界文化和自然遺產(chǎn)公約保護(hù)世界文化和自然遺產(chǎn)公約考慮到任何文化或自然遺產(chǎn)的壞變或消失都構(gòu)成使世界各國遺產(chǎn)枯竭的有害影手段,以及應(yīng)予保護(hù)的財產(chǎn)的所在國不具備充足的經(jīng)濟(jì)、科學(xué)和技術(shù)力量,于哪國人民的這類罕見且無法替代的財產(chǎn),對全世界人民都很重要,盡管不能代替有關(guān)國家采取的行動,但將成為它的有效補(bǔ)充,價值的文化遺產(chǎn)和自然遺產(chǎn)建立一個依據(jù)現(xiàn)代科學(xué)方法組織的永久性的有效制議上曾決定就此問題制訂一項國際公約,為實現(xiàn)本公約的宗旨,下列各項應(yīng)列為“文化遺產(chǎn)”:古跡:從歷史、藝術(shù)或科學(xué)角度看具有突出的普遍價值的建筑物、碑雕和碑畫、由物質(zhì)和生物結(jié)構(gòu)或這類結(jié)構(gòu)群組地質(zhì)和地文結(jié)構(gòu)以及明確劃為受到定和劃分上面第一條和第二條中提及的、本國第一條和第二條中提及的、本國領(lǐng)土內(nèi)的文化方面的援助和合作。國領(lǐng)土內(nèi)的文化遺產(chǎn)和自 保存和展出第十一條第(二)和第(四)款中提及的文化遺產(chǎn)和自然遺產(chǎn)。 (三)本公約締約國同意不故意采取任何可能直接或間接損害第一條和第二條中施。助第八條(一)在聯(lián)合國教育、科學(xué)及文化組織內(nèi),現(xiàn)建立一個保護(hù)具有突出的(二)委員會委員的選舉須保證均衡地代表世界的不同地區(qū)和不同文化。(三)國際文物保存和修復(fù)研究中心(羅馬中心)的一名代表、國際古跡遺址理第九條(一)世界遺產(chǎn)委員會成員國的任期自當(dāng)選之應(yīng)屆大會常會結(jié)束時起至(三)委員會成員國應(yīng)選派在文化或自然遺產(chǎn)方面有資歷的人員擔(dān)任代表。第十條(一)世界遺產(chǎn)委員會應(yīng)通過其議事規(guī)則。(三)委員會可設(shè)立它認(rèn)為為履行其職能所需的咨詢機(jī)構(gòu)。第十一條(一)本公約各締約國應(yīng)盡力向世界遺產(chǎn)委員會遞交一份關(guān)于本國領(lǐng)(二)根據(jù)締約國按照第(一)款規(guī)定遞交的清單,委員會應(yīng)制訂、更新和出版(三)把一項財產(chǎn)列入《世界遺產(chǎn)目錄》需征得有關(guān)國家同意。當(dāng)幾個國家對某)(六)委員會在拒絕一項要求列入本條第(二)和第(四)款中提及的目錄之一(七)委員會經(jīng)和有關(guān)國家商定,應(yīng)協(xié)調(diào)和鼓勵為擬訂本條第(二)和第(四)第十二條未被列入第十一條第(二)和第(四)款提及的兩個目錄的屬于文化第十三條(一)世界遺產(chǎn)委員會應(yīng)接收并研究本公約締約國就已經(jīng)列入或可能適于列入第十一條第(二)和第(四)款中提及的目錄的本國領(lǐng)土內(nèi)成為文化或(二)當(dāng)初步調(diào)查表明有理由進(jìn)行深入的時候,根據(jù)本條第(一)款中提出的國(四)委員會應(yīng)制訂其活動的優(yōu)先順序并在進(jìn)行這項工作時應(yīng)考慮到需予保護(hù)的(五)委員會應(yīng)制訂、更新和發(fā)表已給予國際援助的財產(chǎn)目錄。(六)委員會應(yīng)就根據(jù)本公約第十五條設(shè)立的基金的資金使用問題作出決定。委加這類資金,并為此目的采取一切有益的措施。(七)委員會應(yīng)和擁有和本公約目標(biāo)相似的目標(biāo)的國際和國家級政府組織和非政護(hù)聯(lián)盟,并可約請公共和私立機(jī)構(gòu)及個人。(八)委員會的決定應(yīng)經(jīng)出席及參加表決的委員的2/3多數(shù)通過。委員會委員的第十四條(一)世界遺產(chǎn)委員會應(yīng)由聯(lián)合國教育、科學(xué)及文化組織總干事任命助工作。第十五條(一)現(xiàn)設(shè)立一項保護(hù)具有突出的普遍價值的世界文化遺產(chǎn)和自然遺(二)根據(jù)聯(lián)合國教育、科學(xué)及文化組織《財務(wù)條例》的規(guī)定,此項基金應(yīng)構(gòu)成(三)基金的資金來源應(yīng)包括:(四)對基金的捐款和向委員會提供的其他形式的援助只能用于委員會限定的目第十六條(一)在不影響任何自愿補(bǔ)充捐款的情況下,本公約締約國同意,每(二)然而,本公約第三十一條或第三十二條中提及的國家均可在交存批準(zhǔn)書、(四)為使委員會得以有效地規(guī)劃其活動,已作本條第(二)款中所述聲明的本屬于上述情況但已當(dāng)選委員會成員的締約國的任期,應(yīng)在本公約第八條第(一)鼓勵設(shè)立旨在為保護(hù)本公約第一條和第二條中合國教育、科學(xué)及文化組織贊助下為世界遺產(chǎn)求對本國領(lǐng)土內(nèi)組成具有突出的普遍價值的文的情報和文件資料。第二十條除第十三條第(二)款、第二十二條3項和第二十三條所述情況外,界遺產(chǎn)委員會業(yè)已決定或可能決定列入第十一條第(二)和第(四)款中所述目錄的文化遺產(chǎn)和自然遺產(chǎn)的財產(chǎn)。第二十一條(一)世界遺產(chǎn)委員會應(yīng)制訂對向它提交的國際援助申請的審議程(三)委員會在作出決定之前,應(yīng)進(jìn)行它認(rèn)為必要的研究和磋商。⒈研究在保護(hù)、保存、展出和恢復(fù)本公約第十一條第(二)和第(四)款所確定第二十五條原則上,國際社會只擔(dān)負(fù)必要工程的部分費用。除非本國資源不許援國應(yīng)在它們簽訂的協(xié)定中,確定關(guān)于獲得根展出。和第二條中確定的文化和自然遺產(chǎn)的贊賞和(二)締約國應(yīng)使公眾廣泛了解對這類遺產(chǎn)造成威脅的危險和為履行本公約進(jìn)行的國際援助的締約國應(yīng)采取適當(dāng)措施,使人們。國在按照聯(lián)合國教育、科學(xué)及文化組織大會確定的立法和行政規(guī)定以及采取的其他行動的情況,并詳述在這方面獲得的經(jīng)驗。(二)應(yīng)提請世界遺產(chǎn)委員會注意這些報告。聯(lián)合國教育、科學(xué)及文化組織會員國根據(jù)各自的(二)向聯(lián)合國教育、科學(xué)及文化組織總干事交存加入書后,加入方才有效。家。第三十五第三十五條(一)本公約締約國均可廢棄本公約。 (二)如大會通過一項全部或部分修訂本公約的新公約,除非新公約另有規(guī)定,本公約應(yīng)從新的修訂公約生效之日起停止批準(zhǔn)、接受或加入。第一百零二條,本公約須應(yīng)聯(lián)合國教育、科學(xué)合國秘書處登記。國教育、科學(xué)及文化組織總干事的簽字,由聯(lián)合國教育、科學(xué)及文化組織存檔,經(jīng)驗明無誤之副本將分送至第三十一條和第三十二條所述之所有國家以及聯(lián)合rotectionoftheworldculturalAndAdoptedbytheGeneralConferenceatitsseventeenthsessionmberEnglishText1NINGTHEPROTECTIONTURALANDNATURALHERITAGEceoftheUnitedNationsEducationalScientificandCulturalOrganizationmeetingbertoNovemberatitsseventeenthsessionthenaturalheritageareincreasinglythreatenedwithdestructionnotonlybythetraditionalcausesofdecaybutalsobychangingsocialandeconomicconditionswhichggravatethesituationwithevenmoreformidablephenomenaofdamageordestructionConsideringthatdeteriorationordisappearanceofanyitemoftheculturalornaturalheritageconstitutesaharmfulimpoverishmentoftheheritageofallthenationsoftheworld,Consideringthatprotectionofthisheritageatthenationalleveloftenremainsincompletebecauseofthescaleoftheresourceswhichitrequiresandoftheinsufficienteconomic,scientific,andtechnologicalesofthecountrywherethepropertytobeprotectedissituatedthattheConstitutionoftheOrganizationprovidesthatitwillmaintainincreaseanddiffusedsheritageandrecommendingtothentionsationsandresolutionsconcerninggonghemitisoftheculturalandnaturalheritageofoutstandingancewithmodernscientificmethodsbjectofaninternationalntionAdoptsthissixteenthdayofNovember1972thisConvention.IDEFINITIONOFTHECULTURALANDNATURALHERITAGEArticle1ForthepurposeofthisConvention,thefollowingshallbeconsideredas"culturalheritage":monuments:architecturalworks,worksofmonumentalsculptureandpainting,elementsorstructuresofanarchaeologicalnature,inscriptions,cavedwellingsandcombinationsoffeatures,whichareofoutstandinguniversalvaluefromthepointofviewofhistory,artorscience;groupsofbuildings:groupsofseparateorconnectedbuildingswhich,becauseoftheirarchitecture,theirhomogeneityortheirplaceinthelandscape,areofoutstandinguniversalvaluefromthepointofviewofrtorsciencesites:worksofmanorthecombinedworksofnatureandman,andareasincludingarchaeologicalsiteswhichareofoutstandinguniversalvaluefromthehistorical,aesthetic,ethnologicaloranthropologicalpointofview.Article2ForthepurposesofthisConvention,thefollowingshallbeconsideredas"naturalheritage":naturalfeaturesconsistingofphysicalandbiologicalformationsorgroupsofsuchformations,whichareofoutstandinguniversalvaluefromtheaestheticorscientificpointofview;geologicalandphysiographicalformationsandpreciselydelineatedareaswhichconstitutethehabitatofalsandplantsofoutstandinguniversalvaluefromthepointofviewofscienceservationlineatednaturalareasofoutstandinguniversalvaluefromthepointofviewofscience,conservationornaturalbeauty.Article3ionedinArticlesandaboverticlenrecognizesthatthedutyofensuringtheidentificationprotectionesentationandtransmissiontofuturegenerationsoftheculturalandnaturalheritagedtoinArticlesandandsituatedonitsterritorybelongsprimarilytothatStateItwilldoallitendtotheutmostofitsownresourcesandwhereappropriatewithanyinternationaldcooperationinparticularfinancialartisticscientificandtechnicalwhichitmaybeabletoobtain.Article5Toensurethateffectiveandactivemeasuresaretakenfortheprotection,conservationandpresentationoftheculturalandnaturalheritagesituatedonitsterritory,eachStatePartytothisConventionshallendeavor,insofaraspossible,andasappropriateforeachcountry:(a)toadoptageneralpolicywhichaimstogivetheculturalandnaturalheritageafunctioninthelifeofthecommunityandtointegratetheprotectionofthatheritageintocomprehensivengprogrammesprotectionconservationandpresentationoftheculturalandnaturalheritagewithanpropriatestaffandpossessingthemeanstodischargetheirfunctionsevelopscientificandtechnicalstudiesandresearchandtoworkoutsuchoperatingsaswillmaketheStatecapableofcounteractingthedangersthatthreatenitsculturalralheritagetaketheappropriatelegalscientifictechnicaladministrativeandfinancialmeasuresrotectionconservationpresentationandrehabilitationofthisrdevelopmentofnationalorregionalcentresfortrainingintheandpresentationoftheculturalandnaturalheritageandtoencouragescientificresearchinthisfield.Article6orytheculturalandnaturalheritagecetopropertyrightprovidedbynationalommunityasawholetocooperateerredtoatedsorequesttatedonsPartiestothisConventionArticle7atheritage.IIIINTERGOVERNMENTALCOMMITTEEFORTHEPROTECTIONOFTHEWORLDCULTURALALHERITAGEticlengtheordinaryicandCulturalatesofthedifferentregionsdculturesoftheworldtionandRestorationofonumentsandSitesaturalnmeetingingeneralassemblyduringtheordinarysessionsoftheGeneralConferenceoftheUnitedNationsScientificandCulturalOrganizationrepresentativesofotherintergovernmentalorattendthemeetingsoftheCommitteeinanadvisorycapacity.ticleeshallextendfromtheendofduringwhichtheyareelecteduntiltheendofitsthirdsubsequentordinarysession.signatedatthetimeofthefirstelectionshalllConferencefollowingthatatwhichfurtherthirdofthemembersdesignatedatthesametimetheGeneralConferencefollowingthatatwhichshallbechosenbylotbythePresidentoftheGeneraltionsEducationalScientificandCulturalOrganizationafterthefirstelectionturalheritageefunctions.Article11yStatePartytothisConventionshallinsofaraspossiblesubmittotheWorldHeritageCommitteeaninventoryofpropertyformingpartoftheculturalandnaturalheritage,situatedinitsterritoryandsuitableforinclusioninthelistprovidedforinparagraph2ofthisArticle.Thisinventory,whichshallnotbeconsideredexhaustive,shallincludedocumentationaboutthelocationofthepropertyinquestionanditssignificance.OnthebasisoftheinventoriessubmittedbyStatesinaccordancewithparagraph1,theCommitteeshallestablishkeepuptodateandpublishunderthetitleof"WorldHeritageList,"alistofpropertiesstheconsentoftheStateconcernedTheonoverwhichisclaimedbymorelinnowayprejudicetherightsofthepartiestothedisputeshkeepuptodateandpublishwhenevercircumstancesshallsorequiregeinDangeralistofthepropertyappearingintheWorldHeritageionsarenecessaryandforwhichassistancehasbeenhallcontainanestimateofthecostofsuchoperationsThemingpartoftheculturalandnaturalheritageasisthreatenedbyhethreatofdisappearancecausedbyaccelerateddeteriorationrbanortouristdevelopmentprojectsdestructioncausedlandmajoralterationsduetounknowncausesabandonmentforanyreasonwhatsoevertheoutbreakorthethreatofanarmedconflict;calamitiesandcataclysms;seriousfires,earthquakes,landslides;volcaniceruptions;changesinwaterlevel,floodsandtidalwaves.TheCommitteemayatanytime,incaseofurgentneed,makeanewentryintheListofWorldHeritageinDangerandpublicizesuchentryimmediately.TheCommitteeshalldefinethecriteriaonthebasisofwhichapropertybelongingtotheculturalornaturalheritagemaybeincludedineitherofthelistsmentionedinparagraphs2and4ofthisarticle.Beforerefusingarequestforinclusioninoneofthetwolistsmentionedinparagraphs2and4ofthisarticle,theCommitteeshallconsulttheStatePartyinwhoseterritorytheculturalornaturalpropertyinquestionissituated.TheCommitteeshallwiththeagreementoftheStatesconcerned,co-ordinateandencouragethestudiesandresearchneededforthedrawingupofthelistsreferredtoinparagraphs2and4ofthisarticle.Article12otheculturalornaturalheritagehasnotbeenincludedineitherofthearagraphsandofArticleshallinnowaybeconstruedtomeanthatitdoesotherthanthoseresultingfrominclusionintheselists.Article131.TheWorldHeritageCommitteeshallreceiveandstudyrequestsforinternationalassistanceformulatedbyStatesPartiestothisConventionwithrespecttopropertyformingpartoftheculturalornaturalheritage,situatedintheirterritories,andincludedorpotentiallysuitableforinclusioninthelistsmentionedreferredtoinparagraphs2and4ofArticle11.Thepurposeofsuchrequestsmaybetosecuretheprotection,conservation,presentationorrehabilitationofsuchproperty.RequestsforinternationalassistanceunderparagraphofthisarticlemayalsobeconcernedwithdentificationofculturalornaturalpropertydefinedinArticlesandwhenpreliminaryinvestigationshaveshownthatfurtherinquirieswouldbejustified.TheCommitteeshalldecideontheactiontobetakenwithregardtotheserequests,determinewhereappropriatethenatureandextentofitsassistanceandauthorizetheconclusion,onitsbehalf,ofthenecessaryarrangementswiththegovernmentconcerned.TheCommitteeshalldetermineanorderofprioritiesforitsoperations.Itshallinsodoingbearinmindtherespectiveimportancefortheworldculturalandnaturalheritageofthepropertyrequiringprotection,theneedtogiveinternationalassistancetothepropertymostrepresentativeofanaturalenvironmentorofthegeniusandthehistoryofthepeoplesoftheworld,theurgencyoftheworktobedone,theurcesavailabletotheStatesonwhoseterritorythethreatenedpropertyissituatedandinparticulartheextenttowhichtheyareabletosafeguardsuchpropertybytheirownmeans.TheCommitteeshalldrawupkeepuptodateandpublicizealistofpropertyforwhichinternationalassistancehasbeengranted.8TheCommitteeshalldecideontheuseoftheresourcesoftheFundestablishedunderArticle15ofthisConventionItshallseekwaysofincreasingtheseresourcesandshalltakeallusefulstepstothisend.7.TheCommitteeshallco-operatewithinternationalandnationalgovernmentalandnon-governmentalorganizationshavingobjectivessimilartothoseofthisConvention.Fortheimplementationofitsprogrammesandprojects,theCommitteemaycallonsuchorganizations,particularlytheInternationalCentrefortheStudyofthePreservationandRestorationofCulturalProperty(theRomeCentre),thendSitesICOMOSandtheInternationalUnionforConservationofatureandNaturalResourcesIUCNaswellasonpublicandprivatebodiesandindividualsoftheCommitteeshallbetakenbyamajorityoftwothirdsofitsmemberspresentandvoting.AmajorityofthemembersoftheCommitteeshallconstituteaquorum.Article14retariatappointedbytheDirectorGeneraloftheUnitedNationsEducationalScientificandCulturalOrganization.ationsEducationalScientificandCulturalOrganizationutilizingtionalCentrefortheStudyofthePreservationandretheInternationalCouncilofMonumentsandesourcesIUCNincumentationandortheimplementationofitsdecisionsiclestablishedlationsofntificandCulturalOrganizationfrganizationotherorganizationsoftheUnitedrammeorotherintergovernmentaldualsoftheFundsorganizedforthebenefitofthefundandtionsasdrawnupbytheWorldHeritageCommittee.rformsofassistancemadeavailabletotheCommitteemaybeTheCommitteemayacceptcontributionstoedthattheCommitteeshallhavedecidedontheditionsmaybeattachedtocontributionsmadetotheFundArticle6atesPartiestothisConventionldHeritageFundcontributionstheamountofgeapplicabletoallStatesshallbedeterminedbytheGeneralestotheConventionmeetingduringthesessionsoftheGeneralConferenceofnalScientificandCulturalOrganizationThisdecisionoftheGeneralajorityoftheStatesPartiespresentandvotingwhichhavenotmadethenparagraphofthisArticleInnocaseshallthecompulsorycontributionofStatesPartiestotheConventionexceedofthecontributiontotheregularbudgetoftheUnitedNationsEducational,ScientificandCulturalOrganization.phofthisArticleofthisConventioncleculturalandnaturalheritageasdefinedinArticles1and2ofthisConvention.Article18TheStatesPartiestothisConventionshallgivetheirassistancetointernationalfund-raisingcampaignsorganizedfortheWorldHeritageFundundertheauspicesoftheUnitedNationsEducational,ScientificandCulturalOrganizationTheyshallfacilitatecollectionsmadebythebodiesmentionedinparagraph3ofArticle15forthispurpose.VCONDITIONSANDARRANGEMENTSFORINTERNATIONALASSISTANCEArticle19AnyStatePartytothisConventionmayrequestinternationalassistanceforpropertyformingpartoftheculturalornaturalheritageofoutstandinguniversalvaluesituatedwithinitsterritory.ItshallsubmitwithitsrequestsuchinformationanddocumentationprovidedforinArticleasithasinitspossessionandaswillenabletheCommitteetocometoadecision.rticleSubjecttotheprovisionsofparagraphofArticle,sub-paragraph(c)ofArticle22andArticle23,nternationalassistanceprovidedforbythisConventionmaybegrantedonlytopropertyformingpartoftheculturalandnaturalheritagewhichtheWorldHeritageCommitteehasdecided,ormaydecide,toenterinoneofthelistsmentionedinparagraphs2and4ofArticle11.rticleitageCommitteeshalldefinetheprocedurebywhichrequeststoitforinternationalassistanceshallbeconsideredandshallspecifythecontentoftherequestwhichshoulddefinetheoperationcontemplatedtheworkthatisnecessarytheexpectedcostthereof,thedegreeofurgencyandthereasonswhytheresourcesoftheStaterequestingassistancedonotallowittomeetalltheexpenses.Suchrequestsmustbesupportedbyexperts'reportswheneverpossible.lamitiesshouldbyreasonsoftheurgentworkwhichtheynbytheCommitteewhichshouldhaveareservefundatitsdisposalagainstsuchcontingencies.hallcarryoutsuchstudiesandconsultationsasitdeemsnecessary.cleHeritageFundmaytakethefollowingformscalproblemsraisedbytheprotectionrehabilitationoftheculturalandnaturalheritageasdefinedinthisConventionensurethattheapprovedworkiscorrectlydofidentificationprotectionconservationturalandnaturalheritagetpossessorisnotinapositiontoacquireberepayableonalongtermbasisonalcasesandforspecialreasonsofnonrepayablesubsidiescleinternationalassistancetonationalorregionalcentreslllevelsinthefieldofidentificationprotectionconservationrehabilitationoftheculturalandnaturalheritagerticleydetailedscientificeconomicandtechnicalonthemostadvancedtechniquesfortheprotectionconservationuralandculturalheritageandshallbeconsistentwiththestudiesshallalsoseekmeansofmakingrationaluseoftheresourcesavailableintheStateconcerned.cleAsageneralruleonlypartofthecostofworknecessaryshallbebornebytheinternationalcommunityitingfrominternationalassistanceshallconstituteasubstantialshareeresourcesdevotedtoeachprogrammeorprojectunlessitsresourcesdonotpermitthisclendtherecipientStateshalldefineintheagreementtheyconcludetheprojectforwhichinternationalassistanceunderthetermsofthisiedoutItshallbetheresponsibilityoftheStatereceivingsuchntinuetoprotectconserveandpresentthepropertysosafeguardedinobservanceoftheconditionslaiddownbytheagreement.ALPROGRAMMEScledeavorbyallappropriatemeansandinparticularbyestostrengthenappreciationandrespectbytheirpeoplesoftheculturalandnaturalheritagedefinedinArticlesandoftheConvention.epublicbroadlyinformedofthedangersthreateningthisheritageandoftheactivitiescarriedoninpursuanceofthisConvention.rticletatesPartiestothisConventionwhichreceiveinternationalassistanceundertheConventionshalltakeappropriatemeasurestomakeknowntheimportanceofthepropertyforwhichassistancehasbeenreceivedandtheroleplayedbysuchassistance.IREPORTSrticlePartiestothisConventionshallinthereportswhichtheysubmittotheGeneralConferenceoftheUnitedNationsEducational,ScientificandCulturalOrganizationondatesandinartobedeterminedbyitgiveinformationonthelegislativeandadministrativeprovisionswhichuiredinthisfieldmitteeonLCLAUSESiclenisdrawnupinArabicEnglishFrenchRussianandSpanishthefivetextsbeingequallyauthoritative.icleprocedures.eneraloftheUnitedalOrganizationizationtoaccedetoitrectorGeneralofScientificandCulturalOrganizationtofthetwentiethichhaveccessiononorbeforethatdateItitsinstrumentofeoraccessionhichhaveafederaloralfederalorcentralgovernmentlStatesaljurisdictionofindividualconstituentStates,countries,provincesorcantonsthatarenotobligedbytheconstitutionalsystemofthefederationtotakelegislativemeasures,thefederalgovernmentshallinformthecompetentauthor
