人所得稅、土地增值稅、印花稅等,具體費(fèi)用以相關(guān)稅務(wù)機(jī)關(guān)的規(guī)定為準(zhǔn)。5.3過(guò)戶手續(xù)過(guò)戶手續(xù)由賣方負(fù)責(zé)辦理,買(mǎi)方予以配合。5.4過(guò)戶所需文件過(guò)戶所需文件包括但不限于房屋產(chǎn)權(quán)證、買(mǎi)賣雙方身份證、戶口本、婚姻證明等。第六章房屋交付及驗(yàn)收6.1交付時(shí)間房屋交付時(shí)間為_(kāi)___年__月__日。6.2驗(yàn)收標(biāo)準(zhǔn)房屋交付時(shí),買(mǎi)方有權(quán)對(duì)房屋進(jìn)行驗(yàn)收,驗(yàn)收標(biāo)準(zhǔn)以合同約定為準(zhǔn)。6.3驗(yàn)收程序驗(yàn)收程序?yàn)橘I(mǎi)方在房屋交付時(shí)進(jìn)行現(xiàn)場(chǎng)驗(yàn)收,賣方予以配合。6.4驗(yàn)收責(zé)任如房屋存在質(zhì)量問(wèn)題,賣方應(yīng)承擔(dān)相應(yīng)的修復(fù)責(zé)任。第七章交易稅費(fèi)7.1稅費(fèi)承擔(dān)交易稅費(fèi)按照相關(guān)法律法規(guī)的規(guī)定由買(mǎi)賣雙方各自承擔(dān)。7.2稅費(fèi)計(jì)算稅費(fèi)計(jì)算以相關(guān)稅務(wù)機(jī)關(guān)的規(guī)定為準(zhǔn)。7.3稅費(fèi)繳納時(shí)間稅費(fèi)繳納時(shí)間為買(mǎi)方在房屋交付前完成繳納。第八章?tīng)?zhēng)議解決8.1爭(zhēng)議解決方式本合同在履行過(guò)程中如發(fā)生爭(zhēng)議,應(yīng)通過(guò)友好協(xié)商解決;協(xié)商不成的,任何一方均有權(quán)向合同簽訂地人民法院提起訴訟。8.2爭(zhēng)議解決機(jī)構(gòu)爭(zhēng)議解決機(jī)構(gòu)為合同簽訂地的人民法院。8.3爭(zhēng)議解決費(fèi)用爭(zhēng)議解決費(fèi)用由敗訴方承擔(dān),除非法律另有規(guī)定。第九章合同解除與違約責(zé)任9.1合同解除條件9.1.1賣方未按約定時(shí)間交付房屋的,買(mǎi)方有權(quán)解除合同,并要求賣方承擔(dān)違約責(zé)任。9.1.2買(mǎi)方未按約定支付房款的,賣方有權(quán)解除合同,并要求買(mǎi)方承擔(dān)違約責(zé)任。9.1.3合同約定的其他解除條件。9.2違約責(zé)任9.2.1賣方違約的,應(yīng)向買(mǎi)方支付房屋交易總價(jià)款的____%作為違約金。9.2.2買(mǎi)方違約的,應(yīng)向賣方支付房屋交易總價(jià)款的____%作為違約金。第十章其他約定事項(xiàng)10.1不可抗力因不可抗力導(dǎo)致合同無(wú)法履行的,雙方互不承擔(dān)責(zé)任。但應(yīng)及時(shí)通知對(duì)方,并提供相關(guān)證明。10.2合同附件本合同附件包括但不限于房屋產(chǎn)權(quán)證復(fù)印件、買(mǎi)賣雙方身份證復(fù)印件等。10.3合同變更合同變更需經(jīng)雙方書(shū)面同意,并簽訂補(bǔ)充協(xié)議。10.4合同份數(shù)本合同一式____份,買(mǎi)方執(zhí)____份,賣方執(zhí)____份,具有同等法律效力。第十一章合同生效及終止11.1合同生效條件本合同自雙方簽字(或蓋章)之日起生效。11.2合同終止條件合同約定的終止條件成就時(shí),合同終止。第十二章合同附件(此處列出合同附件的具體內(nèi)容)第十三章合同簽訂人簽字(此處留白供合同簽訂人簽字)賣方簽字:____________________日期:____年__月__日買(mǎi)方簽字:____________________日期:____年__月__日代理人簽字:____________________日期:____年__月__日第十四章合同簽署日期(此處留白供合同簽署日期)賣方簽署日期:____年__月__日買(mǎi)方簽署日期:____年__月__日代理人簽署日期:____年__月__日_________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________
