(8)otherconditionsstipulatedbylawsandregulations.2,bymutualconsensus,thelaborcontractmaybelifted.3,oneofthefollowingcircumstances,PartyAPartyB30daysinadvancewrittennoticetodischargethelaborcontract:(1)Billnessorinjuryatwork,medicaltreatmentaftertheexpirationofnotengagingintheoriginalworkcannotengageinalternativearrangementsbytheParty'swork;(2)PartyBcannotdothework,aftertrainingoradjustmenttowork,stillnotcompetenttowork;(3)Thelaborcontractisbasedontheobjectiveconclusionofsignificantchangeofcircumstances,resultingininabilitytoperformthelaborcontract,theychangedthelaborcontractbymutualagreementthiscontractcannotbeinplacewithin14daysofthechange(including14days)toreachagreementa;(4)PartyA'sbusinesspolicy,theenvironmentchanges,thePartyconsidersitnecessarytoreducepersonnel;(5)pursuanttothelaborcontractaswellasthePartyestablishedrulesandregulationsandotherregulationsinlinewiththeconditionsoflaborcontracts.4,B,oneofthefollowingcircumstances,PartyAlaborcontractcanbeterminatedatanytimeandwithoutpaymentoffinancialcompensationpayments:[1]InthetrialperiodhasbeenprovedtobeinconsistentwiththePartybutnotlimitedtothefollowingstandardsorhiringconditionsofemployment;Hiringconditionsare:Adegreeofcultural:________

__________________________。EOther:_____________。(2)TheWorkingPoorsenseofresponsibility,labordiscipline,lax;(3)abletofulfillthetaskof;(4)disruptthenormalworkorderofPartyA;(5)thereareotherproblems.[2]TherearenotlimitedtothefollowingviolationofPartyrulesandregulationsoflabordisciplineorbehavior:(1)withoutreasonablecausewithinoneyearofcontinuousabsenteeism,oraccumulatedatleastthreedaysoverasix-dayabsenteeism;(2)oftenlate,leaveearly,accordingtothe"handbookforemployees"provisionsofthepunishmentwillnotbechanged;(3)vexatious,entanglement,controlthreaten,threateningemployees,affectthecompany'snormalworkingorder,accordingtothe"handbookforemployees"donotchangetheprovisionsofthedisposition;(4)violationofprofessionalethics,disorderlyconduct,accordingtothe"handbookforemployees"donotchangetheprovisionsofthedisposition;(5)violationofoperatingproceduresorworkingstandards,throughtrainingoraccordingtothe"handbookforemployees"donotchangetheprovisionsofthedisposition;(6)hoursofworkstringKong,off-site,resultinginanaccidentorbadinfluence,accordingtothe"handbookforemployees"donotchangetheprovisionsofthedisposition;(7)PartyBischecked,tothePartycandidatesprovidetheirpersonalinformationwasfalse,includingbutnotlimitedto:terminationverification,identityverification,proofofresidence,educationprovedthatamedicalcertificateisfalseorfraudulent,etc.;candidatesbeforethesufferingfrommentalillness,infectiousdiseasesandotherseriousdiseasesthataffecttheirworkinrecruitment,undeclared;candidatesbeforebyotherunitsofdemeritsretentionprobation,dismissalorremovalfromseriouspunishment,oradrug,orothermisdeedsintherecruitment,withoutstatement;candidateshavebeenpre-laborcamp,detentionorcriminalprosecutionaccordingtolawintherecruitment,withoutadeclaration,etc.;(8)PartyAPartyBaccordingtoresultsofevaluationtoadjustthejob,subjecttoPartyAPartyBdoesnotworkarrangementsandmobility,accordingtothe"handbookforemployees"donotchangetheprovisionsofthedisposition.(9)forbreachoflabordisciplineorthecompanyrulesandregulationsarewarninguptothreetimes(includingthree)aboveorinaccordancewiththe"employeehandbook"andotherprovisionsofrulesandregulationsshouldbeliftedlaborcontract.(10)withouttheconsentoftheuseofPartyAPartyofresources(includingbutnotlimitedtobusinessinformation,vehicles,telephone,Internet,etc.)toservepersonalends.[3]hasthefollowingworkisnotlimitedtonegligence,fraud,damagetotheParty(including,withoutlimitation,theCompanyhassufferedorwillsuffereconomiclossandreputationagainst)behavior:(1)aswellasotheremployerstoestablishlaborrelations,tocompletethetaskseriouslyaffectedParty,ormadebytheParty,refusetocorrectit;(2)beyondthepowerofattorneyorabuseofpowerofattorney,thecompany'slossesorinfluence;(3)utilizationofhealthwouldbeobtainedfromotherpeople'spropertyorillegallytookotherpeople'spropertyorpublicproperty,accordingtotheexisting;(4)forthepurposeofillegalpossession,forgeryofnotes,documents,seals,certificatesandsoon,obtainingfundsofacompany;(5)thesigningofperformanceofthecontractprocess,theresultofmalfeasanceorpracticingfavoritismledtothecompanysufferedlosses;(6)theuseoftheworkofhisposition,occupation,misappropriationoffundsthecompanyorcustomers;(7)Partyandtheleakageofbusinesssecretsorhelpclientscompetitors,theimpacttotheowneroreconomicloss;(8)clerkinthehandlingofbusinessdonotwriteacheckpayableto,orcomplicityinsideandoutsidetotakethecashaccountingmethoddoesnotdamagethecompany'sinterests;(9)totheownerbecauseofsubjectivefaultcausedeconomiclosseshavereachedmorethanRMBTriplethousanddollarsorabreachofthefinancialsystemamountedtoPartyErqianyuan,inadditiontogivingfinancialpenaltyorpunishment,thePartymayalsoterminatethecontractatanytime;
(10)Bisthedriver,anditsownreasons,itsoperatingservices,cards,photosorfailurehasbeen吊扣15days(inclusive)ormoreabovethesameplaceorbecauseofPartyB(includingequivalent)traffic(passengerinjury)diedanaccidentorsub-selectabove(includingsub-duty)largetraffic(passengerinjury)accidentsormaterialdamageofmorethan10,000yuan,PartyAmayatanytimeterminatethecontract.[4]hasbeenheldcriminallyresponsible,orlaborcamp,punishedbypublicsecurityorgansoflawandorder;[5]violationofPartyA"employeehandbook"provisionisguiltyoftheotherwrong;[6]thelossofthenecessaryqualificationsorconditions;[7]tofraud,coercion,orpositionofvulnerability,sothatPartyAinviolationofthetruemeaningofthecasetomakeorchangethelaborcontract.5,PartyApursuanttothiscontracttheprovisionsofArticleVIII,paragraph4,thecaseofdissolutionofthelaborcontract,PartyAPartyBshallpaythefollowingcosts:(1)accordingtoArticleIXofthelaborcontractagreedliquidateddamagesclauseshouldbeundertaken;(2)causedbytheoperationandmanagementofdirecteconomicloss;(3)PartyAPartyBtopayforthetrainingcosts;(4)lawsandregulationsandothercompensation.6,B,suchasdissolutionofthelaborcontractshallbe30daysinadvancewrittennoticetoPartyAorPartyAshallpayonemonth'ssalarytoreplacetheadvancenotice.Oneofthefollowingcircumstances,PartyBcanbeliftedatanytimenotifythelaborcontract:(1)duringtheprobationperiodisrequiredinadvanceonthe3rd;(2)PartyAtothethreatorillegalrestrictionofpersonalfreedommeansofforcedlabor;(3)PartyAdoesnotpaythelaborremunerationinaccordancewiththelaborcontractortoprovideworkingconditions.(4)Partyofviolence,threatorillegalrestrictionofpersonalfreedommeansofforcedlabor,B,orPartyAgivesdirectivestocompelriskyoperationsendangerthepersonalsafetyofPartyB,PartyBcanimmediatelydischargethelaborcontract,withoutpriorinformtheParty.7,oneofthefollowingcircumstances,PartyBcannotbebasedonthe"LaborLaw"theprovisionsofseveringtheirworkingrelationshipwiththeemployer:(1),handlingaccounts,accountform,inconsistentorunclearoftheactualaccount;(2)refusingornotyetpaidtherequiredfees;(3)isresponsibleforhisownworkdoesnotend,notransferofclear;(4)TheeconomiclossescausedtoPartyAhasnotyetbeendisposedof;(Five)asthehandlinglitigationcasesorthepersondirectlyresponsible,thecasehasnotyetover.8,oneofthefollowingcircumstances,PartyAshallnotdischargethelaborcontract:(1)sufferfromoccupationaldiseaseorinjuryatworkandwassurethelossorpartiallossofworkingcapacity;(2)sickorinjured,intheprovisionofmedicalperiod;(3)femaleworkersduringpregnancy,childbirth,breast-feedingperiod;(4)lawsandregulationsinothercircumstances.9,AandBbothlaborcontractexpiresortheterminationofthelaborcontractagreedupontermsoftheemergenceofB,oneofthefollowingcircumstances,whilenotpartofthiscontract,theprovisionsofArticleVIII,paragraph4,ofthecases,thelaborcontractperiodextendedtothedisappearanceofthefollowingcircumstances:(1)sickorinjured,intheprovisionofmedicalcareduringtheperiod;(2)femaleworkersduringpregnancy,childbirthandbreast-feedingperiod;(3)lawsandregulationsinothercircumstances.10,thelaborcontractchanges(1)toenterintothiscontractbasedonthelaws,administrativeregulations,rulesandregulationschange,thiscontractshouldbechangedrelatedtothecontent.(2)byA,Bbymutualagreement,thiscontractmaychange.(3),oneofthefollowingcircumstances,PartyAtherighttochangethiscontract:APartytochangeduetoproductionandbusinessoperation;Bduetoforcemajeurefactorsledtoafailuretoperforminaccordancewiththiscontract;CBaccordingtotherulesandregulationstoexamineandassessthesituationinaccordancewithchangestothiscontract.9,training,andbreachofcontract1,duringthecontractperiod,PartyBshouldbeofprofessionalethics,safetyproductionandallkindsofrulesandregulationsoftheeducationandPartyBaccordingtotheactualsituationontheoperationalandtechnicaltraining.Accesstoeducationandtraining,boththeB'srightandobligationofPartyB,PartyBshallnotrefusewithoutgoodreasontoparticipateinPartyorganizedbyvarioustraining.Trainingpaidfor,butthetrainingperiod,suchasovertimearenotregardedasovertime.Trainingtotrainingrecordssignedbybothsidesasfar.Basaresultofthecontractperiodforpersonalreasons,dismissedorlefttheirjobs,subjecttotheamountoftrainingtheysufferedtocompensatePartyAtrainingcosts.2,BbelongstothePartyprovideresourcesfortrainingortoprovidehousingforitshandlingShanghaisettled,thenthetwo-yearagreementsrelatedservicessoldseparatelydetermined.Intheeventofdefault,accordingtotheprovisionsofstateandPartyBandtherelatedagreementsliability.3,PartyAandPartyBfortheabolitionoflaborcontracts,trainingcostsfortheperiodBcontractualexemptiontreatment,but,ifBintentionallyorcauseseriousviolationofPartyAandPartyBtoliftthecontract,therighttorequestPartyBaccordingtotheprecedingarticleshallbeheldaccountable.4,Bviolationoflaborlaws,regulationsandPartyrulesprovideforadischargethelaborcontractorinviolationofthelaborcontractagreeduponinmatterstothefollowingeconomiclossescausedbyPartyAshallbeliableforcompensationaccordingtolaw.(1)PartyAtopaythecostsfortrainingandrecruitmentrecruitmentfees;(2)theproduction,managementandworkcausedadirecteconomicloss;(3)Thecontractandothercompensation.5,BanyamountsowedbyPartyAorPartyBforbreachofcontractthetermsagreeddissolutionofthelaborcontract,causeanyeconomiclosstotheowner,inaccordancewithlawsandregulationsandthecontractagreementshouldbeartheliabilityofPartyAshallbeentitledtoBsideofthewages,bonusesandallowances,andsubsidies(including,butnotlimitedto)acorrespondingdeductiontodo,butthedeductionshallnotviolatelawsandregulations,lessdeductions,thePartystillhastherighttoPartyBontheremainingpartoftherecovery.10,intellectualpropertyrights
1,Binthelaborcontractperiod,useofPartyA'sproduction,managementandtechnicalinformationmadebyanofficeandworksonthebooks,inadditiontorightofauthorship,theotherrightsvestedParty.
Two,BinthelaborcontractsandlaborcontractsduringtheperiodfollowingtheliftingofayearasaresultofimplementationoftheParty'stasksorengageinPartyA'sproductionandbusinessactivities,aswellastheuseofPartyAorprovideallthetechnicalinformation,materialandtechnicalconditionsofthecompletionofThetechnologicalachievementsoftheownership,userights,transferofvestedParty;iftheoutcomeofthetechnologypatentwasgrantedpatent,theapplicationrightsandpatentrightsisalsoattributabletoParty.
3,ifthePartyAtoPartyBinwritingexpresslyabandonedtheinvention,discoveryandinnovation,patentsorownership,Bcanfreelydisposeofpatents,butthePartyretainstherighttofreeuse.XI,separationprocedures1,nopartytoterminatethecontract,shallbe1monthinadvancetonotifyeachotherbeforetheycancelthecontractprocessingprocedures.Bintheterminationordissolutionoflaborcontractbeforethelastdaywhen,accordingtothehandoverproceduresfortheworkofPartyregulations,includingthedeficiencyintheworkitems,documents,data,andallkindsofofficearticles,etc.,shallbetransferredtoPartyAtotalinventoryofdesignatedofficeranylossiscompensable.
