1、南京海事法院訴訟指南(海商海事糾紛案件立案篇)一、船舶碰撞損害責任糾紛案件如何處理?1、當事人主體一般為船舶所有人或者光船承租人。2、管轄:由碰撞發(fā)生地、碰撞船舶最先到達地、加害船舶被扣留地、被告住所地海事法院管轄。3、起訴所需材料(其余材料與一般海事案件要求相同):(1)起訴狀。起訴狀應寫明碰撞船舶信息、碰撞事故及后果、碰撞事故所致?lián)p害賠償責任承擔方式及計算依據(jù)的陳述等信息。(2)相關證據(jù)材料。原告應提供證明如海事聲明、海事事故報告等可以反映碰撞事故的證據(jù)材料及保險公估報告等可以反映損害結果的證據(jù)材料,還應提交船舶所有權證書、光船租賃登記證書等船舶信息證明材料。二、船員勞務合同糾紛案件如何處
2、理?1、海事法院受理船員勞動(勞務)合同的范圍:與船員登船、在船服務、離船派遣相關的報酬給付糾紛。2、管轄:因海船的船員勞務合同糾紛提起的訴訟,由原告住所地、合同簽訂地、船員登船港或者離船港所在地、被告住所地海事法院管轄。3、船員作為原告提起訴訟的,應提交個人身份證明材料(如戶口本、身份證等)、船員身份證明(船員適任證書、船員服務簿等)及證明當事人之間存在勞務合同關系的證據(jù)材料。三、海上貨物運輸合同糾紛案件如何處理?1、管轄:由運輸始發(fā)地、目的地、被告住所地及轉運港所在地海事法院管轄。2、起訴應提交的材料:證明當事人之間存在海上貨物運輸合同關系的證據(jù)材料(如提單、運單、運輸合同等)、被告違約事
3、實材料(如無單放貨案件中貨物在目的港已被人提取的證據(jù))、因違約所致?lián)p失的證據(jù)材料(報關單、貨損檢驗報告、運費發(fā)票等)。3、集裝箱超期使用費糾紛案件應明確被告的身份(托運人、收貨人或者其他具有付款義務的主體)、原告主張的集裝箱超期使用收費標準及涉案集裝箱超期占用時間。4、無單放貨案件,正本提單持有人作為原告可以要求起訴承運人承擔由此造成的民事責任。原告應提供貨物在目的港已經(jīng)被放行或者被提取的證明材料及其損失的證據(jù)材料。四、海上貨運代理合同糾紛案件如何處理?1、管轄:合同約定履行地點的,以約定的履行地點為合同履行地(約定管轄不能違反級別管轄及專屬管轄規(guī)定)。合同對履行地點沒有約定或者約定不明確,爭
4、議標的為給付貨幣的,接收貨幣一方所在地為合同履行地;其他標的,履行義務一方所在地為合同履行地。合同沒有實際履行,當事人雙方住所地都不在合同約定的履行地的,由被告住所地法院管轄。2、海上貨運代理合同糾紛案件的范圍:因提供訂艙、報關、報檢、報驗、保險服務所發(fā)生的糾紛;因提供貨物的包裝、監(jiān)裝、監(jiān)卸、集裝箱裝拆箱、分撥、中轉服務所發(fā)生的糾紛;因繕制、交付有關單證、費用結算所發(fā)生的糾紛;因提供倉儲、陸路運輸服務所發(fā)生的糾紛;因處理其他海上貨運代理事務所發(fā)生的糾紛。3、貨運代理企業(yè)作為原告起訴委托人主張貨代費訴請的案件應提供證明雙方之間委托關系存在的證據(jù)材料(托書、貨運代理合同等)、原告已經(jīng)履行合同義務的
5、證據(jù)材料(提單、報關單等)及被告拖欠的貨代費的證據(jù)材料。Key points for the filing of maritime disputesI. How to deal with cases concerning disputes over liability for damage arising from collision of vessels? 1. The plaintiff shall provide evidence materials such

Insurance assessment reports reflecting the damage results and the ship information such as certifications of ownership and the bareboat charter registration shall also be submitted.II. How to deal
9、with cases concerning disputes over contracts on employment of seamen and service contracts? 1. The maritime court accepts the following scope of the contracts on employment of seamen and service contracts: disputes over payment of remunerations and compensation relating to seaman boarding, services
10、 on board, and repatriation upon disembarking.2. Jurisdiction: The lawsuit brought by the seafarers crew labor contract dispute shall be under the jurisdiction of the maritime court of the places where the plaintiff resides, the contract is signed, the crews boarding port or the ships port is locate
11、d, and the defendant resides.3. If a crew files a lawsuit as the plaintiff, he/she shall submit personal identification materials (such as household registration card, ID card, etc.), crew identification (crew certification of competency, crew service book, etc.) and evidence of labor contractual re
12、lationship between the parties. . How to deal with cases of disputes over contracts of carriage of goods by sea? 1. Jurisdiction: Such cases shall be under the jurisdiction of the maritime court at the place of: (1) departure of transportation or (2) destination of transportation or (3) domicile of
13、the defendant or (4) port of re-transportation.2. Materials to be filed to initiate such an action: (1) evidence on contract of carriage of goods by sea between the parties, such as bill of lading, waybill, affreightment contract, etc.; (2) evidence on facts of the defendants breach of contract, suc
14、h as evidence on goods taken away at the port of destination in cases about delivery of goods without an original bill of lading; (3) evidence on losses resulted from defendants breach of contract, such as customs declaration, cargo damage inspection report, freight invoice, etc.3. Plaintiff of a co
15、ntainer demurrage case should: (1) identify the defendant as a shipper, consignee or other subjects with payment obligations, and (2) identify the container demurrage standard charged by the plaintiff and the overdue occupation time of the container involved.4. In cases about delivery of goods witho
16、ut an original bill of lading, the holder of an original bill of lading shall, as the plaintiff, require the carrier to bear the civil liability arising therefrom. The plaintiff shall file the evidence on goods delivered or taken at the port of destination, and the losses resulted therefrom. Ho

Jurisdiction: Where the parties have agreed on a place of performance in a contract, such a place of performance shall be the place where the contract is performed (jurisdiction agreements shall not violate the provis
18、ions of laws regarding hierarchical jurisdiction and exclusive jurisdiction). Where the parties fail to agree on or clearly agree on a place of performance in a contract, and the subject matter of dispute is the payment of money, the place where the recipient of money is located shall be the place w
19、here the contract is performed; for any other subject matter, the place of the party performing the agreed obligations shall be the place where the contract is performed. Where a contract is not actually performed, and the place of domicile of either party is not the place of performance as agreed o
20、n in the contract, the peoples court at the place of domicile of the defendant shall have the jurisdiction.2. Disputes over contracts of maritime freight forwarding include disputes arising from: (1) the rendering of services, such as booking space, customs declaration, quarantine declaration, inspection declaration and insurance services; (2) the rendering of services, such as packaging, loading inspection, unloading inspection, container packing and unpacking, allocation and transshipping; (3) the
