化妝品衛(wèi)生監(jiān)督條例(附英文)衛(wèi)生部化妝品衛(wèi)生監(jiān)督條例(附英文)1989年11月13日,衛(wèi)生部第一章總則第一條為加強(qiáng)化妝品的衛(wèi)生監(jiān)督,保證化妝品的衛(wèi)生質(zhì)量和使用安全,保障消費(fèi)者健康,制定本條例。第二條本條例所稱(chēng)的化妝品,是指以涂擦、噴灑或者其他類(lèi)似的方法,散布于人體表面任何部位(皮膚、毛發(fā)、指甲、口唇等),以達(dá)到清潔、消除不良?xì)馕丁⒆o(hù)膚、美容和修飾目的的日用化學(xué)工業(yè)產(chǎn)品。第三條國(guó)家實(shí)行化妝品衛(wèi)生監(jiān)督制度。國(guó)務(wù)院衛(wèi)生行政部門(mén)主管全國(guó)化妝品的衛(wèi)生監(jiān)督工作,縣以上地方各級(jí)人民政府的衛(wèi)生行政部門(mén)主管本轄區(qū)內(nèi)化妝品的衛(wèi)生監(jiān)督工作。第四條凡從事化妝品生產(chǎn)、經(jīng)營(yíng)的單位和個(gè)人都必須遵守本條例。第二章化妝品生產(chǎn)的衛(wèi)生監(jiān)督第五條對(duì)化妝品生產(chǎn)企業(yè)的衛(wèi)生監(jiān)督實(shí)行衛(wèi)生許可證制度?!痘瘖y品生產(chǎn)企業(yè)衛(wèi)生許可證》由省、自治區(qū)、直轄市衛(wèi)生行政部門(mén)批準(zhǔn)并頒發(fā)。《化妝品生產(chǎn)企業(yè)衛(wèi)生許可證》有效期四年,每二年復(fù)核一次。未取得《化妝品生產(chǎn)企業(yè)衛(wèi)生許可證》的單位,不得從事化妝品生產(chǎn)。第六條化妝品生產(chǎn)企業(yè)必須符合下列衛(wèi)生要求:(一)生產(chǎn)企業(yè)應(yīng)當(dāng)建在清潔區(qū)域內(nèi),與有毒、有害場(chǎng)所保持符合衛(wèi)生要求的間距。(二)生產(chǎn)企業(yè)廠房的建筑應(yīng)當(dāng)堅(jiān)固、清潔。車(chē)間內(nèi)天花板、墻壁、地面應(yīng)當(dāng)采用光潔建筑材料,應(yīng)當(dāng)具有良好的采光(或照明),并應(yīng)當(dāng)具有防止和消除鼠害和其他有害昆蟲(chóng)及其孳生條件的設(shè)施和措施。(三)生產(chǎn)企業(yè)應(yīng)當(dāng)設(shè)有與產(chǎn)品品種、數(shù)量相適應(yīng)的化妝品原料、加工、包裝、貯存等廠房或場(chǎng)所。(四)生產(chǎn)車(chē)間應(yīng)當(dāng)有適合產(chǎn)品特點(diǎn)的相應(yīng)的生產(chǎn)設(shè)施,工藝規(guī)程應(yīng)當(dāng)符合衛(wèi)生要求。(五)生產(chǎn)企業(yè)必須具有能對(duì)所生產(chǎn)的化妝品進(jìn)行微生物檢驗(yàn)的儀器設(shè)備和檢驗(yàn)人員。第七條直接從事化妝品生產(chǎn)的人員,必須每年進(jìn)行健康檢查,取得健康證后方可從事化妝品的生產(chǎn)活動(dòng)。凡患有手癬、指甲癬、手部濕疹、發(fā)生于手部的銀屑病或者鱗屑、滲出性皮膚病以及患有痢疾、傷寒、病毒性肝炎、活動(dòng)性肺結(jié)核等傳染病的人員,不得直接從事化妝品生產(chǎn)活動(dòng)。第八條生產(chǎn)化妝品所需的原料、輔料以及直接接觸化妝品的容器和包裝材料必須符合國(guó)家衛(wèi)生標(biāo)準(zhǔn)。第九條使用化妝品新原料生產(chǎn)化妝品,必須經(jīng)國(guó)務(wù)院衛(wèi)生行政部門(mén)批準(zhǔn)?;瘖y品新原料是指在國(guó)內(nèi)首次使用于化妝品生產(chǎn)的天然或人工原料。第十條生產(chǎn)特殊用途的化妝品,必須經(jīng)國(guó)務(wù)院衛(wèi)生行政部門(mén)批準(zhǔn),取得批準(zhǔn)文號(hào)后方可生產(chǎn)。特殊用途化妝品是指用于育發(fā)、染發(fā)、燙發(fā)、脫毛、美乳、健美、除臭、祛斑、防曬的化妝品。第十一條生產(chǎn)企業(yè)在化妝品投放市場(chǎng)前,必須按照國(guó)家《化妝品衛(wèi)生標(biāo)準(zhǔn)》對(duì)產(chǎn)品進(jìn)行衛(wèi)生質(zhì)量檢驗(yàn),對(duì)質(zhì)量合格的產(chǎn)品應(yīng)當(dāng)附有合格標(biāo)記。未經(jīng)檢驗(yàn)或者不符合衛(wèi)生標(biāo)準(zhǔn)的產(chǎn)品不得出廠。第十二條化妝品標(biāo)簽上應(yīng)當(dāng)注明產(chǎn)品名稱(chēng)、廠名,并注明生產(chǎn)企業(yè)衛(wèi)生許可證編號(hào);小包裝或者說(shuō)明書(shū)上應(yīng)當(dāng)注明生產(chǎn)日期和有效使用期限。特殊用途的化妝品,還應(yīng)當(dāng)注明批準(zhǔn)文號(hào)。對(duì)可能引起不良反應(yīng)的化妝品,說(shuō)明書(shū)上應(yīng)當(dāng)注明使用方法、注意事項(xiàng)?;瘖y品標(biāo)簽、小包裝或者說(shuō)明書(shū)上不得注有適應(yīng)癥,不得宣傳療效,不得使用醫(yī)療術(shù)語(yǔ)。第三章化妝品經(jīng)營(yíng)的衛(wèi)生監(jiān)督第十三條化妝品經(jīng)營(yíng)單位和個(gè)人不得銷(xiāo)售下列化妝品:(一)未取得《化妝品生產(chǎn)企業(yè)衛(wèi)生許可證》的企業(yè)所生產(chǎn)的化妝品;(二)無(wú)質(zhì)量合格標(biāo)記的化妝品;(三)標(biāo)簽、小包裝或者說(shuō)明書(shū)不符合本條例第十二條規(guī)定的化妝品;(四)未取得批準(zhǔn)文號(hào)的特殊用途化妝品;(五)超過(guò)使用期限的化妝品。第十四條化妝品的廣告宣傳不得有下列內(nèi)容:(一)化妝品名稱(chēng)、制法、效用或者性能有虛假夸大的;(二)使用他人名義保證或以暗示方法使人誤解其效用的;(三)宣傳醫(yī)療作用的。第十五條首次進(jìn)口的化妝品,進(jìn)口單位必須提供該化妝品的說(shuō)明書(shū)、質(zhì)量標(biāo)準(zhǔn)、檢驗(yàn)方法等有關(guān)資料和樣品以及出口國(guó)(地區(qū))批準(zhǔn)生產(chǎn)的證明文件,經(jīng)國(guó)務(wù)院衛(wèi)生行政部門(mén)批準(zhǔn),方可簽定進(jìn)口合同。第十六條進(jìn)口的化妝品,必須經(jīng)國(guó)家商檢部門(mén)檢驗(yàn);檢驗(yàn)合格的,方準(zhǔn)進(jìn)口。個(gè)人自用進(jìn)口的少量化妝品,按照海關(guān)規(guī)定辦理進(jìn)口手續(xù)。第四章化妝品衛(wèi)生監(jiān)督機(jī)構(gòu)與職責(zé)第十七條各級(jí)衛(wèi)生行政部門(mén)行使化妝品衛(wèi)生監(jiān)督職責(zé),并指定化妝品衛(wèi)生監(jiān)督檢驗(yàn)機(jī)構(gòu),負(fù)責(zé)本轄區(qū)內(nèi)化妝品的監(jiān)督檢驗(yàn)工作。第十八條國(guó)務(wù)院衛(wèi)生行政部門(mén)聘請(qǐng)科研、醫(yī)療、生產(chǎn)、衛(wèi)生管理等有關(guān)專(zhuān)家組成化妝品安全性評(píng)審組,對(duì)進(jìn)口化妝品、特殊用途的化妝品和化妝品新原料進(jìn)行安全性評(píng)審,對(duì)化妝品引起的重大事故進(jìn)行技術(shù)鑒定。第十九條各級(jí)衛(wèi)生行政部門(mén)設(shè)化妝品監(jiān)督員,對(duì)化妝品實(shí)施衛(wèi)生監(jiān)督?;瘖y品衛(wèi)生監(jiān)督員,由省、自治區(qū)、直轄市衛(wèi)生行政部門(mén)和國(guó)務(wù)院衛(wèi)生行政部門(mén),從符合條件的衛(wèi)生專(zhuān)業(yè)人員中聘任,并發(fā)給其證章和證件。第二十條化妝品衛(wèi)生監(jiān)督員在實(shí)施化妝品衛(wèi)生監(jiān)督時(shí),應(yīng)當(dāng)佩戴證章,出示證件?;瘖y品衛(wèi)生監(jiān)督員對(duì)生產(chǎn)企業(yè)提供的技術(shù)資料應(yīng)當(dāng)負(fù)責(zé)保密。第二十一條化妝品衛(wèi)生監(jiān)督員有權(quán)按照國(guó)家規(guī)定向生產(chǎn)企業(yè)和經(jīng)營(yíng)單位抽檢樣品,索取與衛(wèi)生監(jiān)督有關(guān)的安全性資料,任何單位不得拒絕、隱瞞和提供假材料第二十二條各級(jí)衛(wèi)生行政部門(mén)和化妝品衛(wèi)生監(jiān)督員及衛(wèi)生監(jiān)督檢驗(yàn)機(jī)構(gòu)不得以技術(shù)咨詢(xún)、技術(shù)服務(wù)等方式參與生產(chǎn)、銷(xiāo)售化妝品,不得監(jiān)制化妝品。第二十三條對(duì)因使用化妝品引起不良反應(yīng)的病例,各醫(yī)療單位應(yīng)當(dāng)向地衛(wèi)生行政部門(mén)報(bào)告。第五章罰則第二十四條未取得《化妝品生產(chǎn)企業(yè)衛(wèi)生許可證》的企業(yè)擅自生產(chǎn)化妝品的,責(zé)令該企業(yè)停產(chǎn),沒(méi)收產(chǎn)品及違法所得,并且可以處違法所得三到五倍的罰款。第二十五條生產(chǎn)未取得批準(zhǔn)文號(hào)的特殊用途的化妝品,或者使用化妝品禁用原料和未經(jīng)批準(zhǔn)的化妝品新原料的,沒(méi)收產(chǎn)品及違法所得,處違法所得三到五倍的罰款,并且可以責(zé)令該企業(yè)停產(chǎn)或者吊銷(xiāo)《化妝品生產(chǎn)企業(yè)衛(wèi)生許可證》。第二十六條進(jìn)口或者銷(xiāo)售未經(jīng)批準(zhǔn)或者檢驗(yàn)的進(jìn)口化妝品的,沒(méi)收產(chǎn)品及違法所得,并且可以處違法所得三到五倍的罰款。對(duì)已取得批準(zhǔn)文號(hào)的生產(chǎn)特殊用途化妝品的企業(yè),違反本條例規(guī)定,情節(jié)嚴(yán)重的,可以撤銷(xiāo)產(chǎn)品的批準(zhǔn)文號(hào)。第二十七條生產(chǎn)或者銷(xiāo)售不符合國(guó)家《化妝品衛(wèi)生標(biāo)準(zhǔn)》的化妝品的,沒(méi)收產(chǎn)品及違法所得,并且可以處違法所得三到五倍的罰款。二十八條對(duì)違反本條例其他有關(guān)規(guī)定的,處以警告,責(zé)令限期改進(jìn);情節(jié)嚴(yán)重的,對(duì)生產(chǎn)企業(yè),可以責(zé)令該企業(yè)停產(chǎn)或者吊銷(xiāo)《化妝品生產(chǎn)企業(yè)衛(wèi)生許可證》,對(duì)經(jīng)營(yíng)單位,可以責(zé)令其停止經(jīng)營(yíng),沒(méi)收違法所得,并且可以處違法所得二到三倍的罰款。第二十九條本條例規(guī)定的行政處罰,由縣以上衛(wèi)生行政部門(mén)決定。違反本條例第十四條有關(guān)廣告管理的行政處罰,由工商行政管理部門(mén)決定。吊銷(xiāo)《化妝品生產(chǎn)企業(yè)衛(wèi)生許可證》的處罰由省、自治區(qū)、直轄市衛(wèi)生行政部門(mén)決定;撤銷(xiāo)特殊用途化妝品批準(zhǔn)文號(hào)的處罰由國(guó)務(wù)院衛(wèi)生行政部門(mén)決定。罰款及沒(méi)收非法所得全部上交國(guó)庫(kù)。沒(méi)收的產(chǎn)品,由衛(wèi)生行政部門(mén)監(jiān)督處理。第三十條當(dāng)事人對(duì)衛(wèi)生行政部門(mén)的行政處罰決定不服的,可以在收到通知書(shū)次日起十五日內(nèi)向上一級(jí)衛(wèi)生行政部門(mén)申請(qǐng)復(fù)議。上一級(jí)衛(wèi)生行政部門(mén)應(yīng)當(dāng)在三十日內(nèi)給予答復(fù)。當(dāng)事人對(duì)上一級(jí)衛(wèi)生行政部門(mén)復(fù)議決定不服的,可以在收到復(fù)議通知書(shū)次日起十五日內(nèi)向人民法院起訴。但對(duì)衛(wèi)生行政部門(mén)所作出的沒(méi)收產(chǎn)品及責(zé)令停產(chǎn)的處罰決定必須立即執(zhí)行。當(dāng)事人對(duì)處罰決定不執(zhí)行,逾期又不起訴的,衛(wèi)生行政部門(mén)可以申請(qǐng)人民法院強(qiáng)制執(zhí)行。第三十一條對(duì)違反本條例造成人體損傷或者發(fā)生中毒事故的,有直接的責(zé)任的生產(chǎn)企業(yè)和經(jīng)營(yíng)單位或者個(gè)人應(yīng)負(fù)損害賠償責(zé)任。對(duì)造成嚴(yán)重后果,構(gòu)成犯罪的,由司法機(jī)關(guān)依法追究刑事責(zé)任。第三十二條化妝品衛(wèi)生監(jiān)督員濫用職權(quán),營(yíng)私舞弊以及泄露企業(yè)提供的技術(shù)資料的,由衛(wèi)生行政部門(mén)給予行政處分,造成嚴(yán)重后果,構(gòu)成犯罪的,由司法機(jī)關(guān)依法追究刑事責(zé)任。第六章附則第三十三條中國(guó)人民解放軍所屬單位生產(chǎn)的投放市場(chǎng)的化妝品的衛(wèi)生監(jiān)督,依照本條例執(zhí)行。第三十四條本條例由國(guó)務(wù)院衛(wèi)生行政部門(mén)負(fù)責(zé)解釋;實(shí)施細(xì)則由國(guó)務(wù)院衛(wèi)生行政部門(mén)制定。第三十五條本條例自一九九0年一月一日起施行。REGULATIONSCONCERNINGTHEHYGIENESUPERVISIONOVERCOSMETICSImportantNotice:(注意事項(xiàng))英文本源自中華人民共和國(guó)務(wù)院法制局編譯,中國(guó)法制出版社出版的《中華人民共和國(guó)涉外法規(guī)匯編》(1991年7月版).當(dāng)發(fā)生歧意時(shí),應(yīng)以法律法規(guī)頒布單位發(fā)布的中文原文為準(zhǔn).ThisEnglishdocumentiscomingfromthe"LAWSANDREGULATIONSOFTHEPEOPLE'SREPUBLICOFCHINAGOVERNINGFOREIGN-RELATEDMATTERS"(1991.7)whichiscompiledbytheBrueauofLegislativeAffairsoftheStateCouncilofthePeople'sRepublicofChina,andispublishedbytheChinaLegalSystemPublishingHouse.Incaseofdiscrepancy,theoriginalversioninChineseshallprevail.WholeDocument(法規(guī)全文)REGULATIONSCONCERNINGTHEHYGIENESUPERVISIONOVERCOSMETICS(ApprovedbytheStateCouncilonSeptember26,1989,andissuedbyDecreeNo.3oftheMinistryofPublicHealthonNovember13,1989)ChapterIGeneralProvisionsArticle1TheseRegulationsareformulatedtostrengthenhygienesupervisionovercosmeticssoastoensurehygienequalityandsafetyuseofcosmeticsandtosafeguardtheconsumers'health.Article2Theterm"Cosmetics"referredtointheseRegulationsmeansthosedailyusedchemicalproductsappliedonthesurfaceofanypartofthehumanbody(suchasskin,hair,nailsandlips)bywayofsmearing,sprayingorothersimilarmethodstokeepthebodyclean,togetridofundesirablesmell,toprotecttheskin,tomakeupthefaceandtoincreasethebeautyoftheappearance.Article3TheStateshallenforcehygienesupervisionovercosmetics.ThehealthadministrativedepartmentundertheStateCouncilisinchargeofthenationwidehygienesupervisoryworkoncosmeticswhilethehealthadministrationdepartmentsatorabovecountygovernmentlevelareinchargeofthehygienesupervisoryworkoncosmeticswithintheirrespectivejurisdiction.Article4AllunitsorpersonswhoareengagedintheproductionandbusinessofcosmeticsmustabidebytheseRegulations.ChapterIIHygieneSupervisionovertheProductionofCosmeticsArticle5TheStateshallexercisehygienesupervisionovertheenterprisesengagedintheproductionofcosmeticsbymeansofHygieneLicensesystem.HygieneLicensefortheProductionEnterpriseofCosmeticsshallbeapprovedandissuedbythehygieneadministrationdepartmentattheprovincial,autonomousregionalormunicipal(directlyundertheCentralGovernment)level.ThetermofvalidityofaHygieneLicensefortheProductionEnterpriseofCosmeticsisfouryearsanditmustbeverifiedaftertwoyears.NoenterpriseshallbeallowedtoengageintheproductionofcosmeticswithoutaHygieneLicense.Article6Aproductionenterpriseofcosmeticsmustmeetthefollowinghygienerequirements:itmustbebuiltinacleanareaandawayfromareascontaminatedwithpoisonousorotherharmfulmattersatacertaindistanceasrequiredbytherelevanthygieneregulations;theproductionbuildingmustbestrongandclean.Theceiling,wallsandfloorsinsidetheworkshopmustbebuiltwithsmoothandglazedmaterial.Theworkshopmustbewell-litandhavenecessaryfacilitiesandequipmenttokillratsandinsectsandtopreventthemfromcausingharmtotheproductsandfrommultiplying;itmusthaveadequatedepositoryformaterialsandfinishedproductsandworkshopsofappropriatecapacityforprocessingandpackingpurposes;theworkshopsmustbeequippedwiththenecessaryfacilitiestomeetthespecificrequirementsoftheproducts,andthetechnologicalprocessmustmeetthehygienestandard;itmusthavetestinginstrumentsandqualifiedtechnicalpersonneltocarryoutmicrobiologicaltestonitscosmeticproducts.Article7Thestaffandworkersdirectlyinvolvedintheproductionofcosmeticsarerequiredtohaveaphysicalcheck-upeveryyear.Onlythosewhoholdahealthcertificateshallbeallowedtoengageintheproduction.Anyworkerwhosuffersfromringwormoffingers,ringwormoffinger-nails,handeczema,handscale,effusivedermatosis,dysentery,typhoid,virushepatitis,andactivetuberculosisshallnotallowedtobedirectlyengagedintheproductionofcosmetics.Article8ThematerialsandadditivesneededinthemakingofcosmeticsandtheimmediatecontainersandpackingmaterialsofcosmeticsmustmeettheStatehygienestandards.Article9Beforeanewkindofmaterialisusedtomakecosmetics,anapplicationmustbemadetothehealthadministrativedepartmentundertheStateCouncilforapproval."Newkindofmaterial"referstonaturalorsyntheticmaterialsthatareusedtomakecosmeticsforthefirsttimeinChina.Article10TheproductionofspecialcosmeticsmustbeapprovedbythehealthadministrativedepartmentundertheStateCouncil.Onlyafteranapprovaldocumentisobtainedfromthisdepartmentcanthefactorystarttheproduction."SpecialCosmetics"refertothosesubstanceusedforhairnourishment,hair-dye,hairperm,hairremoving,breastmassage,deodorant,fadingcreamandantisunburnlotion.Article11Beforeputtingitscosmeticproductsontothemarket,theproducerisrequiredtoconducthygienequalityexaminationinaccordancewiththeHygieneStandardforCosmeticsformulatedbytheStateandmarkthequalifiedproducts.Theproductsthatarenotexaminedorarenotuptotherequiredhygienestandardarenotallowedtobeshippedoutofthefactory.Article12Onthelabelofacosmeticproduct,thenameoftheproduct,thenameoftheproducerandtheserialnumberofthehygienelicensefortheproductionenterprisemustbeclearlystated;onthesmallerpackageorthespecificationsheet,thedateofproductionandexpirymustbestated.Inthecaseofspecialcosmeticproducts,theapprovaldocumentnumbermustalsobeprinted.Inthecaseofcosmeticsthatmaycauseundesirablereactions,warningsandinstructionsontheuseoftheproductmustbestatedinthespecificationsheet.Noindications,curativeeffectandmedicaltermsareallowedtobewrittenonthelabel,ontheinnerpackingoronthespecificationsheetofcosmeticproducts.ChapterIIIHygieneSupervisionoverCosmeticsSalesArticle13Nounitorpersoninthecosmeticsbusinessshallbeallowedtosellcosmeticsofthefollowingkinds:thecosmeticsproducedbyanenterprisewithoutaHygieneLicensefortheProductionEnterpriseofCosmetics;thecosmeticswithoutaqualitytag;thecosmeticsofwhichthelabel,thesmallerpackageorthespecificationsheetdoesnotconformtotherulesstipulatedinArticle12oftheseRegulations;thespecialcosmeticswithoutanapprovaldocument;thecosmeticsthathasexpired.Article14Thefollowingcontentshallnotbeallowedtobeincludedincosmeticadvertising:exaggeratingtheeffectivenessofthecosmeticproductthroughitschosennameandthedescriptionofitsproductionmethod,itspropertiesandefficacy;givingaguaranteeinthenameofotherpeopleorgivingahinttolureconsumersintomisunderstandingtheefficacyoftheproduct;advertisingthemedicalefficacyofthecosmeticproduct.Article15Whenacosmeticproductisimportedforthefirsttime,theimportingunitisrequiredtosubmittothehealthadministrativedepartmentundertheStateCounciltherelevantinformationsuchasthespecifications,thequalitystandard,andthemethodoftesting,andasampleofthatcosmeticstogetherwithaproductionlicenseissuedbytheofficialdepartmentoftheexportingcountry(orregion).OnlyafteranapprovalbythehealthadministrativedepartmentundertheStateCouncilisobtainedcantheimportingunitsigntheimportcontract.Article16AllimportedcosmeticsaresubjecttoinspectionbytheStateBureauofImportandExportCommoditiesInspection.Onlythosequalifiedcosmeticsareallowedtobeimported.CosmeticsimportedinsmallquantityforpersonaluseshallfollowtheimportformalitiesinaccordancewithCustomsregulations.ChapterIVTheOrganforHygieneSupervisionoverCosmeticsandItsDutiesArticle17Thehealthadministrationdepartmentsatallgovernmentlevelsshallexercisehygienesupervisionovercosmetics.Theyshallentrustaninspectionorgantocarryoutthespecifichygienesupervisoryworkwithintheirjurisdiction.Article18ThehealthadministrativedepartmentundertheStateCouncilshallinviteresearchspecialistsandexpertsfrommedicalunits,productionenterprisesandhealthadministrationorganstoformanappraisalgroupforthesafetyofcosmetics.Theyshallmakeappraisalofthesafetyofimportedcosmetics,specialcosmeticsandthenewingredientsofcosmetics.Besides,theymaketechnicalinvestigationinthehazardousresultsofcosmeticsofpoorquality.Article19Thehealthadministrationdepartmentsatalllevelsshallappointcosmetichygienesupervisorstoexercisehygienesupervisionovercosmetics.CosmeticshygienesupervisorsshallbeselectedbythehealthadministrativedepartmentundertheStateCouncil,attheprovincial,autonomousregionalormunicipal(directlyundertheCentralGovernment)levelfromamongqualifiedhygienepersonnelandshallbeissuedwithbadgesandidentitycards.Article20Whencarryingouttheirduties,thecosmetichygienesupervisorsarerequiredtoweartheirbadgesandshowtheiridentitycards.Theymustkeepconfidentialthetechnicaldatapresentedbytheproductionenterprises.Article21Cosmetichygienesupervisorsarevestedwiththerighttoconductsampletestingofthecosmeticsofanyproductionorbusinessunit.Theymayaskforinformationofcosmeticsafetythatisrelatedtotheirhygienesupervisorywork.Nounitshallrefusetoprovideorwithholdthefacts,ortopresentfalsematerial.Article22Thehealthadministrationdepartments,thecosmetichygienesupervisorsorthehygienesupervisionandinspectionorgansatalllevelsarenotallowedtohaveahandintheproduction,saleorsupervisionofthemakingofcosmeticsintheformoftechnicalconsultancy,technicalserviceandunderanyotherpretences.Article23Ifanymedicaltreatmentunitfindsoutanycaseswhosufferfromundesirableeffectafterusingacertaincosmetics,itisrequiredtomakeareporttothelocalhealthadministrationdepartment.ChapterVPenaltyProvisionsArticle24IfanyproductionenterprisewithoutaHygieneLicensefortheProductionEnterpriseofCosmeticsisfoundtohavemadecosmeticswithoutauthorization,itshallbeorderedtostopproductionanditsproductsandillegalearningsshallbeconfiscatedandafine3to5timestheillegalprofitsshallbeimposedonit.Article25Ifanyproductionenterprisewithoutholdinganapprovaldocumentisfoundtohaveproducedspecialcosmeticsorhaveusedprohibitedmaterialsoranynewingredientsthathadnotbeenpreviouslyapproved,itsproductsandillegalearningsshallbeconfiscatedandafine3to5timestheirillegalprofitsshallbeimposedonit.ItmaybeorderedtostopproductionortohaveitsHygieneLicensefortheProductionEnterpriseofCosmeticsrevoked.Article26Thosewhoimportorsellimportedcosmeticsthathavenotbeenapprovedorexaminedshallbepunishedbyhavingtheirgoodsandillegalearningsconfiscatedandbyafine3to5timestheirillegalprofits.Asforthoseenterprisesholdinganapprovaldocumentfortheproductionofspecialcosmetics,iftheyviolatetheseprovisionsandthecaseisseriousenough,theirapprovaldocumentshallberevoked.Article27ThosewhoproduceorsellanycosmeticsthatarenotuptotheStateHygieneStandardforCosmeticsshallbepunishedbyhavingtheirproductsandillegalearningsconfiscatedandbyafine3to5timestheirillegalprofits.Article28IfanyproductionenterpriseorbusinessenterpriseviolatesotherrulesoftheseRegulations,theyshallbegivenawarningandbeorderedtocorrecttheirwrongdoingswithinaprescribedperiodoftime;ifthecaseisseriousenough,inthecaseofaproductionenterprise,itshallbeorderedtostopproductionortohaveitsHygieneLicensefortheProductionEnterpriseofCosmeticsrevoked;and,inthecaseofabusinessenterprise,itshallbeorderedtostopbusiness,haveitsillegalearningsconfiscatedandbepunishedbyafine2to3timestheirillegalprofits.Article29DisciplinarysanctionsforviolationoftheseRegulationsshallbedecidedbythehealthadministrationdepartmentsatorabovethecountylevel.DisciplinarysanctionsforviolationofArticle14oftheseRegulationsshallbedecidedbytheadministrationdepartmentforindustryandcommerce.ThepunishmentbyrevocationoftheHygieneLicensefortheProductionEnterpriseofCosmeticsshallbedecidedbythehealthadministrationdepartmentattheprovincial,autonomousregionalormunicipal(directlyundertheCentralGovernment)level.ThepunishmentbyrevocationoftheapprovaldocumentfortheproductionofspecialcosmeticsshallbedecidedbythehealthadministrativedepartmentundertheStateCouncil.ThefineandconfiscationshallallbeturnedovertotheStatetreasuryandtheproductsconfiscatedshallbedisposedunderthesupervisionofthehealthadministrationdepartment.Article30Ifthepartyconcerneddoesnotacceptthedisciplinarysanctionimposedbythehealthadministrationdepartment,itmayappealtothehealthadministrationdepartmentatahigherlevelforareviewofthecasewithin15daysafterreceivingthenotificationofthesanction.Thehigherhealthadministrationdepartmentisrequiredtogiveareplywithin30da
