On16March2007,theNationalPeople’sCongressapprovedthenewPRCEnterpriseIncomeTaxLaw.Thislegislationwillreducetheenterpriseincometaxratefordomesticenterprisesfrom33%to25%witheffectfrom2008.InaccordancewithInternationalAccountingStandards(No.12),theGroupre-measureditsnetdeferredtaxassetsofthedomesticoperationsasatthedateofpronouncementofthenewIncomeTaxLawtore?ectfuturerealisationatthenewlyenactedtaxrateandtherebyincreasedthetaxexpenses.Excludingsuchimpact,thepro?taftertaxattributabletoequityholdersoftheBankfromJanuarytoSeptember2007wouldhaveincreased52.97%comparedwiththesameperiodof2006.

2.5.4ThestatementonSubprimeABSandSubprimeCDOsheldbytheGroup

TheGroup’sforeigncurrencydenominatedinvestmentportfolioincludesasset-backedsecuritiesandcollateralizeddebtobligationssupportedbyUSsubprimemortgages(SubprimeABSandSubprimeCDOs).TheGrouphasconductedassessmentonthesesecuritiesbasedonthechangesinmarketconditionofUSsubprimemortgagessincethehalf-yearendof2007.Accordingtotherelevantaccountingstandards,theGroupdecidedtochargeadditionalimpairmentallowanceofUSD135millionandUSD187millionagainsttheseSubprimeABSandSubprimeCDOsrespectively.TheaggregatedamountsoftheseallowanceswereUSD186million(equivalenttoRMB1.395billion)andUSD287million(equivalenttoRMB2.152billion)respectivelyasat30September2007.TheGrouphasalsomadereserveofUSD321million(equivalenttoRMB2.414billion)directlyinthe“Reserveforfairvaluechangesofavailable-for-salesecurities”undertheequity,re?ectingthedepreciationofthefairvalueoftherelatedSubprimesecurities.

Asat30September2007,thecarryingvalueoftheinvestmentinSubprimeABSandSubprimeCDOsstoodatUSD7,451million(equivalenttoRMB55.960billion)andUSD496million(equivalenttoRMB3.727billion),representing2.86%and0.19%oftheGroup’stotalinvestmentsecuritiesrespectively.

ConsideringtheinherentuncertaintiesoftheUSsubprimemortgagesmarket,theGroupwillcloselymonitorthefuturedevelopmentsofthemarket.
