第頁共頁房屋租賃協(xié)議英文租約LEASEAGREEMENT出租方〔甲方〕Lessor〔PartyA〕地址:Address:帳戶名:AccountName:銀行名稱:BankName:帳號:AccountNo.:承租方〔乙方〕Lessee〔PartyB〕地址:Address::PhoneNo.:第1條租賃標的:LeasingPremises:甲方同意將及其設(shè)備〔詳見附件二〕在清潔及良好狀態(tài)下租給乙方〔甲方需在入住前清潔并檢查該房屋及其設(shè)備,確保所有設(shè)備為正常工作狀態(tài)〕該房屋面積為平方米〔房產(chǎn)權(quán)屬證明見附件一〕產(chǎn)權(quán)人:該房屋為居住用處。PropertyOwnerName:TheusageoftheLeasingPremisesisforresidentialpurposeonly.第2條租期:TermofTenancy:2.1租賃期為年,自年月日到年月日止。租期滿個月后,乙方可以提早個月書面通知甲方提早終止合同,無需承當任何責任。Theabovepropertyisherebyleasedforatermofyear,mencingonandexpiringon.Aftermonthsofstay,PartyBmayterminatethisAgreementbygivingmonth'spriornoticeinwrittenwithoutbeingliabletherefore.2.2在租期開場前,出租房屋及附件二所列設(shè)備應(yīng)已裝修或安裝布置完畢,、寬帶、電視均已開通,處于可供租賃的良好狀態(tài)。甲方應(yīng)按時交付出租房屋及附件二所列設(shè)備,如有逾期,乙方有權(quán)解除本租約,甲方應(yīng)應(yīng)返還乙方已付押金及剩余租金,并向乙方支付相當于兩個月租金的違約金。2.3租期屆滿,甲方有權(quán)收回出租房屋及附件二所列全部設(shè)備,乙方亦應(yīng)如期交還;乙方如要求續(xù)租,那么享有優(yōu)先續(xù)租權(quán),但必須在本租約期滿前2個月向甲方提出書面申請,租金雙方另行協(xié)商。租賃終止或解除時,如甲方不及時接收房屋,乙方有權(quán)將房屋鑰匙按通訊地址寄給甲方,以此視為乙方交還完畢以及甲方驗收合格。2.4除本合同另有約定外,租賃期內(nèi)乙方如需提早退租,應(yīng)提早30日通知甲方,并向甲方支付相當于兩個月租金的違約金。UnlessotheragreedinthisAgreement,duringthetermofAgreement,IfpartyBterminatestheTenancyAgreement,PartyBshallinformPartyA30daysinadvanceandshallpayPartyAthepensationwhichequalstotwomonths'srent.第3條租金:Rent:3.1租金每月為人民幣元整,包括家具、電器〔見附件二〕物業(yè)管理費、房租完稅發(fā)票、衛(wèi)星電視的開通費、和寬帶M開通費以及.3.2租金每個月支付一次,每次支付金額為元。甲方應(yīng)于每個支付周期開場日前10日內(nèi)向乙方開具相應(yīng)金額的租賃發(fā)票,乙方應(yīng)在收到甲方正式完稅發(fā)票后個工作日內(nèi)向甲方指定賬戶支付月租金。如假設(shè)甲方未按時提供有關(guān)發(fā)票,乙方有權(quán)延付租金。假設(shè)乙方收到發(fā)票后未按上述期限付款,那么每逾期一日,應(yīng)按未付租金的千分之三向甲方支付滯納金。PartyBshallpayeachmonthsrentwhichequalstoRMB.PartyAshouldprovidewithPartyBthecorrespondinginvoicewithin10daysbeforethemencingdateofeachpaymentpeoriod,andPartyBshouldpaytherenttothedesinatedaccountofPartyAwithinworkingdaysafterreceivingtheinvoicefromPartyA,IncasePartyAfailstodoso,PartyBshallhavetherighttowithholdrentalpayment.IncasePartyBfailstopaytherentafterreceivingtheinvoiceasagreedintheTenancy,penaltyof3‰foreachoverduepaymentshouldbecharged.3.4租金以人民幣支付。在本租約有效期內(nèi),租金不予調(diào)整。TherentshallbepaidinRMB.TherentcannotbeadjustedduringthetermofthisTenancyAgreement.第4條押金:Deposit:4.1本租約簽訂之日起個工作日內(nèi)且起租日前,乙方應(yīng)向甲方繳付相當于個月租金額的租賃押金計人民幣元。甲方應(yīng)于乙方將水、電、煤、費、寬帶等費用及其他損壞賠償費用〔如有〕結(jié)清后7個工作日內(nèi)將押金退還。WithinworkingdaysaftersigningofthisLeaseAgreementandbeforetheleasestartdate,PartyBshallpaytoPartyAmonth'srentasdeposit,andtheamountofdepositisRMBintotal.PartyAshallreturnthedepositinfulltoPartyBwithin7workingdaysafteralltheutilityfeeanddamagefeesarecleared.4.3甲方因乙方違背本合同的規(guī)定而受的損失,可在押金中扣抵合理數(shù)目,在甲方做出該種扣抵前,需書面通知乙方將被扣抵的金額和理由,乙方有權(quán)回絕不合理或不公正的抵扣,缺乏局部乙方必須在接到甲方付款通知后15個工作日內(nèi)補足。4.4押金以人民幣支付,甲方收到押金時應(yīng)向乙方開具收據(jù)。ThedepositshallbepaidinRMB.PartyAshallissueanofficialreceipttoPartyBuponthereceiptofdeposit.第5條其它費用:OtherCharges:5.1乙方在租賃期內(nèi)所用的水、電、煤氣〔天然氣〕,物業(yè)管理公司或公共事業(yè)部門將每月按房屋實際耗用量結(jié)算,由乙方按單繳付。DuringtheperiodofLeaseterm,PartyBshallpaymonthlychargesforusageofwater,electricity,gasbasedontheactualconsumptionamountbilledbythemanagementofficeorrelatinggover____entutilitybureaus.5.2乙方所用,按電信部門相關(guān)標準收費,每月根據(jù)實際用量結(jié)算,由乙方按單繳付。TelephonebillsshallbepaidbyPartyBandbasedontheactualusageaccordingtotherelevantstandardofthethetelemunicationbureau.第6條甲方的權(quán)利和義務(wù):Landlord'sRightsandObligations:6.1本租約簽訂后,甲方不得無故收回房屋,如甲方中途要求收回房屋或擅自解除合同,乙方有權(quán)回絕。在征得乙方書面同意解除租約后,甲方應(yīng)返還乙方已付押金及剩余租金,并向乙方支付相當于兩個月租金的違約金。PartyAisnotpermittedtotakebacktheleasedpropertyorterminatethisAgreementduringthetermofAgreementwithoutanyreason.IfPartyAwishestodoso,PartyBhastherighttorefuse.UponthewrittenconsentofPartyBtoterminatetheLeaseAgreement,PartyAshallreturnthedepositandprepaidrenttoPartyBandshallpayPartyBthepensationofamountwhichequalstotwomonth'srent.6.2甲方應(yīng)確保房屋的各項附屬設(shè)施以及家具家電均處于完好、可租賃狀態(tài)。如上述各項出現(xiàn)損壞或不能正常工作,甲方在收到乙方發(fā)出的通知后24小時內(nèi)迅速修理或修繕該損害處。假設(shè)3個日歷日內(nèi)甲方仍不能修繕或修繕無效,乙方有權(quán)停頓并免于支付租金直到上述情況改良至乙方合理滿意為止,直至上述影響居住的情況改良至乙方合理滿意為止。情況嚴重影響乙方正常居住的,乙方有權(quán)以書面形式通知甲方解除本租賃合同,租金付至合同解除日,甲方應(yīng)返還乙方已付押金及剩余租金,并向乙方支付相當于兩個月租金的違約金。6.3甲方謹在此聲明及保證甲方為出租房屋的合法擁有人并有合法地位出租此房屋于乙方。就本合同及出租此出租房屋予乙方之事,甲方已獲得所有有關(guān)機構(gòu)的批準,包括政府批準及/或抵押權(quán)人的同意〔如適用〕甲方于本合同所做出的聲明及保證,如有錯誤或違背者,甲方須就乙方因此而引致的任何損失、損害、支出及費用做出全部補償。PartyAherebyrepresentsandwarrantsthatPartyAisthelegalowneroftheleasingPremisesandhasthenecessarylegalcapacitytoleasethepropertytoPartyB.PartyAhasalsoobtainedallthenecessaryauthorizationsfromallrelevantauthoritiesinthePeople'sRepublicofChinainrespectofthisLeaseAgreementandtheleasingoftheleasingPremisestoPartyB,includinganynecessarygover____entapprovalsorregistrationsand/ormortgageeconsent〔ifapplicable〕PartyAshallcontinuetobeliabletokeepPartyBfullyindemnifiedagainstanycosts,expenses,lossesanddamagessufferedbyPartyBduetoanybreachofPartyAtoitsabove-mentionedguarantee.6.4如在租賃期內(nèi),出租房屋發(fā)生所有權(quán)全部或局部的轉(zhuǎn)移、或其他影響乙方權(quán)益的事情時〔甲方出售房屋或者抵押房屋〕,甲方應(yīng)保證所有權(quán)人或其他影響乙方權(quán)益的第三者,能繼續(xù)遵守本合同所有條款??v使出租房屋已被轉(zhuǎn)移,如乙方于本合同下的權(quán)益受此等所有權(quán)人或第三所影響或損害,甲方須負責補償乙方的所有損失。Ifduringtheleaseterm,allorpartoftheleasingPremisesistransferredormortgagedtoathirdpartybyPartyA,orPartyB'srighttousetheleasedpropertyisotherwiseaffected,PartyAshallensurethatsuchtransfereeorthirdpartyhavinganeffectonPartyB'srighttousetheleasingPremiseswillcontinuetoabidebythetermsofthisLeaseAgreement.EveniftheleasedPremisesistransferredwhereatransfereeorathirdpartyaffectsPartyB'sinterestsunderthisLeaseAgreement,PartyAshallcontinuetobeliabletokeepPartyBfullyindemnifiedagainstalldamagessufferedbyPartyB.6.5甲方應(yīng)提供無毒無害的居住環(huán)境。假如該房屋中存在有害氣體、噪音或者其他危害安康的情形,經(jīng)執(zhí)證機關(guān)通過專業(yè)檢測后證明房屋內(nèi)的有害氣體、噪音或者其他情形確實超過國家規(guī)定的安康標準的,乙方有權(quán)憑檢測報告解除本協(xié)議,甲方應(yīng)返還乙方全額押金和剩余租金。PartyAshallprovideharmlesscircumstance.Ifthereispoisonousgas,andothercaseswhicharehazardoustohealthintheapartment,whichexceedthestandardregulatedbygover____ent,PartyBhastherighttoterminatethisAgreementimmediately.PartyAshallrefundthewholeamountofdepositandtheprepaidrenttoPartyB.6.6除本合同另有約定外,假設(shè)甲方違背此租約的任何條款并在乙方發(fā)出書面通知15天后仍未改正,乙方有權(quán)解除此租約,收回押金,且有權(quán)要求甲方支付相當于兩個月租金的違約金,同時租金付至合同解除日。UnlessotheragreedinthisAgreement,PartyBshallhavetherighttoterminatetheLeaseAgreementwhenPartyAbreachestheLeaseAgreementandfailstoremedythebreachafterfifteen〔15〕daysofgivingwrittennotificationofPartyB.PartyBshallbeentitledtowithdrawthedepositandrequestPartyAtoundertakethepensationwhichequalstotwomonths'srent.TherentalshouldbepaidtilltheterminationofAgreement.第7條乙方權(quán)利和義務(wù):Tenant'sRightsandObligations:7.1乙方應(yīng)按期交納押金、租金及其他費用。假設(shè)超過限定期限30個工作日,乙方無正當理由仍未支付的,那么甲方有權(quán)解除本租約,并要求乙方承當相當于兩個月租金的違約金。PartyBshouldpaythedeposit,rentandotherchargesaccordingtotheAgreementterm.IfPartyBfailstopaytheabovementionedfeeforover30workingdayswithoutjustfulreason,PartyAhastherighttoterminatethisagreement,PartyBshallpayPartyAthepensationofamountwhichequalstotwomonth'srent.7.2租賃期內(nèi)未經(jīng)甲方同意,乙方不能轉(zhuǎn)租其所租房屋,私自轉(zhuǎn)租無效。Duringtheleaseterm,unlesswiththeagreementofPartyA,PartyBcannotsub-letorletinpartorinfulltheleasingPremises.7.3乙方應(yīng)保護房屋及其設(shè)備,如因使用不當而導(dǎo)致?lián)p壞,乙方應(yīng)負責賠償。PartyBmusttakegoodcareoftheproperty;otherwisePartyBshouldpaypensationtoPartyAforhisimproperuseoftheproperty.7.4除房內(nèi)已有的裝飾和設(shè)施外,乙方如要增加設(shè)備或其他裝修須征得甲方同意。租賃期滿,乙方向甲方交還房產(chǎn)時,除雙方另有約定外,應(yīng)恢復(fù)其原狀〔正常磨損除外〕未經(jīng)甲方書面同意,乙方不得擅自設(shè)立、安裝或挪動設(shè)施及設(shè)備,不能擅自設(shè)立隔斷,不得擅自對房屋的構(gòu)造改動或增加。Inadditiontothedecorationandequipmentalreadyintheproperty,ifPartyBwishestomakeanyalterationsordecorationtosuchproperty,PartyBshouldgettheconsentofPartyA.OnpletionoftheLeaseterm,PartyBmusthandoverthepropertytoPartyAinitsoriginalcondition〔exceptfornormalwear〕PartyBshallnoterect,installorremoveanyfixturesorpartitioning,ortomakeanystructuraladditionsandalterationswithoutthepriorwrittenconsentofPartyA.7.5由于乙方或乙方關(guān)聯(lián)人員的粗心、忽略或成心而造成房屋的損害或損失的,乙方應(yīng)當承當賠償責任,并允許甲方或其受權(quán)人在事先通知后進入房屋,對房屋的損失或損害進展彌補及修復(fù),由此所發(fā)生的費用由乙方負擔。PartyBshallindemnifyPartyAfromanylossordamagestotheleasedpropertyfromnegligentactoromissionofPartyBoritsconnecterandshallpermitPartyAorhisauthorizedrepresentativeswithadvancenoticetoentertheleasedpropertytorepairanysuchlossordamageattheexpenseofPartyB.7.6租賃期間,乙方必須嚴格遵守中華人民共和國的有關(guān)法律、細那么、規(guī)章及法令的規(guī)定,不得利用房屋進展違犯法律及不道德的行為。Strictlytoplyandadhereintheusageoftheleasedpropertyaccordingtoalllaws,regulationsanddecreesofthePeople'sRepublicofChina,andspecificallynottopermittheleasedpropertytobeusedforanypurposethatisunlawfulorimmoral.第8條違約責任BreachofAgreement任何一方違背本協(xié)議的規(guī)定,或其他在本協(xié)議內(nèi)所作的陳述、保證或承諾,造成另一方經(jīng)濟損失的,違背方應(yīng)按照合同約定承當相應(yīng)的違約責任和賠償責任。AnyPartywhobreachestheprovisionsofthisAgreement,oritsrepresentations,warrantiesorconventsmadehereunder,causingtheotherPartyloss,shallbearresponsibilityforpensationaccordingtotheAgreementterm.第9條不可抗力ForceMajeure房屋由于火災(zāi)、惡劣天氣、戰(zhàn)爭或其它不可抗力因素,而不是因為乙方直接或間接的忽略及成心行為造成房屋毀壞而不能被正常使用及居住時,乙方從該日起停頓支付租金,直至房屋可再被使用及居住時為止。假設(shè)甲方根據(jù)自己的意愿及經(jīng)濟、實際意義等原因認為沒有必要修繕復(fù)原房屋時,應(yīng)書面通知乙方,并在做出上述通知后三日內(nèi)將押金及預(yù)付租金全部退還乙方。第10條適用法律及爭議的解決:Legislation&ArbitrationoftheDispute:本租約受中華人民共和國法律的約束,如發(fā)生與本租約有關(guān)的爭議,由雙方友好協(xié)商解決,協(xié)商不成,按以下第_________種方式解決:〔1〕提交_________仲裁委員會仲裁;〔2〕依法向租賃房屋所在地人民法院起訴。1〕submitittoArbitrationmitteeforarbitration.2〕appealtothePeople'sCourtattheplacewheretheLeasingPremiseslocates.第11條通知Notice甲方和乙方特此約定,所有關(guān)于對方的權(quán)利或義務(wù)的交給對方的通知應(yīng)書面做出,并由通信員、郵件、或急件信使送至扉頁地址。任何一方名稱或地址發(fā)生任何變更應(yīng)立即書面告知對方,否那么應(yīng)自行承當由于不能送達導(dǎo)致的法律后果。PartyAandPartyBagreeherebythatallnoticestobedeliveredtotheotherPartywithregardtoeitherParty'srightsorobligationsshallbeinwritingandbesentbymessenger,mail,facsimileorcouriertotheaddresseslistedatthecoverpage.Eachpartymustinformtheotherpartyimmediatelyanychangeofitsnameoraddressifany,otherwise,itshouldsolelytakethelegalresponsibilityresultedfromsuchdeliveryfailure.第12條其它:Others:12.1本租約未盡事宜,經(jīng)甲、乙雙方協(xié)商一致,可訂立補充條款。本租約補充條款、附件均為本租約不可分割的組成局部,本租約正文及其補充條款、附件具有同等法律效力。12.2本租約自簽字之日起生效,租約文本一式肆份,甲、乙兩方各執(zhí)兩份,中英文具有同等法律效力。中英文條款及意思如有不一致之處,以中
