heECcomponenttype-approvalmark.共66頁第5頁1976L0758—中文—2004年5月1日—007.001鑒于關(guān)于機動車的本國法律近似使得各成員國相互承認按照共同要求進行的檢測。M2歐洲共同體委員會采用本指令：第一條▼M31.對于符合有關(guān)附件中規(guī)定的結(jié)構(gòu)及測試要求的任何型式的示廓燈、前位置（側(cè)）燈、后位置（側(cè)）燈、制動燈、日間行車燈和示寬燈，成員國應(yīng)發(fā)放歐共體部件型式認證。▼B2.已發(fā)放歐洲經(jīng)濟共同體部件型式認證的成員國，應(yīng)根據(jù)要求采取措施，證明該產(chǎn)品型號符合經(jīng)認證的型式，并且在需要時應(yīng)與其他成員國主管當局合作。此類證明應(yīng)僅限于抽檢。▼M3第二條對于成員國依據(jù)第一條認證的各種型式的示廓燈、前位置（側(cè)）燈、后位置（側(cè)）燈、制動燈、日間行車燈和示寬燈，成員國應(yīng)向制造商發(fā)放與附件I，附錄3中所示型號一致的歐共體部件型式認證標志。成員國應(yīng)采取適當措施，避免使用易混淆依據(jù)第一條認證的示廓燈、前位置（側(cè)）燈、后位置（側(cè)）燈、制動燈、日間行車燈和示寬燈及其它裝置的標志。第三條1.對于帶有歐共體部件型式認證標志的示廓燈、前位置（側(cè)）燈、后位置（側(cè)）燈、制動燈、日間行車燈和示寬燈，任何成員國不得基于與其制造或性能方法有關(guān)的理由禁止其投放市場。共66頁第6頁1976L0758—N—01.05.2004—007.001M32.Nevertheless,aMemberStatemayprohibittheplacingonthemarketofend-outlinemarkerlamps,frontposition(side)lamps,rearposition(side)lamps,stoplamps,daytimerunninglampsandsidemarkerlampsbearingtheECcomponenttype-approvalmarkwhichconsistentlyfailtoconformtotheapprovedtype.ThatStateshallforthwithinformtheotherMemberStatesandtheCommissionofthemeasurestaken,specifyingthereasonsforitsdecision.Article4ThecompetentauthoritiesoftheMemberStatesshallinformeachother,bymeansoftheprocedurespecifiedinArticle4(6)ofDirective70/156/EEC,ofeachapprovalwhichtheyhavegranted,refusedorwithdrawnpursuanttothisDirective.▼BArticle5▼M31.IftheMemberStatewhichhasgrantedECcomponenttype-approvalfindsthatanumberofend-outlinemarkerlamps,frontposition(side)lamps,rearposition(side)lamps,stoplamps,daytimerunninglampsandsidemarkerlampsbearingthesameECcomponenttype-approvalmarkdonotconformtothetypewhichithasapproved,itshalltakethenecessarymeasurestoensurethatproductionmodelsconformtotheapprovedtype.ThecompetentauthoritiesofthatStateshalladvisethoseoftheotherMemberStatesofthemeasurestaken,whichmay,wherethereisconsistentfailuretoconform,extendtowithdrawalofECcomponenttype-approval.ThesaidauthoritiesshalltakethesamemeasuresiftheyareinformedbythecompetentauthoritiesofanotherMemberStateofsuchfailuretoconform.▼B2.ThecompetentauthoritiesofMemberStatesshallwithinonemonthinformeachotherofanywithdrawalofEECcomponenttype-approval,andofthereasonsforsuchameasure.▼M3Article6AnydecisiontakenpursuanttotheprovisionsadoptedinimplementationofthisDirective,torefuseorwithdrawECcomponenttype-approvalforend-outlinemarkerlamps,frontposition(side)lamps,rearposition(side)lamps,stoplamps,daytimerunninglampsandsidemarkerlamps,orprohibittheirplacingonthemarketoruseshallsetoutindetailthereasonsonwhichitisbased.Suchdecisionsshallbenotifiedtothepartyconcerned,whoshallatthesametimebeinformedoftheremediesavailabletohimunderthelawsinforceintheMemberStatesandofthetimelimitsallowedfortheexerciseofsuchremedies.共66頁第7頁1976L0758——2004年5月1日—007.001M32.但是，若帶有歐共體部件型式認證標志的示廓燈、前位置（側(cè)）燈、后位置（側(cè)）燈、制動燈、日間行車燈和示寬燈一貫不符合經(jīng)認證的型式，成員國可禁止其投放市場。該成員國應(yīng)立即將采取的措施通報其他成員國和委員會，說明做出此決定的理由。第四條對于其依據(jù)本指令發(fā)放、拒絕發(fā)放或已撤銷的認證，各成員國主管當局應(yīng)通過指令70/156/EEC第四條（6）規(guī)定的程序相互通報。▼B第五條▼M31.倘若已發(fā)放歐共體部件型式認證的成員國發(fā)現(xiàn)某些帶有該歐共體部件型式認證標志的示廓燈、前位置（側(cè)）燈、后位置（側(cè)）燈、制動燈、日間行車燈和示寬燈與認證的型式不符，則應(yīng)當采取必要的措施確保這些產(chǎn)品型號與其認證的型式相符。該成員國主管當局應(yīng)就采取的措施向其他成員國的主管當局提出建議，若始終不能相符，應(yīng)采取措施直至撤銷該歐共體部件型式認證。該主管當局在接到另一成員國主管當局關(guān)于此類不相符的通報時，應(yīng)采取相同的措施。▼B2.各成員國主管當局應(yīng)在一個月內(nèi)相互通報對歐洲經(jīng)濟共同體部件型式認證的撤銷以及采取此措施的理由。▼M3第六條對于該指令實施過程中，依據(jù)所采用的條款作出的拒絕發(fā)放或撤銷示廓燈、前位置（側(cè)）燈、后位置（側(cè)）燈、制動燈、日間行車燈和示寬燈的歐共體部件型式認證或禁止其投放市場及使用的決定，都應(yīng)詳細說明該決定所基于的理由。該決定應(yīng)通知有關(guān)各方，同時應(yīng)告知當事方依據(jù)成員國現(xiàn)行法律可以使用的補救辦法以及運用此類補救辦法的時效。共66頁第8頁1976L0758—N—01.05.2004—007.001M3Article7NoMemberStatemayrefusetograntECtype-approvalornationaltype-approvalofanyvehicleongroundsrelatingtoitsend-outlinemarkerlamps,frontposition(side)lamps,rearposition(side)lamps,stoplamps,daytimerunninglampsandsidemarkerlampsifthesebeartheECcomponenttype-approvalmarkandarefittedinaccordancewiththerequirementslaiddowninDirective76/756/EEC.Article8NoMemberStatemayrefuseorprohibitthesale,registration,entryintoserviceoruseofanyvehicleongroundsrelatingtoitsend-outlinemarkerlamps,frontposition(side)lamps,rearposition(side)lamps,stoplamps,daytimerunninglampsandsidemarkerlampsifthesebeartheECcomponenttype-approvalmarkandarefittedinaccordancewiththerequirementslaiddowninDirective76/756/EEC.Article9ForthepurposesofthisDirective,‘vehicle’meansanymotorvehicleintendedforuseontheroad,withorwithoutbodywork,havingatleastfourwheelsandamaximumdesignspeedexceeding25km/h,anditstrailers,withtheexceptionofvehicleswhichrunonrailsandofagriculturalandforestrytractorsandallmobilemachinery.BArticle10AnyamendmentsnecessarytoadjusttherequirementsoftheAnnexestotakeaccountoftechnicalprogressshallbeadoptedinaccordancewiththeprocedurelaiddowninArticle13ofDirective70/156/EEC.Article111.MemberStatesshalladoptandpublishtheprovisionsnecessaryinordertocomplywiththisDirectivebefore1July1977andshallforthwithinformtheCommissionthereof.Theyshallapplytheseprovisionswitheffectfrom1October1977atthelatest.2.OncethisDirectivehasbeennotified,theMemberStatesshallalsoensurethattheCommissionisinfo
