普通勞務(wù)合同合同編號：__________partieswhereas,theemployerisengagedinthebusinessof__________(the"business")andrequirestheservicesofaqualifiedindividualtoperformcertaintasksinconnectionwiththebusiness;andwhereas,theemployeehasthenecessaryskills,knowledgeandexperiencetoperformthetasksrequiredtheemployer;now,therefore,inconsiderationofthemutualpromisescontainedherein,thepartiesheretoagreeasfollows:article1employment1.1employment.theemployerhereemploystheemployeetoperformthetaskssetforthinparagraph3.1ofthisagreement(the"tasks")inaccordancewiththetermsandconditionsofthisagreement.1.3term.unlessearlierterminatedasprovidedinarticle7ofthisagreement,theemploymentshallcontinueforatermof__________(the"term")fromthestartdate.article2dutiesandresponsibilities2.1duties.duringthetermofemployment,theemployeeshallperformthetasksassignedtheemployerinaccordancewiththeinstructionsandrequirementsoftheemployer.2.2responsibilities.theemployeeshall:(a)performthetaskswithduecare,skillanddiligence;(c)maintaintheconfidentialityofallproprietaryandconfidentialinformationoftheemployer;and(d)notengageinanyactivitythatisinconsistentwiththeemployee'sdutiesunderthisagreement.3.1salary.theemployershallpaytheemployeeamonthlysalaryof__________(the"salary")duringthetermofemployment.3.2benefits.theemployershallprovidetheemployeewiththebenefitssetforthintheemployer'sbenefitplan,asmaybeamendedfromtimetotime,inaccordancewiththetermsandconditionsofsuchplan.3.3expenses.theemployershallreimbursetheemployeeforallreasonableandnecessaryexpensesincurredtheemployeeintheperformanceofthetasks,uponpresentationofappropriatedocumentation.article4termination4.1terminationeitherparty.eitherpartymayterminatethisagreementatanytimeuponwrittennoticetotheotherparty.4.2terminationemployer.theemployermayterminatethisagreementwithoutcauseuponwrittennoticetotheemployee,providedthattheemployershallpaytheemployeethesalaryandbenefitsdueunderthisagreementthroughthedateoftermination.4.3terminationemployee.theemployeemayterminatethisagreementuponwrittennoticetotheemployer,providedthattheemployeeshallprovidetheemployerwithatleast__________(the"noticeperiod")days'noticepriortotheeffectivedateoftermination.article5indemnification5.1indemnification.theemployershallindemnifyandholdharmlesstheemployeeagainstanyandallclaims,damages,liabilities,costsandexpenses(includingreasonableattorney'sfees)arisingoutoforinconnectionwiththeperformanceofthetaskstheemployeeunderthisagreement,excepttotheextentcausedtheemployee'sgrossnegligenceorwillfulmisconduct.article6confidentialinformation6.2nondisclosure.theemployeeagreestoholdinconfidenceandnotdisclosetoanyperson,firm,corporationorotherentityanyconfidentialinformationoftheemployer,excepttotheextentrequiredlaworregulation.6.3returnofproperty.upontheterminationofthisagreement,theemployeeshallreturntotheemployerallproperty,documentsandothermaterialsbelongingtotheemployer.article7miscellaneous7.1assignment.thisagreementmaynotbeassignedeitherpartywithoutthepriorwrittenconsentoftheotherparty.7.2amendment.thisagreementmaybeamendedormodifiedonlyawritteninstrumentexecutedbothparties.7.3Governinglaw.thisagreementshallbegovernedandconstruedinaccordancewiththelawsoftheemployer'scountry.7.4disputeresolution.anydisputesarisingoutoforinconnectionwiththisagreementshallberesolvedarbitrationinaccordancewiththerules一、附件列表：1.員工身份證明文件2.雇主營業(yè)執(zhí)照副本3.職位描述和工作任務(wù)書4.雇主和員工之間的協(xié)議書5.勞動和社會保障法規(guī)文件6.保密協(xié)議7.員工手冊8.公司福利計劃說明9.辭職信10.terminationnotice二、違約行為及認定：1.員工未能按照約定時間完成任務(wù)或未能達到工作標準。2.員工違反保密協(xié)議，泄露了公司的機密信息。3.雇主未能按時支付約定的工資和福利。4.雇主未能提供合同規(guī)定的勞動條件和工作環(huán)境。5.任何一方未經(jīng)對方同意擅自變更或終止合同。三、法律名詞及解釋：1.雇主：指根據(jù)合同條款雇傭員工的公司或組織。2.員工：指與雇主簽訂合同并提供勞動服務(wù)的個人。3.勞動合同：指雇主與員工之間確立勞動關(guān)系的協(xié)議。4.工資：指雇主按照合同約定支付給員工的報酬。5.福利：指雇主提供給員工的除工資以外的其他待遇，如健康保險、年假等。6.工作任務(wù)：指員工在合同期間應(yīng)完成的職責和任務(wù)。7.保密協(xié)議：指員工與雇主之間關(guān)于保護公司機密的協(xié)議。四、執(zhí)行中遇到的問題及解決辦法：2.
