鑒于甲乙雙方因感情破裂,經(jīng)協(xié)商一致決定離婚,并就離婚后房產(chǎn)分割事宜達(dá)成如下協(xié)議:
第一條房產(chǎn)信息

第二條房產(chǎn)分割原則
1.甲乙雙方本著公平、合理的原則,對(duì)上述房產(chǎn)進(jìn)行分割。
2.房產(chǎn)分割應(yīng)考慮雙方對(duì)房產(chǎn)的貢獻(xiàn)、婚姻期間的居住情況、子女撫養(yǎng)等因素。
第三條房產(chǎn)分割方案
1.甲方同意將上述房產(chǎn)的所有權(quán)轉(zhuǎn)讓給乙方,乙方同意接受。
2.房產(chǎn)轉(zhuǎn)讓后,乙方擁有該房產(chǎn)的全部產(chǎn)權(quán)。
3.房產(chǎn)轉(zhuǎn)讓過(guò)程中產(chǎn)生的稅費(fèi)由甲方承擔(dān)。
4.房產(chǎn)轉(zhuǎn)讓手續(xù)由甲方負(fù)責(zé)辦理,乙方應(yīng)予以協(xié)助。
第四條房產(chǎn)貸款處理
1.若房產(chǎn)存在貸款,甲方應(yīng)在房產(chǎn)轉(zhuǎn)讓前結(jié)清全部貸款。
2.若房產(chǎn)轉(zhuǎn)讓后仍需繼續(xù)償還貸款,乙方應(yīng)承擔(dān)貸款償還責(zé)任。
第五條房產(chǎn)交付
1.甲方應(yīng)在本協(xié)議簽訂后____天內(nèi)將房產(chǎn)交付給乙方。
2.房產(chǎn)交付時(shí),甲方應(yīng)保證房產(chǎn)結(jié)構(gòu)完整、設(shè)施設(shè)備完好。
3.房產(chǎn)交付后,乙方享有對(duì)房產(chǎn)的占有、使用、收益和處分的權(quán)利。
第六條違約責(zé)任
1.若甲方未按約定時(shí)間交付房產(chǎn),每逾期一日,應(yīng)向乙方支付房產(chǎn)現(xiàn)值____%的違約金。
2.若乙方未按約定時(shí)間支付房產(chǎn)轉(zhuǎn)讓款,每逾期一日,應(yīng)向甲方支付房產(chǎn)轉(zhuǎn)讓款____%的違約金。
第七條爭(zhēng)議解決
本協(xié)議在履行過(guò)程中如發(fā)生爭(zhēng)議,雙方應(yīng)協(xié)商解決;協(xié)商不成的,可向房產(chǎn)所在地人民法院提起訴訟。
第八條其他約定
1.本協(xié)議自雙方簽字之日起生效。
2.本協(xié)議一式兩份,甲乙雙方各執(zhí)一份,具有同等法律效力。
3.本協(xié)議未盡事宜,雙方可另行協(xié)商解決。
