11、ng to the law.三、工作時(shí)間和休息休假Article 3 worki ng hours and holidays1、工作時(shí)間：乙方的崗位實(shí)行(標(biāo)準(zhǔn)、綜合計(jì)算、不定時(shí))工時(shí)工作制。其中，標(biāo)準(zhǔn)工 時(shí)工作制度為(常白班、 班 / 運(yùn)轉(zhuǎn)工作制)，每天工作8小時(shí)，每周休息日為2天 。1. 18、e performa nee salaryassessme nt method will be defi ned as per the performa nee of Party B and the releva nt evaluati on rules formulated by Party A accordi ng to the laws.(3) 計(jì)件工資制：計(jì)件工資的勞動(dòng)定額管理按照甲方依法制訂的相關(guān)規(guī)定，乙方的定額單價(jià)為/ 元。甲方確定、調(diào)整勞動(dòng)定額的標(biāo)準(zhǔn)應(yīng)當(dāng)保證本單位與乙方同崗位90%以上的勞動(dòng)者在法定工作時(shí)間內(nèi)能夠完成。超過法定工作時(shí)間及標(biāo)準(zhǔn)以外勞動(dòng)定額，應(yīng)當(dāng)按照法定加班工資的標(biāo)準(zhǔn)

19、計(jì)算計(jì)件工資。(3) Piecework salary: the quota of piecework, which isRMB/Piece, shall be defi ned as perthe releva nt provisi ons formulated by Party A accord ing the laws. The quota sta ndard defi ned or adjusted by Party A shall en sure 90% employees in the compa ny can complete the work with in the statu

The piecework wages for the working hours exceeding the statutory work ing time or quota bey ond the sta ndard shall be calculated accordi ng to the statutory overtime payme nt sta ndard.(4) 其他工資分配形式：(4) Other salary distributio n forms:2、乙方從事可能產(chǎn)生職業(yè)病危害的崗位工種、夜班勞動(dòng)、高溫等作業(yè)的津貼、補(bǔ)貼，按國(guó)家和甲

In case Party B may take the positions which can cause occupational disease hazard, night shifts and high temperature operations, the compensation and subsidy shall be implemented as per the relevant regulations of state and Party A, or based on collective contract.3、甲方向乙方支付工資時(shí)，必須出具工

22、資清單，包括乙方姓名、發(fā)放時(shí)間、應(yīng)付工資、 實(shí)發(fā)工資、代扣和扣減工資等項(xiàng)目?jī)?nèi)容，由乙方簽字確認(rèn)。3. When paying Party B, Party A shall issue salary list with the name of Party B, salary time, total pay amount, final pay amount, withholding and deduction from wages, etc. Party B shall sign the salary list for confirmation.4、甲方應(yīng)當(dāng)根據(jù)本單位的經(jīng)濟(jì)效益增長(zhǎng)情況、當(dāng)?shù)卣l(fā)

23、布的工資指導(dǎo)線、工資指導(dǎo)價(jià) 位等標(biāo)準(zhǔn)，通過工資集體協(xié)商以及工資正常增長(zhǎng)制度，合理增加乙方工資報(bào)酬。4. In accordance with economic benefits growth status, the local government s wage guidand guidance wage standard, Party A shall rationally increase the wages of Party B through collective wage negotiations and wage growth system.五、社會(huì)保險(xiǎn)Article 5 Socia

24、l Insurance1、自勞動(dòng)關(guān)系建立之月起，甲乙雙方應(yīng)當(dāng)依法參加社會(huì)保險(xiǎn)，按時(shí)足額申報(bào)繳納社會(huì)保 險(xiǎn)費(fèi)，其中乙方應(yīng)繳納的社會(huì)保險(xiǎn)費(fèi)由甲方代扣代繳。1. Since the establishment of labor relationships, the both parties shall attend social insurance according to law, pay on time and full specified amount for each social insurance premium, in which, the Party B part of premiu

25、m shall be deducted and paid by Party A on a monthly basis for and on behalf of Party B, in accordance with the rules of China.2、甲方應(yīng)當(dāng)每年至少一次向本單位職工代表大會(huì)或本單位住所的顯著位置公布本單位和 個(gè)人全年社會(huì)保險(xiǎn)費(fèi)繳納情況，接受乙方監(jiān)督。2. Party A shall publicize the insurance paying status at list once a year for Party B s supervision.3、合同履行期間，乙方

26、依法享受國(guó)家規(guī)定和雙方約定的福利待遇。3. During contract performance, Party B shall legally enjoy the welfares stipulated by state regulations or both parties agreed.六、勞動(dòng)保護(hù)、勞動(dòng)條件和職業(yè)危害防護(hù)Article 6, labor protection, work conditions and occupational hazard protection1、甲方保證執(zhí)行國(guó)家關(guān)于特種作業(yè)、女職工和未成年工特殊保護(hù)的規(guī)定，對(duì)可能產(chǎn)生職 業(yè)病危害的崗位向乙方履行如實(shí)告知

27、義務(wù)，對(duì)乙方進(jìn)行勞動(dòng)安全衛(wèi)生教育，防止勞動(dòng)過程中 的傷亡事故，減少職業(yè)病危害。乙方從事有職業(yè)危害作業(yè)的，甲方應(yīng)當(dāng)定期為乙方進(jìn)行健康 檢查，并在乙方離職前進(jìn)行職業(yè)健康檢查。1. Party A shall promise to implement the special protection regulations of state for specials demoperations, women or the minor. Party A shall inform Party B about all kinds of potential hazards and provide labor s

28、afety and health training to preve nt injury accide nts and occupati onal hazards. In case Party B holds the position of dangerous operation. Party A shall regularly provide Party B with health exam in ati on, and con duct occupati onal health exam in ati on before Party B2、甲方承諾，為乙方提供符合國(guó)家規(guī)定的勞動(dòng)安全衛(wèi)生條件

29、和必要的勞動(dòng)防護(hù)用品。乙 方應(yīng)當(dāng)嚴(yán)格遵守國(guó)家和甲方規(guī)定的勞動(dòng)安全規(guī)程和標(biāo)準(zhǔn)。2. Party A shall promise to provide safety and healthy working conditions and labor protection equipme nt for Party B accordi ng to state regulati ons. Party B shall strictly comply with the labor safety regulati ons and sta ndards of state or Party A.3、甲方及其管理人員

30、應(yīng)當(dāng)保障乙方在工作場(chǎng)所內(nèi)的生命安全和身體健康。乙方有權(quán)拒絕 甲方管理人員違章指揮、強(qiáng)令冒險(xiǎn)作業(yè)，并不視為違反本合同。乙方對(duì)危害生命安全和身體 健康的行為，有權(quán)提出批評(píng)、檢舉和控告。3. Party B has the right to refuse to implement the work with rule violation and forced work at risk by Party

31、 A s man ageme nt staff, without breach of the con tract hPaetyfB has the rights to criticize, expose and accuse of the un safe and un healthy behaviors.4、乙方因工作遭受事故傷害或患職業(yè)病，甲方應(yīng)當(dāng)負(fù)責(zé)及時(shí)救治，并按規(guī)定為乙方申請(qǐng) 工傷認(rèn)定和勞動(dòng)能力鑒定，保障乙方依法享受各項(xiàng)工傷保險(xiǎn)及相關(guān)待遇。乙方患病或非因工 負(fù)傷，甲方保證其享受國(guó)家規(guī)定的醫(yī)療期和相應(yīng)的醫(yī)療待遇。4. 39、甲方可將乙方調(diào)整至新崗位，工資待遇 按新崗位工資執(zhí)行，或解除勞動(dòng)合同，但甲方不支付補(bǔ)償金。(1) During the employment period, in case Party B is not capable for the position, Party A may deploy Party B to the new positi on with salary based on the new positi on, or dismiss the con tract hereof without compe nsatio n for Party B.(2) 公司所有規(guī)章制度甲方已向乙

40、方充分告知，作為本合同書有效附件，具有法律效力， 雙方應(yīng)自覺遵守，如乙方違反制度規(guī)定，甲方有權(quán)按制度規(guī)定進(jìn)行處理。(2) Party A shall notify Party B of all of the regulations and provisions of the company which shall be the effective appe ndix of the con tract hereof with legal force. Both parties shall con sciously abide by the rules. In case Party B viola

43、sults are acceptable.(5) 甲乙雙方應(yīng)依據(jù)國(guó)務(wù)院住房公積金管理?xiàng)l例等有關(guān)規(guī)定繳存住房公積金，其中乙 方應(yīng)繳存的住房公積金由甲方代扣代繳。(5) Both parties shall pay housing fund in accordanceof the relevant stipulations of “ House Fund Management Ordinance ” of the State Council.
