9、eligible payments under the Contract for which these document s are issued. Payment by the IFI will be made only at the request of the Chinese Government and upon approval by the IFI and will be subject inall respects to the terms and conditions of the Loan Agreement. No party other than the People&

10、#39;s Republic of China shall derive any rights from the Loan Agreement or have any claim to the loan proceeds.(二)世行貸款只用于支付瑞士和與中國有商貿(mào)關(guān)系世行成員國生產(chǎn)的產(chǎn)品和提供的服務(wù)。2.2 Payment from the proceeds of the World Bank Loan will be limited to goods produced in, and services supplied from, Switzerland and the member cou

11、ntries of the World Bank which have commercial relations with China.（三）世行貸款不足的部分將由業(yè)主用中國政府提供的資金支付。2.3 All costs not met by the IFI Loan will be paid by the Employer from funds allocated by the Government of China.3、 資格要求Eligibility and Qualification Requirements（一）所有根據(jù)世行的“采購指導(dǎo)原則” 具有資格的國家均可投標(biāo)。3.1 This

12、 tender is open to all pre-qualified tenderers from eligiblesource countries as defined under the "Guidelines for Procurement" of theworld Bank.（二） 本合同項下的一切貨物、服務(wù)均應(yīng)來自上述具有資格的國家。本合同項下的一切開支僅限于支付這樣的貨物和服務(wù)。3.2 All goods and services to be supplied under this Contract shall have their origin in el

13、igible source countries, and all expenditures made under the Contract will be limited to such goods and services.（三）貨物、服務(wù)來源地與投標(biāo)者國籍含義不同。3.3 The origin of goods and services is distinct from the nationality of the tenderer.（四）為說明自己有資格中標(biāo)，投標(biāo)者應(yīng)向業(yè)主提供（一）所規(guī)定的證明，保證有效地執(zhí)行合同。為此，業(yè)主和中國A公司在公布中標(biāo)者前，可要求投標(biāo)者更新其先前提供的資格證

14、明材料。投標(biāo)者提供的材料應(yīng)包括：3.4 To be eligible for award of contract, tenderers shall have provided evidence satisfactory to the Employer of their eligibility under clause 3.1 above, and of their capability and adequacy of resources to effectively carry out the Contract. To this end, the Employer and company ma

15、y, at any time prior to award of contract, request tenderers to amplify or update previously submitted prequalification data. 19、augment the information supplied with their application for pre-qualification, and, in particular, shall give particulars of work in hand at the date of tendering.(六)由兩家或兩家以上公司組成的合資企業(yè)應(yīng)滿足以下條件：3.6 Tenders submitted by a joint venture of two or more firms as partners shall comply with the following req

20、uirements:(1 )標(biāo)書和投標(biāo)成功后的協(xié)議書對所有合資人都有法律約束力。(a) the tender, and in case of a successful tender the Form of Agreement, shall be signed so as to be legally binding on all partners;(2)由所有合資人的授權(quán)簽字人簽署并提交一份委托書，提名合資人中的一個為主辦人。(b) one of the Joint Venture members shall be nominated as sponsor; and this authorisa

26、bear all costs associated with the preparation and submission of his tender and neither the Employer nor his agent Company will in any way beresponsible or liable for those costs, regardless of the outcome of the tendering process.五、現(xiàn)場參觀5. Site Visit(一) 建議投標(biāo)者去工程現(xiàn)場參觀，以便獲得足夠的信息準(zhǔn)備標(biāo)書，撰寫合同?，F(xiàn)場參觀費用由投標(biāo)者自己承擔(dān)

27、。5.1 The tenderer is advised to visit and examine the Site of the Works and the surroundings and to obtain for himself on his own responsibility, all information that may be necessary for preparing the tender and entering into a contract. The costs of visiting the site shall be at the tenderer's

28、 own expense.（二）業(yè)主或其代理人A公司將準(zhǔn)備一份現(xiàn)場參觀交通、食宿安排協(xié)議，在標(biāo)前會議上向投標(biāo)者宣布。詳細(xì)情況在第十六條有規(guī)定。5.2 Arrangements for a visit to site, including transportation and accommodation. will be made by the Employer or his agent Company and will be advised to tenderers atthe pre- tender meeting, details of which are given in Clause

30、r the purpose ofsuch inspection by prior arrangement, but only upon the express condition that the tenderer and his representatives, will release and indemnify the Employer or his agent Company and its personnel from and against all liability in respect thereof and will be responsible for personal i

Tender Prices（2） 除非合同中另有明確規(guī)定，合同包括條款一所述全部工程，以投標(biāo)者提供的項目單價和總價為基礎(chǔ)。2.1 1 Unless explicitly stated otherwise in the tenderdoc

53、ument s, the Contract shall be forthe whole of the Works as described in Clause 1 hereof, based on the schedules ofunit rates and amounts submitted by the tenderer.（3） 無論工程量是否標(biāo)明，投標(biāo)者應(yīng)對工程量表中的每項工程標(biāo)明單價和總價。對單價和總價未標(biāo)明的項目，在建設(shè)中業(yè)主不予以支付，其價格視作已包括在工程量表中其他的單價、總價中。11.2 The tenderer shall fill in rates and amounts

54、for all items of work described in the Bill of Quantities, whether quantities are stated or not. Items against which no rate or amount is entered by the tenderer will not be paid for by the Employer when executed and shall be deemed covered by the other rates and amounts entered in the Bill of Quant

58、cies of Tender and Payment（一） 投標(biāo)者應(yīng)以人民幣對單價和總價報價。如果投標(biāo)者以其他貨幣支付中國以外提供的工程投入（稱作“外幣需求” ）， 要在表一外幣需求中寫明投標(biāo)價格的百分之幾（不包括臨時款項）將用于這樣的外幣支出，無論（1）全部用投標(biāo)者所在國貨幣或其任選貨幣；（2 ）全部用美元。如果投標(biāo)者在一部分外幣需求中使用除（1） （2）以外的貨幣，且希望業(yè)主以同種貨幣付款， 則應(yīng)寫明其在投標(biāo)價格中的百分比。這一比率在合同期內(nèi)保持不變。在合同條款換算和計算投標(biāo)價格時，占不同比率的各種貨幣按下條規(guī)定的匯率進(jìn)行換算。12.1 The unit rates and prices shall be quoted by the tender entirely in RMB.
