LeaseAgreement

ThisLeaseAgreement(the"Agreement")isenteredintoonthis_____dayof____________,20______,byandbetweenthelandlord,___________________________,andthetenant,___________________________,collectivelyknownasthe"Parties".

1.PropertyDescription:

TheLandlordagreestoleasethepremiseslocatedat______________________________(the"Property")totheTenantforthedurationofthisAgreement.

2.Term:

ThetermofthisAgreementshallbeforaperiodof_______months,startingfrom____________andendingon____________.

3.RentPayment:

6.Termination:

EitherpartymayterminatethisAgreementupongiving_______days'writtennoticetotheotherparty.IntheeventofearlyterminationbytheTenant,theTenantshallberesponsibleforpayingrentuntiltheendofthenoticeperiodoruntilthePropertyisre-leased,whichevercomesfirst.

7.GoverningLaw:

ThisAgreementshallbegovernedbyandconstruedinaccordancewiththelawsofthejurisdictionwherethePropertyislocated.

8.EntireAgreement:

ThisAgreementconstitutestheentireagreementbetweenthePartiesandsupersedesanypriorunderstandingsoragreements,whetheroralorwritten,relatingtothesubjectmatterhereof.

9.Severability:

IfanyprovisionofthisAgreementisheldtobeinvalid,illegal,orunenforceable,theremainingprovisionsshallremaininfullforceandeffect.

INWITNESSWHEREOF,thePartieshaveexecutedthisLeaseAgreementasofthedatefirstabovewritten.

10.RenewalOption:

AttheexpirationoftheinitialtermofthisAgreement,theTenantshallhavetheoptiontorenewtheleaseforanadditionaltermof_______months(the"RenewalTerm").TheTenantmustprovidewrittennoticetotheLandlordatleast_______dayspriortotheexpirationoftheinitialtermiftheywishtoexercisethisoption.

11.RentAdjustment:

Intheeventofarenewal,thepartiesshallnegotiateandagreeuponthenewmonthlyrentfortheRenewalTerm.Thenewrentshallbefairandreasonable,takingintoaccountmarketconditionsandanyimprovementsmadetothePropertyduringtheinitialterm.

12.RenewalAgreement:

IftheTenantexercisestheoptiontorenew,thepartiesshallenterintoanewwrittenagreementoutliningthetermsandconditionsoftheRenewalTerm.AllprovisionsofthisAgreementthatarenotmodifiedorcontradictedbytheRenewalAgreementshallremaininfullforceandeffect.

DefaultandRemedies(違約與補(bǔ)救)

13.Default:

IntheeventthateitherpartybreachesorfailstoperformanyoftheprovisionsorobligationsofthisAgreement,itshallbeconsideredadefault.Examplesofdefaultincludenon-paymentofrent,unauthorizedsubletting,ordamagetothePropertybeyondnormalwearandtear.

14.Remedies:

IntheeventofadefaultbytheTenant,theLandlordshallhavetherighttopursueanyremediesavailableunderthelaw,includingbutnotlimitedtoevictionandrecoveringanyoutstandingrentordamages.IntheeventofadefaultbytheLandlord,theTenantshallhavetherighttopursueanyremediesavailableunderthelaw,includingbutnotlimitedtoseekingdamagesandterminationofthisAgreement.

15.LiabilityandIndemnification:

TheTenantshallbeliableforanydamagescausedbytheirnegligenceorintentionalactions,includingdamagestothePropertyorinjurytothirdpartieswhileonthepremises.TheTenantagreestoindemnifyandholdtheLandlordharmlessfromanyclaims,costs,ordamagesarisingfromtheTenant'suseoroccupationoftheProperty.

16.Insurance:

TheTenantisadvisedtoobtainrenter'sinsurancetoprotecttheirpersonalbelongingsandtoprovideliabilitycoverage.TheLandlordshallnotberesponsibleforanylossordamagetotheTenant'spersonalproperty.

Notices(通知)

17.AllnoticesordemandsrequiredorpermittedunderthisAgreementshallbeinwritingandsentbycertifiedmail,returnreceiptrequested,tothepartiesattheaddressesspecifiedinthisAgreement.Noticessentbymailshallbeconsideredreceivedthree(3)daysaftermailing.

18.Counterparts:

ThisAgreementmaybeexecutedinmultiplecounterparts,eachofwhichshallbedeemedanoriginalbutallofwhichtogethershallconstituteoneandthesameinstrument.

AmendmentandWaiver(修訂與棄權(quán))

19.Amendment:

ThisAgreementmayonlybeamendedormodifiedbyawrittenagreementsignedbyboththeLandlordandtheTenant.

20.Waiver:

Thefailureofeitherpartyto
