勞動合同LABORCONTRACT甲方:PartyA:法定代表人:LegalRepresentative:法定地址:RegisteredAddress:乙方:PartyB:身份證號碼:戶口性質(zhì):DomicileNature:家庭地址:HomeAddress:根據(jù)《中華人民共和國勞動協(xié)議法》及有關(guān)法律和法規(guī)規(guī)定,甲乙雙方在平等自愿、協(xié)商一致基礎(chǔ)上簽訂本協(xié)議。AccordingtotheLaborContractLawofPRCandrelevantlawsandregulations,PartyAandPartyBsignthiscontractonthebasisofequality,freewillandmutualconsultation.工作內(nèi)容ArticleOneWorkingContents1.1甲方因生產(chǎn)需要,同意聘任乙方為我司員工,職位為乙方同意接受該安排,遵守勞動紀(jì)律和職業(yè)道德,執(zhí)行勞動安全規(guī)程,提高職業(yè)技能,完畢生產(chǎn)(工作)任務(wù)。Tomeettheproductiondemand,PartyAagreestoemployPartyBas.PartyBagreestoacceptthearrangement,observethelabordisciplineandprofessionalethics,carryoutrulesofsafeoperation,improveprofessionalskillsandaccomplishesproductiontasks.甲方可根據(jù)生產(chǎn)經(jīng)營需要依法調(diào)整乙方工作崗位或職位。PartyAmaylegitimatelyadjustPartyB’spostaccordingtobusinessrequirements.a協(xié)議期限ArticleTwoTermofContract本協(xié)議自年月日至年月日,。勞動協(xié)議期限屆滿或約定終止條件出現(xiàn),勞動協(xié)議即終止執(zhí)行。經(jīng)雙方協(xié)商一致,可以解除或續(xù)訂勞動協(xié)議。Thiscontractwillbeeffectfrom(date,month,year)to(date,month,year),Thecontractwillbeterminatedwhenthecontractisatitsexpiryoragreedterminationconditionsoccurs.Bothpartiesmayrescindorrenewthecontractviamutualconsultation.工作時間ArticleThreeWorkingHours3.1甲方實行每周工作小時和天休息日原則工時制度。PartyAcarriesoutstandardworkinghourssystemofhoursperweekandrestdays(maybetheyarenotSaturday,Sunday).3.2甲方因工作需要,在乙方樂意前提下,可依法安排乙方超時工作或公休日加班。PartyAmaylegitimatearrangePartyBtoworkovertimeorworkongeneralholidaysduetobusinessrequirementsonconditionthatPartyBiswillingtodoso.甲方由于工作需要更改工時制度,經(jīng)政府有關(guān)部門同意后,乙方應(yīng)親密配合執(zhí)行。PartyAmaychangeworkinghourssystemforbusinessrequirementafterapprovalbyrelevantgovernmentauthoritiesandPartyBshallexecuteitofhisownwill.薪酬ArticleFourRemuneration4.1甲方支付乙方每月基本工資為人民幣元。上述薪酬不包括甲方按企業(yè)補助規(guī)定按月向乙方支付所有補助。PartyApaystoPartyBasbasicwagepermonth.TheaforesaidremunerationexcludesallsubsidiespaidtoPartyBpursuanttoPartyA’sstipulation.4.2甲方嚴(yán)格執(zhí)行國家有關(guān)最低工資規(guī)定和原則。PartyAshallstrictlyimplementrelevantregulationsandstandardperthelowestwage.4.3甲方發(fā)薪日期為每月日。PartyAshallpaythewageonthedayeverymonth.勞動保護與勞動條件ArticleFiveLaborProtectionandLaborConditions5.1甲方須對乙方進行勞動安全、業(yè)務(wù)技術(shù)及勞動紀(jì)律等方面教育和培訓(xùn),并根據(jù)國家對勞動保護、安全生產(chǎn)規(guī)定,為乙方提供必要生產(chǎn)(工作)條件,保障乙方安全健康。PartyAshallgivePartyBeducationandtrainingprogramsrelatingtolaborsafety,professionalskillsandlabordisciplinesetc.Accordingtotherequirementsofstatelaborprotectionandsafe-production,PartyAshallprovidenecessaryworkingconditiontoensurePartyB’ssafetyandhealth.社會保險和福利ArticleSixSocialInsuranceandWelfare6.1甲方依法替乙方辦理各項社會保險并繳納保險費用。但依法規(guī)定之分?jǐn)偙壤?,屬于乙方須自行承?dān)之各項社會保險金,由甲方于每月發(fā)薪時,從乙方薪資中代扣代繳。PartyAshalltransactsocialinsuranceandpaythemforPartyB.PartyAshallwithholdthesocialsecuritycontributionlegallyundertookbyPartyBwhenpayingtheremunerationeverymonth.6.2乙方享有國家規(guī)定所有法定假日。PartyBwilltakeallstatutoryholidaysstipulatedbytheState.甲方實行年休假制度,乙方持續(xù)工作滿一年以上可享有有薪年假,申請享有措施按甲方制定年假規(guī)定執(zhí)行。PartyAcarriesoutannualvocationsystem,PartyBcantakepaidannualvocationaftercontinuouslyworkingfor1yearandtheapplyingprocedureforannualvocationshallbedonepursuanttoPartyA’sstipulation.乙方責(zé)任ArticleSevenPartyB’sResponsibility7.1乙方必須認(rèn)真工作和勞動,保質(zhì)保量地完畢自己生產(chǎn)任務(wù)。PartyBmustworkearnestlyandaccomplishitsowntaskswithqualityandquantity.7.2乙方必須如實匯報工作,積極配合和協(xié)助上級工作。PartyBmustreportitsjobaccordingtothefactsandshallcooperatewithitsuppersandassisttheirjobs.7.3乙方應(yīng)嚴(yán)格履行甲方依法制定規(guī)章制度和《員工手冊》。PartyBshallstrictlyimplementtherulesandregulationsandHandbooklegallystipulatedbyPartyA.7.4乙方應(yīng)愛惜甲方財物,對由于本人責(zé)任導(dǎo)致直接經(jīng)濟損失,必須予以賠償并接受甲方懲罰。PartyBshalltakegoodcareofPartyA’spropertyandhe/shemustindemnifydirectdamageduetohis/herliabilityandacceptsPartyA’spunishment.7.5乙方在勞動協(xié)議有效期內(nèi)未經(jīng)甲方事先書面同意,不得為另一家雇主工作。PartyBcannotworkforanotheremployerwithoutPartyA’swrittenconsentinthedurationofLaborContract.7.6乙方應(yīng)嚴(yán)格保守甲方商業(yè)秘密,不得向任何第三方泄露。PartyBshallstrictlykeepPartyA’stradesecretandcannotdivulgetoanythirdparty7.7如實陳說履歷和學(xué)歷。PartyBshallstatehis/hercurriculumvitaeandeducationalbackgroundaccordingtothefacts.7.8如甲方委派乙方培訓(xùn)(包括海外培訓(xùn)),乙方必須遵守甲方培訓(xùn)條規(guī)和承諾。PartyBshallobservePartyA’strainingrulesandundertakingwhenPartyAassignsPartyBtobetrained.甲方免費解除協(xié)議ArticleEightCancellationoftheContractwithoutCompensationbyPartyA若符合下列狀況之一,甲方可以隨時解除協(xié)議,而不必予以乙方任何經(jīng)濟賠償:PartyAmaycanceltheContractatanytimewithoutcompensationtoPartyBunderthefollowingcircumstances:8.1當(dāng)乙方在試用期內(nèi)不符合甲方職工錄取條件,甲方不必予以乙方解除原因。WhenPartyBisproventobeunqualifiedforPartyA’semploymentconditionsduringprobationperiod,PartyAneednotgivePartyBthereasonforcancellation.8.2乙方嚴(yán)重違反甲方依法制定規(guī)章制度和勞動紀(jì)律。PartyBseriouslyviolatesrulesandregulations,labordisciplinelegallystipulatedbyPartyA.8.3乙方嚴(yán)重失職,營私舞弊,給甲方利益導(dǎo)致重大損失。PartyBseriouslyneglectshis/herdutyandgraftsresultinginPartyA’sgreatloss.乙方違反中國法律,受到司法懲罰或追究刑事責(zé)任。PartyBviolatesthelawsofPRCandgainsjudicialpunishmentorisfoundaguilty.甲方有償解除協(xié)議ArticleNightCancellationoftheContractwithCompensationbyPartyA有下列情形之一,甲方可以解除勞動協(xié)議,不過應(yīng)當(dāng)提前30天以書面形式告知乙方或支付一種月基本工資替代,并依法支付乙方經(jīng)濟賠償金或補助費。Underthefollowingcircumstances,PartyAmaycanceltheContractwith30dayspriorwrittennoticetoPartyBorpayingonemonthbasicwageinsteadandlegallypayeconomiccompensationorsubsidytoPartyB.9.1乙方患病或非因工受傷,醫(yī)療期滿后仍不能從事原工作或由甲方另行安排工作。PartyBisillornon-work-relatedinjured,andunabletodotheformerjoborotherjobassignedbyPartyAaftermedicaltreatment.9.2乙方不能勝任工作,通過培訓(xùn)或調(diào)整工作崗位,仍不能勝任。PartyBisnotcompetentforthejobandstillremainssoaftertrainingoradjustmentofthepost.9.3本協(xié)議簽訂時所根據(jù)客觀狀況發(fā)生重大變化,致使本協(xié)議無法履行,甲乙雙方不能就變更本協(xié)議到達協(xié)議。Thebasisfortheconclusionofthecontracthasgreatlychangedsothatthecontractcannolongerbecarriedout,whilebothpartiescannotreachanagreementonmodifyingthecontractbymutualnegotiation.甲方瀕臨破產(chǎn),進入法定整頓期間或者生產(chǎn)經(jīng)營狀況發(fā)生嚴(yán)重困難,到達當(dāng)?shù)厝嗣裾?guī)定嚴(yán)重困難企業(yè)原則,確須淘汰人員,并按法定程序解除勞動協(xié)議。PartyAisclosetobankruptcyandentersintolegalrectificationperiodoritisinaseveredifficultytomeetthestandardofseveredifficultenterprisestipulatedbythelocalgovernmentandtheretrenchmentisneeded,andthenPartyAcancelsthecontractaccordingtolegalprocedure.乙方規(guī)定解除協(xié)議ArticleTenCancellationoftheContractatPartyB’srequest10.1乙方規(guī)定解除勞動協(xié)議,應(yīng)當(dāng)提前三十天以書面形式告知甲方,但必須根據(jù)11.2條款賠償甲方。PartyBshallgive30dayspriorwrittennoticetoPartyAwhenrequestingtocanceltheContract,buthe/sheshallindemnifyPartyAaccordingtoArticle11.2.10.2乙方在下列狀況下,可隨時告知甲方解除勞動協(xié)議。Underthefollowingcircumstances,PartyBmayinformPartyAtoterminatetheContractatanytime.在試用期內(nèi)。Beinprobationperiod.甲方不按照勞動協(xié)議支付勞動酬勞或者提供勞動條件。PartyAdidn’tpaytheremunerationorprovideworkingconditionsaccordingtotheContact.甲方以暴力威脅或者非法限制人身自由措施強迫乙方工作。PartyAforcesPartyBtoworkbymeansofforce,threatorillegalrestrictionofpersonalfreedom.十一、違約責(zé)任ArticleElevenLiabilityforBreachofContract11.1甲方依第9條提前解除協(xié)議,應(yīng)按法律規(guī)定向乙方支付經(jīng)濟賠償金。PartyAshalllegallypayeconomiccompensationtoPartyBwhencancelingtheContractpursuanttoArticleNight.11.2乙方違約不履行協(xié)議,應(yīng)按《培訓(xùn)協(xié)議》約定及法律法規(guī)規(guī)定賠償甲方經(jīng)濟損失。PartyBshallindemnifyPartyAforitseconomiclossaccordingtolawsandregulationsandTrainingAgreementwhenhe/shebreachestheContract.十二、協(xié)議附件ArticleTwelveAnnexesoftheContract12.1本協(xié)議附件為本協(xié)議不可分割構(gòu)成部分,與本協(xié)議具有相等法律效力。TheAnnexesareindivisiblepartsofthiscontractandtheyhavethesameeffectasthiscontract.12.2甲方依法制定《員工手冊》及各項規(guī)章制度是本協(xié)議附件。HandbookandotherrulesandregulationslegallystipulatedbyPartyAareannexesofthisContract.十三、勞動爭議ArticleThirteenLaborDispute甲乙雙方若發(fā)生勞動爭議,應(yīng)通過友好協(xié)商處理;若不能處理,可以向當(dāng)?shù)赜泄茌牂?quán)勞動爭議仲裁委員會申請仲裁;對仲裁不服,可向人民法院起訴。提出仲裁一方應(yīng)當(dāng)在勞動爭議發(fā)生之日起60天內(nèi)向勞動爭議仲裁委員會提出書面申請;當(dāng)事人對仲裁裁決不服,可以在收到仲裁裁決書之日起15天內(nèi)向人民法院起訴。Iflabordisputeoccurs,bothpartiesshallresolveitthroughconsultation.Incaseoffailingtoreachanagreement,eachpartymaysubmitthedisputetoLaborDisputeArbitrationCommitteehavingjurisdiction.Ifrejectingtheaward,eachpartycantakeaproceeding.ThepartyapplyingforarbitrationshallsubmitthearbitrationapplicationtoLaborDisputeArbitrationCommitteewithin60dayswhenthelabordisputearises.Ifrejectingtheaward,thepartycansuetothecourtwithin15daysafterreceiptoftheaward.十四、協(xié)議生效ArticleFourteenEffectivenessoftheContract本協(xié)議自甲、乙雙方簽訂后生效。Thiscontractiseffectivebysignaturesofbothparties.十五、其他ArticleFifteenMiscellaneous15.1本協(xié)議未盡事宜,可由甲、乙雙方另行簽訂補充條款,補充條款與本協(xié)議具有相似法律效力。Ifthereissomethingunclear,bothpartiesmayconcludeasupplementclauseandtheclauseshallhavethesamee
