TheLetterofCreditshallbeavailablefordrawingbySelleronthefinalsettlementwhenalldetailsrelatingtofinalweight,priceandqualityareknown,againstpresentationofSeller’sfinalinvoice.Thefinalsettlementshallbethevaluedeterminedinaccordancewiththerelativeclausesinthiscontractregardingweight,assaysandprices,lessprovisionalpaymentseffected.7.A.4 FordeferredpaymentLetterofCredit,BuyershallpaySellerfinancecharges,atthepublishedFinancialTimesofLondonthreemonthsLIBOR(quotedononboarddateofBillofLading)plus1.5%,calculatedfor90calendardays,basis90%provisionalinvoiceamount.SuchchargesshallbeallowedforintheLetterofCreditandshallbeincludedinfirstprovisionaldrawing.7.A.5 IfduedatefallsonaSaturdayorNewYorkbankingholidayotherthanMonday,paymentshallbemadeontheprecedingNewYorkbankingday.IfpaymentduedatefallsonaSundayorMondaybankholidayinNewYork,paymenttobemadeonthenextNewYorkbankingday.Forthepurposeoffinalsettlement,weighing,samplingandmoisturedeterminationshallbecarriedoutforthebuyer’saccountattheportofdischarge,inaccordancewithstandardinternationalpractises,performedbyCIQ/CCIC.ThefinalweightshallbedeterminedbyCIQ/CCIC,inconjunctionwithSeller’srepresentativeusingdraftsurvey(bulkshipment)orweightscale(containershipment)methodinseller’soptionandsuchweightshallbefinalandbindingonbothparties.TheSellerand/ortheProducerhastherighttobepresentattheseoperationsbyasurveyororrepresentative,actinginnameandonbehalfoftheSellerand/ortheProduceratitsownexpense.Thesamplelotsizeshallbeapproximately500wmtandeachlotshallformaseparateandcompletedeliveryforthepurposesofsettlementofweightandmoisturecontent.Representativesamplesshallbetakenfromeachlotwiththefollowingdistribution:-2setsforBuyer-2setsforSeller-2setsforsupplier-2setstobekeptbyCIQ/CCICinreserveforumpirepurpose.-2setstobeheldbySeller’srepresentativeinreserveforumpirepurpose.AllsamplesshallbesealedandsignedjointlybyCIQ/CCICandSeller’srepresentative.9.A.1AssaysforzincshallbemadeindependentlybyBuyerandSeller,onalotbylotbasis,fromsamplestakenattheaboveoperations.Theseresultsshallbeexchangedinthenormalcommercialmannerlatest45daysfromdateoftheweighing/sampling/moisturereport.ShouldthedifferencebetweenBuyer'sandSeller’sresultsbenotmorethan:Zinc:
