6. The issuing bank shall be first class bank or the banks approved by the Purchaser. The advance payment guarantee shall be valid until Sellers Delivery.在14天有效期內(nèi)/來(lái)自最終用戶(hù)的預(yù)付款收據(jù)，賣(mài)方應(yīng)按照附件c的形式向買(mǎi)方發(fā)送預(yù)付款銀行保證，合同金額的10%應(yīng)當(dāng)用來(lái)?yè)?dān)保賣(mài)方根據(jù)合同交付設(shè)備的義務(wù)。預(yù)付款保證的有效期應(yīng)當(dāng)至賣(mài)方的交付之日。 (b) Sellers Performance Guarantee 賣(mài)方履約保函Within thirty (30) Days of effectiveness of this Contract, the Seller shall issue to Purchaser a Performance Bank Guarantee, in the form of Appendix C, for the amount of 10% of the Contract Price that shall secure the Sellers obligations under the Contract until the Seller has met its Minimum Performance Guarantees.在合同有效期30天內(nèi)，賣(mài)方應(yīng)該根據(jù)附件C的形式把履約保函發(fā)給買(mǎi)方，合同金額的10%應(yīng)該用來(lái)確保賣(mài)方根據(jù)合同履行義務(wù), 直到賣(mài)方已經(jīng)支付最小履約保函。(c) Sellers Warranty 賣(mài)方質(zhì)量保證Not later than 10 Days after the expiration of Sellers Performance Bank Guarantee, Seller shall issue to Purchaser a Warranty Bank Guarantee, in the form of Appendix C, for the amount of 5% of the Contract Price that shall secure the Sellers obligations of Warranty under this Contract. Only those items specifically marked “guaranteed” constitute technical performance guarantees. For failure to achieve the Equipment performance guarantees specifically identified in Appendix A liquidated damages shall be applied as set out in Appendix E up to the overall aggregate limit of liability for all performance liquidated damages set out in article 11.3. Any other specified guarantee shall be subject to make good guarantees. Technical performance guarantees in Appendix A not subject to Liquidated Damages shall be subject to make good guarantees.
