摘要：預(yù)防性羈押是一種司法措施，旨在保護(hù)社會(huì)安全，但是其施行也容易侵犯個(gè)人自由權(quán)利。因此，對于預(yù)防性羈押的限度問題一直備受關(guān)注，本文分別從法律、倫理和實(shí)踐三個(gè)角度探討預(yù)防性羈押的限度。

在法律層面，本文通過分析我國現(xiàn)行法律，明確規(guī)定了預(yù)防性羈押的限度是法律程序、證據(jù)合法性和合理性。合法程序是指要依據(jù)法定步驟予以執(zhí)行，合法證據(jù)是指不能憑空猜測或偏見，合理性則是指必須符合追求正義的原則。在倫理層面，本文分析了預(yù)防性羈押對被羈押人權(quán)利的侵犯問題。在此基礎(chǔ)上，提出了預(yù)防性羈押的限度應(yīng)該考慮如何平衡社會(huì)安全性和個(gè)人自由權(quán)利的問題。在實(shí)踐層面，本文舉例探討了我國公安機(jī)關(guān)和法院在規(guī)范預(yù)防性羈押方面的優(yōu)缺點(diǎn)。并且，本文認(rèn)為公民自身應(yīng)該增強(qiáng)自我保護(hù)意識(shí)，盡可能避免卷入到刑事案件中去。

Abstract：Preventativedetentionisajudicialmeasuredesignedtoprotectsocialsecurity,butitsimplementationcaneasilyviolateindividualrightsandfreedoms.Therefore,thelimitofpreventativedetentionhasalwaysbeenaconcern.Thisarticleexploresthelimitsofpreventivedetentionfromthreeperspectives:legal,ethical,andpractical.

Atthelegallevel,thisarticleclarifiesthatthelimitofpreventivedetentionislegalprocedure,legalevidence,andrationalitythroughtheanalysisofcurrentChineselaw.Legalproceduremeansthatitmustbeexecutedaccordingtostatutoryprocedures.Legalevidencemeansthatitcannotbebasedonguessworkorprejudice,andrationalitymeansthatitmustconformtothepursuitofjustice.Attheethicallevel,thisarticleanalyzestheviolationofthedetainedperson'srightsandproposesthatthelimitofpreventivedetentionshouldconsiderhowtobalancesocialsecurityandindividualfreedom.Atthepracticallevel,thisarticlediscussestheadvantagesanddisadvantagesofpublicsecurityagenciesandcourtsinregulatingpreventativedetentioninChina.Moreover,webelievethatcitizensshouldenhancetheirawarenessofself-protectionandtrytoavoidbeinginvolvedincriminalcases.
