英語版離婚合同協(xié)議書

DivorceAgreement

ThisDivorceAgreement(the"Agreement")ismadeandenteredintoasof[date]byandbetween[Spouse1'sfullname](hereinafterreferredtoas"Husband")and[Spouse2'sfullname](hereinafterreferredtoas"Wife").

I.Divorce

1.HusbandandWifemutuallyconsenttodissolvetheirmarriageandherebyfilefordivorceinaccordancewiththelawsof[Jurisdiction].

II.DivisionofAssets

1.MaritalProperty

-Thepartieshavejointlyidentifiedandagreeduponthefollowingdivisionofmaritalproperty:

-RealEstate:Thepropertylocatedat[Propertyaddress]shallbeawardedto[Spousename].Thepartyreceivingthepropertyshallberesponsibleforanyoutstandingmortgagepayments,propertytaxes,andmaintenancecostsassociatedwiththeproperty.

-Vehicles:The[Make,model,andyearofvehicle]shallbeawardedto[Spousename].Thepartyreceivingthevehicleshallassumeanyoutstandingloansorliensonthevehicle.

-BankAccounts:Thejointbankaccountheldat[Bankname]shallbedividedasfollows:[Percentageoramount]toHusbandand[Percentageoramount]toWife.Eachpartyshallberesponsibleforanytransactionsorobligationsrelatedtotheirrespectiveshareoftheaccount.

-RetirementAccounts:Husband'sretirementaccountwith[Retirementaccountprovider]shallremaininhisname,andWife'sretirementaccountwith[Retirementaccountprovider]shallremaininhername.

2.SeparateProperty

-Eachpartyacknowledgesandagreesthatthefollowingpropertyshallbeconsideredtheirseparatepropertyandshallnotbesubjecttodivisionasmaritalproperty:

-Propertyacquiredbyeitherpartypriortothemarriage.

-Propertyacquiredbyeitherpartyduringthemarriagethroughinheritance,gift,orpersonalinjurysettlement,providedthatsuchpropertywasnotcommingledwithmaritalproperty.

III.DebtsandLiabilities

1.MaritalDebts

-Thepartieshavejointlyidentifiedandagreeduponthefollowingdivisionofmaritaldebts:

-CreditCardDebts:Thecreditcardaccountinthenameof[Spousename]with[Creditcardcompany]shallbetheresponsibilityof[Spousename].Thepartyresponsibleforthecreditcarddebtshallbesolelyliableforallpayments,interest,andfeesassociatedwiththeaccount.

-StudentLoans:Thestudentloandebtinthenameof[Spousename]shallbetheresponsibilityof[Spousename].Thepartyresponsibleforthestudentloandebtshallbesolelyliableforallpayments,interest,andfeesassociatedwiththeloan.

-MortgagesandHomeEquityLoans:Aspreviouslystated,thepartyawardedtherealestatepropertyshallberesponsibleforanyoutstandingmortgages,homeequityloans,orotherliensontheproperty.

2.SeparateDebts

-Eachpartyshallberesponsibleforanydebtsandliabilitiesincurredintheirownnamepriortoorduringthemarriagethatarenotconsideredmaritaldebts.

IV.SpousalSupport

1.AmountandDuration

-HusbandshallpayWifespousalsupportintheamountof[Amount]permonth,commencingon[Startdate]andcontinuingforaperiodof[Duration]months.

-Thespousalsupportamountmaybeadjusteduponashowingofasubstantialchangeincircumstances,suchasasignificantincreaseordecreaseineitherparty'sincome,employmentstatus,orfinancialneeds.

2.TaxImplications

-Thepartiesacknowledgeandagreethatspousalsupportpaymentsshallbetreatedastaxableincometotherecipientandtax-deductibletothepayer,inaccordancewiththeapplicabletaxlaws.

V.ChildCustodyandVisitation(ifapplicable)

1.LegalCustody

-HusbandandWifeshallsharejointlegalcustodyoftheirminorchild(ren):[Child'sname(s),date(s)ofbirth].Jointlegalcustodyshallmeanthatbothparentsshallhaveequalrightsandresponsibilitiesregardingmajordecisionsaffectingthechild(ren)'seducation,healthcare,religion,andgeneralwelfare.

2.PhysicalCustody

-Thepartieshaveagreeduponthefollowingphysicalcustodyarrangement:

-PrimaryPhysicalCustody:[Spousename]shallhaveprimaryphysicalcustodyofthechild(ren),meaningthatthechild(ren)shallresideprimarilywith[Spousename].

-VisitationSchedule:[Spousename]shallhavevisitationrightswiththechild(ren)asfollows:[Describethevisitationschedule,includingspecificdays,times,andholidays].

3.CommunicationandCooperation

-Bothparentsshallencourageandfacilitatefrequentandopencommunicationbetweenthechild(ren)andthenon-custodialparent.Theyshallalsocooperatewitheachotherinmattersrelatedtothechild(ren)'swell-being,includingbutnotlimitedtoattendingparent-teacherconferences,medicalappointments,andextracurricularactivities.

VI.ChildSupport(ifapplicable)

1.AmountandCalculation

-Basedontheincomeandfinancialcircumstancesofbothparties,HusbandshallpayWifechildsupportintheamountof[Amount]permonth,commencingon[Startdate].Thechildsupportamountshallbecalculatedinaccordancewiththechildsupportguidelinesof[Jurisdiction].

-Thechildsupportamountmaybeadjusteduponashowingofasubstantialchangeincircumstances,suchasasignificantincreaseordecreaseineitherparty'sincome,thechild(ren)'sneeds,orthecostofliving.

2.UseofChildSupport

-Childsupportpaymentsshallbeusedforthedirectbenefitofthechild(ren),includingbutnotlimitedtofood,clothing,shelter,education,healthcare,andextracurricularactivities.

VII.Insurance

1.HealthInsurance

-Untilthechild(ren)reachtheageofmajorityorbecomeotherwiseemancipated,[Spousename]shallmaintainthechild(ren)ontheirhealthinsurancepolicy.Thecostofthehealthinsurancepremiumsshallbesharedbetweenthepartiesinproportiontotheirrespectiveincomes,asdeterminedbythechildsupportguidelinesof[Jurisdiction].

2.LifeInsurance

-Husbandshallmaintainalifeinsurancepolicyintheamountof[Amount]forthebenefitofthechild(ren)andWife,astheprimarybeneficiaries,forthedurationofhischildsupportandspousalsupportobligations.Wifeshallmaintainalifeinsurancepolicyintheamountof[Amount]forthebenefitofthechild(ren),astheprimarybeneficiaries,forthedurationofherchildsupportobligations.

VIII.TaxMatters

1.FilingStatus

-Fortaxpurposes,thepartiesshallfiletheirincometaxreturnsinaccordancewiththeirmaritalstatusasoftheendofthetaxyear.Ifthedivorceisfinalizedduringthetaxyear,thepartiesshallconsultwithataxprofessionaltodeterminetheappropriatefilingstatusandtaximplications.

2.DeductionsandCredits

-Eachpartyshallberesponsibleforclaiminganydeductionsandcreditstowhichtheyareentitledunderthetaxlaws,includingbutnotlimitedtodeductionsforalimonypayments,childsupportpayments,anddependentexemptions.

IX.Confidentiality

1.Non-Disclosure

-Eachpartyagreestokeepconfidentialallinformationobtainedfromtheotherpartyduringthecourseoftheirmarriageandthedivorceproceedings,includingbutnotlimitedtofinancialinformation,personalinformation,andinformationrelatedtothechild(ren).

2.Non-Disparagement

-Thepartiesshallrefrainfrommakinganydisparagingordefamatorystatementsabouteachother,eitherdirectlyorindirectly,tothirdparties.

X.EntireAgreement

1.Integration

-ThisAgreementconstitutestheentireagreementbetweenthepartieswithrespecttothesubjectmatterhereofandsupersedesallprioragreementsandunderstandings,oralorwritten,relatingtothesame.

XI.AmendmentsandWaivers

1.Amendments

-Noamendment,modification,orsupplementtothisAgreementshallbeeffectiveunlessinwritingandsignedbybothparties.

2.Waivers

-NowaiverofanyprovisionofthisAgreementshallbeeffectiveunlessinwritingandsignedbythepartywaivingcompliance.

XII.Severability

1.Invalidity
