Beresponsibleforkeepingpublicplacescleanduringconstructionandpackingconstructionmaterialandleavinginthegarbagecollectionplacedesignatedbymanagementofficeeachday.第條程限PeriodConstruction1.根工期和使用需要，商定工程總施工期為天日歷天年月日工至年月日工Accordingtotheperiodconstructionandtheuseneed,thetotalconstructionperiodagreedshallbedays(Calendardays),startthedateofandcompleteonthedateof.2．遇下列況，經(jīng)甲方現(xiàn)場代表簽證后，工期相應(yīng)順延：ConstructionperiodshallbeprolongeduponPartyAsiterepresentative'sconfirmationwhenthemattersoccurasfollows.①按施準(zhǔn)備規(guī)定，甲方未協(xié)乙方辦理臨時(shí)水電及垂直運(yùn),影響進(jìn)場施工；Accordingtotherequirementsofconstructionpreparation,PartyfailtotassistPartyBtoapplyfortemporarywaterandelectricityandverticaltransportationandhaveanimpactonPartyconstruction;②因甲提出增減項(xiàng)目而造成大設(shè)計(jì)變更，因而影響進(jìn)度；ThematerialmodificationorofdesignduetothepartyAsrequirementadditionordeletionofprojecthavetheeffecthindranceontheprogressworks.③未按同規(guī)定撥付預(yù)付款、程款而影響施工；PartyfailtheadvancepaymentandconstructioncostpartyBandimpacttheconstructionprogress;④人力不可抗拒的因素而延誤工期。ThedelayofscheduleofconstructiondueForceMajeure.第條工程質(zhì)4Thequalityofproject一．本工程質(zhì)量經(jīng)雙方研究要求達(dá)到雙方約定之驗(yàn)收標(biāo)準(zhǔn)。Thequalityofprojectshouldachieverequirementsofacceptanceagreedbybothparties.二．乙方必須嚴(yán)格按照施工圖紙明件和國家頒發(fā)的建筑工程規(guī)范程標(biāo)準(zhǔn)進(jìn)行施工，并接受甲方的監(jiān)督。Partyshouldcarryonconstructionstrictaccordancewithdrawing,specificationfileandregulationsandspecificationsauthorizedbythecompetentauthoritiesandbeunderthesupervisionParty三．乙方在施工過程中必須遵守下列規(guī)定：Bshould,duringtheconstruction,

元Thecontractprice×10%,whichisYuan.第條施工與計(jì)更Article6TheModificationofConstructionand一．乙方交付的設(shè)計(jì)圖紙說明有關(guān)技術(shù)資料作施工的有效依據(jù)開工前由甲方組織簽字認(rèn)同，作為施工的補(bǔ)充依據(jù)，甲、乙雙方均不得擅自修改。Designdrawing,illustrationandrelevanttechnicalconsignedbypartyBarebasisforconstructionandshallbeconfirmedbyA’ssignature,deemedasthesupplementarybasisandshallbemodifiedbyanypartywithoutauthorization.二．施工中如發(fā)現(xiàn)因甲方要求而發(fā)生的設(shè)計(jì)錯(cuò)誤或嚴(yán)重不合理的地方應(yīng)及時(shí)以書面形式通知甲方甲及時(shí)會(huì)同乙等有關(guān)單位研究確定修改意見或變更設(shè)計(jì)文件方按修改或變更的設(shè)計(jì)文件進(jìn)行施工。若發(fā)生增加費(fèi)用（包括返工損失、停工、窩工、人員和機(jī)構(gòu)設(shè)備調(diào)遷、材料構(gòu)配件積壓的實(shí)際損失）由甲方負(fù)責(zé)，并調(diào)整合同造價(jià)。

IfandwhenanyerrorormaterialunreasonableproblemofdesignduetopartyArequirement,PartyBshallnotifyPartyApromptlyinwritinganddecideormodificationofthedesigndocumentationbytheconsultationandnegotiationpartiesandunitsconcerned.PartyBshallcarryoutconstructionaccordingthedesigndocumentsmodifiedorchanged.Ifprojectcostincrease(includingtheactuallossreworkloss,stoppageorslowdown,personnelandequipmentrelocated,materialstructures,fixturesbacklog),shallberesponsibilitybyPartyA,andbeadjustedthecontractpricetogetherwithPartyB.三．乙方在保證工程質(zhì)量和不降低設(shè)計(jì)標(biāo)準(zhǔn)的前提下出改設(shè)計(jì)修改工藝的合理化建議，經(jīng)甲方、設(shè)計(jì)單位或有關(guān)技術(shù)部門同意后采取實(shí)施。AnyreasonablesuggestiononthemodificationsofdesignandcraftbyPartyB,subjecttothequalityandwithoutreducingstandardsofdesign,couldcarriedoutupontheapprovalofPartyA,designunitorconcernedtechnicaldepartment.四．甲方如需設(shè)計(jì)變更必作正式修改通知書和修改圖紙乙方才予實(shí)施重大修改和增加造價(jià)時(shí)，必須另行協(xié)商，乙方才予實(shí)施。Partyshould,ifanynecessarydesignchange,theformalamendmentandmodifydrawingsforPartyBimplementation..MaterialchangesandtincreasedmustbenegotiatedbybothpartiesbeforePartyBimplement第七條工程驗(yàn)7Acceptanceproject一．工程施工中地下工程、結(jié)構(gòu)工程必須具有隱蔽驗(yàn)收簽證、試水、抗?jié)B等驗(yàn)收合格記錄。甲方須及時(shí)辦理驗(yàn)收簽訂手續(xù)。Theundergroundengineering,structuralengineeringtheconstructionprojectshouldbecheckedandwithissueofcertificateandtherecordofacceptanceofwatertest,anti-permeabilityandsoPartyAshouldwithacceptancesignedformalitiestimely.二．工程竣工驗(yàn)收后，甲方才可使用PartyAcanusetheprojectaftercompletionacceptance在規(guī)定的保修期內(nèi)凡施工造的質(zhì)量缺陷應(yīng)由乙方無償保修其保修條件范和期限按城鄉(xiāng)建設(shè)環(huán)境保護(hù)部（84）城建字第79號(hào)知印發(fā)《建筑工程保修辦法（試行行。Intheprovisionwarrantyperiod,anyconstructionqualitydefects,PartyBshouldmakemaintenancefreethequalitydefectdueconstruction,scopeanddurationcarryoutaccordingtoissuanceJianNo.79notification"Constructionengineeringguaranteemeasures(Trial)"byUrbanandRuralConstructionandEnvironmentalProtectionDepartment第條違約責(zé)8Liabilityforbreachofcontract乙方的責(zé)任ResponsibilityofPartyB:

一．工程質(zhì)量不符合合同規(guī)定的，負(fù)責(zé)無償修理和返工。Takechargeofgratisrepairandreworkifprojectqualitydoesn'tmeetcontact'sstipulation二．工程不能按合同規(guī)定的工期交付使用的同關(guān)于建設(shè)工期提交或拖后的獎(jiǎng)罰規(guī)定償付逾期罰款。Iffaildelivertheconstructionaccordingtocontractontime,Theoverduefinesaccordingtopunishmentorawardtheprovisionconcerningthedeliveryordelay.甲方的責(zé)任TheresponsibilityofA:一．未能按照合同的規(guī)定履行自己應(yīng)負(fù)的責(zé)任竣工日期得以順延外應(yīng)償乙方由此造成的實(shí)際損失。Failedtotheirresponsibilitiesinaccordancewiththeprovisionsofcontract,inadditiontothecompletiondatetobepostponedshouldbecompensationforactuallossofPartyB.二．工程中途停建緩建或由于計(jì)變更以及設(shè)計(jì)錯(cuò)誤造成的返工采措施彌補(bǔ)或減少損失。同時(shí)，賠償乙方由此造成的停工、窩工、返工、倒運(yùn)、人員和機(jī)械設(shè)備調(diào)遷、材料和構(gòu)件積壓的實(shí)際損失。Theongoingprojectisstopped,postponedduedesignchangesandreworkcausedbydesignerrors,shouldtaketor
