1、女職工特殊保護(hù)專項(xiàng)集體合同COLLECTIVE CONTRACT ON PROTECTION OF FEMALE EMPLOYEES女職工25人以上的企業(yè)應(yīng)簽訂女職工特殊保護(hù)專項(xiàng)集體合同。在一些尚不具備單獨(dú)簽 訂專項(xiàng)集體合同條件的企業(yè),可先以集體合同附件的形式對(duì)女職工特殊保護(hù)作出規(guī)定, 待條件成熟時(shí)再簽訂女職工特殊保護(hù)專項(xiàng)集體合同。Compa ny with 25 female employees above must sig n the Collective Con tract for SpecialProtecti on of Female Employees. 2、ore tha n 25 female employees, regulati ons forspecial protect ion of female can be the annex of compa ny collective con tract till it should bea Special Collective Con tract for Protect ion of Female Employees.第一條 本合同由 _ (單位)與 _ 工會(huì)根據(jù)中華人民共和國勞動(dòng)法、工會(huì) 法、女職工勞動(dòng)保護(hù)規(guī)定、女職工勞動(dòng)保護(hù)辦法等法律法規(guī)以及省、市有 關(guān)條例規(guī)定,為維護(hù)和保障女職工的合法權(quán)
3、益和特殊利益,經(jīng)平等協(xié)商后簽訂。Article 1 This con tract is made betwee n_and_ , accordi ng to releva nt andapplicable“Labor Law”,“Law of Trade Union”,“Regulations on LaborProtecti on for Female Employees”, Law of Labor Protect ion for Female Employees of aswell as other related regulations. It is signed after equa
4、l negotiation of both parties, subject tomain tai n and protect the rights and special in terests accord ing to the laws for femaleemployees.第二條企業(yè)依法保障女職工合法權(quán)益。Article 2 The compa ny protects the rights and in terests of female employees accord ing tothe law.1.企業(yè)保障女職工獲得平等的勞動(dòng)權(quán)益,實(shí)行同工同酬。Company ensures f
5、emale employees of equal labor rights and interests, carrying out the“equal pay for equal works”policy.2.企業(yè)應(yīng)逐步提高企業(yè)職工代表大會(huì)中女代表的比例,使之與女職工比例相適應(yīng)。Compa ny gradually enhances the porti on of female employees in Compa ny EmployeesReprese ntative Conven ti on to make it bala nee the total female employees po
6、rti on.3.企業(yè)吸納工會(huì)女職工委員會(huì)代表參與制定及修改涉及女職工權(quán)益的規(guī)章制度、參與 平等協(xié)商和簽訂集體合同的全過程。Company accepts the representatives of Female Employees Representative Convention ofTrade Union to participate in the establishment and revision of the rules and regulationsrelated to femalesrights and interests, to participate in the who
7、le process of peacefulconsultation and signing of the collective contract.4.企業(yè)嚴(yán)格執(zhí)行勞動(dòng)部頒發(fā)的女職工禁忌勞動(dòng)范圍的規(guī)定。Company shall strictly implement“the regulations on the working scope banned for femaleemployees”issued by the Ministry of Labor.5.企業(yè)應(yīng)按國家有關(guān)規(guī)定落實(shí)女職工孕期、產(chǎn)期、哺乳期的休息休假及待遇。Company shall ensure the breaks and
8、 benefits of female employees during the period ofpregnancy, production and lactation according to relevant laws and regulations.6.企業(yè)應(yīng)對(duì)女職工節(jié)育手術(shù)假、孕期產(chǎn)前檢查、產(chǎn)假、哺乳期內(nèi)的哺乳時(shí)間視同提供 正常勞動(dòng)并支付其工資。女職工按有關(guān)規(guī)定享受的產(chǎn)前假、哺乳假期間的工資不得低 于百分之八十。Company shall regards the female conception control holiday, prenatal examination time,
9、maternity leave and lactation time during the lactation period as the working hours and pay itaccordingly. The payment during the prenatal leave and lactation time shall not be less than80% of previous one.7.企業(yè)不得在女職工孕期、產(chǎn)期和哺乳期內(nèi)解除其勞動(dòng)合同,勞動(dòng)合同期滿也應(yīng)自動(dòng) 延續(xù)至哺乳期結(jié)束為止。Company is not allowed to terminate the labo
10、r contracts during the period of pregnancy,production and lactation of female employees. During the aforesaid period, duration of thelabor contract shall be extended automatically till the expiration of lactation terms when thelabor contract expires.8.企業(yè)應(yīng)按照職工生育保險(xiǎn)管理辦法規(guī)定足額繳納生育保險(xiǎn)費(fèi),按規(guī)定支付生育 醫(yī)療費(fèi)、生育營養(yǎng)補(bǔ)貼、圍產(chǎn)
11、期保健補(bǔ)貼、生育津貼和計(jì)劃生育手術(shù)費(fèi)。對(duì)接受節(jié)育 手術(shù)的女職工給予相關(guān)的假期,報(bào)銷手術(shù)費(fèi)用。Company according to“Measures on Maternity Insurance for Employees”should pay fullbearing insurance premium, bearing service fee, bearing nourishment allowance,confinement health care allowance, bearing allowance and contraception operationexpenses. Comp
12、any shall pay for the female employeescontraceptionoperation as well as allowing relevant holidays for rest.9企業(yè)應(yīng)按照人口與計(jì)劃生育辦法,給予女職工相應(yīng)的待遇。Company shall provide female employees with relevant treatment according to“Populationand Family Planning Policy”.10.企業(yè)至少每兩年組織女職工進(jìn)行一次婦女病普查,并提供相應(yīng)的費(fèi)用和時(shí)間。Company shall
13、organize the examination of gynecologic disease at least every two years andafford relevant expense and time.11.其他可協(xié)商的內(nèi)容Others for negotiations第三條 本合同簽訂后,遇有不可抗力或企業(yè)經(jīng)營狀況發(fā)生重大變化,雙方可協(xié)商修改 合同,但每年只能一次。Article 3 Since the signing date of the contract, it can be modified but only once every year,based on two
14、paritiesnegotiation when company suffers from force majeure or big changes.第四條 本合同有效期為 年,于 年 月 日起至 年 月 日止。并于期滿前三 個(gè)月內(nèi)進(jìn)行下一輪女職工特殊保護(hù)專項(xiàng)集體協(xié)商。Article 4 The validity of the contract is _Y(s), starting from _ to _. 15、maleemployees 30 days before the expiration.第八條 本合同簽訂后,企業(yè)應(yīng)在10日內(nèi)報(bào)送當(dāng)?shù)貏趧?dòng)保障行政部門審查。勞動(dòng)行政 部門自收到本合同之日起十五日內(nèi)未提出異議的,本合同即行生效。The date ofThe date ofArticle 5 The contract should be delivered to local labor guarantee bureau for censoring within10 days since its signing. The contract will come into effect if no exception from local laborguarantee bureau within 15 days since it gets the contract.生效的合同一式四份,雙方各執(zhí)一份,一份由勞動(dòng)保障行政部門存檔,一份報(bào)上級(jí)工 會(huì)備案,并在10日內(nèi)向全體職工公布。The contract is made in four copies, each party holding one, Labor and Social Securit
