前言網(wǎng)絡(luò)商場(chǎng)包羅萬(wàn)象,商品種類(lèi)繁多,購(gòu)買(mǎi)方便快捷,向消費(fèi)市場(chǎng)散發(fā)著難以抵擋的誘惑。據(jù)艾瑞咨詢(xún)數(shù)據(jù)顯示,從2001年到2006年,我國(guó)網(wǎng)絡(luò)購(gòu)物的用戶(hù)規(guī)模從375萬(wàn)人增加到4310萬(wàn)人,與此同時(shí)網(wǎng)絡(luò)購(gòu)物交易額也由6億元增長(zhǎng)至312億元。艾瑞咨詢(xún)2012Q3電子商務(wù)交易規(guī)模199萬(wàn)億隨著水果蔬菜、襯衫、電器、建材甚至鉆石都已經(jīng)搬到網(wǎng)上來(lái)賣(mài),會(huì)有更多的細(xì)分垂直行業(yè)掀起新的網(wǎng)絡(luò)銷(xiāo)售,電子商務(wù)也開(kāi)始由第一波的互聯(lián)網(wǎng)概念真正走向了關(guān)乎人們衣食住行的商務(wù)行為。調(diào)查在我們的調(diào)查中,不少被訪(fǎng)者認(rèn)為網(wǎng)上購(gòu)物既方便又齊全,但也有被訪(fǎng)者反映了網(wǎng)上購(gòu)物的商品信息不齊全,很多商品都是拿官方雜志的圖片混淆消費(fèi)者等問(wèn)題。個(gè)案一小方,女,28歲,江門(mén)臺(tái)山人,自由職業(yè)者“我覺(jué)得網(wǎng)上購(gòu)物弊大于利。大部分網(wǎng)店都是標(biāo)榜韓國(guó)等海外的官方圖片,以漂亮的效果圖混淆消費(fèi)者,而商品卻是仿制品,這就讓我們消費(fèi)者買(mǎi)得不安心,很多理性消費(fèi)者都會(huì)選擇小額消費(fèi)。”個(gè)案二黃先生,男,40歲,江門(mén)人,某服裝店老板“網(wǎng)上購(gòu)物不能看到實(shí)物,衣物等物品也不能試穿,黑心賣(mài)家還會(huì)以次充好,把瑕疵品賣(mài)給買(mǎi)家。一方面,交易不安全,在實(shí)體店買(mǎi)賣(mài)都是現(xiàn)金交易,而在網(wǎng)上購(gòu)物卻要款到發(fā)貨,根本不確定賣(mài)方是否能誠(chéng)信交易;另一方面,維修困難。當(dāng)你在網(wǎng)上購(gòu)買(mǎi)了數(shù)碼產(chǎn)品,使用出現(xiàn)故障了,你是否能得到聯(lián)保的保修服務(wù)?!眰€(gè)案三小陳,男,22歲,江門(mén)人,五邑大學(xué)學(xué)生“我曾在網(wǎng)上購(gòu)買(mǎi)50元充值卡,買(mǎi)回來(lái)后發(fā)現(xiàn)卻是30元充值卡,一直也聯(lián)系不上賣(mài)家,所以在網(wǎng)上購(gòu)物存在很大風(fēng)險(xiǎn),經(jīng)營(yíng)者多用虛擬網(wǎng)名注冊(cè),經(jīng)營(yíng)者的真實(shí)身份、住所等信息無(wú)法予以確認(rèn),很多網(wǎng)上交易又是跨省市的異地交易,給受理和查處帶來(lái)困難,使消費(fèi)者的損失難以被追回?!本W(wǎng)絡(luò)購(gòu)物的弊端分析我們?cè)诳吹骄W(wǎng)上購(gòu)物優(yōu)點(diǎn)的同時(shí)更要認(rèn)清它在現(xiàn)階段存在的問(wèn)題,以便盡早地找到解決方案以促進(jìn)網(wǎng)上購(gòu)物的良性發(fā)展??梢哉f(shuō),現(xiàn)階段我國(guó)消費(fèi)者對(duì)網(wǎng)上購(gòu)物狀況的評(píng)價(jià)是“痛并快樂(lè)著”,而這其中痛的指數(shù)要高于快樂(lè)指數(shù)。第一、交易對(duì)象認(rèn)定的模糊性。明確交易對(duì)象對(duì)于消費(fèi)者來(lái)說(shuō)是非常重要的事情,這關(guān)系到法律責(zé)任的承擔(dān)問(wèn)題。在傳統(tǒng)購(gòu)物環(huán)境下交易對(duì)象非常明確,商店里掛的營(yíng)業(yè)執(zhí)照就表明了經(jīng)營(yíng)者的身份。一旦出了問(wèn)題可以直接到原購(gòu)物地點(diǎn)追討責(zé)任。但是在網(wǎng)絡(luò)環(huán)境下,消費(fèi)者只有通過(guò)經(jīng)營(yíng)者網(wǎng)站中提供的信息了解對(duì)方,但是至于信息是否真實(shí)、對(duì)方到底是誰(shuí)根本不清楚。第二、知情權(quán)難以保證。知情權(quán)是消費(fèi)者享有的一項(xiàng)基本權(quán)利也是一項(xiàng)重要權(quán)利。然而上網(wǎng)購(gòu)物時(shí),消費(fèi)者獲取信息的范圍是有限的,它并不像傳統(tǒng)購(gòu)物時(shí)能看到、摸到真實(shí)立體的商品,并向售貨員詳細(xì)打聽(tīng)有關(guān)商品的基本情況。此時(shí)的消費(fèi)者只能從網(wǎng)上提供的內(nèi)容中獲取有關(guān)商品的部分信息,看到的充其量也就是一張或幾張關(guān)于商品的平面照片。因此,網(wǎng)上購(gòu)物的消費(fèi)者一般對(duì)商品信息的了解都是缺失的。第三、格式合同的制約。由于網(wǎng)上購(gòu)物的特殊性,格式合同不可避免地成了消費(fèi)者和經(jīng)營(yíng)者達(dá)成合意的必要環(huán)節(jié)?,F(xiàn)在的問(wèn)題是經(jīng)營(yíng)者往往利用特權(quán)制定一些又長(zhǎng)又復(fù)雜甚至危害消費(fèi)者權(quán)利的條款,有時(shí)為逃避責(zé)任還會(huì)使用一些模棱兩可的語(yǔ)言,一旦出了問(wèn)題會(huì)以此為自己辯解。消費(fèi)者有時(shí)為了圖省事不會(huì)仔細(xì)閱讀每一條款,有時(shí)就算讀了也很有可能領(lǐng)會(huì)不到其中的微妙之處,有時(shí)即便發(fā)現(xiàn)有什么可疑的地方但為了及時(shí)買(mǎi)到所需商品也無(wú)所顧忌,因此,有時(shí)一個(gè)“我同意”的點(diǎn)擊會(huì)給消費(fèi)者帶來(lái)了購(gòu)物后一系列的麻煩。第四、交貨延遲。付款后不能按期收到貨物的事屢見(jiàn)不鮮,有時(shí)付款后收不到貨物的情況也會(huì)出現(xiàn)。第五、退貨困難。網(wǎng)上購(gòu)得的貨物想要退掉并不是件容易的事,經(jīng)營(yíng)者往往找種種理由拒絕退貨。有時(shí)甚至直接在格式合同中明文規(guī)定某些商品不得退貨。對(duì)于在退貨范圍內(nèi)的商品,通過(guò)經(jīng)營(yíng)者的規(guī)定看也根本無(wú)法退換。第六、網(wǎng)上欺詐與虛假?gòu)V告。互聯(lián)網(wǎng)技術(shù)使得某些商家可通過(guò)匿名的方式躲避調(diào)查,利用監(jiān)管難度大、隱蔽性強(qiáng)、傳播快的特點(diǎn)大行虛假?gòu)V告和欺詐之道,它們往往打著“跳樓價(jià)”“超值大獎(jiǎng)等你拿”一類(lèi)的旗號(hào)吸引消費(fèi)者的眼球,借機(jī)侵犯消費(fèi)者的權(quán)益而為自己牟利。第七、無(wú)人問(wèn)津的售后服務(wù)。許多網(wǎng)民表示,網(wǎng)上購(gòu)物的售后服務(wù)較差,有時(shí)商品出了問(wèn)題經(jīng)營(yíng)者能推則推,就算有售后服務(wù)也只是表面應(yīng)付一下,許多問(wèn)題根本得不到實(shí)質(zhì)解決。第八、處于危機(jī)中的隱私權(quán)。這個(gè)問(wèn)題是現(xiàn)在大家廣泛關(guān)注的問(wèn)題,也是挑戰(zhàn)網(wǎng)絡(luò)安全的主要大敵。一些商家為了擴(kuò)大銷(xiāo)售額,不惜將以前消費(fèi)者的信息建立數(shù)據(jù)庫(kù),根據(jù)其經(jīng)濟(jì)狀況、上網(wǎng)習(xí)慣等不停轟炸消費(fèi)者的郵箱以推銷(xiāo)自己的產(chǎn)品;更有甚者,為了眼前的經(jīng)濟(jì)利益將消費(fèi)者的信息賣(mài)給他人。此外,消費(fèi)者的信用卡賬號(hào)、密碼被篡改、被盜也是常有的事。所有這些問(wèn)題如果不能及時(shí)有效地解決,肯定會(huì)制約未來(lái)網(wǎng)上購(gòu)物的進(jìn)一步發(fā)展。當(dāng)今信息產(chǎn)業(yè)高速發(fā)展,商品借助網(wǎng)絡(luò)產(chǎn)生了一種新的交易方式網(wǎng)絡(luò)購(gòu)物,今天很高興和對(duì)方辯友共同探討網(wǎng)絡(luò)購(gòu)物利弊的問(wèn)題,我方觀(guān)點(diǎn)是網(wǎng)絡(luò)購(gòu)物弊大于利,首先,我們明確這樣的概念網(wǎng)絡(luò)購(gòu)物指的是通過(guò)互聯(lián)網(wǎng)檢索信息,并通過(guò)訂購(gòu)者發(fā)出請(qǐng)求,通過(guò)第三方支付工具或銀行付款,通過(guò)郵寄方式或快遞公司配送的購(gòu)物方式。今天我們研究利弊的對(duì)象,是看網(wǎng)絡(luò)購(gòu)物對(duì)個(gè)人,對(duì)社會(huì),乃至對(duì)國(guó)家是利是弊。下面我方從從以下三方面進(jìn)行闡述。第一、從個(gè)人的角度出發(fā),網(wǎng)絡(luò)購(gòu)物使個(gè)人權(quán)益受到威脅。我們知道網(wǎng)絡(luò)購(gòu)物需要大量的個(gè)人信息,而現(xiàn)在的網(wǎng)絡(luò)上個(gè)人信息外泄的現(xiàn)象越來(lái)越嚴(yán)重,甚至有人倒賣(mài)個(gè)人信息。再者,通過(guò)網(wǎng)絡(luò)進(jìn)行購(gòu)物,消費(fèi)者難以知悉其商品和接受的服務(wù)的真實(shí)情況,由于網(wǎng)絡(luò)具有虛擬性,看得見(jiàn)卻摸不著,網(wǎng)絡(luò)消費(fèi)者僅能憑著自己的感官或經(jīng)驗(yàn)去判定產(chǎn)品質(zhì)量和性能。眾多消費(fèi)者對(duì)網(wǎng)絡(luò)產(chǎn)品質(zhì)量,性能了解是局部的,片面的。因此,包括因產(chǎn)品存在的瑕疵等質(zhì)量問(wèn)題而引發(fā)的糾紛時(shí)常發(fā)生。由于網(wǎng)絡(luò)購(gòu)物無(wú)確定的發(fā)生地,交易地而導(dǎo)致消費(fèi)者難以享有應(yīng)有的售后服務(wù),甚至國(guó)家三包政策都難以實(shí)現(xiàn)。當(dāng)消費(fèi)者的權(quán)益受到侵害時(shí),由于網(wǎng)絡(luò)身份信息核實(shí)難,證據(jù)真?zhèn)伪鎰e難,權(quán)利義務(wù)認(rèn)定難的三大特點(diǎn)而導(dǎo)致消費(fèi)者權(quán)益無(wú)法得到正當(dāng)?shù)木S護(hù)。無(wú)論是網(wǎng)購(gòu)的
