被租賃物業(yè):LeasedProperty:1.物業(yè)名稱:NameofProperty:2.物業(yè)房號(hào):NumberofUnit:3.物業(yè)地址:Address:4.物業(yè)面積:Size:二、租期和租金:LeasingPeriodandRent:租期:年LeasingPeriod:year起租日期CommencementDate:終止日期TerminationDate:月租金:人民幣(包括)MonthlyRent:RMB(inclusiveof)首月租金應(yīng)于入住前繳清。PartyBshouldpay1stmonth’srenttoPartyAbeforecommencementdate.租金押金:人民幣,乙方須于合同簽定后三個(gè)工作日內(nèi)交付甲方租賃押金。押金不可用于抵付房租。Deposit:RMB,partyBshouldpaythedepositinfulltopartyAwithin3daysuponsigningofthecontract.Thedepositcannotbebalancedoutastherent.甲方應(yīng)提前10日發(fā)付款通知給乙方,乙方須將租金按時(shí)匯入甲方指定賬戶。PartyAshallsendinvoicetoPartyB10daysinadvance.PartyBshallpaytherentaltoPartyA’sdesignatedaccountontime。付款方式meansofpayment:以美金/人民幣月付/季付USD/RMBpaymenteverymonth/quarter.甲方指定賬號(hào)名稱:PartyA’sdesignatedaccountname:銀行名稱:Nameofbank:銀行賬號(hào)(美金/人民幣):AccountNo:(USD/RMB):地址:BankAdd:三、約定事項(xiàng):Agreedon:1.租賃用途:乙方向甲方承租上述物業(yè)(以下簡(jiǎn)稱單元)作為之用。乙方不得將該單元用于本條款限定之外用途。Useofproperty:PartyBisleasingfromPartyAtheabove-mentionedproperty(hereinaftercalledasthePremises)foruse.ThePremisesshallnotbeusedinwaysotherthanthoseprescribedinthisclause.2.費(fèi)用支付:租用單元之水,電,煤氣,電話費(fèi),網(wǎng)絡(luò)費(fèi),有線電視費(fèi)由乙方支付。PartyBshallpaychargesofwater,electricity,gas,internet,cabletelevisionandtelephonefeesofthepremises.3.家具及電器配置:家具清單詳見本合同后附件一。Furnitureandelectricalappliances:PartyAshallsupplyPartyBwithfurnitureandelectricalappliancesofthepremises.Thelistisattachedtothiscontract.(SeeAnnex1).4.乙方如未續(xù)租則應(yīng)在到期當(dāng)日搬出該單元。甲方在乙方付清由乙方支付的所有費(fèi)用(含水,電,煤氣及電話費(fèi))后,在7天內(nèi)全部退還乙方承租押金(不計(jì)利息)。如甲方延遲退還,應(yīng)按日加付滯納金0.5%給乙方。PartyBshallvacatethePremisesonexpiredateofthisContract.Ifeitherpartydoesn’twishtorenewthisContractuponitsexpiry,PartyAshallreturnthedepositinfull(withoutinterest)withinsevendaystoPartyBafterPartyBhaspaidinfullfortherent,includingutilityfeestelephoneexpenseswhichshallbebornebyPartyB.IfPartyAdelaythepaybackthedeposit,thenapenaltyof0.5%perdaywillbeaddedtoPartyB.5.乙方若需續(xù)租該單元,應(yīng)提前兩個(gè)月書面通知甲方。在同等條件下,乙方有優(yōu)先續(xù)租權(quán);續(xù)租租金視當(dāng)時(shí)市場(chǎng)價(jià)格而定。IfPartyBwishestochoosetorenewtheLeaseContractattheendoftheterm,itshallnotifyPartyAinwritingtwomonthsinadvance.PartyBshallbegiventhepriorityoftenancyoverthePremiseswhiletherentshallbedependentonthemarketstandardbythen.四、雙方責(zé)任Responsibilities1.甲方責(zé)任:PartyA’sresponsibilities:甲方應(yīng)保證該物業(yè)的合法性及出租該物業(yè)的合法權(quán)利。PartyAshouldguaranteethelegalityoftheleasedpropertyanditslegalrighttoleasetheproperty.(2)甲方須按時(shí)交房,因未及時(shí)交房而引起的損失由甲方承擔(dān)。PartyAshallgivethepossessionofthePremisestoPartyBontheeffectivedayofthisContract.PartyAshallbearallliabilitiesforthedelay.(3)合同期內(nèi),甲方不得將該單元出租給任何其他第三方。PartyAshallnotrentthePremisesorpartofittoanythirdpartywithinthevalidterm.(4)如果該單元的內(nèi)部結(jié)構(gòu),屬甲方的家具電器設(shè)備由于非乙方原因而是由于自然損耗原因引起損壞,致使乙方無(wú)法正常生活,甲方須及時(shí)安排修理。IftheinteriorstructureofthePremisesoritsfurnitureandapplianceswhichbelongstoPartyAaresubstantiallydestroyedordamagedwhichmakesitimpossibleforPartyBtolive,andnotowingtothedefaultorneglectofPartyB,thenPartyAshallarrangetorepairitimmediatelytoensureitsuse.(5)甲方應(yīng)盡力督促管理公司提供充分的保安及消防工作。PartyAshallberesponsibletodohisbesttoprocuretheestatemanagertoprovideadequatesecurity&fireprevention.(6)甲方應(yīng)遵守政府部門所規(guī)定的有關(guān)該房屋的任何法律規(guī)定。PartyAshallcomplywithanylawsregulationsofgovernmentauthority.(7)甲方應(yīng)支付由政府機(jī)構(gòu)規(guī)定的應(yīng)由業(yè)主所承擔(dān)的各項(xiàng)稅費(fèi)。TopaytheapplicabletaxesandchargespayableonthesaidpremisesasdesignatedbyanyrelevantgovernmentauthorityorotherlawfulauthoritytobepayableonlybythePartyA.2.乙方責(zé)任PartyB’sresponsibilities:(1)乙方須按上述付款日期支付各項(xiàng)費(fèi)用,因乙方延期付款而引起的損失由乙方承擔(dān)。PartyBshallpaythefeesinaccordancewiththeprovisionsofthisContract.PartyBshallbearalltheliabilitiesforthedelayofthepayment.(2)乙方應(yīng)正確維護(hù)使用單元內(nèi)屬甲方的家具電器設(shè)備,因乙方的故意或過失損毀甲方物品,由乙方承擔(dān)賠償責(zé)任。乙方需更換單元內(nèi)屬甲方物品須有同甲方協(xié)商解決。PartyBshallproperlyuseandmaintainthefurnitureandequipmentbelongingtoPartyAinthePremises.PartyBshallbeliableforcompensatinganydamagecausedbyitsimproperorwrongfuluse.PartyBshallconsultPartyAifithastochangethefurnitureofequipmentbelongingtoPartyAinthePremises.(3)非經(jīng)甲方及物業(yè)管理公司書面許可,乙方不得在單元內(nèi)搭建,增減建筑物,不得將單元內(nèi)建筑結(jié)構(gòu)及裝修予以改變,但允許乙方在墻上安裝釘子掛相片等物品,否則,乙方將承擔(dān)由此產(chǎn)生的一切責(zé)任。PartyBmaynot,withoutthepermissionofPartyAandthebuildingmanagementcompany,erect,addorremoveanystructuresanddecorationinorfromthePremises.ItmaynotchangethestructuralconstructionofPremises,exceptfornailinguppictures,etc.Itshallbeliableforexpensesincurredtherefrom.(4)入住前提供護(hù)照復(fù)印件、照片等,并保證本合同期內(nèi)其個(gè)人在京簽證及工作簽證為有效簽證。Providepassportcopy,photoetcbeforemoveinandmaketheworkpermitandthevisainBeijingisall-validduringtheleaseterminthispremises.(5)在甲方預(yù)先通知的情況下,租賃期最后兩個(gè)月,允許甲方或其代理人帶領(lǐng)有意租賃或購(gòu)買房屋的客人視察房屋。WithPartyA’spriornotice,PartyAshallhavetherighttoshowtheleasedpropertytoprospectivetenantsorpurchasersduringthelasttwomonthsoftenancy.(6)乙方應(yīng)遵守政府部門及物業(yè)管理公司所規(guī)定的有關(guān)該房屋的任何法律規(guī)定。如違反規(guī)定造成甲方遭受經(jīng)濟(jì)損失的,乙方應(yīng)全額賠償,甲方有權(quán)單方面解除合同并沒收押金并保留追索欠款及索賠的權(quán)利。PartyBshallcomplywithanyrulesrelatingtogovernmentauthorityandManagementOffice.PartyBshallpayforallPartyA’slossinfullduetoileagalactionsforPartyB.PartyAhastherighttoterminatethecontractandforfeitthedepositandhastherighttogetbackthepaymentinarrearsandcompensation.五、違約責(zé)任LiabilitiesofDefault甲乙方提前退約:在定約期內(nèi),因甲方原因提前終止合同,甲方除應(yīng)全額退還乙方租賃押金外,須支付乙方相等押金額作為違約金;反之,如乙方提前終止合同,則甲方?jīng)]收押金。IfPartyAwishestoterminatethisContractbeforeexpiry,PartyAshallreturnthedepositinfullandinadditiontopaythedefaultfeethatisequaltotheamountofthedeposit.Inopposite,PartyBterminatesthecontractthenPartyBshallforfeitthedeposit.2.乙方延付費(fèi)用:乙方應(yīng)按合同規(guī)定支付上述費(fèi)用,若逾期5日未付,除應(yīng)及時(shí)支付所欠費(fèi)用外,還應(yīng)每天支付甲方月租金的0.5%滯納金;延期超過10天,甲方有權(quán)單方面解除合同并沒收押金及保留追索欠款及索賠的權(quán)利。PartyBshallpaytheaboverentandallotherfeesinaccordancewiththeprovisionsofthisContract.Iftherentisnotpaidwithinfivedaysfromtheduedate,PartyBshall,inadditiontopaytherentinarrears,payPartyAlatepaymentchargeof0.5%ofmonthlyrentperdayoflatepayment.Ifthepaymentofrentisoverduebymoretendays,PartyAshallhavetherighttounilaterallyterminatethisContractandconfiscatethefullamountofdepositpaidbyPartyBandhavetherighttogetbackthepaymentinarrearsandcompensation.六、不可抗力:Miscellaneous:房屋由于火災(zāi)、惡劣天氣、戰(zhàn)爭(zhēng)或其它甲方不可抗拒因素,而不是因?yàn)橐曳街苯踊蜷g接的疏忽及故意行為造成房屋毀壞而不能被正常使用及居住時(shí),乙方從該日起停止支付租金,直至房屋可再被使用及居住為止,如該房屋因任何不能歸因乙方的原因不能正常使用超過20天,乙方有權(quán)終止合同并無(wú)需承擔(dān)任何責(zé)任,甲方應(yīng)退還全部押金及預(yù)付租金。甲方根據(jù)自己的意愿及經(jīng)濟(jì)、實(shí)際意義等原因,沒有義務(wù)必須修繕復(fù)原房屋。若此情況發(fā)生,甲方應(yīng)書面通知乙方,并在做出上述通知的十天之內(nèi)將押金及預(yù)付租金全部退還乙方。Iftheleasedpropertyaresubstantiallydestroyedordamagedbyfire,badweather,war,forcemajor,orothercausesbeyondthecontrolofPartyAnotattributabledirectlyorindirectlytothenegligenceormaliceofPartyBorareotherwiserenderedunfitforuseoroccupation,therentshallceasetobepayablefromthedatetheleasedpropertybecomeunfitforuseoccupationuntiltheleasedpropertyshallagainberenderedaccessibleandfitforuse,ifthelesson’spropertycannotbeproperlyusedforanyreasonsbeyond20days,PartyBhastherighttoterminatetheagreementwithoutanyliabilities,thereof,PartyAshallrefundthedepositandthepre-paidrent,however,thatthePartyAshallbeundernoobligationtorepairtheleasedproperty,wheninPartyA’sopinion,itisnotreasonablyoreconomicallyorpracticallytodoso.Ifsuchaneventoccurs,PartyAshallgiveawrittennoticetoPartyB,andthedepositpaidbyPartyBandthepre-paidrent.七、適用法及爭(zhēng)議的解決:Legislation&ArbitrationoftheDispute:本租約受中華人民共和國(guó)法律的約束,如發(fā)生與本租約有關(guān)的爭(zhēng)議,由雙方友好協(xié)商解決,協(xié)商不成,提請(qǐng)?jiān)O(shè)在北京的中國(guó)國(guó)際經(jīng)濟(jì)貿(mào)易仲裁委員會(huì),依該委員會(huì)在仲裁申請(qǐng)?zhí)岢鰰r(shí)有效的仲裁規(guī)定進(jìn)行仲裁,仲裁在北京進(jìn)行,仲裁語(yǔ)言為漢語(yǔ),仲裁裁決是終局的,對(duì)雙方當(dāng)事人均有約束力。ThisLeaseAgreementisunderthelegalauthorityofPRC.Incaseanydisputearisesoverthisagreement,thetwopartiesshallnegotiatefriendly,iffailed,shallsubmittothechina
