2、,協(xié)商一致的基礎(chǔ)上,同意訂立本勞動(dòng)合同,共同遵守本合同所列條款。The Parties, intending to be bound hereby, agree to enter into this Employment Contract on the basis of equality, free will and mutual consultationpursuant to the Labor Law of the People s Republic of (China“PRC”), the Employment Contract Law of the PRC and other laws

3、, regulations and rules.第一條 勞動(dòng)合同類型及期限Article 1 Type and Term of the Employment Contract一、勞動(dòng)合同類型及期限按下列第項(xiàng)確定。1. 6、ay be changed with the Partiesmutualconsent based on Party A s work needs.第三條 工作時(shí)間和休息休假Article 3 Working Hours, Rest and Leave Entitlements一、工作時(shí)間按下列第項(xiàng)確定:1. The working hours shall be determined as set forth in Item _ below:1、實(shí)行標(biāo)準(zhǔn)工時(shí)制。乙方每日工作時(shí)間不超過8 小時(shí),每周工作時(shí)間不超過 40 小時(shí),每周至少休息一天。(1) The normal working hou

Party B shall work no more than 8 hours a day, and 40 hours a week, and shall have at leastone day s rest each week.2、實(shí)行經(jīng) 勞動(dòng)保障 行政部門批準(zhǔn)實(shí)行的 不定時(shí)工作制 。(2) A non-fixed working hours system shall be implemented with the necessary approval from the relevant labor administratio

8、n authorities.3、實(shí)行經(jīng) 勞動(dòng)保障 行政部門批準(zhǔn)實(shí)行的 綜合計(jì)算工時(shí)工作制 。結(jié)算周期:按 結(jié)算。(3) A cumulative working hours system shall be implemented with thenecessary approval from the relevant labor administration authorities.二、甲方由于生產(chǎn)經(jīng)營需要經(jīng)與工會(huì)和乙方協(xié)商后可以延長乙方工作時(shí)間,一般每日不得超過一小時(shí); 因特殊原因需要延長工作時(shí)間的,每日不得超過三小時(shí),但每月不得超過三十六小時(shí)。甲方依法保證乙方的休息休假權(quán)利。2. Due

9、to its operational needs, Party may extend Party B s working hours upon consultation with the Trade Union and Party B, provided that the extended working hours for a given day should generally not exceed one hour. If an extension of working hours is necessary for special reasons, the extended workin

10、g hours for a given day should not exceed three hours, provided that the extended working hours for a month should not exceed 36 hours. Party A shall ensure that Party B will receive their rest and leave entitlements according to the law.第四條 勞動(dòng)報(bào)酬及支付方式與時(shí)間Article 4 Work Remuneration, Payment Method an

11、d Date of Payment.一、乙方試用期間的月勞動(dòng)報(bào)酬為元。1. The monthly remuneration payable to Party B during the probationary period shall be RMB_.二、試用期滿后, 乙方在法定工作時(shí)間內(nèi)提供正常勞動(dòng)的月勞動(dòng)報(bào)酬為元,或根據(jù)甲方確定的薪酬制度確定為。2. After the expiration of the probationary period, the monthly remuneration for Party B s performance of his normal labor

12、obligations within statutory working hours shall be RMB_, or RMB _ determined under Party A remuneration policies. s乙方工資的增減,獎(jiǎng)金、津貼、補(bǔ)貼、加班加點(diǎn)工資的發(fā)放,以及特殊情況下的工資支付等, 均按相關(guān)法律法規(guī)及甲方依法制定的規(guī)章制度執(zhí)行。甲方支付給乙方的工資不得低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn) 。Party B s wage increase/decrease, bonuses, allowances and subsidies,and overtime wages, as well

13、 as the wage payment in special circumstances,shall be governed by relevant laws and regulations and Party A s internal rulesand policies. The wages paid by Party A to Party B shall not be less than theminimum wage standard stipulated by the people s government where theemployer is located.三、甲方的工資發(fā)放

During any period when Party B participates in any social activities which citizens are reques

15、ted to perform for national or public interests, duringstatutory working hours, Party A shall pay wages to Party B according to the law.第五條 社會(huì)保險(xiǎn)Article 5 Social Insurance甲、乙雙方必須依法參加社會(huì)保險(xiǎn),按月繳納社會(huì)保險(xiǎn)費(fèi)。乙方繳納部分,由甲方在乙方工資中代為扣繳。Party a and Party B must participate in social insurance and pay social insurance p

16、remiums on a monthly basis in accordance with the law. Theamount payable by Party B shall be withheld by Par ty B from the Party A s monthly wages.第六條 勞動(dòng)保護(hù)、勞動(dòng)條件和職業(yè)危害防護(hù)Article 6 Labor Protection, Working Conditions and Protections Against Occupational Hazards甲乙雙方都必須嚴(yán)格執(zhí)行國家有關(guān)安全生產(chǎn)、勞動(dòng)保護(hù)、職業(yè)衛(wèi)生等規(guī)定。有職業(yè)危害的工種應(yīng)

17、在合同約定中告知,甲方應(yīng)為乙方的生產(chǎn)工作提供符合規(guī)定的勞動(dòng)保護(hù)設(shè)施、 勞動(dòng)防護(hù)用品及其他勞動(dòng)保護(hù)條件。乙方應(yīng)嚴(yán)格遵守各項(xiàng)安全操作規(guī)程。甲方必須自覺執(zhí)行國家有關(guān)女職工勞動(dòng)保護(hù)和未成年工特殊保護(hù)規(guī)定。The Parties must strictly implement relevant national occupational safety, labor protection and occupational sanitation procedures and standards. Any job exposed to occupational hazards shall be specifi

18、ed in the contract, and Party A shall provide Party B with work safety and hygiene facilities, labor protectionequipment and other necessary conditions for Party B s work activities. Party B must strictly comply with the work disciplines, operating procedures and safetyrules set by Party A. Party A

19、must conscientiously carry out relevant provisions formulated by the state for the protection of female and under-aged employees,第七條 勞動(dòng)合同變更、解除、終止Article 7 Modification, Cancellation and Termination the EmploymentContract一、經(jīng)甲乙雙方協(xié)商一致,可以變更勞動(dòng)合同相關(guān)內(nèi)容。變更勞動(dòng)合同,應(yīng)當(dāng)采用書面形式。變更后的勞動(dòng)合同文本由甲乙雙方各執(zhí)一份。1. The Parties may

20、modify relevant terms of the Employment Contract where they have agreed to do so through mutual consultation and agreement.二、經(jīng)甲乙雙方協(xié)商一致,可以解除勞動(dòng)合同。2. The Parties may terminate the Employment Contract where they have agreed to do so through mutual consultation and agreement.三、乙方提前三十日以書面形式通知甲方,可以解除勞動(dòng)合同。

21、乙方在試用期內(nèi)提前三日通知甲方,可以解除勞動(dòng)合同。3. Party B may terminate the Employment Contract with 30 dayswritten notice to Party A. Party B may terminate the Employment Contractduring the probationary period with 3 days written notice to Party A.prior四、甲方有下列情形之一的,乙方可以解除勞動(dòng)合同:4. Party B may terminate his employment cont

22、ract under any of the following circumstances involving Party A:1、未按勞動(dòng)合同約定提供勞動(dòng)保護(hù)或者勞動(dòng)條件的;(1) Where Party A has failed to provide labor protection or working conditions as stipulated in the employment contract;2、未及時(shí)足額支付勞動(dòng)報(bào)酬的;(2) Where Part A has failed to pay remuneration on time or in full; 3、未依法繳納社會(huì)

23、保險(xiǎn)費(fèi)的;(3) Where Party A has failed to contribute social insurance premiums onbehalf of Party B in accordance with the law;4、規(guī)章制度違反法律、法規(guī)的規(guī)定,損害乙方權(quán)益的;4. Where Party A s policies violate laws or regulations, thereby infringing upon Party B s rights and interests;5、以欺詐、脅迫的手段或乘人之危,使乙方在違背真實(shí)意思的情況下訂立或者變更勞動(dòng)合同致使勞動(dòng)合同無效的;(5) Where Party A has concluded or modified the Employment Contract against the true
