1、CONVENTION ON THE SERVICEABROAD OF JUDICIAL AND EXTRAJUDICIAL DOCUMENTS IN CIVIL OR COMMERCIAL MATTERS(Concluded 15 November 1965) (Entered into force 10 February 1969)The States signatory to the present Convention,Desiring to create appropriate means to ensure that judicial and extrajudicial docume

2、nts to be served abroad shall be brought to the notice of the addressee in sufficient time,Desiring to improve the organization of mutual judicial assistance for that purpose by simplifying and expediting the procedure,Have resolved to conclude a Convention to this effect and have agreed upon the fo

3、llowing provisions:Article 1The present Convention shall apply in all cases, in civil or commercial matters, where there is occasion to transmit a judicial or extrajudicial document for service abroad.This Convention shall not apply where the address of the person to be served with the document is n

4、ot known.關(guān)于向國(guó)外送達(dá)民事和商事司法文書和司法外文書公約本公約締約國(guó),希望創(chuàng)立適當(dāng)方法,以確保須予送達(dá)到國(guó)外的司法文書和司法外文書在足夠的時(shí)間內(nèi)為收件人所知悉,希望通過(guò)簡(jiǎn)化并加快有關(guān)程序,改進(jìn)為此目的而進(jìn)行相互司法協(xié)助的體制,為此目的,茲決定締結(jié)一項(xiàng)公約,并議定下列各條:第一條在所有民事或商事案件中,如有須遞送司法文書或司法外文書以便向國(guó)外送達(dá)的情形,均應(yīng)適用本公約。在文書的受送達(dá)人地址不明的情況下,本公約不予適用。CHAPTER I JUDICIAL DOCUMENTSArticle 2Each Contracting State shall designate a Central

5、 Authority which will undertake to receive requests for service coming from other Contracting States and to proceed in conformity with the provisions of Articles 3 to 6.Each State shall organize the Central Authority in conformity with its own law.第一章司法文書第二條每一締約國(guó)應(yīng)指定一個(gè)中央機(jī)關(guān),負(fù)責(zé)根據(jù)第三條至第六條的規(guī)定,接收來(lái)自其它締約國(guó)的送達(dá)

6、請(qǐng)求書,并予以轉(zhuǎn)遞。每一締約國(guó)應(yīng)依其本國(guó)法律組建中央機(jī)關(guān)。Article 3The authority or judicial officer competent under the law of the State in which the documents originate shall forward to the Central Authority of the State addressed a request conforming to the model annexed to the present Convention, without any requirement of

7、legalization or other equivalent formality.The document to be served or a copy thereof shall be annexed to the request. The request and the document shall both be furnished in duplicate.第三條依文書發(fā)出國(guó)法律有權(quán)主管的當(dāng)局或司法助理人員應(yīng)將符合本公約所附范本的請(qǐng)求書送交文書發(fā)往國(guó)中央機(jī)關(guān),無(wú)須認(rèn)證或其它類似手續(xù)。請(qǐng)求書應(yīng)附有須予送達(dá)的文書或其副本。請(qǐng)求書和文書均須一式兩份。Article 4If the Cen

8、tral Authority considers that the request does not comply with the provisions of the present Convention it shall promptly inform the applicant and specify its objections to the request.第四條如中央機(jī)關(guān)認(rèn)為該請(qǐng)求書不符合本公約的規(guī)定,應(yīng)及時(shí)通知申請(qǐng)者,并說(shuō)明其對(duì)請(qǐng)求書的異議。Article 5The Central Authority of the State addressed shall itself ser

9、ve the document or shall arrange to have it served by an appropriate agency, either a) by a method prescribed by its internal law for the service of documents in domestic actions upon persons who are within its territory, orb) by a particular method requested by the applicant, unless such a method i

10、s incompatible with the law of the State addressed.Subject to sub-paragraph (b) of the first paragraph of this Article, the document may always be served by delivery to an addressee who accepts it voluntarily.If the document is to be served under the first paragraph above, the Central Authority may

11、require the document to be written in, or translated into, the official language or one of the official languages of the State addressed.That part of the request, in the form attached to the present Convention, which contains a summary of the document to be served, shall be served with the document.

12、第五條文書發(fā)往國(guó)中央機(jī)關(guān)應(yīng)按照下列方法之一,自行送達(dá)該文書,或安排經(jīng)由一適當(dāng)機(jī)構(gòu)使之得以送達(dá):(一)按照其國(guó)內(nèi)法規(guī)定的在國(guó)內(nèi)訴訟中對(duì)在其境內(nèi)的人員送達(dá)文書的方法,或(二)按照申請(qǐng)者所請(qǐng)求采用的特定方法,除非這一方法與文書發(fā)往國(guó)法律相抵觸。除本條第一款第(二)項(xiàng)規(guī)定外,均可通過(guò)將文書交付自愿接受的收件人的方法進(jìn)行送達(dá)。如依上述第一款送達(dá)文書,則中央機(jī)關(guān)可要求該文書以文書發(fā)往國(guó)的官方文字或其中之一寫成,或譯為該種文字。依本公約所附格式填寫的請(qǐng)求書中包括被送達(dá)文書概要的部分應(yīng)連同文書一并送達(dá)。Article 6The Central Authority of the State addressed

13、or any authority which it may have designated for that purpose shall complete a certificate in the form of the model annexed to the present Convention.The certificate shall state that the document has been served and shall include the method, the place and the date of service and the person to whom

14、the document was delivered. If the document has not been served, the certificate shall set out the reasons which have prevented service.The applicant may require that a certificate not completed by a Central Authority or by a judicial authority shall be countersigned by one of these authorities.The

15、certificate shall be forwarded directly to the applicant.第六條文書發(fā)往國(guó)中央機(jī)關(guān)或該國(guó)為此目的可能指定的任何機(jī)關(guān)應(yīng)依本公約所附范本格式出具證明書。證明書應(yīng)說(shuō)明文書已經(jīng)送達(dá),并應(yīng)包括送達(dá)的方法、地點(diǎn)和日期,以及文書被交付人。如文書并未送達(dá),則證明書中應(yīng)載明妨礙送達(dá)的原因。申請(qǐng)者可要求非中央機(jī)關(guān)或司法機(jī)關(guān)出具的證明書由上述一個(gè)機(jī)關(guān)副署。證明書應(yīng)直接送交申請(qǐng)者。Article 7The standard terms in the model annexed to the present Convention shall in all case

16、s be written either in French or in English. They may also be written in the official language, or in one of the official languages, of the State in which the documents originate.The corresponding blanks shall be completed either in the language of the State addressed or in French or in English.第七條本

18、ed to such service within its territory, unless the document is to be served upon a national of the State in which the documents originate.第八條每一締約國(guó)均有權(quán)直接通過(guò)其外交或領(lǐng)事代表機(jī)構(gòu)向身在國(guó)外的人完成司法文書的送達(dá),但不得采用任何強(qiáng)制措施。任何國(guó)家均可聲明其對(duì)在其境內(nèi)進(jìn)行此種送達(dá)的異議,除非該文書須送達(dá)給文書發(fā)出國(guó)國(guó)民。Article 9Each Contracting State shall be free, in addition, to use

19、 consular channels to forward documents, for the purpose of service, to those authorities of another Contracting State which are designated by the latter for this purpose.Each Contracting State may, if exceptional circumstances so require, use diplomatic channels for the same purpose.第九條此外,每一締約國(guó)有權(quán)利用

20、領(lǐng)事途徑將文書送交另一締約國(guó)為此目的指定的機(jī)關(guān),以便送達(dá)。如有特別情況需要,每一締約國(guó)可為同一目的使用外交途徑。Article 10Provided the State of destination does not object, the present Convention shall not interfere with a) the freedom to send judicial documents, by postal channels, directly to persons abroad,b) the freedom of judicial officers, official

21、s or other competent persons of the State of origin to effect service of judicial documents directly through the judicial officers, officials or other competent persons of the State of destination,c) the freedom of any person interested in a judicial proceeding to effect service of judicial document

22、s directly through the judicial officers, officials or other competent persons of the State of destination.第十條如送達(dá)目的地國(guó)不表異議,本公約不妨礙:(一)通過(guò)郵寄途徑直接向身在國(guó)外的人送交司法文書的自由;(二)文書發(fā)出國(guó)的司法助理人員、官員或其他主管人員直接通過(guò)送達(dá)目的地國(guó)的司法助理人員、官員或其他主管人員完成司法文書的送達(dá)的自由;(三)任何在司法程序中有利害關(guān)系的人直接通過(guò)送達(dá)目的地國(guó)的司法助理人員、官員或其他主管人員完成司法文書的送達(dá)的自由。Article 11The presen

23、t Convention shall not prevent two or more Contracting States from agreeing to permit, for the purpose of service of judicial documents, channels of transmission other than those provided for in the preceding Articles and, in particular, direct communication between their respective authorities.第十一條

24、本公約不妨礙兩個(gè)或更多締約國(guó)達(dá)成協(xié)議,允許采用上述各條所規(guī)定的遞送途徑以外的途徑,特別是通過(guò)其各自機(jī)關(guān)直接聯(lián)系的途徑,以便送達(dá)司法文書。Article 12The service of judicial documents coming from a Contracting State shall not give rise to any payment or reimbursement of taxes or costs for the services rendered by the State addressed.The applicant shall pay or reimburse

25、the costs occasioned by-a) the employment of a judicial officer or of a person competent under the law of the State of destination,b) the use of a particular method of service.第十二條發(fā)自締約一國(guó)的司法文書的送達(dá)不應(yīng)產(chǎn)生因文書發(fā)往國(guó)提供服務(wù)所引起的稅款或費(fèi)用的支付或補(bǔ)償。申請(qǐng)者應(yīng)支付或補(bǔ)償下列情況產(chǎn)生的費(fèi)用:(一)有司法助理人員或依送達(dá)目的地國(guó)法律主管人員的參與;(二)特定送達(dá)方法的使用。Article 13Where

26、a request for service complies with the terms of the present Convention, the State addressed may refuse to comply therewith only if it deems that compliance would infringe its sovereignty or security.It may not refuse to comply solely on the ground that, under its internal law, it claims exclusive j

27、urisdiction over the subject-matter of the action or that its internal law would not permit the action upon which the application is based.The Central Authority shall, in case of refusal, promptly inform the applicant and state the reasons for the refusal.第十三條如果送達(dá)請(qǐng)求書符合本公約的規(guī)定,則文書發(fā)往國(guó)只在其認(rèn)為執(zhí)行請(qǐng)求將損害其主權(quán)或安全

28、時(shí)才可拒絕執(zhí)行。一國(guó)不得僅根據(jù)下列理由拒絕執(zhí)行,即:依其國(guó)內(nèi)法,該國(guó)主張對(duì)該項(xiàng)訴訟標(biāo)的專屬管轄權(quán),或其國(guó)內(nèi)法不允許進(jìn)行該項(xiàng)申請(qǐng)所依據(jù)的訴訟。在拒絕執(zhí)行的情況下,中央機(jī)關(guān)應(yīng)迅速通知申請(qǐng)者,并說(shuō)明拒絕的理由。Article 14Difficulties which may arise in connection with the transmission of judicial documents for service shall be settled through diplomatic channels.第十四條在為了送達(dá)而遞送司法文書的過(guò)程中可能產(chǎn)生的困難,應(yīng)通過(guò)外交途徑解決。Articl

29、e 15Where a writ of summons or an equivalent document had to be transmitted abroad for the purpose of service, under the provisions of the present Convention, and the defendant has not appeared, judgment shall not be given until it is established that a) the document was served by a method prescribe

30、d by the internal law of the State addressed for the service of documents in domestic actions upon persons who are within its territory, orb) the document was actually delivered to the defendant or to his residence by another method provided for by this Convention,and that in either of these cases t

31、he service or the delivery was effected in sufficient time to enable the defendant to defend.Each Contracting State shall be free to declare that the judge, notwithstanding the provisions of the first paragraph of this Article, may give judgment even if no certificate of service or delivery has been

32、 received, if all the following conditions are fulfilled-a) the document was transmitted by one of the methods provided for in this Convention,b) a period of time of not less than six months, considered adequate by the judge in the particular case, has elapsed since the date of the transmission of t

33、he document,c) no certificate of any kind has been received, even though every reasonable effort has been made to obtain it through the competent authorities of the State addressed.Notwithstanding the provisions of the preceding paragraphs the judge may order, in case of urgency, any provisional or

34、protective measures.第十五條如須根據(jù)本公約向國(guó)外遞送傳票或類似文書,以便送達(dá),而被告沒(méi)有出庭,則在確定以下情況之前,不得作出判決:(一)該文書已依文書發(fā)往國(guó)的國(guó)內(nèi)法所規(guī)定的在國(guó)內(nèi)訴訟中對(duì)在其境內(nèi)的人送達(dá)文書的方法予以送達(dá);或(二)該文書已依本公約規(guī)定的其它方法被實(shí)際交付被告或其居所。并且,在上述任何一種情況下,送達(dá)或交付均應(yīng)在能保證被告進(jìn)行答辯的足夠時(shí)間內(nèi)完成。每一締約國(guó)均可聲明,只要滿足下述條件,即使未收到送達(dá)或交付的證明書,法官仍可不顧本條第一款的規(guī)定,作出判決:(一)已依本公約所規(guī)定的一種方法遞送該文書;(二)法官根據(jù)具體案件認(rèn)為自遞送文書之日起不少于六個(gè)月的適當(dāng)期間

35、已滿;(三)盡管為獲取證明書已通過(guò)文書發(fā)往國(guó)的主管機(jī)關(guān)盡了一切合理的努力,但仍未收到任何種類的證明書。雖有上述各款規(guī)定,法官仍可在緊急情況下決定采取任何臨時(shí)性或保護(hù)性的措施。Article 16When a writ of summons or an equivalent document had to be transmitted abroad for the purpose of service, under the provisions of the present Convention, and a judgment has been entered against a defenda

36、nt who has not appeared, the judge shall have the power to relieve the defendant from the effects of the expiration of the time for appeal from the judgment if the following conditions are fulfilled a) the defendant, without any fault on his part, did not have knowledge of the document in sufficient

37、 time to defend, or knowledge of the judgment in sufficient time to appeal, andb) the defendant has disclosed a prima facie defence to the action on the merits.An application for relief may be filed only within a reasonable time after the defendant has knowledge of the judgment.Each Contracting Stat

38、e may declare that the application will not be entertained if it is filed after the expiration of a time to be stated in the declaration, but which shall in no case be less than one year following the date of the judgment.This Article shall not apply to judgments concerning status or capacity of per

39、sons.第十六條如須根據(jù)本公約向國(guó)外遞送傳票或類似文書,以便送達(dá),且已對(duì)未出庭的被告作出敗訴判決,則在滿足下述條件的情況下,法官有權(quán)使被告免于該判決因上訴期間屆滿所產(chǎn)生的喪失上訴權(quán)的效果:(一)被告非因自己的過(guò)失,未能在足夠期間內(nèi)知悉該文書,以便提出答辯,或未能在足夠期間內(nèi)知悉該判決,以便提起上訴,并(二)被告對(duì)該案的實(shí)質(zhì)問(wèn)題提出了表面可以成立的答辯理由。被告只能在其知悉該判決后的合理期間內(nèi)提出免除喪失上訴權(quán)效果的申請(qǐng)。每一締約國(guó)均可聲明對(duì)在該聲明中所指明的期間屆滿后提出的申請(qǐng)不予受理,但這一期間在任何情況下均不得少于自判決之日起的一年。本條不適用于有關(guān)人的身份或能力的判決。CHAPTER

40、II EXTRAJUDICIAL DOCUMENTSArticle 17Extrajudicial documents emanating from authorities and judicial officers of a Contracting State may be transmitted for the purpose of service in another Contracting State by the methods and under the provisions of the present Convention.第二章司法外文書第十七條締約一國(guó)的機(jī)關(guān)和司法助理人員發(fā)

41、出的司法外文書可依本公約的方法并按照本公約各條規(guī)定遞送到締約另一國(guó),以便送達(dá)。CHAPTER III GENERAL CLAUSESArticle 18Each Contracting State may designate other authorities in addition to the Central Authority and shall determine the extent of their competence.The applicant shall, however, in all cases, have the right to address a request d

42、irectly to the Central Authority.Federal States shall be free to designate more than one Central Authority.Article 19To the extent that the internal law of a Contracting State permits methods of transmission, other than those provided for in the preceding Articles, of documents coming from abroad, f

43、or service within its territory, the present Convention shall not affect such provisions.第三章一般條款第十八條每一締約國(guó)除指定中央機(jī)關(guān)外,還可指定其它機(jī)關(guān),并應(yīng)確定這些機(jī)關(guān)的主管范圍。但在任何情況下,申請(qǐng)者均有權(quán)將請(qǐng)求書直接送交中央機(jī)關(guān)。聯(lián)邦制國(guó)家有權(quán)指定一個(gè)以上的中央機(jī)關(guān)。第十九條只要締約國(guó)的國(guó)內(nèi)法允許使用上述各條規(guī)定之外的其它方法遞送來(lái)自國(guó)外的文書,以便在其境內(nèi)送達(dá),本公約不影響此類規(guī)定。Article 20The present Convention shall not prevent an agr

44、eement between any two or more Contracting States to dispense with a) the necessity for duplicate copies of transmitted documents as required by the second paragraph of Article 3,b) the language requirements of the third paragraph of Article 5 and Article 7,c) the provisions of the fourth paragraph

45、of Article 5,d) the provisions of the second paragraph of Article 12.第二十條本公約不妨礙兩個(gè)或更多的締約國(guó)達(dá)成協(xié)議,以免除下列規(guī)定的適用:(一)第三條第二款關(guān)于須予遞送的文書必須一式兩份的要求;(二)第五條第三款和第七條關(guān)于文字的要求;(三)第五條第四款的規(guī)定;(四)第十二條第二款的規(guī)定。Article 21Each Contracting State shall, at the time of the deposit of its instrument of ratification or accession, or at

46、 a later date, inform the Ministry of Foreign Affairs of the Netherlands of the following a) the designation of authorities, pursuant to Articles 2 and 18,b) the designation of the authority competent to complete the certificate pursuant to Article 6,c) the designation of the authority competent to

47、receive documents transmitted by consular channels, pursuant to Article 9.Each Contracting State shall similarly inform the Ministry, where appropriate, of a) opposition to the use of methods of transmission pursuant to Articles 8 and 10,b) declarations pursuant to the second paragraph of Article 15

48、 and the third paragraph of Article 16,c) all modifications of the above designations, oppositions and declarations.Article 22Where Parties to the present Convention are also Parties to one or both of the Conventions on civil procedure signed at The Hague on 17th July 1905, and on 1st March 1954, th

49、is Convention shall replace as between them Articles 1 to 7 of the earlier Conventions.Article 23The present Convention shall not affect the application of Article 23 of the Convention on civil procedure signed at The Hague on 17th July 1905, or of Article 24 of the Convention on civil procedure sig

50、ned at The Hague on 1st March 1954.These Articles shall, however, apply only if methods of communication, identical to those provided for in these Conventions, are used.Article 24Supplementary agreements between Parties to the Conventions of 1905 and 1954 shall be considered as equally applicable to

51、 the present Convention, unless the Parties have otherwise agreed.Article 25Without prejudice to the provisions of Articles 22 and 24, the present Convention shall not derogate from Conventions containing provisions on the matters governed by this Convention to which the Contracting States are, or s

52、hall become, Parties.Article 26The present Convention shall be open for signature by the States represented at the Tenth Session of the Hague Conference on Private International Law.It shall be ratified, and the instruments of ratification shall be deposited with the Ministry of Foreign Affairs of t

53、he Netherlands.Article 27The present Convention shall enter into force on the sixtieth day after the deposit of the third instrument of ratification referred to in the second paragraph of Article 26.The Convention shall enter into force for each signatory State which ratifies subsequently on the six

54、tieth day after the deposit of its instrument of ratification.Article 28Any State not represented at the Tenth Session of the Hague Conference on Private International Law may accede to the present Convention after it has entered into force in accordance with the first paragraph of Article 27. The i

55、nstrument of accession shall be deposited with the Ministry of Foreign Affairs of the Netherlands.The Convention shall enter into force for such a State in the absence of any objection from a State, which has ratified the Convention before such deposit, notified to the Ministry of Foreign Affairs of

56、 the Netherlands within a period of six months after the date on which the said Ministry has notified it of such accession.In the absence of any such objection, the Convention shall enter into force for the acceding State on the first day of the month following the expiration of the last of the peri

57、ods referred to in the preceding paragraph.Article 29Any State may, at the time of signature, ratification or accession, declare that the present Convention shall extend to all the territories for the international relations of which it is responsible, or to one or more of them. Such a declaration s

58、hall take effect on the date of entry into force of the Convention for the State concerned.At any time thereafter, such extensions shall be notified to the Ministry of Foreign Affairs of the Netherlands.The Convention shall enter into force for the territories mentioned in such an extension on the sixtieth day after the notification referred to in the preceding paragraph.Article 30The present Convention shall remain in force for five years from
