10、is RMB YUAN ;第四條 工程設(shè)計(jì) Article Four Project Design 發(fā)包方責(zé)任 Employers Responsibilities1、發(fā)包方負(fù)責(zé)本工程基礎(chǔ)土建的設(shè)計(jì)。Design of civil work of project foundation shall be on employer.2、發(fā)包方委托承包方承擔(dān)鋼結(jié)構(gòu)部分的設(shè)計(jì)，發(fā)包方提供設(shè)計(jì)所需要的工藝條件及技術(shù)條件（詳見第一條工程技術(shù)條件）并在本協(xié)議生效后三天內(nèi)提供全部相關(guān)的技術(shù)條件和工藝條件，以供承包方進(jìn)行設(shè)計(jì)。Employer shall commission contractor to assu

12、three days upon validity of this contract for contractors design. 承包方責(zé)任 Contractors Responsibilities1、承包方必須按現(xiàn)行國家鋼結(jié)構(gòu)相關(guān)規(guī)范和發(fā)包方提供的相關(guān)資料文件資料及技術(shù)條件進(jìn)行設(shè)計(jì)，發(fā)包方的超規(guī)范要求必須書面告之，承包方在國家規(guī)范允許的范圍內(nèi)給予適當(dāng)傾向量。Contractor should process the design in accordance with States relevant norms of steel structure and respected materia

15、Article Five Responsibilities of Site Representative 發(fā)包方駐工地代表 Employers site representative1、發(fā)包方任命的駐工地代表及其委托代理人由具體管理人員擔(dān)任，并代表發(fā)包方簽發(fā)關(guān)于工程聯(lián)系單、驗(yàn)收單、結(jié)算付款單等。經(jīng)該代表簽署的所有單據(jù)具有法律效力，但與本協(xié)議條款相沖突的簽單無效，以本協(xié)議條款為準(zhǔn)。The duties of site representative appointed by and deputy of party A will be assumed by specific managers who

18、ave been made the signature of the representative thereon and submit in writing to contractors representative who sign its name on return receipt thereof.第六條 施工籌備 Article Six Execution Preparation 承包方 By Contractor1、在本協(xié)議生效后_日內(nèi)，由承包方向發(fā)包方提供設(shè)計(jì)圖紙_套，并通知發(fā)包方組織設(shè)計(jì)會(huì)審和施工圖交底會(huì)議，會(huì)后_日內(nèi)，由發(fā)包方提出修改決定，交承包方修改設(shè)計(jì)，如有設(shè)計(jì)變更的，則

19、工期視變更情況作相應(yīng)調(diào)整，增減的工程量按報(bào)價(jià)單計(jì)算作相應(yīng)調(diào)整并另簽補(bǔ)充協(xié)議。Contractor will, within days after contract coming into force and effect, submit sets of design drawings to employer and a notice for the meeting of joint exam on design and execution drawings. 22、n of entering site of material / semi-finished article (including plan of water, electricity supply ) shall be made and submitted to employer. 發(fā)包方 Employer1、協(xié)議商定委托承包方設(shè)計(jì)的項(xiàng)目，在本協(xié)議簽訂的同時(shí)，由發(fā)包方提供本協(xié)議規(guī)定的資料文件資料及技術(shù)條件，供承包方設(shè)計(jì)，在設(shè)計(jì)履行后有義務(wù)書面確認(rèn)設(shè)計(jì)。With respect to the design item done by contractor commissioned by cont

24、工程符合鋼結(jié)構(gòu)安裝要求的混凝土基礎(chǔ)及預(yù)埋螺栓并驗(yàn)收合格，同時(shí)提供全套土建竣工資料文件資料及發(fā)包方驗(yàn)收數(shù)據(jù)的結(jié)論。Employer should, before contractor enter into the site, complete concrete foundation and embedded bolt for this project, which meet the requirements for installation of steel structure, and through acceptance, at same time submit a full set of

25、documents on completion of civil engineering project , and conclusion of data information from employer acceptance.3、在承包方進(jìn)場前，保證本工程施工所需各類車輛進(jìn)出道路的暢通，接通施工現(xiàn)場的施工用水及照明和動(dòng)力電源（包括水表、配電板、電表）。Employer should, before contractor enter into site, ensure the road on which all types of vehicles necessary for project

26、execution smooth and free; and make connection of supply of , on site, water for execution and electricity for lighting and power (including water meter, power distribution panel and power meter).4、開工前辦理建筑許可證等。如因無建筑許可證而發(fā)生的相關(guān)責(zé)任和所有費(fèi)用由發(fā)包方承擔(dān)。Employer should, prior to commencement, process with Construct

32、on, and subject to the surveillance of supervision engineer / site representative on behalf of employer.第九條 鋼結(jié)構(gòu)材料的供應(yīng)、 驗(yàn)收 Article Nine Provision / Acceptance of Steel Materials由承包方提供的主要原材料、標(biāo)準(zhǔn)件，必須按關(guān)于規(guī)定提供產(chǎn)品質(zhì)量合格證或進(jìn)行驗(yàn)收合格后方可用于工程。由發(fā)包方提供的主要原材料、標(biāo)準(zhǔn)件，也必須有產(chǎn)品質(zhì)量合格證方可用于工程。鋼構(gòu)主體工程必須經(jīng)發(fā)包方派駐代表檢查、驗(yàn)收簽章后，方可進(jìn)行圍護(hù)結(jié)構(gòu)的安裝。The m

Steel main project should, after through the exam and acceptance with the signature / seal of employers site representative, be processed with the installation of retaining structure.第十條 工程價(jià)款的支付與結(jié)算 Article Ten Payment and Settlement of Project Cost工程價(jià)款的

35、支付和結(jié)算，根據(jù)國家關(guān)于部門制定的工程價(jià)款結(jié)算辦法,并結(jié)合鋼結(jié)構(gòu)建筑的特殊情況進(jìn)行支付與結(jié)算。Payment and settlement of project cost shall, in accordance with the regulations of engineering cost settlement stipulated by States authority concerned, and combined with the particular circumstances of steel project, be processed.一、本工程鋼梁、鋼柱進(jìn)場三日內(nèi)，發(fā)包方支付

36、協(xié)議總價(jià)的20作為工程預(yù)付款，計(jì)人民幣_(tái)萬元，承包方開始安裝。Employer should, within three days upon the date of steel beams and steel columns entering into the site, make payment of 20% of total contract cost as projects advance payment which equal to RMB YUAN before contractor commence the installation.二、安裝竣工并驗(yàn)收合格后的七天內(nèi)支付協(xié)議總價(jià)的7

37、5，計(jì)人民幣_(tái)萬元，尾款5，計(jì)人民幣_(tái)萬元作為質(zhì)保金留滯,質(zhì)保期為一年,待質(zhì)保期滿后三日內(nèi)付清全部質(zhì)保金。Employer shall, within seven days on and after installation completion and through acceptance, pay contractor 75% of total contract cost, valued sum of RMB YUAN , and remaining 5% which valued RMB YUAN as retention money withheld for one year of q

40、文件資料，作為施工的有效依據(jù)，開工前由發(fā)包方組織設(shè)計(jì)交底和各方會(huì)審，任何一方不得擅自修改。Formal design drawings, interpretation and relevant technical materials are the effective basis of project execution, for which, prior to commencement, employer shall organize design discussion and joint review by the parties concerned, any party shall no

41、t make unilateral alteration.二、施工中如發(fā)現(xiàn)設(shè)計(jì)的錯(cuò)誤或嚴(yán)重不合理的地方，發(fā)現(xiàn)方應(yīng)及時(shí)以書面形式通知對(duì)方，由提供設(shè)計(jì)圖紙方及時(shí)會(huì)同關(guān)于設(shè)計(jì)單位研究確定修改建議或意見或變更設(shè)計(jì)資料文件，承包方按修改或變更的設(shè)計(jì)資料文件進(jìn)行施工。若因此致使增加費(fèi)用則由責(zé)任方承擔(dān)，并調(diào)整協(xié)議造價(jià)。Provided that any discovery of error or substantial unreasonable item in design, the party which discover should in time give written notice to opp

43、ore, if any, shall be on the account of the party with obligation, and contract cost may be adjusted correspondingly.第十二條 工程驗(yàn)收 Article Twelve Acceptance of Project一、混凝土基礎(chǔ)工程由發(fā)包方驗(yàn)收或監(jiān)理驗(yàn)收合格后在發(fā)包方發(fā)出進(jìn)場開工通知前交承包方復(fù)驗(yàn)。Concrete foundation project shall, through acceptance of employer or supervision engineer, pri

46、esponsibility一、工程質(zhì)量不符合設(shè)計(jì)規(guī)定的，負(fù)責(zé)無償修理。Wherever project quality fails to meet the stipulations of design, contractor should make repair in free.二、因承包方過錯(cuò)未能按協(xié)議規(guī)定的期限交付使用的，每天按工程總價(jià)的萬分之五償付逾期違約金。Provided that contractor fail to deliver project to use due to the fault of contractor, overdue penalty shall be cha
