17、查，法定代表人符合有關(guān)法律、法規(guī)規(guī)定的任職資格，不存在以下情況： 1、 無民事行為能力或者限制民事行為能力的； 2、 正在被執(zhí)行刑罰或者正在被執(zhí)行刑事強制措施的； 3、 正在被公安機關(guān)或者國家安全機關(guān)通緝的； 4、 因犯有貪污賄賂罪、侵犯財產(chǎn)罪或者破壞社會主義市場經(jīng)濟秩序罪，被判處刑罰，執(zhí)行期滿未逾五年的；因犯有其他罪，被判處刑罰，執(zhí)行期滿未逾三年的；或者因犯罪被判處剝奪政治權(quán)利，執(zhí)行期滿未逾五年的； 5、 擔(dān)任因經(jīng)營不善破產(chǎn)清算的企業(yè)的法定代表人或者董事、經(jīng)理，并對該企業(yè)的破產(chǎn)負有個人責(zé)任，自該企業(yè)破產(chǎn)清算完結(jié)之日起未逾三年的； 6、 擔(dān)任因違法被吊銷營業(yè)執(zhí)照的企業(yè)的法定代表人，并對該企業(yè)違

18、法行為負有個人責(zé)任，自該企業(yè)被吊銷營業(yè)執(zhí)照之日起未逾三年的； 7、 個人負債數(shù)額較大，到期未清償?shù)模?8、 法律法規(guī)規(guī)定的其他不能擔(dān)任企業(yè)法定代表人、董事、監(jiān)事、經(jīng)理的。 審查人蓋章（簽字）： Through examination, the legal representative is qualified for holding the post according to laws and regulations, without any of the following cases:1. has no civil disposing capacity or his/her civil d

19、isposing capacity is limited;2. criminal penalty of mandatory criminal measure is being enforced on him/her;3. is being wanted by the police or state security departments;4. is sentenced due to taking graft or committing bribery, offences against property, disrupting socialism market economic order

20、and has completed a term of imprisonment for less than 5 years; is sentenced due to other offences and has completed a term of imprisonment for less than 3 years; or is sentenced to depriving of political rights due to offence and has completed a term of imprisonment for less than 5 years;5. ever wa

21、s the legal representative or director or manager of any enterprise which was bankrupted due to bad operation and was responsible for the bankruptcy of such enterprise, and it is less than three years since the completion of liquidation for the bankruptcy of the enterprise;6. ever was the legal repr

22、esentative of any enterprise which was revoked Business License due to illegal activities and was responsible for such illegal activities, and it is less than three years since the revocation of Business License;7. has large outstanding debts;8. the person who is not allowed to be the legal represen
