5、動節(jié)，國慶節(jié)以及法律、法規(guī)中所規(guī)定的其他節(jié)日。party b is entitled to the following paid holidays and festivals in china, including new years day, springfestival, may day, national day and other holidays stipulated by chinese laws and regulations.5.6. 不超過 20 天。單次事假原則上不能超過 3 天，超過 3 天后每天扣除 2 天的工資。 private affairs leaveof the

9、the chinesegovernment, the party a work system and regulations concerning administration of foreign experts.2.甲方對乙方的工作負(fù)責(zé)指導(dǎo)、監(jiān)督以及評價(jià)。party a shall conduct direction, supervision and evaluation of party bs work.3.甲方應(yīng)向乙方提供必要的工作設(shè)施。party a shall provide party b with necessary working facilities.4.甲方應(yīng)向乙方每月按

10、期發(fā)放工資。party a shall pay party bs salary regularly by the month.5.甲方將對乙方的工作進(jìn)行指導(dǎo)和評估。party a will provide guidance and evaluation of party bs work.vi.乙方義務(wù)party bs obligations1.乙方必須遵守中國的法律、法規(guī)和將關(guān)規(guī)定，不干涉中國內(nèi)政。party b shall observe the laws, decrees and relevant regulations enacted by thechinese government a

11、nd shall not interfere in chinas internal affairs.3.4.5.6.國著作權(quán)法規(guī)定的全部人身權(quán)利和全部財(cái)產(chǎn)權(quán)利。未有甲方書面許可，乙方將不得出于任 何目的使用之。乙方確保其研究、開發(fā)及教學(xué)成果不侵犯任何第三方的知識產(chǎn)權(quán)。vii.合同的終止 termination of contract1.在以下情形下，甲方將書面通知解除與乙方的合同： party a will terminate the contract with writtennotice to the foreign teacher under such circumstances:(1)如

12、果乙方違反了中華人民共和國相關(guān)法律法規(guī)、合同體系工作 要求、中國政府關(guān)于外籍人員的相關(guān)管理辦法及合同的相關(guān)事 宜，甲方將解除與乙方的合同。乙方將不能得到補(bǔ)償。 the contract will beterminated immediately if party b in violation of the laws and regulations of china, party work system ofemployer, and the regulation of chinese government about foreign teachers or other contract ter

13、ms.(2)如果乙方不能滿足合同中要求的工作表現(xiàn)，甲方將解除與乙方 的合同。甲方將考慮給予乙方 15 天的工作改變期來改善乙方的 工作，如果在 15 天工作改善期之后乙方之工作仍然沒有改善， 甲方將解除與乙方的合同。乙方將不能得到額外的補(bǔ)償。if party b fails to satisfactory perform his/her duties and responsibilities, the contract will be terminatedimmediately, or, at the sole discretion of party a, party b will be gi

14、ven 15 days to improve his/her jobperformance. if, after 15 days, the foreign teacher has not improved his/her job performance to thesatisfaction of party a, the contract will then be terminated and party b will not receive any additional pay;(3)乙方在得到執(zhí)業(yè)醫(yī)師證明的前提下，如不能完成或者繼續(xù)完成 其合同工作超過 30 天，甲方將解除與乙方的合同。在

15、這種情況 下，乙方將不能得到額外的補(bǔ)償。if, in the judgment of a qualified medical doctor, party b is unable to resume his/her duties andresponsibilities after the expiration of 30 days of sick leave. in this instance, no further payments will bemade to party b.2. 如果乙方提出解除與甲方的合同，乙方必須于合同解除日前 30 天向 甲方書面提出解除合同。在這種情況下，乙方將能

22、ol schedule).if have some urgent situation, for example, schoolschedule adjusted, the two parties should discuss to solve.七、 薪酬標(biāo)準(zhǔn)salary criterion1 、雙方協(xié)商達(dá)成一致，按課時費(fèi)的方式計(jì)算工資the two parties agree with each other。2、雙方協(xié)商達(dá)成一致，甲方不負(fù)責(zé)乙方寒、暑假的工作和生活，即甲方不支付工資給乙方， 乙方可自行安排假期生活。但是甲方若為乙方安排了課程，乙方應(yīng)首先滿足甲方的要求，甲 方按實(shí)際課時付費(fèi)給乙方

23、。the two parties agree with each other ,at summer and winter vacation, part a will not pay part b,part b cando other things by themselves.but if part a arrange class for part b,part b should satisfy parta firstly ,and part a will pay part b.3、雙方合作期間，甲方為乙方提供住房一套，乙方使用房屋所產(chǎn)生的費(fèi)用由乙方自行負(fù)責(zé)， 甲方每月第一周將當(dāng)月房屋租賃費(fèi)以現(xiàn)

24、金方式支付給乙方。雙方合作結(jié)束，甲方不再為乙方 提供住房。八、其他事項(xiàng) other things1、乙方在合作期間的健康及醫(yī)療由乙方自行解決。2、病假及事假：sick leave and private affair leave（ 1）如果乙方因患病并經(jīng)醫(yī)院證明確不能工作，可以向甲方提出請假， 乙方在病假期間無工資。 如果乙方連續(xù) 7 天請病假， 甲方可以按照國家外專局合同有關(guān)規(guī)定中止與受聘方的合同。if part b wassick and have certificate from hospital to can not work, part b can apply leave,but n

32、位及工作崗位的調(diào)整第二條 工作崗位2.1 甲方根據(jù)工作需要及乙方的崗位意向， 聘用乙方在 _部門，擔(dān)任 _ 專業(yè)崗位工作。2.2 乙方應(yīng)當(dāng)完成的工作量以及應(yīng)當(dāng)達(dá)到的質(zhì)量標(biāo)準(zhǔn)為： （注： 該工作崗位職責(zé)因篇幅要求可 以附件的形式列明。 ）2.3 乙方應(yīng)始終勝任受聘崗位，并且高效履行相應(yīng)的各項(xiàng)職責(zé)和義務(wù)。2.4 乙方應(yīng)按時、按質(zhì)、按量的完成甲方交付的工作任務(wù)，并且交付聘用成果或以約定的方 式履行合同義務(wù)。2.5 乙方在本合同履行期間在沒有得到甲方事先的書面同意前，乙方不能直接或間接地受聘 于其他單位或個人。第三條 工作崗位的調(diào)整3.1 甲方根據(jù)工作需要及乙方的工作能力和表現(xiàn)，可以調(diào)整乙方的工作崗位，乙方應(yīng)服從。3.2 當(dāng)乙方工作崗位調(diào)整時，甲方相應(yīng)調(diào)整乙方的崗位工資及福利待遇。3.3 當(dāng)乙方對于甲方調(diào)整工作崗位有異議時，可以按照甲方規(guī)章制度規(guī)定的程序向甲方提出 異議或者辭職， 但乙方異議的提出不影響甲方?jīng)Q定的執(zhí)行， 乙方應(yīng)當(dāng)辦理崗位調(diào)動交接手續(xù)， 并到新的崗位提供服務(wù)。三、工時制度和工作條件第四條 工時制度4.1 甲方實(shí)行與本單位工作性質(zhì)相適應(yīng)的，且符合國家和所在地相關(guān)聘用法規(guī)的工作和休息 制度。4.2 根據(jù)甲方工作需要和乙方的工作崗位，甲方安
