WiththousandsofcareerrelatedsitesontheInternet,findingpromising

ThismonthSingaporepassedabillthatwouldgivelegalteethtothemoral
obligationtosupportone’sparents.CalledtheMaintenanceofParentsBill,it
receivedthebackingoftheSingaporeGovernment.
Thatdoesnotmeanithasn’tgenerateddiscussion.Severalmembersofthe
Parliamentopposedthemeasureasun-Asian.Otherswhoacknowledgedthe
problemoftheelderlypoorbelieveditadisproportionateresponse.Still
othersbelieveitwillsubvertrelationswithinthefamily:cynicsdubbeditthe
“SueYourSon”law.
Thosewhosaythatthebilldoesnotpromotefilialresponsibility,ofcourse,
areright.Ithasnothingtodowithfilialresponsibility.Itkicksinwherefilial
responsibilityfails.Thelawcannotlegislatefilialresponsibilityanymore
thanitcanlegislatelove.Allthelawcandoistoprovideasatietynetwhere
thismoralityprovesinsufficient.Singaporeneedsthisbillnottoreplace
morality,buttoprovideincentivestoshoreitup.
Likemanyotherdevelopednations,Singaporefacestheproblemsofan
increasingproportionofpeopleover60yearsofage.Demographyis
inexorable.In1980,7.2%ofthepopulationwasinthisbracket.Bytheendof
thecenturythatfigurewillgrowto11%.By2030,theproportionisprojected
tobe26%.Theproblemisnotoldageperse.Itisthattheratioof
economicallyactivepeopletoeconomicallyinactivepeoplewilldecline.
Butnoamountofgovernmentexhortationorpaternalismwillcompletely
eliminatetheproblemofoldpeoplewhohaveinsufficientmeanstomake
endsmeet.Somepeoplewillfallthroughtheholesinanysafetynet.
Traditionally,aperson’sinsuranceagainstpovertyinhisoldagewashis
family.Thisisnotarevolutionaryconcept.NorisituniquelyAsian.Care
andsupportforone’sparentsisauniversalvaluesharedbyallcivilized
societies.
TheprobleminSingaporeisthatthemoralobligationtolookafterone’s
parentsisunenforceable.Afathercanbecompelledbylawtomaintainhis
children.Ahusbandcanbeforcedtosupporthiswife.But,untilnow,ason
ordaughterhadnolegalobligationtosupporthisorherparents.
In1989,anAdvisoryCouncilwassetuptolookintotheproblemsofthe
aged.Itsreportstatedwithatingeofcomplacencythat95%ofthosewhodid
nothavetheirownincomewerereceivingcashcontributionsfromrelations.
Butwhataboutthe5%whoaren’tgettingrelatives’support?Theyhave
severaloptions:(a)getajobandworkuntiltheydie;(b)applyforpublic
assistance(youhavetobedestitutetoapply);or(c)starvequietly.Noneof
theseoptionsissociallyacceptable.Andwhatifthis5%figuregrows,asitis
likelytodo,associetyages?
TheMaintenanceofParentsBillwasputforthtoencouragethetraditional
virtuesthathavesofarkeptAsiannationsfromsomeofthebreakdowns
encounteredinotheraffluentsocieties.Thislegislationwillallowapersonto
applytothecourtformaintenancefromanyorallofhischildren.Thecourt
wouldhavethediscretiontorefusetomakeanorderifitisunjust.
Thosewhoderidetheproposalforopeningupthecourtstofamilylawsuits
missthepoint.Onlyinextremecaseswouldanyparenttakehischildto
court.Ifitdoesindeedbecomelaw,thebill’seffectwouldbefarmoresubtle.
First,itwillreaffirmthenotionthatitiseachindividual’s—notsociety’s—
responsibilitytolookafterhisparents.Singaporeisstillconservativeenough
thatmostpeoplewillnotobjecttothisidea.Itreinforcesthetraditional
valuesanditdoesn’thurtasocietynowandthentoreminditselfofitscore
values.
Second,andmoreimportant,itwillmakethosewhoareinclinedtoshirk
theirresponsibilitiesthinktwice.Untilnow,ifapersonaskedfamilyelders,
clergymenortheMinistryofCommunityDevelopmenttohelpgetfinancial
supportfromhischildren,themosttheycoulddowastomediate.But
mediatorshavenoteeth,andachildcouldsimplyignoretheirpleas.
Buttobesuedbyone’sparentswouldbeamassivelossofface.Itwouldbe
apublicdisgrace.Fewpeoplewouldbesothick-skinnedastosay,“Sueand
bedamned”.Thehandoftheconciliatorwouldbeimmeasurably
strengthened.Itisfarmorelikelythatsomesortofamicablesettlement
wouldbereachediftherecalcitrantsonordaughterknowsthatthealternative
isapublictrial.
ItwouldbenicetothinkSingaporedoesn’tneedthiskindoflaw.Butthat
beliefignoresthecleardemographictrendsandtheeffectofaffluenceitself
ontraditionalbends.Thoseofuswhopushedforthebillwillconsider
ourselvesmostsuccessfulifitactsasanincentivenottohaveitinvokedin
thefirstplace.
