesufficientgroundsforYYtoexerciseitsrightsundertheContract.ShouldtheContractorfailorrefusetomaintainitsinsuranceabove,YYwillsecure,renewormaintainsaidinsurance,andanyandallexpensesincurredtherebyshallbedeductedfromanyandallsumsdueormaybecomeduetotheContractor.ThePerformanceBondsubmittedbytheContractorshallalsobeusedwherenecessarytocoversuchexpenses.承包商應(yīng)發(fā)起和獲得所有損失和/損害的賠償金。若承包商未能在合理的期限內(nèi)開始或解決該索賠，則YY集團(tuán)有足夠理由履行其合同賦予的權(quán)利。若承包商未能或拒絕進(jìn)行上述投保，則YY集團(tuán)將提供、續(xù)保或保持上述保險有效，但由此招致的全部費用從任何或所有到期付款中扣除。根據(jù)需要，可以從承包商提交的履行保函中扣除上述費用。2.AllRiskInsuranceforTransportationofEquipmentandMaterials.設(shè)備和材料運輸一切險保險WithoutprejudicetotheContractor'sobligationsandresponsibilitiesundertheContract,theContractorshallinsuretheequipmentandmaterialstobesuppliedanddeliveredwithareputableinsurancecompanyacceptabletoYY.TheinsuranceshallbetakenoutinthejointnamesoftheContractorandYYfortheirrespectiverightsandinterests,andshallcoverallRisksincludingseaandlandtransport,andwarrisk,fromplaceoforigintotheSite.在與合同項下規(guī)定的承包商義務(wù)和責(zé)任不相沖突的情況下，承包商應(yīng)為將提供和交付的設(shè)備和材料投保一切險保險，承包商應(yīng)投保信用可靠的、YY集團(tuán)接受的保險公司。由承包商和YY集團(tuán)依照各自的合同權(quán)利和利益聯(lián)名共同投保，一切險范圍為從原產(chǎn)地到工程現(xiàn)場之間的所有運輸保險，包括海運險、陸運險、戰(zhàn)爭險。Theinsurancecoverageshallbeonehundredandtenpercent(110%)ofthedeliveredcostandinsurancepremiumsshallbepaidbytheContractor.Undersuchinsurance,theindemnitymustbepayableinUSdollars,freelyusabletoreplaceorrepairsuchgoods.TheContractor,actingasagentforYY,shallinitiateproperactionandpursuesettlementregardinginsuranceclaimswheneverdamagesand/orlossesareinflictedonthegoods.TheContractorshallbeauthorizedtoreceivetheindemnitydirectlyfromtheinsurancecompaniesunlessotherwisedirectedbyYY.保額為交付的材料或貨物的價值的百分之一十（110%），保費由承包商支付。依照本保險單之規(guī)定，保險賠付必須采用美元支付，其應(yīng)能夠自由使用，以更換或修復(fù)保險賠付部分的貨物。作為YY
