應(yīng)提前5天以書面形式通知承包人，并在通知中寫明替換者的姓名、職務(wù)、職權(quán)、權(quán)限和任命時間。Theemployershould,ifreplacementofitschiefengineer,notifythecontractorinwritingfivedaysinadvanceandstatethename,position,authority,powerlimitedandappointmenttimeofthereplacementtherein.第3條承包人Contractor3.1承包人的主要權(quán)利和義務(wù)Contractor'smainrightsandobligations3.1.1承包人應(yīng)按照合同約定的標(biāo)準(zhǔn)、規(guī)范、工程的功能、規(guī)模、考核目標(biāo)和竣工日期，完成設(shè)計、采購、施工、竣工試驗和（或）指導(dǎo)竣工后試驗等工作，不得違反國家強制性標(biāo)準(zhǔn)、規(guī)范的規(guī)定。本工程的具體承包范圍，應(yīng)依據(jù)合同協(xié)議書第一項“工程概況”中有關(guān)“工程承包范圍”的約定。Thecontractorshould,subjecttothestandards,specifications,functions,scale,assessmentobjectivesandcompletiondatesoftheprojectasstipulatedinthecontract,completetheworksofdesign,procurement,construction,completionoftestsand/orguidanceforpost-completiontestingetc.andshallnotviolatetheprovisionsofthecompulsorystandardsandnormsofState.Thespecificcontractedscopeofthisprojectshallbesubjecttotheagreementofthe"ScopeofProjectContracting"ofthefirstitemof"ProjectGeneralView"inthecontractagreement.3.1.2承包人應(yīng)按合同約定，自費修復(fù)因承包人原因引起的設(shè)計、文件、設(shè)備、材料、部件、施工中存在的缺陷、或在竣工試驗和竣工后試驗中發(fā)現(xiàn)的缺陷。Thecontractorshall,asthestipulationshereof,athisownexpense,repairthedefectsduetothecontractor’sreason,inthedesign,documents,equipment,materials,components,construction,orfoundinthecompletionandpost-completiontests.3.1.3承包人應(yīng)按合同約定和發(fā)包人的要求，提交相關(guān)報表。報表的類別、名稱、內(nèi)容、報告期、提交時間和份數(shù)，在專用條款中約定。Thecontractorshallsubmittherelevantreportsastheagreementofcontractandtherequirementsofthecontractor,andthecategory,name,content,reportingperiod,submissiontimeandnumberofcopiesshallbespecifiedintheparticularcondition.3.1.4承包人有權(quán)根據(jù)4.6.4款承包人的復(fù)工要求、14.9款付款時間延誤和17條不可抗力的約定，以書面形式向發(fā)包人發(fā)出暫停通知。除此之外，凡因承包人原因的暫停，造成承包人的費用增加由其自負(fù)，造成關(guān)鍵路徑延誤的應(yīng)自費趕上。Thecontractorshall,inaccordancewiththearticle4.6.4[Contractor'sRequestforResumptionofWork],article14.9[DelayinPayment]andarticle17[ForceMajeure],havetherighttoissueanoticeinwritingofsuspensiontotheemployer.Inaddition,theincreasedcosttothecontractorforsuspensionduetothecontractoritselfreasonshallbefortheaccountofthecontractorandthedelayofcriticalpathshouldbeexpeditedatthecontractor?sownexpense.3.1.5對因發(fā)包人原因給承包人帶來任何損失、損害或造成工程關(guān)鍵路徑延誤的，承包人有權(quán)要求賠償或（和）延長竣工日期。Thecontractorshallhavetherighttoclaimcompensationor/andextendthecompletiondateforanyloss,damageordelayinthecriticalpathoftheworkscausedbytheemployer.3.2項目負(fù)責(zé)人、設(shè)計負(fù)責(zé)人、施工負(fù)責(zé)人Thepersoninchargeoftheproject,thepersoninchargeofthedesign,thepersoninchargeoftheconstruction3.2.1項目負(fù)責(zé)人、設(shè)計負(fù)責(zé)人、施工負(fù)責(zé)人，應(yīng)是當(dāng)事人雙方所確認(rèn)的人選。項目負(fù)責(zé)人經(jīng)授權(quán)并代表承包人負(fù)責(zé)履行本合同。項目負(fù)責(zé)人、設(shè)計負(fù)責(zé)人、施工負(fù)責(zé)人的姓名、職責(zé)和權(quán)限在專用條款中約定。Thepersoninchargeoftheproject,thepersoninchargeofthedesignandthepersoninchargeoftheconstructionshallbethecandidateconfirmedbythepartieshereto.Theprojectleaderbeingauthorizedtakeresponsibilityfortheperformanceofthiscontractonbehalfofthecontractor.Thename,responsibilityandauthorityofthepersoninchargeoftheproject,thepersoninchargeofthedesignandthepersoninchargeoftheconstructionarestipulatedintheparticularconditions.3.2.2項目負(fù)責(zé)人、設(shè)計負(fù)責(zé)人、施工負(fù)責(zé)人應(yīng)是承包人的員工，承包人應(yīng)在合同生效后10日內(nèi)向發(fā)包人提交項目負(fù)責(zé)人、設(shè)計負(fù)責(zé)人、施工負(fù)責(zé)人與承包人之間的勞動合同，以及承包人為項目負(fù)責(zé)人、設(shè)計負(fù)責(zé)人、施工負(fù)責(zé)人繳納社會保險的有效證明，承包人不提交上述文件的，項目負(fù)責(zé)人、設(shè)計負(fù)責(zé)人、施工負(fù)責(zé)人無權(quán)履行職責(zé)，由此影響工程進(jìn)度或發(fā)生其它問題的，由承包人承擔(dān)責(zé)任。Theprojectleader,designleaderandconstructionleadershallbethecontractor’sstaff.Thecontractorshall,within10daysafterthecontractbecomeseffective,submittotheemployerthelaborcontractbetweenandamongtheprojectleader,designleaderandconstructionleaderandthecontractorinadditiontotheeffectivecertificateofpayingsocialinsurancewhicheffectedbythecontractorfortheminchargeoftheconstruction.Wherethecontractorfailstosubmittheabovedocumentsorcertificates,theprojectleader,designleaderandconstructionleadershallnothavetherighttoperformhisduties,therebyaffectingtheprogressoftheprojectorotherproblemsshallbebornebythecontractor.3.2.3項目負(fù)責(zé)人、設(shè)計負(fù)責(zé)人、施工負(fù)責(zé)人應(yīng)常駐項目現(xiàn)場，且每月在現(xiàn)場時間不得少于專用條款約定的天數(shù)。項目負(fù)責(zé)人、設(shè)計負(fù)責(zé)人、施工負(fù)責(zé)人不得同時擔(dān)任其它項目的項目負(fù)責(zé)人。項目負(fù)責(zé)人、設(shè)計負(fù)責(zé)人、施工負(fù)責(zé)人確需離開項目現(xiàn)場時應(yīng)事先取得發(fā)包人同意，并指定一名有經(jīng)驗的人員臨時代行其職責(zé)。承包人違反上述約定的，按照專用條款的約定，承擔(dān)違約責(zé)任。Thepersoninchargeoftheproject,thepersoninchargeofdesignandthepersoninchargeofconstructionshallberesidentatthesiteoftheproject,andthetimeatthesiteshallnotbelessthanthedaysnumbereachmonthwhichstipulatedintheparticularconditionsandshallnotactasthepersoninchargeofotherprojectsatthesametime.Thepersoninchargeoftheproject,thepersoninchargeofdesignandthepersoninchargeofconstructionshall,whenleavingtheprojectsite,obtaintheconsentofthecontractorinadvanceandappointanexperiencedpersontocarryouthisduties.Ifthecontractorviolatestheabove-mentionedagreement,heshallbeliableforbreachofcontractinaccordancewiththestipulationsofparticularconditions.3.2.4項目負(fù)責(zé)人按合同約定的項目進(jìn)度計劃，并按發(fā)包人代表和（或)工程總監(jiān)依據(jù)合同發(fā)出的指令組織項目實施。在緊急情況下，且無法與發(fā)包人代表和（或)工程總監(jiān)取得聯(lián)系時，項目經(jīng)理有權(quán)采取必要的措施保證人身、工程和財產(chǎn)的安全，但須在事后48小時內(nèi)向發(fā)包人代表和（或)工程總監(jiān)送交書面報告。Theprojectleadershall，underprojectscheduleasstipulatedinthecontractandtheinstructionsissuedbytheemployerand/orchiefengineer,organizetheimplementationoftheproject.Incaseofemergencyandintheabsenceofcontactwiththeemployer'srepresentativeand/orchiefengineer,projectleadershallhavetherighttotakesuchmeasuresasmaybenecessarytoensurethesafetyofpersons,worksandproperty,however,awrittenreportshallbesenttotheemployer'srepresentativeand/orchiefengineerwithin48hoursaftertheevent.3.2.5承包人部更換項目經(jīng)理時，提前15日以書面形式通知發(fā)包人，并征得發(fā)包人的同意，繼任的項目經(jīng)理須繼續(xù)履行第3.2.1款約定的職責(zé)和權(quán)限。未經(jīng)發(fā)包人同意，承包人不得擅自更換項目經(jīng)理。承包人擅自更換項目經(jīng)理的，按專用條款的約定，承擔(dān)違約責(zé)任。Thecontractorshallnotifytheemployerinwriting15daysinadvanceofthereplacementoftheprojectmanagerandobtaintheconsentthereof.Thesuccessorofprojectmanagershallcontinuetoperformthedutiesandauthoritystipulatedinarticle3.2.1.Thecontractormaynotreplacetheprojectmanageratitsowninitiativewithouttheconsentoftheemployer.Wherethecontractorreplacestheprojectmanagerwithoutauthorization,shallbeliableforbreachofcontractasstipulatedintheparticularcondition.3.2.6發(fā)包人有權(quán)以書而形式通知更換其認(rèn)為不稱職的項目經(jīng)理，應(yīng)說明更換因由，承包人應(yīng)在接到更換通知后15日內(nèi)向發(fā)包人提出書面的改進(jìn)報告。發(fā)包人收到改進(jìn)報告后仍以書面形式通知更換的，承包人應(yīng)在接到第二次更換通知后的30日內(nèi)進(jìn)行更換，并將新任命的項目經(jīng)理的姓名、簡歷以書面形式通知發(fā)包人。新任項目經(jīng)理繼續(xù)履行第3.2.1款約定的職責(zé)和權(quán)限。Theemployershallhavetherighttonotifyinwritingthecontractortoreplacetheprojectmanagerwhichbeingdeemedincompetentcompaniedwiththecauseofreplacement,andthecontractorshallsubmitawrittenimprovementreporttotheemployerwithin15daysuponreceiptofthereplacenotice.Wheretheemployerstillnotifyinwritingtoreplaceuponreceiptoftheimprovementreport,thecontractorshall,within30daysofreceivingthesecondnoticeofreplacement,effectthereplacementandinforminwritingtheemployerofthenameandresumeofthenewlyappointedprojectmanager.?Thenewprojectmanagershallcontinuetoperformthedutiesandpowersstipulatedinarticle3.2.1.3.3工程質(zhì)量保證Engineeringqualityguarantee承包人應(yīng)按合同約定的質(zhì)量標(biāo)準(zhǔn)規(guī)范，確保設(shè)計、采購、加工制造、施工、竣工試驗等各項工作的質(zhì)量，建立有效的質(zhì)量保證體系，并按照國家有關(guān)規(guī)定，通過質(zhì)量保修責(zé)任書的形式約定保修范圍、保修期限和保修責(zé)任。Thecontractorshall,asrequiredbythequalitystandardsandspecificationsstipulatedherein,ensurethequalityofallworkssuchasdesign,procurement,processing/manufacturing,construction,completiontestandother,establishaneffectivequalityassurancesystem,andeffectagreementonthescope,durationandliabilityofwarrantybytheformofqualitywarrantyinaccordancewithState’srelevantregulations.3.4安全保證Safetyguarantee3.4.1工程安全性能Engineeringsafetyfunction承包人應(yīng)按照合同約定和國家有關(guān)安全生產(chǎn)的法律規(guī)定，進(jìn)行設(shè)計、采購、施工、竣工試驗，保證工程的安全性能。Thecontractorshall,underthestipulationshereofandState’slawsonsafetyinproduction,carryoutthedesign,purchase,constructionandcompletiontestandensurethesafetyperformanceoftheproject.3.4.2安全施工Safetyconstruction承包人應(yīng)遵守7.8款職業(yè)健康、安全和環(huán)境保護(hù)的約定。Thecontractorshallabidebythestipulationsofarticle7.8[OccupationalHealth,SafetyandEnvironmentalProtection].3.4.3因承包人未遵守發(fā)包人按2.4.2款通知的安全規(guī)定和位置范圍限定所造成的損失和傷害，由承包人負(fù)責(zé)。Thecontractorshallberesponsibleforanylossorinjuryduetothecontractor'sfailuretoabidebysafetyregulationsandlocationlimits,whicharenotifiedbytheemployerunderarticle2.4.2.3.4.4承包人全面負(fù)責(zé)其施工場地的安全管理，保障所有進(jìn)入施工場地的人員的安全。因承包人原因所發(fā)生的人身傷害、安全事故，由承包人負(fù)責(zé)。Thecontractorshalltakeoverallresponsibilityforthesafetymanagementofitsconstructionsiteandensurethesafetyofallpersonnelenteringtheconstructionsite.Anypersonalinjuryorsafetyaccidentduetothecontractor’sreasonwillbetheresponsibilityofthecontractor.3.5職業(yè)健康和環(huán)境保護(hù)保證Guaranteeforoccupationalhealthandenvironmentalprotection3.5.1工程設(shè)計Engineeringdesign承包人應(yīng)按照合同約定，并遵照《建設(shè)工程勘察設(shè)計管理條例》、《建設(shè)工程環(huán)境保護(hù)條例》及其它相關(guān)法律規(guī)定進(jìn)行工程的環(huán)境保護(hù)設(shè)計及職業(yè)健康防護(hù)設(shè)計，保證工程符合環(huán)境保護(hù)和職業(yè)健康相關(guān)法律和標(biāo)準(zhǔn)規(guī)定。Thecontractorshallcarriesoutthedesignsofenvironmentalprotectionandoccupationalhealthprotectionoftheprojectinaccordancewiththecontractagreement,andthe"RegulationsontheAdministrationofConstructionEngineeringSurveyandDesign",the"RegulationsonEnvironmentalProtectionofConstructionProjects"andotherrelevantlegalprovisions,andensuretheprojectcomplieswithlawsandstandardsrelatedtoenvironmentalprotectionandoccupationalhealth.4.2設(shè)計進(jìn)度計劃Designprogressschedule4.2.1設(shè)計進(jìn)度計劃Designprogressschedule承包人根據(jù)批準(zhǔn)的項目進(jìn)度計劃和5.3.1款約定的設(shè)計審查階段及發(fā)包人組織的設(shè)計階段審查會議的時間安排，編制設(shè)計進(jìn)度計劃。設(shè)計進(jìn)度計劃經(jīng)發(fā)包人認(rèn)可后執(zhí)行。發(fā)包人的認(rèn)可并不能減輕或免除承包人的合同責(zé)任。Thecontractorshalldrawupthedesignprogressschedulesubjecttotheappr
