3、e confirmed that the Premises shall be for the purpose of Residential.1.3該物業(yè)的家俱、家電配置,見本合同附件一。The furniture & appliances of the Premises please see Appendix I.二、租賃期Leasing Term2.1本合同租賃期為個(gè)月,自年月日起至年月日止。The leasing term of this contract shall becalendar months,commencing fromto.2.2租賃期滿,甲方有權(quán)收回該物業(yè),乙方應(yīng)如期歸還

6、乙方。在租賃期滿,乙方如期交還該物業(yè),并付清居住期間所有租金和其它費(fèi)用后十五天內(nèi),甲方應(yīng)將保證金無(wú)息退還乙方。Within five days after the signing of this Contract, Party B shall payto Party A as Deposit, which is equivalent to one months rental, and Party A shall issue a receipt for the said value. 7、the Deposit to PartyB without interest within 15 days after Party B has returned the Premises and paid all the rent and other expenses for the terms thatParty B has occupied the Premises.3.3乙方應(yīng)在每月日前支付該月租金,若乙方在租金到期后十五天仍未支付,每逾期一天,則乙方應(yīng)按日租金的支付滯納金。若超過(guò)三十天未付,則視乙方自動(dòng)退租并構(gòu)成違約,甲方有權(quán)收回該物業(yè),沒收保證金并追究相關(guān)損失。PartyB shal

If the Rent has not been paid within 15 days of its due date, Party B shall be required to pay a late penalty fee equal to_of the rental per day for each day of delay. 12、費(fèi)由房東支付。The remittance fee charged by the Landlords bank for receiving should be paid by the Landlord.四、出租人的責(zé)任Landlord s Responsibilities4.1甲方須按時(shí)將出租物業(yè)及家具電器(見附件一)以良好的狀態(tài)交付給乙方使用。Party A should deliver on schedule the leased property and the furniture and appliances (refer to Appendix I) in good conditio

13、n to Party B.4.2 甲方應(yīng)確?;蜇?zé)成物業(yè)管理公司對(duì)物業(yè)及其公共設(shè)施進(jìn)行定期維修保養(yǎng),包括4.3 但不限于物業(yè)內(nèi)的空調(diào)、上下水管、電線電纜、煤氣管道、通訊及有線電視等設(shè)施,使之處于正常的使用狀態(tài)。Party A should guarantee or order the property management company to carry out maintenance and repair of the said premisesand the facilities in good and proper operation regularly, including but n

14、ot restricted to air-conditions, water pipelines, wires and cables,gas pipelines, communication and cable TV etc.4.3 房屋基本設(shè)施和結(jié)構(gòu)損壞時(shí)(不包括乙方損壞的家具和器具) ,甲方必須在 24 小時(shí)內(nèi)提供維修服務(wù)或給予乙方答復(fù),并承擔(dān)相關(guān)的費(fèi)用。In case of the basic facilities and structure of the premises being damaged (not including furniture and appliances dam

15、aged by PartyB), Pa rty A shall repair or respond to Party B s complaints within 24 hours, and bear all costs related thereto.4.4 甲方在此聲明及保證甲方為出租房屋的合法擁有人并有合法地位出租此房屋給乙方。就本合同及出租此房屋于乙方之事,甲方已取得所有有關(guān)機(jī)構(gòu)的批準(zhǔn),包括政府批準(zhǔn)及抵押權(quán)人的同意。 甲方于本合同所做出的聲明與保證, 如有錯(cuò)誤或違反者,甲方須就因此而對(duì)乙方引起的任何損失、損害、支出及費(fèi)用對(duì)乙方做出全額補(bǔ)償。PartyA hereby represents

17、rtyAshallbeliable to keep Party B fully indemnified against any costs, expenses,losses and damages incurred and suffered by Party B as a result ofany breach of Party A s representations or warranties herein.4.5 如在租賃期內(nèi), 租賃房屋發(fā)生所有權(quán)全部或部分轉(zhuǎn)移, 和其它影響乙方權(quán)益的事情時(shí),甲方應(yīng)保證所有權(quán)人或其它影響乙方權(quán)益的第三人, 能繼續(xù)遵守本合同所有條款。如乙方于本合同下的權(quán)益受

20、y.4.6甲方應(yīng)負(fù)責(zé)根據(jù)中國(guó)法律法規(guī)所定因本樓宇租賃而產(chǎn)生的一切稅務(wù)( 包括但不限于房產(chǎn)稅,所得稅和營(yíng)業(yè)稅 ) 和法定費(fèi)用 ( 包括但不限于土地使用費(fèi) ) ,并必須將該些稅務(wù)和法定費(fèi)用直接向有關(guān)稅局繳付。The Landlordshall beresponsibleforandpay directly totherelevanttaxauthoritiesallapplicabletaxes(includingbutnotlimited to Real Estate Tax, Income Tax and Business Tax) and othergovernmentcharges (in

21、cludingbutnotlimitedto LandUse Fee)required by Chinese law or any relevant regulations arising from theleasing of the Premises.4.7在乙方遵守本合同的條款及交付租金的前提下,乙方有權(quán)于租賃期內(nèi)拒絕甲方或其他人騷擾而安靜享用出租房屋。Provided that Party B paying the rental and performing and observingparty B sterms and conditions herein contain shall p

22、eaceably hold and enjoy the Premises throughout the term of this Contract withoutany interruption by Party A or other persons.4.8租期為一年 , 如若任何一方提前解約,支付違約金為一年的租金( 人民幣 _元 ) 。Leasing Term is one year . 23、uan).五、承租人的責(zé)任Tenant s Responsibilities5.1乙方應(yīng)按時(shí)支付合同中規(guī)定的保證金、租金及水、電、煤氣、電話費(fèi) , 寬帶費(fèi)等公用事業(yè)費(fèi)。Party B should promptly pay the deposit, rental and water , broad band ,electricity, gas, telephone charge etc.5.2 未經(jīng)甲方書面同意,乙方不得將該物業(yè)轉(zhuǎn)租或分租給第三方。Party B shall not transfer or sub-lease the said premises to any thirdpart

24、y without Party A s written consent.5.3 乙方應(yīng)愛護(hù)使用租賃的房屋,如因乙方的過(guò)失或過(guò)錯(cuò)致使房屋及設(shè)施受到損壞(正常損耗除外),乙方應(yīng)負(fù)賠償責(zé)任。Party B shall treat the leased property with care. If, as a result ofPartyB snegligenceormisconduct,theleasedpropertyandtherelatedfacilitiessufferanydamage(fairwearandtearexcepted),PartyBshallberesponsiblefor

Any such consent shallnot be unreasonablywithheldordelayed.Onexpiryofthetenancy,PartyBmusthandoverthepropertytoPartyAinitsoriginalcondition(fairwearand tearexcepted).Allfeesarisingfromsuchwork to do so a

27、re to be borne by Party B.Party A agrees to provideParty B with two months notice prior to the expiry of the contract, intheeventPartyArequiresdemolitionofanyalterationorimprovement carried out to the property by Party B.5.5 若乙方、乙方雇員或任何其他經(jīng)乙方許可的人員進(jìn)入該物業(yè),對(duì)甲方或其他住戶造成損失,不論故意或過(guò)失,乙方皆應(yīng)對(duì)造成的所有損失予以賠償。In case of

28、 Party B, employees of Party B or any other person permitted by Party B to enter the property causing damages to PartyA or other tenants, whether intentionally or negligently, Party B shall compensate for all the losses caused by such damages.5.6 乙方不得攜帶任何違禁危險(xiǎn)物品進(jìn)入該物業(yè),嚴(yán)禁從事任何違反中華人民共和國(guó)法律法規(guī)的活動(dòng);如因此發(fā)生損害,乙方

29、應(yīng)承擔(dān)全部責(zé)任。Party B shall not bring anything dangerous or forbidden in the leasedproperty, and not behave against the laws or regulations of the People sRepublic of China, and shall be fully responsible for any damages or losses as a result thereof.5.7在本合同期滿前一個(gè)月內(nèi),乙方應(yīng)允許甲方或其指定的代理人經(jīng)與乙方預(yù)約后,在合理的時(shí)間內(nèi)陪同其他有興趣租住該

30、樓宇的人士參觀TheTenantshallpermittheLandlordoritsdesignatedagenttoenter the Premises with other potential tenants to see the Premises,at reasonable time and upon prior appointment with the Tenant within one month before the expiration of this Contract.5.8租期為一年, 如若任何一方提前解約,支付違約金為一年的租金( 即人民幣_(tái)元 ) 。Leasing Te

If any side terminates the agreement aheadof time, must pay the penalty is one year rent(RMB78000.00yuan).六、違約處理Breach of Contract6.1甲、乙任何一方如未按本合同的條款履行,構(gòu)成違約,應(yīng)承擔(dān)相應(yīng)的違約責(zé)任,雙方同意違約方應(yīng)賠償受害方之直接損失(間接和結(jié)果性損失除外) 。甲方若有違約并在七日內(nèi)未予補(bǔ)救,乙方則有權(quán)延付租金和管理費(fèi)或做相應(yīng)的扣除。If either Party A or Party B fails to perform i

32、ts obligations hereunder,it shallconstitutea breachof thisContractandthedefaultingpartyshall undertake the liabilities for such breach. 34、eContractandhaverecourseto arefundofthetwomonth ssecuritydepositandrentalalreadypaidtogetherwithacompensationsumequivalenttotwomonths rental if party A commits one of the following:(a) 未經(jīng)乙方同意,在租賃期間收回該物業(yè)。During the lease term, take possession of the Premises without Party s B consent.(b) 本合同開始三十天后,仍未

35、向乙方移交該物業(yè)。Fail to hand over the Premises to Party B within thirty days after the commencing date of the Contract.6.3乙方有下列行為之一的,甲方有權(quán)中止本合同,收回該房屋并且保證金不予退還。Party A shall have the right to terminate this Contract, re-possess the leased property and forfeit the security deposit if Party B commits one of th

36、e followings.(a) 將承租的房屋擅自轉(zhuǎn)租,但轉(zhuǎn)租給乙方本公司人員除外。Sublets the leased property to another person without Party A sconsent, but associated person of Party B excepted.(b) 未得甲方同意,將承租的房屋擅自拆改結(jié)構(gòu)或改變用途的。Alters the structure of the premises without authorization or uses the premises other than the purpose stated here

37、in.(c)無(wú)故拖欠租金超過(guò)三十天。Fail to pay rental without any reason for more than 30 days after the due date.七、不可抗力Force Majeure若由于不可抗拒的自然災(zāi)害(包括但不限于火災(zāi)、洪水、地震、施工、戰(zhàn)爭(zhēng)、暴動(dòng)、敵隊(duì)等行為等)或其它非雙方過(guò)錯(cuò)所造成的對(duì)本物業(yè)的損毀致使其無(wú)法居住或使用本物業(yè),雙方有權(quán)中止本合同, 甲方必須退還乙方所有保證金和已支付但未居住的租金。屆時(shí)合同雙方將不再承擔(dān)進(jìn)一步的任何責(zé)任。If the leased property is destroyed, damaged and re
