Packing List in three copies issued by the seller裝箱單一式三份 13、 Term of Shipment裝運條款To be governed by “Incoterms 2010”.裝運條款應(yīng)按照2010年國際貿(mào)易術(shù)語解釋通則的規(guī)定辦理。14、 Shipping Advice(裝運通知)：The Seller shall, immediately upon the completion of the loading of the goods, advise by email t

9、he buyers of the ocean waybill and packing list document (it includes commodity, quantity, gross weight, name of vessel and date of delivery etc.). In case due to the sellers not having emailed in time, all losses caused shall be borne by the seller. 裝運通知：賣方應(yīng)于裝貨后，立即將提單和裝箱單資料（包括貨物、數(shù)量、毛重、運輸工具名稱、交貨日期、貨

10、物預(yù)計抵達日等）通過郵件通知買方。如果由于賣方未及時通知買方造成的所有損失均由賣方承擔(dān)。15、 Guarantee of Quality: The seller guarantee that the commodity is fulfil the buyers contract requirement. The guarantee period is 12 months since the buyer received the commodity.質(zhì)量保證：賣方保證合同按照客戶的要求進行生產(chǎn)。質(zhì)量保證期為客戶收到貨物12個月。16、 Claim（索賠）：Within 60days after

11、the arrival of the goods at destination, and found the commodity quality are lower than the approval sample, the buyer has the authority to replace or reimbursement. 索賠：貨物抵達目的地60天內(nèi)，如發(fā)現(xiàn)產(chǎn)品低于買方確認的樣品標(biāo)準(zhǔn)，買方有權(quán)要求替換或補償。17、 Force Majeure (不可抗力)：The Seller shall not be held responsible for failure or delay in

12、delivery of the entire lot or a portion of the goods under this Sales Contract in consequence of any Force Majeure incidents which may occur. Force Majeure as referred to in this contract means unforeseeable, unavoidable and insurmountable objective conditions.由于發(fā)生當(dāng)事人不能預(yù)見、不可避免或無法控制的不可抗力事件，致使本合約不能履行，

13、部分或全部商品延誤交貨，賣方概不負責(zé)。18、 Arbitration 仲裁：Any dispute arising from or in connection with this Contract shall be submitted to China International Economic and Trade Arbitration Commission for arbitration which shall be conducted in accordance with the commissions arbitration rules in effect at the time o

14、f applying for arbitration. The arbitral awards is final and binding upon both parties.凡因本合同引起的或與本合同有關(guān)的任何爭議，均應(yīng)提交中國國際貿(mào)易仲裁委員會，按照申請仲裁時該會現(xiàn)行有效的仲裁規(guī)則進行仲裁。仲裁裁決是終局的，對雙方均有約束力19、 Notice 通知：All notices shall be written in _and served to both parties by fax/courier according to the following address within _days after the change.所有通知用_文寫成，并按照如下地址用傳真/快件送達給各方。如果地址有變更，一方應(yīng)在變更后_內(nèi)書面通知另一方。14.
