4、hedevelopmentandpeacefuluseofnuclearenergyandtechnology.Article 2 ThisLawshallbeapplicabletothepreventionandcontrolofradioactivepollutiondischargedinthecourseofsiteselection,construction,operationanddecommissioningofnuclearinstallationsandinthecauseofdevelopmentandutilizationofnucleartechnology,uran

5、ium(thorium)andaccompanyingradioactiveminesintheterritoryofthePeople'sRepublicofChinaandintheterritorialwatersunderitsjurisdiction.Article 3 Inpreventionandcontrolofradioactivepollution,theStateappliestheprinciplesofputtingpreventionfirst,combiningpreventionandcontrolmeasures,exercisingrigorousc

6、ontrol,andgivingprioritytosafety.Article 4 TheStateencouragesandsupportsscientificresearchin,andthedevelopmentandutilizationoftechnologyfor,thepreventionandcontrolofradioactivepollution,andthewideuseofadvancedtechnologyintheeffort.TheStatesupportsinternationalexchangeandco-operationinpreventionandco

7、ntrolofradioactivepollution.Article 5 People'sgovernmentsatorabovethecountylevelshallincorporatetheworkforpreventionandcontrolofradioactivepollutionintotheirplansforenvironmentalprotection.People'sgovernmentsatorabovethecountylevelshalltakechargeofdisseminationandeducationaimedatpreventingan

8、dcontrollingradioactivepollution,inordertokeepthegeneralpublicinformedofthesituation,andimparttothemscientificknowledge,relatedtothepreventionandcontrolofradioactivepollution.Article 6 Everyunitandindividualshallhavetherighttoreporttotheauthoritiesandbringachargeagainstanyactthatcausesradioactivepol

9、lution.Article 7 People'sgovernmentatorabovethecountylevelshallgiverewardstounitsandindividualsthatmakeoutstandingachievementsinpreventionandcontrolofradioactivepollution.Article 8 TheadministrativedepartmentforenvironmentalprotectionundertheStateCouncilshall,inaccordancewithlaw,exerciseunifieds

10、upervisionoverthepreventionandcontrolofradioactivepollutionthroughoutthecountry.TheadministrativedepartmentforhealthundertheStateCouncilaswellastherelevantdepartmentsshall,incompliancewiththeirdutiesdefinedbytheStateCouncilandinaccordancewithlaw,exercisesupervisionoverthepreventionandcontrolofradioa

11、ctivepollution.ChapterIISupervisionoverPreventionandControlofRadioactivePollutionArticle9TheadministrativedepartmentforenvironmentalprotectionundertheStateCouncilshall,inaccordancewiththerequirementsforenvironmentalsafetyandonthebasisoftheeconomicandtechnologicalconditionsoftheState,formulatenationa

12、lstandardsforpreventionandcontrolofradioactivepollution.SuchstandardsshalljointlybeissuedbytheadministrativedepartmentforenvironmentalprotectionundertheStateCouncilandtheadministrativedepartmentforstandardizationundertheStateCouncil.Article10TheStateestablishesasystemformonitoringradioactivepollutio

13、n.TheadministrativedepartmentforenvironmentalprotectionundertheStateCouncilshall,inconjunctionwiththerelevantdepartmentsundertheStateCouncil,formanenvironmentalmonitoringnetworktomonitorandcontrolradioactivepollution.Article11TheadministrativedepartmentforenvironmentalprotectionundertheStateCouncila

14、ndtherelevantdepartmentsundertheStateCouncilshall,inaccordancewiththeirdivisionofdutiesandrespectiveresponsibilitiesandbyexchanginginformationandactingincloseco-ordination,conductsupervisionandinspectionofthepreventionandcontrolofradioactivepollutiondischargedbynuclearinstallationsandinthecourseofex

15、ploitinguranium(thorium)mines.Theadministrativedepartmentsforenvironmentalprotectionunderthelocalpeople'sgovernmentatorabovethecountylevelandtherelevantdepartmentsatthesamelevelshall,inaccordancewiththeirdivisionofdutiesandrespectiveresponsibilitiesandbyexchanginginformationandactingincloseco-or

16、dination,conductsupervisionandinspectionofthepreventionandcontrolofradioactivepollutiondischargeinthecauseofutilizingnucleartechnologyandexploitingaccompanyingradioactiveminesintheirrespectiveadministrativeregions.Whenconductingon-the-spotinspection,thesupervisorsandinspectorsshallproducetheiridenti

17、ficationdocuments.Theunitsunderinspectionshallgiveatruthfulreportofthesituationandprovidethenecessaryinformation.Thesupervisorsandinspectorsshallkeepconfidentialthetechnologicalandprofessionalsecretsoftheunitsunderinspection.WhenconductinginspectionoftheunitsandlocationsrelatedtoStatesecrets,theysha

18、llobserverelevantStateregulationsforguardingStatesecretsandgothroughtherelevantformalitiesofexaminationandapprovalinaccordancewithlaw.Article12Unitsthatoperatenuclearinstallations,utilizenucleartechnology,orexploituranium(thorium)andaccompanyingradioactiveminesshallberesponsibleforpreventionandcontr

19、olofradioactivepollutionintheirownunits,subjectthemselvestosupervisionbytheadministrativedepartmentforenvironmentalprotectionandtherelevantdepartmentsand,inaccordancewithlaw,beartheresponsibilityforradioactivepollutioncaused.Article13Unitsthatoperatenuclearinstallations,utilizenucleartechnology,orex

20、ploituranium(thorium)andaccompanyingradioactiveminesshalladoptsafetyandprotectivemeasurestopreventtheoccurrenceofanykindofaccidentthatmayleadtoradioactivepollutionandtoavoidhazardsincurredbysuchpollution.Unitsthatoperatenuclearinstallations,utilizenucleartechnology,orexploituranium(thorium)andaccomp

21、anyingradioactiveminesshallprovidetheirworkerswitheducationandtraininginsafetyfromradiationandadopteffectiveprotectiveandsafetymeasures.Article14TheStateappliesaqualificationcontrolsystemamongtheprofessionalsengagedinthepreventionandcontrolofradioactivepollution,aswellasamongtheinstitutionsengagedin

22、monitoringofradioactivepollution.Article 15 Fortransportofradioactivematerialandradiation-emittingdevicescontainingradioactivesources,effectivemeasuresshallbeadoptedtopreventradioactivepollution.SpecificmeasuresshallbeformulatedbytheStateCouncil.Article 16 Radioactivematerialandradiation-emittingdev

23、icesshallbeattachedwithclearradiationlabelsandwarningdescriptionsinChinese.Theplaceswhereradioactivematerialandradiation-emittingdevicesareproduced,marketed,used,storedordisposedofandthemeansoftransportforradioactivematerialandradiation-emittingdevicescontainingradioactivesourcesshallbeputwithclearm

24、arksofradiation.Article 17 Productscontainingradioactivematerialshallconformtonationalstandardsforpreventionandcontrolofradioactivepollution;productsthatdonotconformtosuchstandardsshallnotleavethefactoryorbeputonthemarket.Slagfromaccompanyingradioactiveminesandstonematerialscontainingnaturalradioact

25、ivesubstancesshallbeusedforconstructionandrefurbishinginconformitywiththenationalstandardsforthecontrolofradioactivenuclidesinconstructionmaterials.ChapterIIIPreventionandControlofRadioactivePollutionCausedbyNuclearInstallationsArticle18Thesitefornuclearinstallationsshallbeselectedonthebasisofscient

26、ificdemonstration,andtheformalitiesofexaminationandapprovalshallbegonethroughinaccordancewithrelevantStateregulations.Beforegoingthroughtheexaminationandapprovalformalitiesforselectionofthesitefornuclearinstallations,anenvironmentalimpactreportshallbepreparedandsubmittedtotheadministrativedepartment

27、forenvironmentalprotectionundertheStateCouncilforexaminationandapproval;withoutapproval,therelevantdepartmentshallnotissueapprovaldocumentsforselectionofsuchasite.Article19Beforeconstruction,fuelloading,operationordecommissioningofnuclearinstallations,theunitsthatoperatesnuclearinstallationsshall,in

28、accordancewithregulationsoftheStateCouncilonsupervisionofnuclearinstallationsafety,applyforalicenceforconstructionandoperationofnuclearinstallationsandgothroughtheformalitiesofexaminationandapprovalforfuelloadinganddecommissioning.Theunitthatoperatesnuclearinstallationsshall,onlyafterobtainingtherel

29、evantlicenceorapprovaldocument,proceedtoconstructnuclearinstallations,loadfuel,operateordecommissionsuchinstallationsaccordingly.Article20Beforeapplyingforalicenceforconstructionandoperationofnuclearinstallationsorgoingthroughtheformalitiesofexaminationandapprovalfortheirdecommissioning,theunitthato

30、peratesthenuclearinstallationsshallprepareanenvironmentalimpactreportandsubmitittotheadministrativedepartmentforenvironmentalprotectionundertheStateCouncilforexaminationandapproval;intheabsenceofsuchapproval,therelevantdepartmentshallnotissuethelicenceorapprovaldocument.Article21Thefacilitiesforprev

31、entionandcontrolofradioactivepollutioninsupportofnuclearinstallationsshallbedesigned,constructedandputintooperationsimultaneouslywiththemainpartoftheproject.Thefacilitiesforpreventionandcontrolofradioactivepollutionshallbecheckedandacceptedsimultaneouslywiththemainpartoftheproject.Onlyaftertheyareac

32、ceptedasqualifiedmaythemainpartoftheprojectbeputintoproductionoroperation.Article22Importednuclearinstallationsshallconformtothenationalstandardsforpreventionandcontrolofradioactivepollution;wheretherearenosuchstandardsappropriatetotheimportednuclearinstallations,relevantforeignstandardsdesignatedby

33、theadministrativedepartmentforenvironmentalprotectionundertheStateCouncilshallbeused.Article23Plannedrestrictedzonesshallbedelimitedontheperipheryofnuclearpowerplantsandotherimportantnuclearinstallations.MeasuresfordelimitingandcontrollingtheplannedrestrictedzonesshallbeformulatedbytheStateCouncil.A

34、rticle24Theunitthatoperatesnuclearinstallationsshallmonitorthetypesandconcentrationofradioactivenuclidesintheenvironmentsurroundingthenuclearinstallationsaswellasthetotalquantityoftheradioactivenuclidesintheeffluentsfromthenuclearinstallationsandshall,atregularintervals,reportthemonitoringresultstot

35、headministrativedepartmentforenvironmentalprotectionundertheStateCouncilandtosuchdepartmentunderthepeople'sgovernmentofaprovince,autonomousregion,ormunicipalitydirectlyundertheCentralGovernmentwheretheunitislocated.TheadministrativedepartmentforenvironmentalprotectionundertheStateCouncilshallber

36、esponsibleforsupervisorymonitoringofthenuclearpowerplantsandotherimportantnuclearinstallationsand,wherenecessary,formonitoringoftheeffluentsfromothernuclearinstallations.Theexpensesforestablishment,operationandmaintenanceofthesystemforsupervisorymonitoringshallbecoveredbythefinancialbudget.Article25

37、Theunitthatoperatesnuclearinstallationsshallsetupasoundsecurityandsafeguardsystem,enhancesecurityandsafeguardwork,andacceptsupervisionandguidancefrompublicsecuritydepartments.Tobefullypreparedforanemergency,theunitthatoperatesnuclearinstallationsshalldrawupanin-siteemergencyplanfornuclearaccidentinc

38、onformitywiththesizeandnatureofthenuclearinstallations.Intheeventofaninstantnuclearaccident,theunitthatoperatesnuclearinstallationsshallimmediatelytakeeffectiveemergencymeasurestokeeptheaccidentundercontrolandshallreportthemattertothedepartmentinchargeofnuclearinstallations,theadministrativedepartme

39、ntsforenvironmentalprotection,forhealthandforpublicsecurityandtotheotherdepartmentsconcerned.Article 26 TheStateestablishesasoundemergencysystemfornuclearaccidents.Thedepartmentinchargeofnuclearinstallations,theadministrativedepartmentsforenvironmentalprotection,forhealthandforpublicsecurityandtheot

40、herdepartmentsconcernedshall,underthecoordinationandleadershipofthepeople'sgovernmentatthesamelevel,incompliancewiththeirrespectivedutiesandinaccordancewithlaw,successfullycopewithemergenciescausedbynuclearaccidents.TheChinesePeople'sLiberationArmyandtheChinesePeople'sArmedPoliceForcesha

41、ll,inaccordancewiththerelevantregulationsoftheStateCouncilandtheCentralMilitaryCommission,rendereffectiveassistanceinemergencycausedbynuclearaccident.Article 27 Theunitthatoperatesnuclearinstallationsshalldrawupplansfordecommissioningofsuchinstallations.Theexpansesfordecommissioningofnuclearinstalla

42、tionsandfordisposingofradioactivewasteshallbewithdrawninadvanceandshallbeincludedinthebudgetaryestimatesofinvestmentorinproductioncost.Themeasuresforwithdrawalandcontrolofthemoneytodefraytheexpensesfordecommissioningofnuclearinstallationsandfordisposalofradioactivewasteshallbeformulatedbythedepartme

43、ntoffinanceandthedepartmentforpricingundertheStateCouncil,inconjunctionwiththeadministrativedepartmentforenvironmentalprotectionandthedepartmentinchargeofnuclearinstallationsundertheStateCouncil.ChapterIVPreventionandControlofRadioactivePollutionCausedbyUtilizationofNuclearTechnologyArticle28Anyunit

44、thatproduces,sellsorusesradioisotopesandradiation-emittingdevicesshall,inaccordancewiththeregulationsoftheStateCouncilregardingprotectionagainstradiationreleasedbyradioisotopesandradiation-emittingdevices,applyforalicenceandgothroughtheformalitiesofregistration.Anyunitthattransfersownershipoforimpor

45、tsradioisotopesandradiation-emittingdevicesandanyunitthatisequippedwithradioisotopeinstrumentsshall,inaccordancewiththeregulationsoftheStateCouncilregardingprotectionagainstradiationreleasedbyradioisotopesandradiation-emittingdevices,gothroughtherelevantformalities.Article29Anyunitthatproduces,sells

46、andusesradioisotopes,accelerators,neutrongeneratorsandradiation-emittingdevicescontainingradioactivesourcesshall,beforeapplyingforalicence,drawupanenvironmentalimpactassessmentdocumentandsubmitittotheadministrativedepartmentforenvironmentalprotectionunderthepeople'sgovernmentofaprovince,autonomo

47、usregion,ormunicipalitydirectlyundertheCentralGovernmentforexaminationandapproval;intheabsenceofsuchapproval,therelevantdepartmentshallnotissuethelicence.TheStateestablishesasystemforradioisotoperegistration.SpecificmeasuresshallbeformulatedbytheStateCouncil.Article30Thefacilitiesforprotectionagains

48、tradiationattheworkplacereleasingradiationthatistobeconstructed,reconstructed,orexpandedshallbedesigned,constructedandputintooperationsimultaneouslywiththemainpartoftheproject.Thefacilitiesforprotectionagainstradiationshallbecheckedandacceptedsimultaneouslywiththemainpartoftheproject;onlyaftertheyar

49、eacceptedasqualifiedmaythemainpartoftheprojectbeputintoproductionoroperation.Article31Radioisotopesshallbestoredseparatelyandshallnotbeplacedtogetherwithcombustible,explosive,corrosivesubstances,etc;attheplaceswheretheyarestored,effectivesafetyandprotectivemeasuresshallbetakenagainstfire,theftandlea

50、kageofradioactiverays,andapersonshallbedesignatedtobeinchargeofthestorageoftheradioisotopes.Whenradioisotopesarestored,taken,usedandreturned,theyshallberegisteredandchecked,sothattheregistrationshallagreewiththeradioisotopes.Article32Anyunitthatproducesorusesradioisotopesandradiation-emittingdevices

51、shall,inaccordancewiththeregulationsoftheadministrativedepartmentforenvironmentalprotectionundertheStateCouncil,collect,packageandstoreanyradioactivewasteproduced.Anyunitsthatproducesradioactivesourcesshall,inaccordancewiththeregulationsoftheadministrativedepartmentforenvironmentalprotectionunderthe

52、StateCouncil,retrieveandutilizedisusedradioactivesources;anyunitthatusesradioactivesourcesshall,inaccordancewiththeregulationsoftheadministrativedepartmentforenvironmentalprotectionundertheStateCouncil,returndisusedradioactivesourcestotheunitthatproducessuchsourcesorsendsuchsourcestotheunitthatisspe

53、cializedinstoringordisposingofsolidradioactivewaste.Article33Anyunitthatproduces,sells,uses,orstoresradioactivesourcesshallestablishasoundsecurityandsafeguardsystem,designateapersontotakecharge,implementthesecurityresponsibilitysystem,andformulatenecessarycontingencymeasuresagainstaccidents.Whenradi

54、oactivesourcesaremissingorstolenoranaccidentcausingradioactivepollutionoccurs,theunitandindividualsconcernedshallimmediatelyadoptcontingencymeasuresandreportthemattertothepublicsecuritydepartmentandtheadministrativedepartmentsforhealthandforenvironmentalprotection.Afterreceivingthereportofthemissing

55、ortheftofradioactivesourcesortheaccidentcausingradioactivepollution,thepublicsecuritydepartmentandtheadministrativedepartmentsforhealthandforenvironmentalprotectionshallreportthemattertothepeople'sgovernmentatthesameleveland,incompliancewiththeirrespectiveresponsibilities,immediatelymakearrangem
