5、正常經營。4、除有明確約定外,不得干涉乙方正常的經營活動。5、應對市場進行商業(yè)管理,維護并改善市場的整體形象,包括:對商品品種的規(guī)劃和控制、功能區(qū)域的劃分、商品檔次的定位、商品經營的管理及質量管理;服務質量管理;營銷管理;形象設計;市場調研;公共關系協(xié)調;糾紛調解;人員培訓;?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_。6、應對市場進行物業(yè)管理,并負責市場內的安全防范和經營設施的建設及維護,包
6、括:建筑物(包括公共區(qū)域及租賃場地)的管理及維修保養(yǎng);對乙方裝修的審查和監(jiān)督;水、電、氣、空調、電梯、扶梯等設備、管道、線路、設施及系統(tǒng)的管理、維修及保養(yǎng);清潔管理;保安管理并負責市場的公共安全;消防管理;內外各種通道、道路、停車場的管理;?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_。7、做好市場的整體廣告宣傳,并保證每年廣告宣傳費用不低于市場當年租金總額的?_?_?_%。?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_
7、?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_。第七條乙方權利義務1、有權監(jiān)督甲方履行合同約定的各項義務。2、應具備合法的經營資格,并按照工商行政管理部門核準的經營范圍依法亮證照經營。3、應自覺遵守甲方依法制訂的各項規(guī)章制度及索票索證制度,服從甲方的監(jiān)督管理。4、應按期支付租金并承擔因經營產生的各項稅費。5、應愛護并合理使用市場內的各項設施,如需改動應先征得甲方同意,造成損壞的還應承擔修復或賠償責任。6、應按照約定的用途,本著公平合理
8、、誠實信用的原則依法經營,不得損害國家利益及其他經營者和消費者的合法權益,并承擔因違法經營造成的一切后果。7、將場地轉讓給第三人或和其他租戶交換場地的,應先征得甲方的書面同意,按規(guī)定辦理相關手續(xù),并不得出租、轉讓、轉借營業(yè)執(zhí)照。8、應按照甲方的要求提供有關本人或本企業(yè)的備案資料。9、建筑物外立面及建筑物內部非乙方承租場地范圍內的廣告發(fā)布權歸甲方所有,未經甲方同意,乙方不得以任何形式在上述范圍內進行廣告宣傳。?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?

10、等費用的。7、違反保證金協(xié)議的有關約定的。8、未經甲方同意連續(xù)?_?_?_日未開展經營活動的。9、違反甲方依法制訂的規(guī)章制度情節(jié)嚴重或拒不服從甲方管理的。?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_。甲方或乙方因自身原因需提前解除合同的,應提前?_?_?_日書面通知對方,經協(xié)商一致后辦理解除租賃手續(xù),并按照?_?_?_?_?_?_?_?_?_?_?_?_?_的標準向對方支付違約金。因甲方自身原因提前解除合同的,除按約定支付違約金外,還應減收相應的租金,并退還保證金及利息。第九條其他違約責任1、甲方未按約
11、定提供場地或用水、用電等市場內的經營設施或條件致使乙方不能正常經營的,應減收相應租金,乙方有權要求甲方繼續(xù)履行合同或解除合同,并要求甲方賠償相應的損失。2、甲方未按約定投保致使乙方相應的損失無法得到賠償?shù)?,甲方應承擔賠償責任。3、乙方未按照約定支付租金或水電等費用的,應每日向甲方支付遲延租金或費用?_?_?_%的違約金。?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?
12、_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_?_。第十條免責條款因不可抗力或其他不可歸責于雙方的原因,使場地不適于使用或租用時,甲方應減收相應的租金。如果場地無法復原的,本合同自動解除,應退還乙方保證金及利息,雙方互不承擔違約責任。第十一條續(xù)租本合同續(xù)租適用以下第?_?_?_種方式:1、乙方有意在租賃期滿后續(xù)租的,應提前?_?_?_日書面通知甲方,甲方應在租賃期滿前對
13、是否同意續(xù)租進行書面答復。甲方同意續(xù)租的,雙方應重新簽訂租賃合同。租賃期滿前甲方未做出書面答復的,視為甲方同意續(xù)租,租期為不定期,租金標準同本合同。2、租賃期滿乙方如無違約行為的,則享有在同等條件下對場地的優(yōu)先租賃權,如乙方無意續(xù)租的,應在租賃期滿前?_?_?_日內書面通知甲方;乙方有違約行為的,是否續(xù)租由甲方決定。第十二條租賃場地的交還租賃期滿未能續(xù)約或合同因解除等原因提前終止的,乙方應于租賃期滿或合同終止后?_?_?_日內將租賃的場地及甲方提供的配套設施以良好、適租的狀態(tài)交還甲方。乙方拒不交還的,甲方有權采取必要措施予以收回,由此造成的損失由乙方承擔。第十三條爭議解決方式本合同項下發(fā)生的爭
