nyofthefollowingcircumstances,partyAmayimmediatelyterminatethelaborcontract.1、在試用期內(nèi)被證明不符合錄用條件的；Beenprovennottomeettheconditionsofemploymentduringthetrialperiod.2、采取欺詐手段訂立本合同的；Adoptedfraudulentmeanstoenterintothiscontract.3、嚴重違反勞動紀律或規(guī)章制度給甲方造成重大損害的；SeriouslyviolatedlabordisciplineorregulationstocausesignificantharmtothePartyA.4、嚴重失職、營私舞弊，或泄露甲方商業(yè)秘密，給甲方利益造成重大損失的；Grossnegligence,malpractice,ordisclosureoftradesecretsPartyA,tocauseheavylossestotheinterestsofthePartyA.5、乙方同時與其他用人單位建立勞動關(guān)系，對完成本單位的工作任務(wù)造成嚴重影響，或者經(jīng)用人單位提出，拒不改正的；PartyAbuiltlaborrelationshipswithotherunit,tocauseaseriousimpactonthecompletionofthetasksoftheunit,orrefusedtocorrecttherulesmade??bytheemployer6、被依法追究刑事責任的。Beinvestigatedforcriminalresponsibilityaccordingtolaw（三）有下列情形之一的，甲方可以提前30日以書面形式通知乙方解除勞動合同：Ofthefollowingcircumstances,PartyAcangivenoticetoinformPartyBtoterminatethelaborcontractaheadof30days.1、乙方不能勝任工作，經(jīng)培訓(xùn)或調(diào)整工作崗位仍不能勝任工作的；PartyBisnotcompetentforwork,aftertrainingoradjustmentofjobs.2、乙方患病或者非因工負傷，醫(yī)療期滿后，不能從事原工作，也不能從事甲方另行安排工作的；PartyBwasillorinjuredduetonon-workrelation,aftercompletionofmedical,PartAisnotcompetentforhisoriginalwork,oralternativearrangedjobs.3、勞動合同訂立時所依據(jù)的客觀情況發(fā)生重大變化，致使勞動合同無法履行，雙方協(xié)商不能就變更勞動合同達成協(xié)議的。Iftheobjectivesituationthiscontractbasedon,changessignificantly,toresultthecontractunabletoperform,mutualconsentcannotbereached,inchangeofthislaborcontracts.（四）有下列情形之一的，甲方可以提前30日通知工會，經(jīng)工會同意后，與乙方解除勞動合同：Ofthefollowingcircumstances,PartyAcangivenoticeaheadof30days,toinformtheLaborUnion,afteragreement,PartyAmayterminatethelaborcontract.1、甲方依照企業(yè)破產(chǎn)法規(guī)定進行重整的；PartyArestructuredpursuanttotheEnterpriseBankruptcyLaw2、甲方生產(chǎn)經(jīng)營發(fā)生嚴重困難的；ProductionandbusinessoperationofPartyAmetseriousdifficulties.3、甲方轉(zhuǎn)產(chǎn)、重大技術(shù)革新或者經(jīng)營方式調(diào)整，經(jīng)變更勞動合同后，仍需裁減人員的；production,technologicalinnovationorbusinessmethodofPartyAadjusted,afterthechangeoflaborcontracts,stillneededtoreducestaff.4、其他因勞動合同訂立時依據(jù)的客觀經(jīng)濟情況發(fā)生重大變化，致使勞動合同無法履行的。Ifotherobjectivesituationthiscontractbasedon,changessignificantly,toresultthecontractunabletoperform.（五）乙方有下列情形之一的，甲方不得解除勞動合同：Ofanyofthefollowingcircumstances,partyAcannotterminatethelaborcontract.1、在本單位患職業(yè)病或者因工負傷并被確認喪失或者部分喪失勞動能力的；Injuredduetooccupationaldiseaseorwork-relatedreasons,andwasconfirmedashavinglostorpartiallylosttheabilitytowork.2、患病或者非因工負傷，在規(guī)定的醫(yī)療期內(nèi)的；Illnessornon-workrelatedinjurywithintheprescribedperiodofmedicaltreatment.3、女職工在孕期、產(chǎn)期、哺乳期的；womenworkersinpregnancy,childbirth,breastfeeding.4、在本單位連續(xù)工作滿十五年，且距法定退休年齡不足五年的；Workedcontinuouslyfor15yearsandlessthanfiveyearsawayfromhislegalretirementageInthisunit.5、法律、行政法規(guī)規(guī)定的其他情形。Othercircumstancesstipulatedbylawsandadministrativeregulations.（六）乙方解除勞動合同，應(yīng)當提前三十日（試用期內(nèi)提前三日）以書面形式通知甲方，甲方在乙方完成業(yè)務(wù)以及清理完債權(quán)債務(wù)的情況下，可以解除勞動合同。Ofthefollowingcircumstances,PartyBshallgivenoticetoinformPartyAtoterminatethelaborcontractaheadof30daysaftercleaningupthecreditsanddebts.（七）有下列情形之一的，乙方可以通知甲方解除勞動合同：Ofthefollowingcircumstances,PartyBmaygivenoticetoinformPartyAtoterminatethelaborcontract.1、在試用期內(nèi)的；Duringthetrialperiod.2、甲方以暴力、威脅或者非法限制人身自由的手段強迫勞動的；PartyAforcedPartyAtolaborbyviolence,threatorillegalrestrictionofpersonalfreedom.3、甲方未按勞動合同約定提供勞動保護和勞動條件的；PartyAfailedtoprovidethelaborprotectionandlaborconditions.4、甲方未按照勞動合同的約定支付工資報酬的；PartyAfailedtopaywagesinaccordancewiththelaborcontract.5、法律、行政法規(guī)規(guī)定勞動者可以解除勞動合同的其他情形。Othercircumstancesstipulatedbylaws,administrativeregulationsbywhichemployeemayterminatethelaborcontract.九、勞動合同的終止Terminationoflaborcontracts（一）有下列情形之一的，勞動合同即行終止：Ofanyofthefollowingcircumstances,thelaborcontractmaybeimmediatelyterminate1、勞動合同期滿的；Thelaborcontractexpired.2、勞動者開始依法享受養(yǎng)老保險待遇的；Workersbegantoenjoyendowmentinsurancetreatmentlawfully.3、勞動者死亡，或者被人民法院宣告死亡或者宣告失蹤的；Laborerdied,orwasdeclareddeadormissingbythepeople'scourt.4、甲方被依法宣告破產(chǎn)的；PartyAwasdeclaredbankruptbythepeople'scourt5、甲方被吊銷營業(yè)執(zhí)照、責令關(guān)閉、撤銷或者提前解散的；BusinesslicenseofPartyBwasrevoked,orderedtoclose,cancellationorearlydissolutionof.6、法律、行政法規(guī)規(guī)定的其他情形。Othercircumstancesstipulatedbylaws,administrativeregulations.（二）乙方應(yīng)在勞動合同期滿前30天通知甲方，甲方同意續(xù)訂，乙方應(yīng)及時申請辦理續(xù)訂手續(xù)；若甲方不同意續(xù)訂，到期即辦理終止合同手續(xù)。乙方未辦理終止合同手續(xù)而離職的，甲方保留追究其法律責任的權(quán)利。PartyBshallgivenoticetoinformPartyAtorenewthelaborcontractaheadof30days.IfPartyAdisagreedtonewalease,thelaborcontractwouldgoexpire.IfPartyBleftwithouttheterminationprocedures,PartyAwouldretainrighttopursueitslegalresponsibility.十、違反勞動合同的責任Breachofdutyofthelaborcontract（一）賠償經(jīng)濟損失Compensationforeconomiclosses甲方有下列情形之一，給乙方造成經(jīng)濟損失的，應(yīng)當承擔賠償責任：Ofanythefollowingcircumstances,partyAshallbeliableforcompensationoftheeconomiclossesofpartyB.1、由于甲方制定的勞動合同條款無效的；SinceLaborPartyestablishedthetermsoftheinvalidcontract;2、違反勞動合同法規(guī)定的條件解除勞動合同的。Conditionsinviolationoftheprovisionsofthe“LaborContractLaw“toterminatethelaborcontract.乙方有下列情形之一，給甲方造成經(jīng)濟損失的，還應(yīng)當承擔賠償責任：Ofanythefollowingcircumstances,partyBshallbeliableforcompensationoftheeconomiclossesofpartyA.1、乙方違反《勞動合同法》規(guī)定的條件或者勞動合同的約定解除勞動合同，給甲方造成經(jīng)濟損失的，應(yīng)當按照損失的程度，承擔賠償責任；PartyBviolatedtheconditionsinthe"LaborContractLaw"orterminatedthelaborcontracttocausetheeconomiclossesofpartyA,PartyBshallbeliableforcompensationoftheeconomiclossesofpartyA.2、乙方違反勞動合同約定的保密事項，給甲方造成經(jīng)濟損失的，應(yīng)當依法承擔賠償責任；ConfidentialmattersPartyviolationsoflaborcontract,causingeconomiclossestothePartyshallbeliableforcompensationaccordingtolaw.3、乙方在合同期內(nèi)嚴重違反甲方的有關(guān)規(guī)章制度、操作規(guī)程給甲方造成損失或致甲方聘用的其他勞動者人身損害的，由乙方根據(jù)責任的大小負責賠償。Inthecontractperiod,ifPartyBcausedseriousviolationsofrelevantrulesandregulationsoftheParty,procedures,orcausedlosses,orcausespersonalinjuryofotherworkersemployedbythePartyA.PartyBshallpaycompensationinaccordancewiththesizeoftheresponsibility.（二）違約金Penalty1、甲方為乙方提供專項技能培訓(xùn)，乙方違反培訓(xùn)協(xié)議，須向甲方支付違約金；PartyAshallprovidespecialskillstrainingforPartyB.IfPartyBviolatedtrainingprotocol,PartyBshallpayliquidateddamagestoPartyA.2、甲方對乙方實施了競業(yè)限制，乙方違反競業(yè)限制條款，須向甲方支付違約金。PartyAimplementedthenon-competitionforthePartyB.Ifitisviolated,PartyBshallpayliquidateddamages十一、雙方約定條款A(yù)greedTermsbytwoParties（一）甲方采取了保密措施保護的商業(yè)秘密，乙方負有保密義務(wù)；PartyAhastakenmeasurestoprotecttheconfidentialityoftradesecrets,PartyBhastheconfidentialityobligations.（二）甲方可以就保密的內(nèi)容、范圍和地點，雙方的權(quán)利義務(wù)，保密期限，違約責任以及競業(yè)限制條款等與乙方簽訂協(xié)議；PartyAcansignwithPartyonconfidentialityincontent,scopeandlocationoftherightsandobligationsofbothparties,theconfidentialityperiod,andbreachofcontractandnon-competeclause.（三）若乙方在甲方是從事過管理、經(jīng)營、技術(shù)工作的，在離開甲方兩年以內(nèi)，不得在本行業(yè)內(nèi)其它企業(yè)工作，不得泄露甲方的生產(chǎn)、經(jīng)營秘密；IfPartyBisengagedinthemanagement,operation,technicalwork.Afterleavingthepartyinlessthantwoyears,PartyBcannotworkinothercompaniesinthisindustry,andshallnotdivulgeproduction,businesssecretsofPartyA.（四）勞動合同依法解除或終止時，乙方應(yīng)當歸還甲方的保密資料。Whenthe
