2、into this Contract in respect of Party A leasing the Premises to Party B.一、 租賃物業(yè)Leased Premises1.1 甲方將坐落于 (以下簡稱該物業(yè))出租給乙方使用,該物業(yè)建筑面積為 平方米。Party A lets (hereinafter referred to the Premises), to Party B, and the size of the Premises is square meters.1.2 甲乙雙方確定該物業(yè)用途為 住宅 。Both Party A and Party B have co
3、nfirmed that the Premises shall be for the purpose of Residential.1.3 該物業(yè)的家俱、家電配置,見本合同附件一。 The furniture & appliances of the Premises please see Appendix I.二、 租賃期Leasing Term2.1 本合同租賃期為 個月,自 年 月 日起至 年 月 日止。The leasing term of this contract shall be calendar months, commencing from to . 2.2 租賃期滿,
4、甲方有權收回該物業(yè),乙方應如期歸還;乙方如要求續(xù)租,須在 本合同期滿前 1 個月向甲方提出書面申請,經甲方同意后重新簽訂租賃合同。On expiry of this lease, Party A has the right to take back the Premises, and Party B shall return the Premises on time. If Party B wishes to extend the lease, Party B is required to give written notice to Party A one months prior to t
5、he expiry of the lease and subject to Party A and Party Bs consent, a new leasing contract shall be signed.三、 租金及保證金 Rental and Deposit3.1 租金為每月 元人民幣,租金含物業(yè)管理費,發(fā)票。 The monthly rental is per month, inclusive of management fee, formal invoice。 3.2 乙方應予簽署本合同后五日內向甲方支付相當于一個月租金的金額,即人民幣_元,作為保證金,甲方應出具收據(jù)給乙方。在
6、租賃期滿,乙方如期交還該物業(yè),并付清居住期間所有租金和其它費用后十五天內,甲方應將保證金無息退還乙方。Within five days after the signing of this Contract, Party B shall pay to Party A as Deposit, which is equivalent to one months rental, and Party A shall issue a receipt for the said value. At the expiration of the Contract, Party A shall refund the
7、 Deposit to Party B without interest within 15 days after Party B has returned the Premises and paid all the rent and other expenses for the terms that Party B has occupied the Premises.3.3 乙方應在每月 日前支付該月租金,若乙方在租金到期后十五天仍未支付,每逾期一天,則乙方應按日租金的 支付滯納金。若超過三十天未付,則視乙方自動退租并構成違約,甲方有權收回該物業(yè),沒收保證金并追究相關損失。Party B s
8、hall pay the rental on or before the day of each calendar month. If the Rent has not been paid within 15 days of its due date, Party B shall be required to pay a late penalty fee equal to _of the rental per day for each day of delay. If the rental has not been paid more than 30 days after the due da
9、te, Party b will be deemed to have automatically terminated the leasing resulting in a breach of the Contract, Party A will be entitled to take back the Premises, retain deposit and seek related losses.3.4 甲方在收到租金后五天內應提供給乙方正式發(fā)票,若甲方在月底前仍未提供乙方發(fā)票,則乙方有權延遲支付下月租金直至收到正式發(fā)票。甲方有責任根據(jù)稅務局和/或房管局的規(guī)定、要求和有關程序支付相應的有關
10、租賃房屋的稅款。Party A will issue an official invoice within 5 days after receiving the rental. If Party A has not issue an official invoice by the end of the month, Party B has the right to delay the payment of the following months rental until the invoice of the said month is received. Party A is respons
11、ible for complying with regulations, requirements and procedures originating from the Tax Bureau and/or Housing Bureau related to the taxes of the rent of the Premises.3.5 甲方的銀行帳戶資料:戶名: 賬號: 銀行: Party As bank account information: Name: A/C No.: Bank: 收取租金時,房東的銀行所收的手續(xù)費由房東支付。The remittance fee charged
12、by the Landlord's bank for receiving should be paid by the Landlord.四、出租人的責任 Landlords Responsibilities4.1 甲方須按時將出租物業(yè)及家具電器(見附件一)以良好的狀態(tài)交付給乙方使用。Party A should deliver on schedule the leased property and the furniture and appliances (refer to Appendix I) in good condition to Party B.4.2 甲方應確?;蜇煶晌飿I(yè)管
13、理公司對物業(yè)及其公共設施進行定期維修保養(yǎng),包括4.3 但不限于物業(yè)內的空調、上下水管、電線電纜、煤氣管道、通訊及有線電視等設施,使之處于正常的使用狀態(tài)。Party A should guarantee or order the property management company to carry out maintenance and repair of the said premises and the facilities in good and proper operation regularly, including but not restricted to air-condit
14、ions, water pipelines, wires and cables, gas pipelines, communication and cable TV etc.4.3房屋基本設施和結構損壞時(不包括乙方損壞的家具和器具),甲方必須在24小時內提供維修服務或給予乙方答復,并承擔相關的費用。In case of the basic facilities and structure of the premises being damaged (not including furniture and appliances damaged by Party B), Party A shal
15、l repair or respond to Party Bs complaints within 24 hours, and bear all costs related thereto. 4.4甲方在此聲明及保證甲方為出租房屋的合法擁有人并有合法地位出租此房屋給乙方。就本合同及出租此房屋于乙方之事,甲方已取得所有有關機構的批準,包括政府批準及抵押權人的同意。甲方于本合同所做出的聲明與保證,如有錯誤或違反者,甲方須就因此而對乙方引起的任何損失、損害、支出及費用對乙方做出全額補償。Party A hereby represents and warrants that Party A is th
16、e legal owner of the leased property and has the necessary capacity to lease the property to Party B. Party A has also obtained all the necessary authorizations from all relevant authorities in respect of this Contract and the leasing of the property to Party B, including government approval and/or
17、mortgage consent. Party A shall be liable to keep Party B fully indemnified against any costs, expenses, losses and damages incurred and suffered by Party B as a result of any breach of Party As representations or warranties herein.4.5 如在租賃期內,租賃房屋發(fā)生所有權全部或部分轉移,和其它影響乙方權益的事情時,甲方應保證所有權人或其它影響乙方權益的第三人,能繼續(xù)
18、遵守本合同所有條款。如乙方于本合同下的權益受此等所有權人或第三者影響或損害,甲方應負責賠償乙方的所有損失、損害、支出及費用。 If during the term of the tenancy, all or part of the leased property is transferred or Party Bs right to use leased property is affected, Party A shall ensure that such transferee or third party having an effect on Party Bs right to use
19、 the leased property will continue to abide by the terms of this Contract. Party A shall also be liable to keep Party B fully indemnified against any costs, expenses, losses and damages when any of Party Bs interests herein are affected or prejudiced by such transferee or third party. 4.6 甲方應負責根據(jù)中國法
20、律法規(guī)所定因本樓宇租賃而產生的一切稅務(包括但不限于房產稅,所得稅和營業(yè)稅)和法定費用(包括但不限于土地使用費),并必須將該些稅務和法定費用直接向有關稅局繳付。The Landlord shall be responsible for and pay directly to the relevant tax authorities all applicable taxes (including but not limited to Real Estate Tax, Income Tax and Business Tax) and other government charges (includ
21、ing but not limited to Land Use Fee) required by Chinese law or any relevant regulations arising from the leasing of the Premises. 4.7 在乙方遵守本合同的條款及交付租金的前提下,乙方有權于租賃期內拒絕甲方或其他人騷擾而安靜享用出租房屋。 Provided that Party B paying the rental and performing and observing party Bs terms and conditions herein contain
22、shall peaceably hold and enjoy the Premises throughout the term of this Contract without any interruption by Party A or other persons. 4.8 租期為一年,如若任何一方提前解約,支付違約金為一年的租金(人民幣_元)。Leasing Term is one year. 23、00yuan). 五、承租人的責任 Tenants Responsibilities5.1 乙方應按時支付合同中規(guī)定的保證金、租金及水、電、煤氣、電話費,寬帶費等公用事業(yè)費。Party B should promptly pay the deposit, rental and water, broad band,electricity, gas, telephone charge etc.5.2 未經甲方書面同意,乙方不得將該物業(yè)轉租或分租給第三方。Party B shall not transfer or sub-lease the said premises to any third pa
24、rty without Party As written consent.5.3 乙方應愛護使用租賃的房屋,如因乙方的過失或過錯致使房屋及設施受到損壞(正常損耗除外),乙方應負賠償責任。Party B shall treat the leased property with care. If, as a result of Party Bs negligence or misconduct, the leased property and the related facilities suffer any damage (fair wear and tear excepted), Party
25、B shall be responsible for compensating Party A for such damages.5.4 除在物業(yè)內已有的裝飾和設施外,乙方如要增加設備或裝修,須征得甲方的同意,甲方不得無理拒絕或延誤;租賃期滿必須恢復原狀(正常損耗、磨損除外),并承擔其費用,經甲方驗收認可后歸還甲方。甲方同意期滿前兩個月通知乙方其所需拆除的在物業(yè)內的任何改變及改進的設施。In addition to the decoration and equipment already in the property, if Party B wishes to make any altera
26、tions or improvements to the property, Party B must get Party As consent. Any such consent shall not be unreasonably withheld or delayed. On expiry of the tenancy, Party B must hand over the property to Party A in its original condition (fair wear and tear excepted). All fees arising from such work
27、to do so are to be borne by Party B. Party A agrees to provide Party B with two months notice prior to the expiry of the contract, in the event Party A requires demolition of any alteration or improvement carried out to the property by Party B.5.5若乙方、乙方雇員或任何其他經乙方許可的人員進入該物業(yè),對甲方或其他住戶造成損失,不論故意或過失,乙方皆應對
28、造成的所有損失予以賠償。In case of Party B, employees of Party B or any other person permitted by Party B to enter the property causing damages to Party A or other tenants, whether intentionally or negligently, Party B shall compensate for all the losses caused by such damages.5.6乙方不得攜帶任何違禁危險物品進入該物業(yè),嚴禁從事任何違反中華人
29、民共和國法律法規(guī)的活動;如因此發(fā)生損害,乙方應承擔全部責任。Party B shall not bring anything dangerous or forbidden in the leased property, and not behave against the laws or regulations of the Peoples Republic of China, and shall be fully responsible for any damages or losses as a result thereof. 5.7 在本合同期滿前一個月內,乙方應允許甲方或其指定的代理人
30、經與乙方預約后,在合理的時間內陪同其他有興趣租住該樓宇的人士參觀The Tenant shall permit the Landlord or its designated agent to enter the Premises with other potential tenants to see the Premises, at reasonable time and upon prior appointment with the Tenant within one month before the expiration of this Contract.5.8 租期為一年,如若任何一方提
31、前解約,支付違約金為一年的租金(即人民幣_元)。Leasing Term is one year. If any side terminates the agreement ahead of time, must pay the penalty is one year rent(RMB78000.00yuan).六、違約處理 Breach of Contract 6.1 甲、乙任何一方如未按本合同的條款履行,構成違約,應承擔相應的違約責任,雙方同意違約方應賠償受害方之直接損失(間接和結果性損失除外)。甲方若有違約并在七日內未予補救,乙方則有權延付租金和管理費或做相應的扣除。If either
32、Party A or Party B fails to perform its obligations hereunder, it shall constitute a breach of this Contract and the defaulting party shall undertake the liabilities for such breach. The parties agree that the party in breach shall pay the other party the direct losses and damage (excluding indirect
33、 and consequential loss and damages). If Party A is in breach of this Contract and does not rectify within 7 days, then Party B is entitled to withhold or deduct the rental as well as management fee. 6.2 甲方有下列行為之一的,乙方有權中止本合同,甲方除應退還乙方保證金和已支付但未居住的租金外,還應支付乙方兩個月的租金的金額作為賠償。Party B shall have the right to
34、 terminate the Contract and have recourse to a refund of the two months security deposit and rental already paid together with a compensation sum equivalent to two months rental if party A commits one of the following:(a) 未經乙方同意,在租賃期間收回該物業(yè)。During the lease term, take possession of the Premises witho
35、ut Partys B consent.(b) 本合同開始三十天后,仍未向乙方移交該物業(yè)。Fail to hand over the Premises to Party B within thirty days after the commencing date of the Contract.6.3 乙方有下列行為之一的,甲方有權中止本合同,收回該房屋并且保證金不予退還。Party A shall have the right to terminate this Contract, re-possess the leased property and forfeit the security
36、 deposit if Party B commits one of the followings. (a) 將承租的房屋擅自轉租,但轉租給乙方本公司人員除外。 Sublets the leased property to another person without Party As consent, but associated person of Party B excepted. (b)未得甲方同意,將承租的房屋擅自拆改結構或改變用途的。 Alters the structure of the premises without authorization or uses the pre
37、mises other than the purpose stated herein.(c) 無故拖欠租金超過三十天。Fail to pay rental without any reason for more than 30 days after the due date.七、不可抗力 Force Majeure若由于不可抗拒的自然災害(包括但不限于火災、洪水、地震、施工、戰(zhàn)爭、暴動、敵隊等行為等)或其它非雙方過錯所造成的對本物業(yè)的損毀致使其無法居住或使用本物業(yè),雙方有權中止本合同,甲方必須退還乙方所有保證金和已支付但未居住的租金。屆時合同雙方將不再承擔進一步的任何責任。If the lea
38、sed property is destroyed, damaged and rendered uninhabitable and unusable due to force majeure (including but not limited to fires, flood, earthquake, accidents, strikes, wars, insurrections, public enemy etc.) or actions that are not the result of Party A or Party Bs fault, either party has the ri
39、ght to terminate the Contract and prorated balance of al rental prepaid, as well as the deposit, shall be returned to Party B. Thereafter, the both parties shall not have any responsibilities to each other.八、爭議的解決 Dispute Resolution凡因本合同條款、翻譯、任何合同相關事宜所引起的一切爭議,雙方應友好協(xié)商解決;協(xié)商不成,應提交上海市仲裁委員會,按其仲裁原則和中華人民共和國仲裁法在上海進行仲裁,仲裁裁決是終局的,對雙
