(shí)候不適航所造成.3.DeviationClauseTheVesselhaslibertytocallatanyportorportsinanyorder,foranypurpose,tosailwithoutpilots,totowand/orassistVesselsinallsituations,andalsotodeviateforthepurposeofsavinglifeand/orproperty.3.繞航條款船舶有權(quán)為任目的以任次序掛靠任港口,沒(méi)有引航員在船也可航行,在任情況下拖帶和/或幫助他船,亦可為拯救人命和/或財(cái)產(chǎn)而繞航.4.PaymentofFreight運(yùn)費(fèi)支付ThefreightattheratestatedinBox13shallbepaidincashcalculatedontheintakenquantityofcargo.運(yùn)費(fèi)應(yīng)按第13欄所列費(fèi)率,依照裝船貨物的數(shù)量計(jì)算,以現(xiàn)金支付.Prepaid.IfaccordingtoBox13freightistobepaidonshipment,itshallbedeemedearnedandnon-returnable,Vesseland/orcargolostornotlost.NeithertheOwnersnortheiragentsshallberequiredtosignorendorsebillsofladingshowingfreightprepaidunlessthefreightduetotheOwnershasactuallybeenpaid.(b)預(yù)付.如按第13欄,運(yùn)費(fèi)是在裝船時(shí)支付,則應(yīng)視為運(yùn)費(fèi)已經(jīng)收取并且是不能退還的,而不論船舶和/或貨物可否發(fā)生滅失.若是應(yīng)支付給全部人的運(yùn)費(fèi)還沒(méi)有實(shí)質(zhì)支付則不能夠要求所有人或其代理人簽發(fā)或背書(shū)表示運(yùn)費(fèi)已經(jīng)預(yù)付的提單.專(zhuān)業(yè)資料.(c)Ondelivery.IfaccordingtoBox13freight,orpartthereof,ispayableatdestinationitshallnotbedeemedearneduntilthecargoisthusdelivered.Notwithstandingtheprovisionsunder(a),iffreightorpartthereofispayableondeliveryofthecargotheCharterersshallhavetheoptionofpayingthefreightondeliveredweight/quantityprovidedsuchoptionisdeclaredbeforebreakingbulkandtheweight/quantitycanbeascertainedbyofficialweighingmachine,jointdraftsurveyortally.CashforVessel'sordinarydisbursementsattheportofloadingtobeadvancedbytheCharterers,ifrequired,athighestcurrentrateofexchange,subjecttotwo(2)percenttocoverinsuranceandotherexpenses.到付.如按第13欄,運(yùn)費(fèi)或部分運(yùn)費(fèi)在目的地支付,則在貨物按按這種式交托以前,不應(yīng)認(rèn)為運(yùn)費(fèi)已經(jīng)收取.只管有(a)款規(guī)定,若是運(yùn)費(fèi)或部分運(yùn)費(fèi)在交托貨物時(shí)支付,承租人應(yīng)有選擇按交托貨物的重量/數(shù)量支付運(yùn)費(fèi)的權(quán)益,只要這種選擇是在散貨分解之前宣布的,并且該重量/數(shù)量可由公認(rèn)的衡重儀器,共同查驗(yàn)票據(jù)或理貨加以確定.如經(jīng)要求,承租人應(yīng)現(xiàn)金墊付船舶在裝貨港的經(jīng)常開(kāi)銷(xiāo),而按最高兌換率折合并附加2%補(bǔ)償保險(xiǎn)費(fèi)和其他開(kāi)銷(xiāo)。5.Loading/Discharging(a)Costs/RisksThecargoshallbebroughtintotheholds,loaded,stowedand/ortrimmed,tallied,lashedand/orsecuredandtakenfromtheholdsanddischargedbytheCharterers,freeofanyrisk,liabilityandexpensewhatsoevertotheOwners.TheCharterersshallprovideandlayalldunnagematerialasrequiredfortheproper專(zhuān)業(yè)資料.stowageandprotectionofthecargoonboard,theOwnersallowingtheuseofalldunnageavailableonboard.TheCharterersshallberesponsibleforandpaythecostofremovingtheirdunnageafterdischargeofthecargounderthisCharterPartyandtimetocountuntildunnagehasbeenremoved.開(kāi)銷(xiāo)/風(fēng)險(xiǎn)貨物應(yīng)由承租人負(fù)責(zé)送至艙,裝船,積載和/或平艙,理貨,綁扎和/或固定,并從艙取出和卸船,全部人不擔(dān)當(dāng)當(dāng)風(fēng)險(xiǎn),責(zé)任和開(kāi)銷(xiāo).承租人應(yīng)供給并鋪設(shè)為適合積載和保護(hù)船上貨物所需要的墊艙物料,但全部人有權(quán)決定可否允全部這些墊艙物料在船上的使用.依照本租船合同當(dāng)貨物卸船后,承租人應(yīng)負(fù)責(zé)將其墊料移走并支付移走墊料所需的開(kāi)銷(xiāo),開(kāi)銷(xiāo)的時(shí)間計(jì)入裝卸時(shí)間,直到墊料已經(jīng)移走.(b)CargoHandlingGearUnlesstheVesselisgearlessorunlessithasbeenagreedbetweenthepartiesthattheVessel'sgearshallnotbeusedandstatedassuchinBox15,theOwnersshallthroughoutthedurationofloading/discharginggivefreeuseoftheVessel'scargohandlinggearandofsufficientmotivepowertooperateallsuchcargohandlinggear.Allsuchequipmenttobeingoodworkingorder.Unlesscausedbynegligenceofthestevedores,timelostbybreakdownoftheVessel'scargohandlinggearormotivepower-proratathetotalnumberofcranes/winchesrequiredatthattimefortheloading/dischargingofcargounderthisCharterParty-shallnotcountaslaytimeortimeondemurrage.OnrequesttheOwnersshallprovidefreeofchargecranemen/winchmenfromthecrewtooperatetheVessel'scargohandlinggear,unlesslocalregulationsprohibit專(zhuān)業(yè)資料.this,inwhichlattereventshorelabourersshallbefortheaccountoftheCharterers.Cranemen/winchmenshallbeundertheCharterers'riskandresponsibilityandasstevedorestobedeemedastheirservantsbutshallalwaysworkunderthesupervisionoftheMaster.(b)貨物裝卸設(shè)施除非船上無(wú)裝卸設(shè)施或經(jīng)當(dāng)事協(xié)議不使用船上的裝卸設(shè)施,并在第15欄中載明,全部人在整個(gè)裝卸過(guò)程中能夠自由使用船上的貨物裝卸設(shè)施并使用充分動(dòng)力控制所有這些設(shè)施.全部這些設(shè)施應(yīng)處于優(yōu)秀工作狀態(tài).若是不是由于裝卸人員的馬虎所造成,船上的貨物裝卸設(shè)施或動(dòng)力故障惹起的時(shí)間損失,應(yīng)按發(fā)生故障的設(shè)施占依照本租船合同裝/卸貨物時(shí)所要求的起重機(jī)/起貨機(jī)總數(shù)的比例予以扣減,不計(jì)入裝卸時(shí)間或滯期時(shí)間.若是當(dāng)?shù)匾?guī)定不加禁止.經(jīng)承租人要求,全部人應(yīng)供給由海員充任的起貨機(jī)司機(jī)/起重機(jī)司機(jī)來(lái)縱船上的貨物裝卸設(shè)施,但全部人對(duì)這些司機(jī)其實(shí)不擔(dān)當(dāng)責(zé)任.若是當(dāng)?shù)匾?guī)定不允,岸上的勞動(dòng)力應(yīng)由承租人負(fù)責(zé)聘任.起貨機(jī)司機(jī)/起重機(jī)司機(jī)應(yīng)由承租人擔(dān)當(dāng)風(fēng)險(xiǎn)和責(zé)任,并且作為裝卸人員應(yīng)視為承租人的受雇人,當(dāng)應(yīng)向來(lái)工作在船長(zhǎng)的監(jiān)察之下.(c)StevedoreDamageTheCharterersshallberesponsiblefordamage(beyondordinarywearandtear)toanypartoftheVesselcausedbyStevedores.SuchdamageshallbenotifiedassoonasreasonablypossiblebytheMastertotheCharterersortheiragentsandtotheirStevedores,failingwhichtheCharterersshallnotbeheldresponsible.TheMastershallendeavourtoobtaintheStevedores'writtenacknowledgementofliability.TheCharterersareobligedtorepairanystevedoredamagepriortocompletionof專(zhuān)業(yè)資料.th
