PAGEPAGE1云南省勞動合同書英文版ContractofEmploymentThisContractofEmployment(the"Contract")ismadeandenteredintoasof[Date],byandbetween[Employer'sName],acompanyorganizedandexistingunderthelawsofthePeople'sRepublicofChina,withitsregisteredofficelocatedat[Employer'sAddress](the"Employer"),and[Employee'sName],anindividual,withapassportnumber[PassportNumber],andresidingat[Employee'sAddress](the"Employee").WHEREAS,theEmployerdesirestoemploytheEmployee,andtheEmployeedesirestobeemployedbytheEmployer,onthetermsandconditionssetforthherein.NOW,THEREFORE,inconsiderationofthemutualcovenantsandagreementscontainedherein,thepartiesheretoagreeasfollows:1.Employment.TheEmployerherebyemploystheEmployee,andtheEmployeeherebyacceptsemploymentwiththeEmployer,inthepositionof[JobTitle](the"Position"),commencingon[StartDate](the"CommencementDate"),andterminatingon[EndDate](the"Term"),unlessterminatedearlierinaccordancewiththetermsandconditionssetforthherein.2.DutiesandResponsibilities.TheEmployeeshallperformsuchdutiesandresponsibilitiesasarecustomarilyassociatedwiththePositionandasmaybereasonablyassignedtotheEmployeebytheEmployerfromtimetotime.TheEmployeeshalldevotehis/herfulltimeandbesteffortstotheperformanceofhis/herdutieshereunder.3.Compensation.AscompensationfortheservicestoberenderedbytheEmployeehereunder,theEmployershallpaytotheEmployeeamonthlysalaryof[SalaryAmount](the"BaseSalary"),payableinaccordancewiththeEmployer'sstandardpayrollpractices.TheBaseSalaryshallbesubjecttosuchreviewsandadjustmentsastheEmployermaydetermineinitssolediscretion.4.Benefits.DuringtheTerm,theEmployeeshallbeeligibletoparticipateinsuchemployeebenefitplansandprogramsasmaybemaintainedbytheEmployerforthebenefitofitsemployeesgenerally,subjecttothetermsandconditionsofsuchplansandprograms.5.Termination.TheEmployermayterminatethisContractandtheEmployee'semploymenthereunderatanytime,withorwithoutCause.IntheeventofterminationwithoutCause,theEmployershallprovidetheEmployeewith[NoticePeriod]priorwrittennoticeoftermination,orpaymentinlieuofnoticeinanamountequaltotheBaseSalarythatwouldhavebeenpayableduringsuchnoticeperiod.TheEmployeemayterminatethisContractandhis/heremploymenthereunderatanytime,upon[NoticePeriod]priorwrittennoticetotheEmployer.6.Confidentiality.TheEmployeeshallnot,duringoraftertheTerm,disclosetoanypersonorentityanyConfidentialInformation(asdefinedbelow)oftheEmployer,exceptasrequiredbylaworwiththepriorwrittenconsentoftheEmployer."ConfidentialInformation"meansanyandallinformation,whetherinoral,written,graphic,orelectronicform,thatisproprietarytotheEmployerandnotgenerallyknowntothepublic,including,butnotlimitedto,tradesecrets,customerlists,financialdata,andbusinessplans.7.Non-Competition.DuringtheTermandforaperiodof[Non-CompetitionPeriod]followingtheterminationofthisContractforanyreason,theEmployeeshallnot,directlyorindirectly,engageinanybusinessthatiscompetitivewiththebusinessoftheEmployer,within[GeographicalArea].8.GoverningLaw.ThisContractshallbegovernedbyandconstruedinaccordancewiththelawsofthePeople'sRepublicofChina,withoutregardtoitsconflictoflawsprinciples.9.EntireAgreement.ThisContractconstitutestheentireagreementbetweenthepartieswithrespecttothesubjectmatterhereofandsupersedesallprioragreements,negotiations,andunderstandings,whetherwrittenororal,betweenthepartieswithrespecttosuchsubjectmatter.INWITNESSWHEREOF,thepartiesheretohaveexecutedthisContractasofthedatefirstabovewritten.[Employer'sName][Employee'sName]By:___________________________By:___________________________Name:_________________________Name:__________________________Title:_________________________Title:_________________________2024帶目錄帶附件詳細版-云南省勞動合同書英文版目錄1.引言2.定義和解釋3.雇傭關系4.雇員的職責和責任5.薪酬和福利6.合同期限和終止7.保密協(xié)議8.競業(yè)禁止9.法律適用和爭議解決10.完整協(xié)議11.附件1.引言本合同（以下簡稱“合同”）由以下雙方于2024年[日期]簽訂：[雇主名稱]，一家根據中華人民共和國法律成立并存續(xù)的公司，注冊地址位于[雇主地址]（以下簡稱“雇主”）;[雇員名稱]，一名持有護照號碼[護照號碼]，居住在[雇員地址]的個人（以下簡稱“雇員”）。鑒于雇主希望雇傭雇員，雇員希望被雇主雇傭，雙方根據本合同條款達成協(xié)議。2.定義和解釋除非本合同另有規(guī)定，否則本合同中使用的術語應具有以下含義：2.1“雇傭期”是指本合同第3條所述的雇傭期限。2.2“保密信息”是指任何形式的雇主專有信息，包括但不限于商業(yè)秘密、客戶名單、財務數據和商業(yè)計劃。2.3“競業(yè)禁止期”是指本合同第8條所述的競業(yè)禁止期限。3.雇傭關系雇主特此雇傭雇員，雇員接受雇主的雇傭，擔任[職位名稱]（以下簡稱“職位”），自[開始日期]（以下簡稱“開始日期”）開始，直至本合同根據本合同條款被終止。4.雇員的職責和責任雇員應履行與職位通常相關的職責和責任，并應按照雇主不時合理分配的工作履行職責。雇員應全心全意地為履行職責投入全職努力。5.薪酬和福利作為對雇員提供服務的報酬，雇主應支付給雇員每月基本工資[工資金額]（以下簡稱“基本工資”），按雇主的標準工資支付程序支付。基本工資應根據雇主的決定進行審查和調整。雇員在雇傭期間有權參加雇主為其員工普遍提供的員工福利計劃，遵守這些計劃的條款和條件。6.合同期限和終止本合同的雇傭期為[雇傭期限]，除非根據本合同條款提前終止。雇主可以在任何時候，有或無理由地終止本合同和雇員的雇傭。在無理由終止的情況下，雇主應提前[通知期]書面通知雇員終止，或支付相當于通知期內應支付的基本工資的款項作為替代通知。7.保密協(xié)議雇員在雇傭期間及雇傭期終止后的[保密期限]內，不得向任何個人或實體披露雇主的保密信息，除非法律要求或得到雇主的書面同意。8.競業(yè)禁止在雇傭期間及雇傭期終止后的[競業(yè)禁止期限]內，雇員不得直接或間接參與與雇主業(yè)務相競爭的任何業(yè)務，在[地理范圍]內。9.法律適用和爭議解決本合同應受中華人民共和國法律的約束，并應根據該法律進行解釋。雙方同意，任何因本合同引起的或與本合同有關的爭議應通過友好協(xié)商解決。如果協(xié)商未能解決爭議，任何一方均有權將爭議提交[仲裁機構名稱]進行仲裁。10.完整協(xié)議本合同構成雙方關于本合同主題事項的完整協(xié)議，并取代雙方之間以前關于此類事項的所有協(xié)議、談判和諒解，無論是書面還是口頭。11.附件本合同附件包括：附件A：薪酬細節(jié)附件B：福利計劃附件C：保密協(xié)議附件D：競業(yè)禁止協(xié)議雇主簽名：______________________雇員簽名：______________________日期：______________________日期：______________________附件列表:1.附件A:薪酬細
