1、中華人民共和國衛(wèi)生部令Order of the Ministry of Health of the Peoples Republic of China第 49 號No.49建設(shè)項目職業(yè)病危害分類管理辦法 已于 2006 年 6 月 15 日經(jīng)衛(wèi)生部部務(wù)會議討論通過,現(xiàn)予以發(fā)布。本辦法自發(fā)布之日起施行。Construction Project Occupational Disease Hazards Classification Management Regulations were discussed and adopted by the Ministry of Health Internal
2、 Affairs Meeting on June 15, 2006 and is hereby issued. These Regulations shall go into effect as of the date of promulgation.部 長 高強(qiáng)Gao Qiang, Minister 二 0 ( 六年七月二十七日J(rèn)uly 27, 2006建設(shè)項目職業(yè)病危害分類管理辦法Construction Project Occupational disease hazards Classification Management Regulations第一條 為了預(yù)防、控制和消除建設(shè)項目可
3、能產(chǎn)生的職業(yè)病危害, 根據(jù)中華人民共和國職業(yè)病防治法 (以下稱職業(yè)病防治法 ),制定本辦法。Article 1 These Regulations are formulated for the purpose of preventing, controlling and eliminating possible occupational disease hazards caused by construction projects according to The Peoples Republic of China Occupational Disease Prevention Law (he
4、reinafter referred to as the Occupational Disease Prevention Law).第二條 本辦法所稱的建設(shè)項目,是指可能產(chǎn)生職業(yè)病危害的新建、擴(kuò)建、改建建設(shè)項 目和技術(shù)改造、 技術(shù)引進(jìn)項目。Article 2 The construction projects referred to in these Regulations are the new, expanded, renovated construction projects and technological transformation and technology import p
5、rojects which may produce possible occupational disease hazards.第三條 可能產(chǎn)生職業(yè)病危害項目是指存在或產(chǎn)生 職業(yè)病危害因素分類目錄所列職 業(yè)病危害因素 的項目。Article 3 Projects which may cause potential occupational disease hazards refer to those where occupational disease hazards listed in the Occupational Disease Hazard Elements Categories e
6、xist or produce.可能產(chǎn)生嚴(yán)重職業(yè)病危害的因素包括下列內(nèi)容:Elements which may cause serious occupational disease hazards include the following:( 一 ) 高毒物品目錄所列化學(xué)因素;(I) Chemical factors listed in the List of Highly Toxic Substances;( 二 )石棉纖維粉塵、含游離二氧化硅10% 以上粉塵;(II) Asbestos fiber dust, dust containing more than 10% free sili
7、ca;( 三 ) 放射性因素:核設(shè)施、輻照加工設(shè)備、加速器、放射治療裝置、工業(yè)探傷機(jī)、油 田測井裝置、甲 級開放型放射性同位素工作場所和放射性物質(zhì)貯存庫等裝置或場所;(III) Radioactive elements: devices and locations such as nuclear facilities, radiation processing equipment, accelerators, radiotherapy equipment, industrial defectoscopes, oil field well logging devices, Class A ope
8、n radioisotopes workplace and radioactive material storage;( 四 ) 衛(wèi)生部規(guī)定的其他應(yīng)列入嚴(yán)重職業(yè)病危害因素范圍的。(IV) Other elements which should be included in the scope of serious occupational disease hazards elements provided by the Ministry of Health.第四條 建設(shè)項目的備案、審核、審查和竣工驗收實行分級管理。Article 4 A graded approach shall be imp
9、lemented in the filing, auditing, review and final acceptance of construction projects.衛(wèi)生部負(fù)責(zé)下列建設(shè)項目的備案、審核、審查和竣工驗收:Ministry of Health is responsible for the filing, auditing, review and final acceptance of the following construction projects:(一) 由國務(wù)院投資主管部門和國務(wù)院授權(quán)的有關(guān)部門審批、 核準(zhǔn)或備案, 總投資在 50 億人民幣 以上的建設(shè)項目;( 1
10、) Construction projects reviewed, approved or filed by the investment authorities of the State Council and relevant departments authorized by the State Council and with a total investment of more than 5 billion yuan;(二)核設(shè)施、絕密工程等特殊性質(zhì)的建設(shè)項目;II) Construction projects of special nature such as nuclear fa
11、cilities, top-secret works;(三)跨省、自治區(qū)、直轄市行政區(qū)域的建設(shè)項目。( III ) Construction projects crossing provinces, autonomous regions and municipalities directly under the Central Government.其他建設(shè)項目的備案、審核、審查和竣工驗收,由省級衛(wèi)生行政部門根據(jù)本地區(qū)的實際 情況確定。Other construction projects record, audit, review and final acacr epdtaentecremi
12、nedby the provincial-level health administrative department according to the actual conditions in the region.第五條 上級衛(wèi)生行政部門可以委托下級衛(wèi)生行政部門負(fù)責(zé)有關(guān)職業(yè)病危害建設(shè)項目 的備案、審核、審 查和竣工驗收。Article 5 Higher level health administrative departments can commission the lower health administrative departments to be responsible for
13、 the record, audit, review and final acceptance of occupational disease hazard construction projects.第六條 國家對職業(yè)病危害建設(shè)項目實行分類管理。 對可能產(chǎn)生職業(yè)病危害的建設(shè)項目 分為職業(yè)病危 害輕微、職業(yè)病危害一般和職業(yè)病危害嚴(yán)重三類。Article 6 Classified management is implemented for occupational disease hazards construction projects. The construction projects w
14、ith possible occupational disease hazards are divided into projects with mild, general or serious occupational disease hazards.(一)職業(yè)病危害輕微的建設(shè)項目,其職業(yè)病危害預(yù)評價報告、控制效果評價報告應(yīng)當(dāng) 向衛(wèi)生行政部 門備案;( I) For the construction projects with mild occupational disease hazards, the occupational disease hazard evaluation repor
15、t and the control effect evaluation report should be filed to the administrative department of health;(二)職業(yè)病危害一般的建設(shè)項目, 其職業(yè)病危害預(yù)評價、 控制效果評價應(yīng)當(dāng)進(jìn)行審核、 竣工驗 收;( II) For the construction projects with general occupational disease hazards, review and final acceptance should be performed for the occupational di
16、sease hazard evaluation and control effect evaluation;(三)職業(yè)病危害嚴(yán)重的建設(shè)項目,除進(jìn)行前項規(guī)定的衛(wèi)生審核和竣工驗收外,還應(yīng)當(dāng)進(jìn)行設(shè)計階段的職業(yè)病防護(hù)設(shè)施設(shè)計的衛(wèi)生審查。(3) For construction projects with serious occupational disease hazards, in addition to the review and final acceptance provided in the foregoing article, the health review of the occupa
17、tional health protection facility design in the design phase should also be carried out.第七條 對存在或可能產(chǎn)生職業(yè)病危害因素的建設(shè)項目的職業(yè)病危害評價報告實行專 家審查制度。Article 7 An expert review system is executed for the occupational disease hazards evaluation report of the construction projects where occupational disease hazards exi
18、st or may produce.衛(wèi)生部和省級衛(wèi)生行政部門應(yīng)當(dāng)分別建立國家和省級專家?guī)?,專家?guī)彀绰殬I(yè)衛(wèi)生、 輻射 防護(hù)、衛(wèi)生工 程、檢測檢驗等專業(yè)分類,并指定機(jī)構(gòu)負(fù)責(zé)管理。Ministry of Health and provincial-level health administrative departments shall establish national and provincial expert pools whose disciplines include occupational health, radiation protection, public health eng
19、ineering, inspection and testing, and an agency should be designated to be responsible for the management.專家?guī)鞂<覒?yīng)當(dāng)熟悉職業(yè)衛(wèi)生相關(guān)法律法規(guī)、 具有較高的專業(yè)理論水平、實踐經(jīng)驗和建設(shè)項目評價相關(guān)的專業(yè)背景以及良好的職業(yè)道德。 專家參與建設(shè)項目職業(yè)病危害評價報告審查,應(yīng)當(dāng)遵循科學(xué)、客觀、公正的原則,并對審查意見負(fù)責(zé)。Experts from expert pool should be familiar with occupational health related laws and r
20、egulations, and should be very professional and knowledgeable, with practical experience, construction project evaluation related professional background and good work ethic. When reviewing occupational disease hazard evaluation report, experts should follow the scientific, objective, impartial prin
21、ciple and be responsible for the comments.專家?guī)煊嘘P(guān)規(guī)定另行制定。Expert pool related regulations will be formulated separately.第八條 職業(yè)病危害預(yù)評價、 職業(yè)病危害控制效果評價應(yīng)當(dāng)由依法取得資質(zhì)的職業(yè)衛(wèi)生技術(shù)服務(wù)機(jī)構(gòu)承擔(dān)。Article 8 Occupational disease hazard pre-evaluation and occupational disease hazard control effect evaluation shall be undertaken by qu
22、alified occupational health service organizations.由衛(wèi)生部負(fù)責(zé)備案、審核、審查和驗收的建設(shè)項目,其職業(yè)病危害預(yù)評價和職業(yè)病危害 控制效果評價 應(yīng)當(dāng)由取得甲級資質(zhì)的職業(yè)衛(wèi)生技術(shù)服務(wù)機(jī)構(gòu)承擔(dān)。For the construction projects whose record, audit, review and final acceptance is responsible by the Ministry of Health, the occupational disease hazard pre-evaluation and occupatio
23、nal disease hazard control effect evaluation shall be undertaken by occupational health service organizations obtaining Class A certification.第九條 職業(yè)衛(wèi)生技術(shù)服務(wù)機(jī)構(gòu)應(yīng)當(dāng)依據(jù)建設(shè)項目的可行性論證報告或設(shè)計文件, 職業(yè)衛(wèi)生有按照關(guān)技術(shù)規(guī)范、 標(biāo)準(zhǔn)進(jìn)行職業(yè)病危害預(yù)評價和職業(yè)病危害控制效果評價, 具評價報告,評價報并出告應(yīng)當(dāng)公正、客觀。Article 9 Occupational health service organizations shall per
24、form the occupational disease hazard pre-evaluation and occupational disease hazard control effect evaluation based on theconstruction project feasibility study report or design documents and in accordance with occupational health-related technical specifications and standards, and issue the evaluat
25、ion reports which should be fair and objective.評價報告的形式根據(jù)建設(shè)項目規(guī)模和職業(yè)病危害因素的復(fù)雜程度確定。投資規(guī)模較大、 職業(yè)病危害因 素復(fù)雜的應(yīng)當(dāng)編制評價報告書, 其它項目可編制評價報告表。 評價報告規(guī)范另行頒布。Evaluation report forms are determined according to construction project size and complexity of occupational disease hazards. Evaluation reports shall be prepared for
26、the projects with a large investment and complex occupational disease hazards, and evaluation report form can be prepared for other construction projects. Evaluation report standard will be promulgated separately.第十條 職業(yè)衛(wèi)生服務(wù)機(jī)構(gòu)應(yīng)當(dāng)根據(jù)建設(shè)項目是否存在嚴(yán)重職業(yè)病危害因素, 工作場所 可能存在職業(yè) 病危害因素的毒理學(xué)特征、濃度(強(qiáng)度) 、潛在危險性、接觸人數(shù)、頻度、 時間、職業(yè)
27、病危害防護(hù)措 施和發(fā)生職業(yè)病的危(風(fēng))險程度等進(jìn)行綜合分析后,對建設(shè)項目的職業(yè)病危害進(jìn)行分類。Article 10 Occupational health service organizations shall conduct a comprehensive analysis of toxicological characteristics, concentration ( intensity ) , potential risk, exposure people number, frequency, time, occupational disease hazard protection m
28、easures and the risk of occupational diseases as for whether occupational disease hazards exist at construction projects or possibly exist at workplaces before classifying occupational disease hazards of construction projects.建設(shè)項目職業(yè)病危害的分類標(biāo)準(zhǔn)另行規(guī)定。The classification criteria for construction projects o
29、ccupational disease hazards will be provided separately.第十一條 職業(yè)衛(wèi)生技術(shù)服務(wù)機(jī)構(gòu)應(yīng)當(dāng)組織5 名以上專家,對評價報告進(jìn)行技術(shù)審查。 審查專家應(yīng)當(dāng)具有與所評價的建設(shè)項目相關(guān)的專業(yè)背景, 一般由相關(guān)專業(yè)的專家和相關(guān)行業(yè)專家組成,其中從專家?guī)斐槿〉膶<覕?shù)不少于參加審查專家總數(shù)的 3/5 。Article 11 Occupational health service organizations shall organize over five experts to conduct technical review of the evaluat
30、ion report. Review experts should have the professional background related to the construction project to be evaluated, generally experts of relevant professions or industries, and experts from the expert pool shall not be less than 3/5 of all experts participating in the review.衛(wèi)生部審批的項目,從國家專家?guī)斐槿<摇?/p>
31、審查專家實行回避制度,參加評價報告編 制、審核人員 不得作為審查專家。For Ministry of Health approved projects, experts shall be drawn from national expert pool. Review experts shall comply with the challenge system, participants in the preparation and review of evaluation reports shall not be review experts.職業(yè)衛(wèi)生技術(shù)服務(wù)機(jī)構(gòu)應(yīng)當(dāng)如實、 客觀地記錄專家審查
32、意見。審查意見應(yīng)當(dāng)由專家組全體人員簽字。專家審查意見、意見采納情況及審查專家名單應(yīng)當(dāng)作為評價報告的附件。 Occupational health service organizations shall accurately and objectively record the comments of the experts. The review comments shall be signed by all the experts. The expert review comments, adoption of the comments and the list of experts sha
33、ll be annexed to the evaluation report.對建設(shè)項目有管轄權(quán)的衛(wèi)生行政部門必要時可以指派人員參加審查會并監(jiān)督審查過程。Health administrative departments having jurisdiction over the construction projects will assign personnel to participate in the review meeting and supervise the review process if necessary.職業(yè)衛(wèi)生技術(shù)服務(wù)機(jī)構(gòu)對其作出的評價報告負(fù)責(zé)。Occupationa
34、l health service organizations are responsible for their evaluation reports.第十二條 建設(shè)單位應(yīng)當(dāng)在建設(shè)項目可行性論證階段, 根據(jù)職業(yè)病危害因素分類目錄 和建設(shè)項 目職業(yè)衛(wèi)生專篇編制規(guī)范編寫職業(yè)衛(wèi)生專篇,并委托具有相應(yīng)資質(zhì)的職業(yè)衛(wèi)生技術(shù)服務(wù)機(jī)構(gòu)進(jìn)行職業(yè)病危害預(yù)評價。Article 12 The construction unit shall, in the construction project feasibility study phase, prepare a chapter exclusive for occu
35、pational health according to Categories of Occupational disease hazards and Construction Project Occupational Health Chapter Preparation Standard, and entrust qualified occupational health service organization for evaluation of occupational disease hazards.第十三條 建設(shè)單位在可行性論證階段完成建設(shè)項目職業(yè)病危害預(yù)評價報告后, 應(yīng)當(dāng)按 規(guī)定填
36、寫建 設(shè)項目職業(yè)病危害預(yù)評價報告審核( 備案 ) 申請書 ,向有管轄權(quán)的衛(wèi)生 行政部門提出申請并提交申報材料。Article 13 The construction units, after completing the construction project occupational disease hazard evaluation report in the feasibility study phase, should complete Construction Project Occupational disease hazard Pre-Evaluation Report Rev
37、iew (Record) Application and apply to the competent health administrative departments and submit the application materials.按照國家有關(guān)規(guī)定, 不需要進(jìn)行可行性論證的建設(shè)項目, 建設(shè)單位應(yīng)當(dāng)在建設(shè)項目開工 前提出職業(yè) 病危害預(yù)評價報告的衛(wèi)生審核或備案。For construction projects not requiring feasibility study in accordance with relevant state regulations, the cons
38、truction units should put forward the occupational disease hazard preevaluation report review or record before the start of the construction project.第十四條 衛(wèi)生行政部門收到建設(shè)項目職業(yè)病危害預(yù)評價報告審核(備案)申請書 和有關(guān)資料后, 屬于審核管理的項目,應(yīng)當(dāng)對申請資料是否齊全進(jìn)行核對,并在5 個工 作日內(nèi)作出是否受理申請的決定或出具申請材料補(bǔ)正通知書。屬于備案管理的項目,應(yīng) 當(dāng)對申請資料完整性和合法性進(jìn)行核對,符合要求的予以備案,并出具備案通
39、知書。不 符合要求的不予備案。Article 14 Upon receiving the Construction Project Occupational disease hazard Pre-Evaluation Report Review (Record) Application and relevant information, the health administrative department, for projects for review, shall verify the completeness of the information, and within 5 work
40、ing days make a decision on whether to accept the application or issue a correction notice of the application materials. And for projects for record, the health administrative department shall verify the integrity and validity of the materials, record those reports meeting requirements and issue a n
41、otice of record. Those reports not meeting the requirements will not be filed.第十五條 衛(wèi)生行政部門應(yīng)當(dāng)對建設(shè)項目職業(yè)病危害預(yù)評價報告進(jìn)行審核, 審核的內(nèi)容包括:職業(yè)衛(wèi)生技術(shù)服務(wù)機(jī)構(gòu)資質(zhì)、服務(wù)范圍,評價報告的規(guī)范性,技術(shù)審查專家組成及審查意見處理情況等。Article 15 The health administrative department should review the occupational disease hazardpre-evaluation report for occupational he
42、alth service organization qualification, scope of services, standardization of evaluation reports, technical review experts composition and their comments disposition and so on.衛(wèi)生行政部門對職業(yè)病危害預(yù)評價報告審核同意的,應(yīng)當(dāng)在受理之日起20 個工作日內(nèi) 予以批復(fù);不同意的,應(yīng)當(dāng)書面通知建設(shè)單位并說明理由。If the health administrative department agrees to the occ
43、upational disease hazard preevaluation report, it should approve within 20 working days of receiving the application; if it does not agree, a notice in writing shall be issued to the construction unit with the reasons stated.第十六條 建設(shè)項目未經(jīng)衛(wèi)生行政部門審核同意或備案的, 有關(guān)部門不得批準(zhǔn)該建設(shè)項 目。Article 16 Without the approval o
44、r record of the health administrative department, the construction project cannot be approved by the relevant government agencies.第十七條 建設(shè)項目職業(yè)病危害預(yù)評價報告經(jīng)衛(wèi)生行政部門審核或備案后, 建設(shè)項目的 生產(chǎn)規(guī)模、工藝或者職業(yè)病危害因素的種類、防護(hù)設(shè)施等發(fā)生變更時,應(yīng)當(dāng)對變更內(nèi)容重新進(jìn)行職業(yè)病危害預(yù)評價和衛(wèi)生審核或備案。Article 17 After the construction project occupational disease hazard p
45、re-evaluation report is approved or recorded by the health administrative department, if the construction projects production scale, process, or the types of occupational disease hazards, protective facilities alter, a second occupational disease hazard pre-evaluation and the health review or record
46、 shall be conducted on the changes.第十八條 職業(yè)病危害嚴(yán)重的建設(shè)項目,在初步設(shè)計階段,建設(shè)單位應(yīng)當(dāng)委托具有資質(zhì) 的設(shè)計單位對該 項目編制職業(yè)病防護(hù)設(shè)施設(shè)計專篇。Article 18 For construction projects with serious occupational disease hazards, in the preliminary design phase, the construction unit shall entrust qualified design unit with the preparation of a chapt
47、er exclusive for occupational disease protective facility design.第十九條 職業(yè)病危害嚴(yán)重的建設(shè)項目, 建設(shè)單位應(yīng)當(dāng)向原審批職業(yè)病危害預(yù)評價報告 的衛(wèi)生行政部 門提出建設(shè)項目職業(yè)病防護(hù)設(shè)施設(shè)計衛(wèi)生審查申請,填寫 建設(shè)項目職業(yè)病防護(hù)設(shè)施設(shè)計審查申請書 ,并按規(guī)定提交申報材料。Article 19 For construction projects with serious occupational disease hazards, the construction unit shall put forward the applica
48、tion for construction project occupational disease protective facility design health review to the health administrative department approving the occupational disease hazard pre-evaluation report, fill out the Construction Project Occupational Disease Protective Facility Design Review Application an
49、d submit required application materials.中、高能加速器、進(jìn)口放射治療裝置、 丫輻照加工裝置等大型輻射裝置建設(shè)項目還應(yīng)當(dāng)提交衛(wèi)生部指定的放射防護(hù)技術(shù)機(jī)構(gòu)出具的職業(yè)病防護(hù)設(shè)施設(shè)計技術(shù)審查意見。For construction projects of large radiation devices such as medium-, high-energy accelerators, imported radiati on treatme nt devices, Y irradiati on process ing devices, occupati onal
50、disease protective facility design technical review comments given by the radiological protection technical organization designated by the Ministry of Health shall also be submitted.和有關(guān)資料后,應(yīng)當(dāng)對申出具申請材料補(bǔ)正通知書。第二十條 衛(wèi)生行政部門收到 建設(shè)項目職業(yè)病防護(hù)設(shè)施設(shè)計審查申請書請資料是否齊全進(jìn)行核對,并在5 個工作日內(nèi)作出是否受理申請的決定或Article 20 Upon receiving Cons
51、truction Project Occupational Disease Protective Facility Design Review Application and the relevant information, the health administrative department shall verify whether the information is complete, and within 5 working days make the decision whether to accept the application or issue a correction
52、 notice of application materials.第二十一條 衛(wèi)生行政部門可以指定機(jī)構(gòu)或組織專家對建設(shè)項目職業(yè)病防護(hù)設(shè)施設(shè)計進(jìn)行技術(shù)審查,并根據(jù)技術(shù)審查結(jié)論進(jìn)行行政審查。 審查同意的, 應(yīng)當(dāng)在受理之日起20 個工作日內(nèi)予以批復(fù);不同意的,應(yīng)當(dāng)書面通知建設(shè)單位并說明理由。Article 21 The health administrative department can designate organizations or organize experts to perform a technical review of the construction project occ
53、upational disease protective facility design and, based on conclusions of the technical review, perform the administrative review. If it agrees, it shall approve within 20 working days; otherwise, it shall notify the construction unit in writing and explain the reasons.第二十二條職業(yè)病危害嚴(yán)重的建設(shè)項目, 其職業(yè)病防護(hù)設(shè)施設(shè)計未
54、經(jīng)審查或?qū)彶椴缓细竦?,不得施工。Article 22 The construction project with serious occupational disease hazards can not start construction if its occupational disease protective facility design has not been reviewed or does not get the approval after review.第二十三條建設(shè)單位在竣工驗收前, 應(yīng)當(dāng)委托具有資質(zhì)的職業(yè)衛(wèi)生技術(shù)服務(wù)機(jī)構(gòu)進(jìn)行職業(yè)病危害控制效果評價, 職業(yè)病危害控制效果
55、評價應(yīng)當(dāng)盡可能由原編制職業(yè)病危害預(yù)評價報告的技術(shù)機(jī)構(gòu)承擔(dān)。Article 23 Before the final acceptance, the construction unit shall entrust a qualified occupational health technical service organization to evaluate the occupational disease hazards control effect, and the evaluation should be performed by the technical organization pr
