國(guó)際土木工程建筑承包合同中英文對(duì)照PART工GENERALCONDITIONS第一章總則DEFINITIONSANDINTERPRETATION定義和釋義1．（1）IntheContract，ashereinafterdefined，thefollowingwordsandexpressionsshallhavethemeaningsherebyassignedtothem，exceptwherethecontextotherwiserequires：1．1在本合同中，除按上下文另具意義者外，下列詞語應(yīng)解釋如下：（a）'Employer'meansthepartynamedinPartIIwhowillemploytheContractorandthelegalsuccessorsintitletotheEmployer，butnot，exceptwiththeconsentoftheContractor，anyassigneeoftheEmployer．“業(yè)主”指第二章中所指定的雇用承包人的一方或其權(quán)利繼承人，但不包括業(yè)主的受讓人，經(jīng)承包人同意者除外。（b）“Contractor”meansthepersonorpersons，firmorcompanywhosetenderhasbeenacceptedbytheEmployerandincludestheContractor’spersonalrepresentatives，successorsandpermittedassigns．“承包人”指標(biāo)書已被業(yè)主接受的某個(gè)或某些人、商行或公司，包括其個(gè)人代表，繼承人和業(yè)經(jīng)認(rèn)可的受讓人。（c）“Engineer”meanstheEngineerdesignatedassuchinPartII，orotherEngineerappointedfromtimetotimebytheEmployerandnotifiedinwritingtotheContractortoactasEngineerforthepurposesoftheContractinplaceoftheEngineer、designated．“工程師”指第二章中所指定的工程師，或由業(yè)主隨時(shí)任命且書面通知承包人以代替指定工程師履行合同職責(zé)的其他工程師。（d)'Engineer’sRepresentative'meansanyresidentengineerorassistantoftheEngineeroranyclerkofworksappointedfromtimetotimebytheEmployerortheEngineertoperformthedutiessetforthinClause2hereof，whoseauthorityshallbenotifiedinwritingtotheContractorbytheEngineer．“工程師代表”指任何常駐工程技術(shù)人員、工程師助手，或由業(yè)主或工程師隨時(shí)任命履行本合同第二條規(guī)定職責(zé)的任何工程現(xiàn)場(chǎng)監(jiān)督，其權(quán)限應(yīng)由工程師書面通告承包人。（e)“Works”shallincludebothPermanentWorksandTemporaryWorks，“工程”包括永久性工程和臨建工程。（f）“Contract”meanstheConditionsofContract，specification，Drawings，pricedBillofQuantities，ScheduleofRatesandPrices，ifany，Tender，LetterofAcceptanceandtheContractAgreement，ifcompleted．“合同”指合同條款、技術(shù)規(guī)范、圖紙、標(biāo)價(jià)的建筑工程清單、單價(jià)和價(jià)格表（如果有），還可指標(biāo)書、接受證書以及承包協(xié)議（如已完成）。（g)“ContractPrice”meansthesumnamedintheLetterofAcceptance,subjecttosuchadditionstheretoordeductionstherefromasmaybemadeundertheprovisionshereinaftercontained．“合同價(jià)格”指在接受證書中確定的數(shù)額，可按本合同以下條款規(guī)定增減。（h)“ConstructionalPlant'meansallappliancesorthingsofwhatsoevernaturerequiredinorabouttheexecutionormaintenanceoftheWorksbutdoesnotincludematerialsorotherthingsintendedtoformorformingpartofthePermanentWorks．“建筑設(shè)備”指工程施工和維修中或有關(guān)施工和維修所需的全部設(shè)備或物品，不論任何性質(zhì)，但不包括旨在構(gòu)成或正在構(gòu)成永久性工程某一部分的材料或其他物品。（i）“TemporaryWorks'meansalltemporaryworksofeverykindrequiredinorabouttheexecutionormaintenanceoftheWorks．“臨建工程”指工程施工或維修或有關(guān)工程施工或維修所需的各種臨時(shí)工程。（j）“PermanentWorks”meansthepermanentworkstobeexecutedandmaintainedinaccordancewiththeContract．“永久性工程”指按合同將施工和維修的永久工程。（k）“Specification”meansthespecificationreferredtointheTenderandanymodificationthereoforadditiontheretoasmayfromtimetotimebefurnishedorapprovedinwritingbytheEngineer．“技術(shù)規(guī)范”指在標(biāo)書或任何標(biāo)書更改中提及的規(guī)范，或由工程師隨時(shí)可能增加或書面同意增加的部分。（1）“Drawings”meansthedrawingsreferredtointheSpecificationandanymodificationofsuchdrawingsapprovedinwritingbytheEngineerandsuchotherdrawingsasmayfromtimetotimebefurnishedorapprovedinwritingbytheEngineer．“圖紙”指技術(shù)規(guī)范中規(guī)定的圖紙，經(jīng)工程師書面同意對(duì)此種圖紙所作的任何更改，以及可由工程師隨時(shí)提供或書面認(rèn)同的其他圖紙。（m）“Site”meansthelandandotherplaceson，under，inorthroughwhichthePermanentWorksorTemporaryWorksdesignedbytheEngineeraretobeexecutedandanyotherlandsandplacesprovidedbytheEmployerforworkingspaceoranyotherpurposeasmaybeapecificallydesignatedintheContractasformingpartoftheSite．“工地”指工程師設(shè)計(jì)的永久性或臨建工程施工所需的土地及其他場(chǎng)地，包括地面、地下、在之上或通過部分，以及由業(yè)主所提供的用作臨時(shí)儲(chǔ)存或其他目的的其他土地或場(chǎng)所，只要能按合同明文規(guī)定構(gòu)成工地的組成部分。（n）“Approved”meansapprovedinwriting，includingsubsequentwrittenconfirmationofpreviousverbalapprovaland“approval'meansapprovalinwriting，includingasaforesaid．“業(yè)經(jīng)認(rèn)可”指已經(jīng)經(jīng)書面認(rèn)可，包括過后對(duì)口頭認(rèn)可的書面確認(rèn)，“認(rèn)可”指書面認(rèn)可，包括上述規(guī)定在內(nèi)。（2）Wordsimportingthesingularonlyalsoincludethepluralandviceversawherethecontextrequires•1．2按合同上下文所需，單數(shù)含義的單詞也可具有復(fù)數(shù)的含義，反之一樣。（3）TheheadingsandmarginalnotesintheseConditionsofContractshallnotbedeemedtobepartthereoforbetakenintoconsiderationintheinterpretationorconstructionthereoforoftheContract．1．3合同條款的標(biāo)題和邊注不得視為合同的一部分，不得用于考慮解釋條款或合同。（4）Theword“cost'shallbedeemedtoincludeoverheadcostswhetheronorofftheSite．1．4“費(fèi)用”一詞應(yīng)視為含工地上或以外發(fā)生的間接費(fèi)用。ENGINEERANDENGINEER’SREPRF．SFNTATIVE工程師及工程師代表2．（1）TheEngineershallcarryoutsuchdutiesinissuingdecisions，certificatesandordersasarespecifiedintheContract．IntheeventoftheEngineerbeingrequiredintermsofhisappointmentbytheEmployertoobtainthespecificapprovaloftheEmployerfortheexecutionofanypartoftheseduties，thisshallbesetoutinPartIIoftheseConditions．2．1工程師必須按合同明文規(guī)定，履行作決斷、頒發(fā)證書和發(fā)出指令等職責(zé)。如業(yè)主簽發(fā)的工程師任命書中規(guī)定其某些職責(zé)的履行得經(jīng)業(yè)主專門認(rèn)可，其要件應(yīng)在本合同第二部分予以規(guī)定。（2）TheEngineermayfromtimetotimeinwritingdelegatetotheEngineer'sRepresentativeanyofthepowersandauthoritiesvestedintheEngineerandshallfurnishtotheContractorandtotheEmployeracopyofallsuchwrittendelegationsofpowersandauthorities．AnywritteninstructionorapprovalgivenbytheEngineer’sRepresentativetotheContractorwithinthetermsofsuchdelegation，butnototherwise，shallbindtheContractorandtheEmployerasthoughithadbeengivenbytheEngineer．Providedalwaysasfollws：2．2工程師可隨時(shí)書面授權(quán)其代表代行其任何職權(quán)，但必須將所有此種授權(quán)書的副本提交給承包人和業(yè)主。在授權(quán)期間，工程師代表給承包人的任何書面指令或認(rèn)可（僅限于此）對(duì)承包人和業(yè)主具有與工程師的指令或認(rèn)可同樣的效力。以下規(guī)定屬于例外：（a）FailureoftheEngineer'sRepresentativetodisapproveanyworkormaterialsshallnotprejudicethepoweroftheEngineerthereaftertodisapprovesuchworkormaterialsandtoorderthepullingdown，removalorbreakingupthereof．工程師代表對(duì)任何工程或材料的不予否認(rèn)，不得影響工程師此后否認(rèn)以及命令拆毀、移動(dòng)或拆除此種工程或材料的權(quán)力。（b）IftheContractorshallbedissatisfiedbyreasonofanydecisionsoftheEngineer'sRepresentativeheshallbeentitledtoreferthemattertotheEngineer，whoshallthereuponconfirm，reverseorvarysuchdecision．若承包人對(duì)工程師代表的任何決定不滿意，其有權(quán)將此決定提交工程師確認(rèn)、取消或更改。ASSIGNMENTANDSUB—LETTING轉(zhuǎn)讓和分包3．TheContractorshallnotassigntheContractoranypartthereof，oranybenefitorinterestthereinorthereunder，otherwisethanbyachargeinfavoroftheContractor'sbankersofanymoniesdueortobecomedueunderthisContract，withoutthepriorwrittenconsentoftheEmployer．3．未經(jīng)業(yè)主事前書面同意，承包人不得將合同或其他任何部分，或合同所規(guī)定或依合同而產(chǎn)生的任何收益轉(zhuǎn)讓，向承包人的開戶銀行支付按本合同規(guī)定到期或即將到期的款項(xiàng)除外。4．TheContractorshallnotsub-letthewholeoftheWorks．ExceptwhereotherwiseprovidedbytheContract，theContractorshallnotsub-letanypartoftheWorkswithoutthepriorwrittenconsentoftheEngineer，whichshallnotbeunreasonablywithheld，andsuchconsent，ifgiven，shallnotrelievethe（contractorfromanyliabilityorobligationundertheContractandheshallberesponsiblefortheacts，defaultsandneglectsofanysub-contractor，hisagents，servantsorworkmenasfullyasiftheyweretheacts，defaultsorneglectsoftheContractor，hisagents．servantsorworkmen．ProvidedalwaysthattheprovisionoflaboronapieceworkbasisshallnotbedeemedtobeasublettingundertheClause．4．承包人不得轉(zhuǎn)包整個(gè)工程。除非合同另有規(guī)定，未經(jīng)工程師事前書面同意，承包人也不得分包工程的任何部分，但工程師不得無故不同意分包，一旦同意分包，此種同意不得免去承包人所承擔(dān)的任何合同所規(guī)定的責(zé)任或義務(wù)，他必須對(duì)任何分包人、其代理人、雇員或工人的行為、不履行和過失負(fù)完全責(zé)任，如同這些行為、不履行或過失是承包人、其代理人、雇員或工人所為。以計(jì)件方式提供勞力不得視為是本條所規(guī)定的分包。CONTRACTDOCUMENTS合同文件5．（1）ThereshallbestatedinPart1IoftheseConditions：5．1以下要件得在合同第二部分規(guī)定：（a）thelanguageorlanguagesinwhichtheContractdocumentsshallbedrawnupand．用以起草合同文件的語言；（b）thecountryorstate，thelawofwhichistoapplytotheContractandaccordingtowhichtheContractistobeconstrued．合同適用哪個(gè)國(guó)家的法律以及用哪個(gè)國(guó)家的法律解釋合同。Ifthesaiddocumentsarewritteninmorethanonelanguage，thelanguageaccordingtowhichtheContractistobeconstruedandinterpretedshallalsobedesignatedinPartII，beingthereindesignatedthe“RulingLanguage”．如果文件用一種以上語言作成，用以解釋合同的語言也必須在第二部分中規(guī)定，且將被寇為“主體語言”。（2）ExceptifandtotheextentotherwiseprovidedbytheContract，theprovisionsoftheConditionsofContractPartsⅠandⅡshallprevailoverthoseofanyotherdocumentformingpartoftheContract．Subjecttotheforegoing，theseveraldocumentsformingtheContractaretobetakenasmutuallyexplanatoryofoneanother，butincaseofambiguitiesordiscrepanciesthesameshallbeexplainedandadjustedbytheEngineerwhoshallthereuponissuetotheContractorinstructionsthereon．Providedalwaysthatif，intheopinionoftheEngineer，compliancewithanysuchinstructionsshallinvolvetheContractorinanycost，whichbyreasonofanysuchambiguityordiscrepancycouldnotreasonablyhavebeenforeseenbytheContractor，theEngineershallcertifyandtheEmployershallpaysuchadditionalsumasmaybereasonabletocoversuchcosts．5．2除合同中另有規(guī)定外，合同第一、二部分的條款規(guī)定優(yōu)于其他任何構(gòu)成合同的文件的規(guī)定。以上述規(guī)定為準(zhǔn)，構(gòu)成合同的數(shù)個(gè)文件可視為能互相解釋，如意思含糊或不一致時(shí)，由工程師解釋和處理，并由此向承包人發(fā)出指令。如工程師認(rèn)為，服從此種指令會(huì)使承包人發(fā)生額外費(fèi)用，而此種費(fèi)用是承包人由于上述意思含糊或不一致而按理無法預(yù)見的，工程師應(yīng)予以證明，業(yè)主必須支付相應(yīng)的額外款額以補(bǔ)償此種費(fèi)用。6．（1）TheDrawingsshallremaininthesolecustodyoftheEngineer，buttwocopiesthereofshallbefurnishedtotheContractorfreeofcharge．TheContractorshallprovideandmakeathisownexpenseanyfurthercopiesrequiredbyhim．AtthecompletionoftheContracttheContractorshallreturntotheEngineerallDrawingsprovidedundertheContract．6．1圖紙由工程師獨(dú)自保管，但須向承包人免費(fèi)提供兩份副本。承包人所需的其余副本由他自己制作并承擔(dān)費(fèi)用。合同履行后，承包人須將全部合同圖紙歸還工程師。（2）OnecopyoftheDrawings，furnishedtotheContractorasaforesaid，shallbekeptbythecontractorontheSiteandthesameshallatallreasonabletimesbeavailableforinspectionandusebytheEngineerandtheEngineer'sRepresentativeandbyanyotherpersonauthorizedbytheEngineerinwriting．6．2承包人必須將按上述規(guī)定所提交的一份圖紙副本留在工地，讓工程師及其代表，或工程師書面授權(quán)的任何其他人在所有合理的時(shí)間內(nèi)查閱使用。（3）TheContractorshallgivewrittennoticetotheEngineerwheneverplanningorprogressoftheWorks'islikelytobedelayedordisruptedunlessanyfurtherdrawingororder，includingadirection，instructionorapproval，isissuedbytheEngineerwithinareasonabletime．Thenoticeshallincludedetailsofthedrawingororderrequiredandofwhyandbywhenitisrequiredandofanydelayordisruptionlikelytobesufferedifitislate．6．3如工程師不在適當(dāng)時(shí)間內(nèi)再提供圖紙或命令，包括指示、指令或認(rèn)可，工程計(jì)劃或進(jìn)展便可能被延誤或中斷時(shí)，承包人必須書面通知工程師。通知書中應(yīng)詳細(xì)說明所需的圖紙或命令，所需原因和時(shí)間，以及如果不及時(shí)提供而可能造成的任何延誤和中斷。（4）If，byreasonofanyfailureorinabilityoftheEngineertoissuewithinatimereasonableinallthecircumstancesanydrawingororderrequestedbytheContractorinaccordancewithsubclause（3）ofthisClause，theContractorsuffersdelayand/orincurscoststhentheEngineershalltakesuchdelayintoaccountindetermininganyextensionoftimetowhichtheContractorisentitledunderClause44hereofandtheContractorshallbepaidtheamountofsuchcostasshallbereasonable．6．4如承包人按本條第3款規(guī)定索要圖紙或命令，由于工程師沒有或不能在合理時(shí)間內(nèi)提供，從而導(dǎo)致承包人誤工和左戊承擔(dān)費(fèi)用，工程師必須考慮此種延誤，以決定是否按本合同第44條規(guī)定延長(zhǎng)承包人的工期，且只要有理由，承包人所承擔(dān)的此種費(fèi)用必須得到補(bǔ)償。7．TheEngineershallhavefullpowerandauthoritytosupplytotheContractorfromtimetotime,duringtheprogressoftheWorks，suchfurtherdrawingsandinstructionsasshallbenecessaryforthepurposeoftheproperandadequateexecutionandmaintenanceoftheWorks．TheContractorshallcarryoutandbeboundbythesame．7．在施工期間，工程師全權(quán)負(fù)責(zé)隨時(shí)進(jìn)一步向承包人提供圖紙和指示，以滿足工程正常施工和維護(hù)所需。承包人必須執(zhí)行且受圖紙和指示的約束。GENERALOBLIGATIONS總義務(wù)8．（1）TheContractorshall，subjecttotheprovisionsoftheContract，andwithduecareanddiligence,executeandmaintaintheWorksandprovidealllabor，includingthesupervisionthereof,materials，ConstructionalPlantandallotherthings，whetherofatemporaryorpermanentnature，requiredinandforsuchexecutionandmaintenance，sofarasthenecessityforprovidingthesameisspecifiedinorisreasonablytobeinferredfromtheContract．8．1承包人必須根據(jù)合同條款，對(duì)工程的施工和維護(hù)予以應(yīng)有的注意，且提供此種施工和維護(hù)所必需的包括勞動(dòng)管理在內(nèi)的所有勞力、材料、施工成套設(shè)備及其他一切物品，不管其是臨時(shí)或長(zhǎng)期性質(zhì)，只要合同明文規(guī)定需要或根據(jù)合同合理推斷需要。（2）TheContractorshalltakefullresponsibilityfortheadequacy，stabilityandsafetyofallsiteoperationsandmethodsofconstruction，providedthattheContractorshallnotberesponsible,exceptasmaybeexpresslyprovidedintheContract，forthedesignorspecificationofthePermanentWorks，orforthedesignorspecificationofanyTemporaryWorkspreparedbytheEngineer•8．2承包人必須對(duì)現(xiàn)場(chǎng)操作和施工方法的恰當(dāng)、穩(wěn)定及安全性負(fù)全部責(zé)任。除非合同另有明文規(guī)定，承包人對(duì)工程師制定的永久性工程的設(shè)計(jì)或規(guī)格，或臨建工程的設(shè)計(jì)或規(guī)格概不負(fù)責(zé)。9．TheContractorshall，whencalleduponsotodo，enterintoandexecuteaContractAgreement，tobepreparedandcompletedatthecostoftheEmployer，intheformannexedwithsuchmodificationasmaybenecessary，9．如經(jīng)要求，承包人必須簽署一承包協(xié)議，該協(xié)議由業(yè)主制定并承擔(dān)費(fèi)用，協(xié)議應(yīng)附帶必要的修正條款。10．If，forthedueperformanceoftheContract，theTendershallcontainanundertakingbytheContractortoobtain，whenrequired，abondorguaranteeofaninsurancecompanyorbank,orotherapprovedsuretiestobejointlyandseverallyboundwiththecontractortotheEmployer,inasumnotexceedingthatstatedintheLetterofAcceptanceforsuchbondorguarantee，thesaidinsurancecompanyorbankorsuretiesandthetermsofthesaidbondorguaranteeshallbesuchasshallbeapprovedbytheEmployer．TheobtainingofsuchbondorguaranteeortheprovisionofsuchsuretiesandthecostofthebondorguaranteetobesoenteredintoshallbeattheexpenseinallrespectsoftheContractor，unlesstheContractotherwiseprovides．10．為正常履行合同，在標(biāo)書中，承包人應(yīng)承諾按要求取得保險(xiǎn)公司或銀行的保單或保函，或其他業(yè)經(jīng)認(rèn)可由承包人向業(yè)主負(fù)連帶責(zé)任的擔(dān)保，其數(shù)額不超過驗(yàn)收證書中規(guī)定的保單或保函額，上述保險(xiǎn)公司、銀行或擔(dān)保以及上述保單或保函的條款必須經(jīng)業(yè)主認(rèn)可。此種保單或保函的取得或擔(dān)保的提供，以及締結(jié)保單或保函的費(fèi)用應(yīng)全部由承包人承擔(dān)，合同中另有規(guī)定的除外。11．TheEmployershallhavemadeavailabletotheContractorwiththeTenderdocumentssuchdataonhydrologicalandsub-surfaceconditionsasshallhavebeenobtainedbyoronbehalfoftheEmployerfrominvestigationsundertakenrelevanttotheWorksandtheTendershallbedeemedtohavebeenbasedonsuchdata，buttheContractorshallberesponsibleforhisowninterpretationthereof．11．業(yè)主必須在招標(biāo)文件中向承包人提供由業(yè)主或其代理人在進(jìn)行工程考察時(shí)獲得的水文及地質(zhì)情況資料，標(biāo)書必須視為是基于此種資料所制定的，但承包人必須對(duì)資料的理解自行負(fù)責(zé)。TheContractorshallalsobedeemedtohaveinspectedandexaminedtheSiteanditssurroundingsandinformationavailableinconnectiontherewithandtohavesatisfiedhimself，sofarasispracticable，beforesubmittinghisTender，astotheformandnaturethereof，includingthesub-surfaceconditions，thehydrologicalandclimaticconditions，theextentandnatureofworkandmaterialsnecessaryforthecompletionoftheWorks，themeansofaccesstothesiteandtheaccommodationhemayrequireand，ingeneral，shallbedeemedtohaveobtainedallnecessaryinformation，subjectasabovementioned，astorisks，contingenciesandallothercircumstanceswhichmayinfluenceofaffecthisTender．承包人也必須被視為已視察了工地及周圍環(huán)境，查閱了可獲得的有關(guān)工地資料，且在提交標(biāo)書前，對(duì)一切實(shí)際情況，從形式到性質(zhì)，包括地質(zhì)條件、水文和氣候條件、工程范圍和性質(zhì)以及完成工程所必需的材料、到達(dá)工地的交通工具和所需的食宿等感到滿意，總之，承包人必須被視為已得到所有必要的資料，除涉及上述情況外，還涉及風(fēng)險(xiǎn)、意外事件及其他一切可能影響其投標(biāo)的情況。12．TheContractorshallbedeemedtohavesatisfiedhimselfbeforetenderingastothecorrectnessandsufficiencyofhisTenderfortheWorksandoftheratesandpricesstatedinthepricedBillofQuantitiesandtheScheduleofRatesandPrices，ifany，whichTenderratesandpricesshall，exceptinsofarasitisotherwiseprovidedintheContract，coverallhisobligationsundertheContractandallmattersandthingsnecessaryfortheproperexecutionandmaintenanceoftheWorks．if，however，duringtheexecutionoftheWorkstheContractorshallencounterphysicalcon eyarerequiredtosupervise，and（1）對(duì)本專業(yè)熟悉和經(jīng)驗(yàn)豐富的技術(shù)人員，能勝任規(guī)定監(jiān)管工作的分代理人、工頭和領(lǐng)班，以及（b）suchskilled，semi-skilledandunskilledlaborasisnecessaryfortheproperandtimelyexecutionandmaintenanceoftheWorks．（2）為正常和及時(shí)施工和維護(hù)工程所需的熟練、半熟練和非熟練工人。（2）TheEngineershallbeatlibertytoobjecttoandrequiretheContractortoremoveforthwithfromtheWorksanypersonemployedbytheContractorinorabouttheexecutionormaintenanceoftheWorkswho，intheopinionoftheEngineer，misconductshimself，orisincompetentornegligentintheproperperformanceofhisduties，orwhoseemploymentisotherwiseconsideredbytheEngineertobeundesirableandsuchpersonshallnotbeagainemployedupontheWorkswithoutthewrittenpermissionoftheEngineer．AnypersonsoremovedfromtheWorksshallbereplacedassoonaspossiblebyacompetentsubstituteapprovedbytheEngineer．16．2如工程師認(rèn)為承包人雇來進(jìn)行或有關(guān)施工或工程維護(hù)的任何人員行為不軌、或不能或疏于履行其職責(zé)、或認(rèn)為其雇傭純屬不必要，工程師有權(quán)反對(duì)雇傭，并要求承包人立即將其從工地解雇，未經(jīng)工程師的書面同意，此種人員不得再被雇用到工地。凡被從工地解雇人員的職位應(yīng)盡快由工程師認(rèn)可的稱職人選接替。17．TheContractorshallberesponsibleforthetrueandpropersetting-outoftheWorksinrelationtooriginalpoints，linesandlevelsofreferencegivenbytheEngineerinwritingandforthecorrectness，subjectasabovementioned，oftheposition，levels，dimensionsandalignmentofallpartsoftheWorksandfortheprovisionofallnecessaryinstruments，appliancesandlaborinconnectiontherewith．If，atanytimeduringtheprogressoftheWorks，anyerrorshallappearorariseintheposition，levels，dimensionsoralignmentofanypartoftheWorks，theContractor，onbeingrequiredsotodobytheEngineerortheEngineer'sRepresentative，shall，athisowncost，rectifysucherrortothesatisfactionoftheEngineerortheEngineer'sRepresentative，unlesssucherrorisbasedonincorrectdatasuppliedinwritingbytheEngineerortheEngineer'sRepresentative，inwhichcasetheexpenseofrectifyingthesameshallbebornebytheEmployer．Thecheckingofanysetting-outorofanylineorlevelbytheEngineerortheEngineer'sRepresentativeshallnotinanywayrelievetheContractorofhisresponsibilityforthecorrectnessthereofandtheContractorshallcarefullyprotectandpreserveallbench-marks，sight-rails，pegsandotherthingsusedinsetting-outtheWorks．17．承包人負(fù)責(zé)按工程師提交的書面參考原圖的有關(guān)點(diǎn)、線和面的規(guī)定，忠實(shí)恰當(dāng)?shù)剡M(jìn)行測(cè)定放線，如上所述，使工程的位置、水平、面積正確無誤，并校準(zhǔn)工程的各部分，且負(fù)責(zé)提供與工程相關(guān)的所有必要工具、設(shè)備和勞力。在施工中，如任何時(shí)候在工程的位置、水平、面積或工程任何部分的校正出現(xiàn)差錯(cuò)，應(yīng)工程師或工程師代表的要求，承包人必須改正錯(cuò)誤以使工程師或工程師代表滿意，改正費(fèi)用由承包人自己承擔(dān)，此種錯(cuò)誤是由工程師或工程師代表提供的書面資料差錯(cuò)而導(dǎo)致的除外，在這種情況下，須由業(yè)主承擔(dān)改正費(fèi)用。承包人不得因工程師或工程師代表對(duì)任何位置測(cè)定或任何線或任何水平面的檢查而免去確保其正確無誤的責(zé)任，承包人必須仔細(xì)保護(hù)和保存工程位置測(cè)定中使用過的水準(zhǔn)點(diǎn)、觀測(cè)桿、測(cè)標(biāo)及其他物品。18．If，atanytimeduringtheexecutionoftheWorks，theEngineershallrequiretheContractortomakeboreholesortocarryoutexploratoryexcavation，suchrequirementshallbeorderedinwritingandshallbedeemedtobeanadditionorderedundertheprovisionsofClause51hereof，unlessaprovisionalsuminrespectofsuchanticipatedworkshallhavebeenincludedintheBillofQuantities．18．在施工中，工程師如在任何時(shí)間要求承包人鉆孔或進(jìn)行挖掘勘探，此種要求必須作成書面形式，且得視為是根據(jù)本合同第51條規(guī)定作出的附加命令，除非數(shù)量清單中已經(jīng)列有有關(guān)此種預(yù)計(jì)工程的備用款。19．TheContractorshallinconnectionwiththeWorksprovideandmaintainathisowncostalllights，guards，fencingandwatchingwhenandwherenecessaryorrequiredbytheEngineerortheEngineer'sRepresentative，orbyanydulyconstitutedauthority，fortheprotectionoftheWorks，orforthesafetyandconvenienceofthepublicorothers．19．凡有必要或應(yīng)工程師或工程師代表、或任何正式成立的工程管理處的要求，承包人必須自費(fèi)提供和維護(hù)與工程有關(guān)的所有燈光、警衛(wèi)、柵欄和看護(hù)以保衛(wèi)工程，或保障公眾及其他人的安全和便利。20．（1）FromthecommencementoftheWorksuntilthedatestatedintheCertificateofcompletionforthewholeoftheWorkspursuanttoClause48hereoftheContractorshalltakefullresponsibilityforthecarethereof．ProvidedthatiftheEngineershallissueaCertificateofCompletioninrespectofanypartofthePermanentWorkstheContractorshallceasetobeliableforthecareofthatpartofthePermanentWorksfromthedatestatedintheCertificateofCompletioninrespectofthatpartandtheresponsibilityforthecareofthatpartshallpasstotheEmployer．ProvidedfurtherthattheContractorshalltakefullresponsibilityforthecareofanyoutstandingworkwhichheshallhaveundertakentofinishduringthePeriodofMaintenanceuntilsuchoutstandingworkiscompleted．Incaseanydamage，lossorinjuryshallhappentotheWorks，ortoanypartthereof，fromanycausewhatsoever，saveandexcepttheexceptedrisksasdefinedinsubclause（2）ofthisClause，whiletheContractorshallberesponsibleforthecarethereoftheContractorshall，athisowncost，repairandmakegoodthesame，sothatatcompletionthePermanentWorksshallbeingoodorderandconditionandinconformityineveryrespectwiththerequirementsoftheContractandtheEngineer'sinstructions．Intheeventofanysuchdamagelossorinjuryhappeningfromanyoftheexceptedrisks，theContractorshall，ifandtotheextentrequiredbytheEngineerandsubjectalwaystotheprovisionsofClause65hereof，repairandmakegoodthesameasaforesaidatthecostoftheEmployer．TheContractorshallalsobeliableforanydamagetotheWorksoccasionedbyhiminthecourseofanyoperationscarriedoutbyhimforthepurposeofcompletinganyoutstandingworkorcomplyingwithhisobligationsu
