航空包機(jī)運(yùn)輸條款(中英文對(duì)照)航空包機(jī)運(yùn)輸條款TERMSANDCONDITIONSFORTHETRANSPORTOFAIRCHARTERFLIGHTSTABLEOFCONTENTS第一章適用范圍Chapter1ApplicableScope第二章包機(jī)手續(xù)Chapter2CharterProcedure第三章乘機(jī)手續(xù)Chapter3BoardingProcedure第四章標(biāo)準(zhǔn)空中服務(wù)Chapter4StandardAirService第五章標(biāo)準(zhǔn)地面服Chapter5StandardGroundService第六章收費(fèi)服務(wù)Chapter6PaymentServices第七章財(cái)務(wù)條款Chapter7TermsofFinance第八章保險(xiǎn)條款Chapter8TermsofInsurance第九章價(jià)格條Chapter9TermsofPrice第十章延誤條款Chapter10TermsofDelay第十一章?急救條款Chapter11TermsofFirstAid第十二章?衛(wèi)星通信收費(fèi)標(biāo)準(zhǔn)Chapter12ChargeStandardforSatelliteCommunicationService第十三章?不可抗力情況下收費(fèi)原則Chapter13ChargingPrinciplesforForceMajeureCases第十四章?危險(xiǎn)地區(qū)飛行收費(fèi)Chapter14ChargeforFlightinDangerousRegion第十五章?特殊機(jī)場(chǎng)飛行條款Chapter15FlightTermsofSpecialAirports第十六章?航務(wù)申請(qǐng)條款Chapter16TermsofAirportApplication第十七章?行李物品攜帶條款Chapter17Luggageoritemscarryingterms第十八章?定義Chapter18Definition部分章節(jié)示例如下：第五條承運(yùn)人根據(jù)包機(jī)人飛行意向提供報(bào)價(jià)單。Article5TheCARRIERshallprovidequotationinaccordancewiththeflightintentionoftheCHARTERER.包機(jī)人確認(rèn)飛行后承運(yùn)人為包機(jī)人提供包機(jī)運(yùn)輸合同及《乘客保障信息單》（客戶填寫內(nèi)容包括航線、日期、時(shí)刻、人數(shù)、乘客姓名、證件名稱、證件號(hào)碼、行李重量、接送車輛、飛行各站聯(lián)系人及聯(lián)系方式、機(jī)上餐食要求等其他服務(wù)要求的詳細(xì)信息,詳見附件六）。AftertheCHARTERERhasconfirmedtheflight,theCARRIERshallprovidetheCHARTERERwithCharterFlightContractandFlightServiceInformationForm(seeAppendixVIforthecontentfilledinbytheclient,includingthespecificinformationofflightroute,date,time,passengernumber,passengername,credentialname,credentialNo.,luggageweight,pickingupvehicle,contactpersonandcontactinformationofeachflightstation,flightcateringrequirementsandotherservicerequirements).(一)如包機(jī)人在飛行過程中出現(xiàn)起飛時(shí)刻，飛行日期，任務(wù)航段、乘客信息、各地機(jī)場(chǎng)接送機(jī)聯(lián)系人或車輛等一切和飛行有關(guān)的信息變更，包機(jī)人有責(zé)任第一時(shí)間通知承運(yùn)人。(1)Incasethere’schangeofinformationrelevanttotheflightincludingdeparturetime,flightdate,missionflightleg,passengerinformation,contractpersonforpickupserviceineachairport,orvehicle,theCHARTERERhastheresponsibilitytoinformtheCARRIERimmediately.(二)包機(jī)人應(yīng)保證每位乘客持有符合中國民航現(xiàn)行規(guī)定的有效證件，進(jìn)出境乘客應(yīng)保證持有相關(guān)國家要求的有效旅行證件，國際飛行應(yīng)遵守各國航空管制規(guī)定和法律規(guī)定。(2)TheCHARTERERshallguaranteethateachpassengerholdsthevalidcredentialcomplyingwiththeexistinglawsandregulationsbyChinaCivilAviation.Thecrossingpassengershallguaranteetoholdvalidtravelcredentialsrequiredbyrelevantcountry,andinternationalflightshallfollowtheairtrafficcontrolstipulationsandlegalregulationsofeachcountry.(三)由于包機(jī)人原因（如身份證、護(hù)照等證件與本人身份不符，或攜帶民航和國家法律法規(guī)規(guī)定的危險(xiǎn)品登機(jī)，或不能按合同規(guī)定時(shí)間準(zhǔn)時(shí)登機(jī)等）包機(jī)人未能按約定時(shí)間執(zhí)行或未能履行簽訂的飛行計(jì)劃，承運(yùn)人不負(fù)責(zé)因此導(dǎo)致未能飛行產(chǎn)生的后果，對(duì)于飛行計(jì)劃中未執(zhí)行的部分包機(jī)款，承運(yùn)人應(yīng)返還包機(jī)人，但包機(jī)人應(yīng)承擔(dān)未執(zhí)行該飛行任務(wù)而產(chǎn)生的實(shí)際費(fèi)用。(3)TheCARRIERshallbeexemptedfromtheliabilityforbreachofContractforfailuretoimplementthescheduledflightmissioninlightofthereasonscausedbytheCHARTERER(suchascredential(IDorpassport)notbeingconsistentwithone’sidentity,carryinganydangerousgoodsprohibitedbycivilaviationandstatelawsandregulations,orpassenger’sdelayedboarding).TheCARRIERshallreturntheunimplementedcharterexpensetotheCHARTERER,butCHARTERERshallassumeanyexpensesarisingtherefrom.(四)包機(jī)人如租用多架承運(yùn)人飛機(jī)，需事先將每架飛機(jī)乘坐的乘客名單提供給承運(yùn)人。(4)IncasetheCHARTERERrentsmultipleaircrafts,he/sheshallprovideCARRIERwiththepassengerlistforeachaircraft.(五)根據(jù)民航有關(guān)規(guī)定，如乘客攜帶行李超過承運(yùn)人機(jī)型限制范圍，承運(yùn)人可協(xié)助乘客辦理地面轉(zhuǎn)運(yùn)或儲(chǔ)存，費(fèi)用由乘客自理。如乘客堅(jiān)持要求攜帶超額行李乘坐公務(wù)機(jī)，承運(yùn)人有權(quán)拒絕起飛。如乘客攜帶特殊行李請(qǐng)?zhí)崆白稍兂羞\(yùn)人。(5)Accordingtotherelevantstipulationsbycivilaviation,incasethepassengercarriestheluggageexceedingthelimitedrangeofthejettype,theCARRIERmayassistthepassengeringroundtransferorstorageandtheexpenseshallbepaidbythepassenger.Ifthepassengerstillinsiststotaketheextraluggageonboard,thecarriershallbeentitledtorefusetoprovideflightservices.Incaseofspecialluggage,thepassengershallconsulttheCARRIERinadvance.(六)如因承運(yùn)人原因無法安排合同中原定機(jī)型執(zhí)行飛行，承運(yùn)人將免費(fèi)為包機(jī)人升級(jí)至更高級(jí)別機(jī)型保障飛行，若因包機(jī)人拒絕機(jī)型調(diào)配，則簽訂的包機(jī)合同可被終止，雙方承擔(dān)各自的損失。承運(yùn)人機(jī)型等級(jí)順序從低到高依次為“豪客系列→灣流200系列→灣流IV→灣流V→灣流450系列→達(dá)索7X→灣流550→BBJ1→BBJ2－ACJ”。（6）IncasetheplannedjettypeinthecontractisnotavailablebecauseoftheCARRIER,theCARRIERshallprovideahigherleveljettypefortheCHARTERER.IftheCHARTERERrefusestoacceptthejetadjustment,thecontractshallbeended.TheCHARTERERandtheCARRIERshouldassumetheirrespectiveexpensesderivingtherefrom.第六條包機(jī)人按照合同規(guī)定時(shí)間支付包機(jī)款。Article6TheCHARTERERshallpaythecharterexpenseinaccordancewiththeContract.第七條承運(yùn)人為包機(jī)人在指定保險(xiǎn)公司承保。Article7TheCARRIERshallunderwritefortheCHARTERERinspecifiedinsurancecompany.第八條承運(yùn)人在起飛前一天向包機(jī)聯(lián)系人提供航線各機(jī)場(chǎng)地面代理聯(lián)系方式，由各機(jī)場(chǎng)地面代理與包機(jī)聯(lián)系人直接聯(lián)系并約定飛行當(dāng)日迎候乘客的時(shí)間和地點(diǎn)。Article8TheCARRIERshallprovidethechartercontactpersonwithcontactinformationofeachairport'sgroundagentonedaybeforetheflight,sothegroundagentcandirectlycontactthechartercontactpersontodecidethetimeandlocationtomeetthepassengers.第九條飛行當(dāng)日起飛前一至二小時(shí)確認(rèn)乘客到達(dá)當(dāng)?shù)貦C(jī)場(chǎng)的時(shí)間，并通報(bào)各保障單位做好飛行前準(zhǔn)備，根據(jù)約定的時(shí)間，機(jī)場(chǎng)地面代理在約定地點(diǎn)接引乘客進(jìn)場(chǎng)、協(xié)助乘客辦理相關(guān)入場(chǎng)手續(xù)。Article9Confirmthearrivaltimeoneortwohoursbeforethedepartureandinformallsupportunitstowellpreparefortheflight.Inaccordancewiththeagreedtime,theairportgroundagentmeetsandguidesthepassengerstoentertheairportatagreedlocationandhelpthemgothroughrelevantboardingprocedure.第十條執(zhí)行包機(jī)飛行。Article10Thechartertakestheflight.第十一條?飛機(jī)抵達(dá)目的地前當(dāng)?shù)氐孛娲硖崆芭c迎接乘客的接機(jī)人取得聯(lián)系，通知等候乘客的時(shí)間和地點(diǎn)。Article11Beforearrivingatthedestination,thelocalgroundagentshallcontactthepick-uppersoninadvancetoinformthepick-uptimeandlocation.第十二條?飛機(jī)降落后當(dāng)?shù)貦C(jī)場(chǎng)地面代理安排乘客出場(chǎng)并送乘客至前來接機(jī)的車輛旁。Article12Aftertheaircraftislanded,thelocalairportgroundagentshallarrangethepassengerstoexittheairportandsendthemtothepick-upvehicle.第十三條?飛行結(jié)束后承運(yùn)人征詢包機(jī)人的飛行意見，承運(yùn)人在接收到包機(jī)人提出的意見或投訴后需要在5個(gè)工作日內(nèi)給予包機(jī)人回復(fù)處理意見或辦法。Article13Aftertheflight,theCARRIERshallaskCHARTERERforideasorcommentsontheflightandprovidetreatmentplanormethodwithin5workdaysafterreceivingtheopinionorcomplaint.第三章乘機(jī)手續(xù)Chapter3BoardingProcedure第十四條?國內(nèi)飛行乘客需要在起飛前20分鐘抵達(dá)起飛地機(jī)場(chǎng)，國際飛行乘客需要在起飛前2小時(shí)抵達(dá)起飛地機(jī)場(chǎng)；Article14Thedomesticflightpassengershallarriveattheairport20minutesbeforethedeparture,andinternationalflightpassengershallarriveattheairport2hoursbeforethedeparture.第十五條?北京出港航班：送乘客車輛停在貴賓室停車場(chǎng)，乘客走VIP通道過安檢，上貴賓擺渡車到達(dá)飛機(jī)下。Article15ForBeijingoutboundflights:thepick-upvehicleshallstopattheparkinglotfortheVIProom.ThepassengersgothroughthesafetyinspectionbyVIPpassageandarriveattheaircraftbyVIPshuttle.第十六條?北京進(jìn)港航班：乘客下飛機(jī)后上貴賓擺渡車，擺渡到機(jī)坪出口乘客接機(jī)車輛等候處。Article16Beijinginboundflights:aftergettingofftheaircraft,thepassengersgetontheVIPshuttleandtheshuttlesendsthemtopick-upvehiclesattheexit.第十七條?包機(jī)人在飛行及進(jìn)出機(jī)場(chǎng)過程中需隨身攜帶有效證件。Article17TheCHARTERERshallbringvalidcredentialalongduringflightandwhenenteringandexitingtheairport.第十八條?根據(jù)《中國民航乘客規(guī)定》，如乘客攜帶貴重物品乘機(jī)，需事先在《乘客保障信息單》中注明所帶物品清單并嚴(yán)格遵守國家與民航的法律法規(guī)，如未事先聲明，造成的任何后果，由包機(jī)人自行承擔(dān)。Article18InlinewithPassengerRequirementsofCivilAviationAdministrationofChina,passengersbringingpreciousitemsshallidentifythecarryingitemsinPassengerGuaranteeInformationFormandstrictlycomplywiththelawsandregulationsofChinaandcivilaviation.Ifnotstatedinadvance,theCHARTERERshallbeartheconsequencesarisingtherefrom.第十九條?貴重物品的性質(zhì)、價(jià)值等應(yīng)符合相關(guān)的國際規(guī)定和承運(yùn)人規(guī)定，如乘客攜帶危險(xiǎn)品或違禁物品，造成的任何后果，由包機(jī)人承擔(dān)。Article19ThenatureandvalueofpreciousitemsshallcomplywithrelevantinternationalstipulationsandCARRIERregulations.IncasepassengerscarrydangerousgoodsorprohibiteditemsspecifiedbyPassengerRequirementsofCivilAviationAdministrationofChina,theCHARTERERshallbeliableforanyconsequencesarisingtherefrom.第二十條如乘客攜帶小動(dòng)物，需參照《中國民用航空旅客、行李國內(nèi)運(yùn)輸規(guī)則》中關(guān)于小動(dòng)物的規(guī)定。Article20PassengerscarryingsmallanimalsinthecourseofdomesticflightsshallabidebyregulationsonliveanimalstipulatedbyChina'scivilaviationpassengers,baggage,domestictransportationrules.第二十一條包機(jī)人須認(rèn)真了解前往國家和地區(qū)的證件要求，并應(yīng)保證每位乘機(jī)人持有有效證件。承運(yùn)人可按時(shí)提醒并協(xié)助包機(jī)人辦理相關(guān)證件手續(xù)，但由于包機(jī)人所提供的乘客證件與本人不符、失效或不符合前往國家或地區(qū)的相關(guān)規(guī)定而導(dǎo)致飛行未能按合同約定時(shí)間執(zhí)行或取消時(shí)，由包機(jī)人承擔(dān)所有相應(yīng)的責(zé)任，與承運(yùn)人無關(guān)。承運(yùn)人應(yīng)返還包機(jī)人合同中未執(zhí)行航段費(fèi)用，但包機(jī)人需承擔(dān)因此而產(chǎn)生的實(shí)際費(fèi)用，所有涉及乘客相關(guān)責(zé)任的問題，包機(jī)人和承運(yùn)人有義務(wù)向乘客傳達(dá)。Article21TheCHARTERERshallensurethateachpassengerholdsvaliddocuments.IncasepassengerdocumentsprovidedbytheCHARTERERareinconsistentorinvalid,theCHARTERERshallassumeallresponsibilitiesincurredbyfailingtooperatetheflightonagreedscheduleunderthecontractorflightcancellation.TheCARRIERshallrefundthefeeofunimplementedfightlegstotheCHARTERERaccordingtothecontract,buttheCHARTERERshallpaytheactualcostsarisingtherefrom.AllissuesrelatedtotheliabilitiesofpassengersshallbecommunicatedtopassengersbytheCHARTERERandCARRIER.第二十二條包機(jī)人所執(zhí)行的航線涉及到中國境內(nèi)外的相關(guān)機(jī)場(chǎng)時(shí)，乘客應(yīng)自覺遵守相關(guān)的機(jī)場(chǎng)規(guī)定，如有違反而導(dǎo)致的法律責(zé)任和刑事責(zé)任，由乘客自行承擔(dān)。Article22PassengersshouldconsciouslyabidebyregulationsstipulatedbyrelevantdomesticairportswheretheCHARTERERimplementstheflightroutes.Thepassengershouldbearlegalandcriminalliabilitiesderivingtherefrominsuredbyhimselforherself.第二十三條包機(jī)人乘坐北京首都國際機(jī)場(chǎng)進(jìn)出港國際航班時(shí)，需由客人本人填寫中華人民共和國海關(guān)統(tǒng)一制作的《進(jìn)出境旅客行李物品申報(bào)單》并簽字，銷售代表、乘務(wù)員、地面服務(wù)人員等均不得代客人填寫；Article23?TheCharterneedtofillintheChinaCustomsLuggageDeclarationFormswhenChartertakeinternationalflightsinandoutofChinabyBeijingcapitalinternationalairport,salesrepresentatives,cabincrews,groundservicestaffsarenotallowedtofilloutInsteadofCharter.第二十四條合同中提到的兒童，是指年齡滿兩周歲但不滿十二周歲的人。?Article24Childrenmentionedinthecontractarepassengersovertwo(2)butlessthantwelve(12)yearsofage.第四章標(biāo)準(zhǔn)空中服務(wù)Chapter4StandardAirService第二十五條承運(yùn)人會(huì)根據(jù)航程時(shí)刻信息，結(jié)合機(jī)型特點(diǎn)、乘客國籍、宗教信仰、身體狀況（是否有糖尿病、高血壓等）安排餐食。Article25Basedontheflighttime,TheCARRIERwillarrangethecateringbycombiningthejettypefeatures,passenger'snationality,religion,physicalcondition(whetherthere’sdiabetesmellitus,highbloodpressure,etc).第二十六條在自身具備配餐公司的機(jī)場(chǎng)，參照海南航空頭等艙標(biāo)準(zhǔn)配備餐食；在自身不具備配餐公司的機(jī)場(chǎng)，由機(jī)場(chǎng)代理或乘務(wù)員從星級(jí)酒店或高檔餐廳外購。外購餐食受航班起飛時(shí)刻、包機(jī)人指定地點(diǎn)衛(wèi)生條件、運(yùn)輸保存等條件限制，承運(yùn)人不承擔(dān)因以上不可控情況而產(chǎn)生的餐食安全和質(zhì)量責(zé)任。Article26TheairportswithcateringcompanyshallpreparethecateringbyreferringtofirstclassstandardofHainanAirlines,andairportswithoutcateringcompanyshallhavetheairportagentorflightattendantsbuyfoodfromstarhotelorfirstclassrestaurant.Outsourcingmealsischarteredflightdeparturetime,designatedplacesanitation,transportation,preservationconditions,suchasmorethanthecarrierdoesnotundertakebecauseofuncontrolledsituationoffoodsafetyandqualityresponsibility.第十一章急救條款Chapter11TermsofFirstAid第六十九條執(zhí)行急救飛行任務(wù)前，包機(jī)人須向承運(yùn)人提交病人的醫(yī)療報(bào)告、攜帶醫(yī)療設(shè)備清單、呈民航局總調(diào)度室關(guān)于急救飛行航線申請(qǐng)函、急救飛行免責(zé)聲明等材料；Article69TheCHARTERERshallprovidetheCARRIERwiththepatient'smedicalreport,listofmedicalequipmenttransport,applicationletteronfirst-aidflightroutesubmittedtothegeneralcontrolcenterofCivilAviationAdministrationofChina,andtheDisclaimerofFirst-aidFlightbeforetheimplementationoffirst-aidflightmission;第七十條?在飛行過程中，如承運(yùn)人發(fā)現(xiàn)病人的病情與提交的醫(yī)療報(bào)告不符，承運(yùn)人可以拒載并要求包機(jī)人承擔(dān)已發(fā)生的全部費(fèi)用，同時(shí)承運(yùn)人保留因包機(jī)人有意隱瞞患者實(shí)際病況而引發(fā)不良后果的追償與索賠權(quán)利；Article70IncasetheCARRIERfindsthatthepatient'sconditiondoesnotconformtothesubmittedmedicalreportinthecourseofflight,theCARRIERmayrefusetotakethepassengerandrequiretheCHARTERERtopayallexpensesincurredthereof;meanwhile,theCARRIERreservesclaimsofrecoveryandrightsofindemnityforadverseconsequencescausedbytheCHARTERERwhointendstoconcealtheactualconditionofthepatient;第七十一條如承運(yùn)人發(fā)現(xiàn)包機(jī)人攜帶醫(yī)療設(shè)備與提交的醫(yī)療設(shè)備清單不符，承運(yùn)人可以拒載并要求包機(jī)人承擔(dān)已發(fā)生的全部費(fèi)用；Article71IncasetheCARRIERfindsthatthemedicalequipmentcarriedbytheCHARTERERdoesnotconformtothesubmittedlist,theCARRIERmayrefusetotaketheequipmentandrequiretheCHARTERERtopayallexpensesincurredthereof;第七十二條?急救飛行免責(zé)聲明需在飛行前由患者親屬或患者授權(quán)代理人簽字后提交給承運(yùn)人，承運(yùn)人在飛行前未收到該協(xié)議，有權(quán)拒載；Article72TheDisclaimerofFirst-aidFlightshallbesubmittedtotheCARRIERuponthesignatureofthepatient’srelativeorauthorizedrepresentativepriortotheflight.TheCARRIERshallhavetherighttorefusetocarrythepatientwithouttheagreementpriortotheflight;第七十三條承運(yùn)的病人如患有傳染性疾病，但是不處于傳染期，則應(yīng)當(dāng)出示醫(yī)生證明以及第三方出具的非傳染性證明方可承運(yùn)；急救公司還應(yīng)負(fù)責(zé)在急救飛行結(jié)束后對(duì)飛機(jī)進(jìn)行消毒或支付消毒所需費(fèi)用；Article73Incasethepatientsuffersfrominfectiousdiseases,butnotintheinfectiousperiod,amedicalcertificateandnon-infectiouscertificateissuedbythethirdpartyshouldbesubmittedbeforetheflight;thefirst-aidcompanyshallberesponsibletosterilizetheaircraftattheendoftheflightandpaythesterilizationfee;第七十四條?如急救飛行為地區(qū)或國際航線，包機(jī)人需在飛行前按照各地機(jī)場(chǎng)及航空局的要求提供三關(guān)函及英文的醫(yī)療報(bào)告。Article74Incasethefirst-aidflightisimplementedatregionalorinternationalflightroute,theCHARTERERshallsubmitthreerelatedlettersandmedicalreportinEnglishbeforetheflightinaccordancewiththerequirementsofcorrespondingairportandairportaviationauthority.第七十五條?急救氧氣瓶配備規(guī)定：Article75OxygenCylinderAllocationRegulation:（一）合同負(fù)責(zé)人在與包機(jī)人簽訂《北京首都航空有限公司急救運(yùn)輸服務(wù)合同》或《上海金鹿公務(wù)航空有限公司急救運(yùn)輸服務(wù)合同》前，應(yīng)向包機(jī)人確定此次急救飛行中所需每瓶氧氣瓶的容量和瓶數(shù)（如需配備120升的氧氣瓶2瓶，311升的氧氣瓶1瓶）；（1）BeforethesigningofFirst-aidTransportationServiceContractofBeijingCapitalAirlinesCo.,LtdorFirst-aidTransportationServiceContractofShanghaiDeerJetAirlinesCo.,Ltd,thechartershouldinformthecarrierofthenumberandthecapacityofoxygencylinderneeded.(Forexample,120L:2;311L:1)（二）合同負(fù)責(zé)人需將包機(jī)人所需氧氣瓶瓶數(shù)、容量及收費(fèi)金額在急救運(yùn)輸服務(wù)合同正文“行程登記表”及報(bào)價(jià)單中注明清楚；（2）ThepersoninchargeofcontractsigningshouldstateclearlythenumberandcapacityofoxygencylinderneededandthechargeamountintheFlightRouteRegistrationFormoftheFirst-aidTransportationServiceContractaswellasthequotationlist.（三）簽訂急救運(yùn)輸服務(wù)合同后，如因包機(jī)人原因原定氧氣瓶數(shù)量需要減少或飛行結(jié)束后尚有剩余，則承運(yùn)人不退還未使用完畢的氧氣瓶費(fèi)用；（3）AfterthesighingoftheFirst-aidTransportationServiceContract,thecartercannotreducethenumberofoxygencylinderandthecarrierwillnotrefundthechargeoftheoxygenleft.（四）簽訂急救運(yùn)輸服務(wù)合同后，如因承運(yùn)人原因無法按照包機(jī)人要求提供所需氧氣瓶數(shù)量，則承運(yùn)人應(yīng)根據(jù)最終提供的氧氣瓶數(shù)量重新計(jì)算報(bào)價(jià)并簽訂合同，同時(shí)需將剩余氧氣瓶款項(xiàng)退還包機(jī)人；（4）WhenthecarriercannotprovideenoughoxygencylindersasrequiredbythecharterafterthesigningoftheFirst-aidTransportationServiceCont
