國際貿(mào)易合同中的裝運條款國際貿(mào)易合同中的裝運條款SHIPPINGCLAUSE裝運條款主要包括裝運港和目的港、裝運期、是否允許分批裝運與轉(zhuǎn)船、裝運通知、裝卸時間、裝卸率、滯期和速遣等多個單項條款1、裝運港Portofshipmen/Portofloading和目的港條款PortofDestination/discharge例如：裝運港：天津Portofshipment:Tianjin目的港：鹿特丹PortofDestination:Rotterdan2、裝運期TimeofShipment例1規(guī)定具體的裝運月份2003年3月裝運shipmentduringMarch,2003例2規(guī)定一段裝運時間2003年3月5日至20日裝運shipmentfromMarch5-20,20033、分批裝運Partialshipment與轉(zhuǎn)船Transshipment例1允許分批裝運。允許轉(zhuǎn)運Partialshipment&Transshipment例24/5/6月份每月裝一批，每批數(shù)量相等shipmentinApr/May/Junein3equalmonthlylots4、裝運通知shippingAdvice例如：貨物全部裝船后，賣方應立即將合同編號、商品名稱、數(shù)量、毛重、發(fā)票金額、船名及開航日期電告買方。如由賣方未及時將裝運通知電告買方，以致貨物未及時保險而發(fā)生的一切損失由賣方承擔。(Immediatelythegoodsarecompletelyloaded,thesellersshallcabletonotifytheBuyersofthecontractnumber;nameofcommodity、quantity、grossweight,invoicevalue、nameofthecarryingvesselandthedateofsailing.incasethegoodsarenotinsuredintimeowingtotheseller’shavingfailedtogivetimelyadvice,anyandconsequentlossshallbebornbythesellers)5、裝卸時間(timeofshipment)、裝卸率(loadingrare)、滯期和速遣(Demurage&FastDespatch)例如：賣方須于買方所租的載貨船只到達裝運港的當日開始裝船。裝貨率為每個晴天工作日100公噸，裝貨時間為6個晴天工作日。滯期費為每個晴天工作日4000美元，不足一天者按比例計算；速遣費是滯期費的一半，不足一天者按比例計算（Thesellersshouldstartloadingattheverydaythecarringvesselcharteredbythebuyerarrivestheportofshipment.theaverageloadingrateis100metrictonsperWeatherWorkingDays.Theloadingofallgoodsshouldfinishin6WeatherWorkingDays.DemurageisattherateofUS$4000peraWeatherWorkingDay.DespatchrateishalfthedemuragerateorprorateforanypartofaWeatherWorkingDay.）一、收到信用證后一定時間內(nèi)裝運例收到信用證后30天內(nèi)裝運，買方必須在5月15日之前將有關(guān)信用證開道賣方。Shipmentwithin30daysafterreceiptofL/C,therelevantL/CmustreachthesellernotlaterthanMay15.從五月份開始分三批按月等量裝運，每批裝運20噸Inthreeequalmonthlyinstallment(shipments/lots)eachof20tons(of20tonseach)beginning(commercing)from(with/in)May.貨物約等分兩批裝運，每批間隔25天Intwoapproximatelyequalshipmentsrequired25daysapartatintervalsof25days.賣方應保證每個晴天工作日裝700噸進入全部貨倉，或按可供貨倉數(shù)量的比例裝貨。每日的速遣費為600美元，滯期費為1200美元Sellersguaranteetoload700M/TperWD(weatherworkingdays)forallhatches,orprorateaccordingtoavailabilityofhatches.DispatchatUS600perdayandDemurrageatUS1200perday.本合同所定貨物一經(jīng)裝運，應即以電報通知買方。Shipmenteffectedunderthiscontractshallbepromptlyinformedtothebuyerbyable.提單日期應作為裝運期，若延遲交貨，買方得撤銷合同，并索賠因違約所造成的損失。ThedateofBillofladingshallbeconsideredasthedateofshipment.Intheeventofdelayinshipment,buyermaycancelthecontractandclaimdamagesforbreachofthecontract.二、規(guī)定收到信匯、電匯、票匯后一定時間內(nèi)裝運例收到信匯（電匯、票匯后）25天內(nèi)裝運。Shipmentwithin25daysafterreceiptofM/T(T/T,D/D)三、規(guī)定具體的裝運期限5月30日前裝運。ShipmentbeforeMay30.3月份裝運100公噸，4月份裝運100公噸。Shipment100M/TduringMarchand100M/TduringApril.8-9月份分兩批平均裝運。ShipmentduringAugust/Septemberintwoequallots.四、裝運術(shù)語立即裝運shipmentimmediately盡快裝運shipmentASAP裝運港：上海(portofshipment:Shanghai)目的港：倫敦，允許在香港轉(zhuǎn)船portofdestination:London.T?ranshipmentatHongKongallowed.五、載運貨物的船只安排載運船只由賣方安排，允許分批載運及轉(zhuǎn)船。賣方于貨物裝船后，應將合同號碼、品名、船名、裝船日期以電報通知買方。Thecarryingvesselshallbeprovidedbythesellers.Partialshipmentandtransshipmentareallowed.Afterloadingiscompleted,thesellershallnotifythebuyersbycableofthecontractednumber,nameofcommodity,nameofthecarryingvesselanddateofshipment.ex與per源自拉丁語的介詞ex與per有各自不同的含義。英譯由某輪船“運來”的貨物時用ex，由某輪船“運走”的貨物用Per，而由某輪船“承運”用by。由“維多利亞”輪運走/運來/承運的最后一批貨將于10月1日抵達倫敦。Thelastbatchper/ex/byS.S."Victoria"willarriveatLondononOctober(S.S.=Steamship)裝運條款TermsofShipment(1)FOB交貨方式賣方應在合同規(guī)定的裝運日期前30天，以＿＿方式通知買方合同號、品名、數(shù)量、金額、包裝件、毛重、尺碼及裝運港可裝日期，以便買方安排租船/訂艙。裝運船只按期到達裝運港后，如賣方不能按時裝船，發(fā)生的空船費或滯期費由賣方負擔。在貨物越過船弦并脫離吊鉤以前一切費用和風險由賣方負擔。TheSellershall,30daysbeforetheshipmentdatespecifiedintheContract,advisetheBuyerby_____oftheContractNo.,commodity,quantity,amount,packages,grossweight,measurement,andthedateofshipmentinorderthattheBuyercancharteravessel/bookshippingspace.IntheeventoftheSeller'sfailuretoeffectloadingwhenthevesselarrivesdulyattheloadingport,allexpensesincludingdeadfreightand/ordemurragechargesthusincurredshallbefortheSeller'saccount.(2)CIF或CFR交貨方式賣方須按時在裝運期限內(nèi)將貨物由裝運港裝船至目的港。在CFR術(shù)語下，賣方應在裝船前2天以＿＿方式通知買方合同號、品名、發(fā)票價值及開船日期，以便買方安排保險。TheSellershallshipthegoodsdulywithintheshippingdurationfromtheportofloadingtotheportofdestination.UnderCFRterms,theSellershalladvisetheBuyerby_____oftheContractNo.,commodity,invoicevalueandthedateofdispatchtwodaysbeforetheshipmentfortheBuyertoarrangeinsuranceintime.賣方應在每一包裝箱相鄰的四面用不可擦除的油漆和明顯的英語字樣做出以下標記：TheSuppliershallmarkthefollowingonthefouradjacentsidesofeachpackagewithindeliblepaintinconspicuousEnglishprintedwords；六、溢短裝Quantity,unlessotherwisearranged,shallbesubjecttoavariationof5%plusorminusatSeller’soption.量：除非另作安排，量可由賣方選擇作加或減5%的變動。Thesellerhastheoptionofdelivering5%moreorlessofthecontractedquantity.買方有權(quán)決定按合同數(shù)量增減5%ShouldtheweightascertainedasaresultofreweightingthegoodsattheportofdestinationdifferfromthebillofLadingweightbyuptoonepercentmoreorless,thebillofLadingweightshallbedeemedfinalforthesettlementofaccountsbetweentheparties.在目的港對貨物再次所得的重量，如與提單重量相差僅1%增減，則提單重量作為上方結(jié)算的最后依據(jù)。Netshippingweight;lossinweightexceeding(orover)5%tobeforSeller’saccount.以裝運凈重為準，如重量損耗超過5%，超過部分由賣方負擔。W
