1、房屋租賃合同中英文對照范本房屋租賃合同lease contract-中英文對比發(fā)布時(shí)間:2010-12-19 11:18:55http:本合同雙方當(dāng)事人出租方甲方:承租方乙方:依據(jù)國家有關(guān)法律、法規(guī)和本市有關(guān)規(guī)定,甲、乙雙方在公平自愿的根底上,經(jīng)友好協(xié)商全都,就甲方將其合法擁有的房屋出租給乙方用法,乙方承租用法甲方房屋事宜,訂立本合同。一、建物地址甲方將其全部的位于上海市區(qū)的房屋及其附屬設(shè)施在良好狀態(tài)下出租給乙方用法。lease contractlessor hereinafter referred to as party a:lessee hereinafter referred to as
2、 party b:party a and b have reached an agreement through friendly consultation to conclude thefollowing contract.1.location of the premisesparty a will lease to party b the premises and attached facilities owned by itself which is located atand in good condition for .二、房屋面積出租房屋的登記面積為平方米建筑面積。三、租賃期限租賃
3、期限自_年_月_日起至_年_月_日止,為期年,甲方應(yīng)于年月日將房屋騰空并交付乙方用法。2.size of the premisesthe registered size of the leased premises is _squaremeters gross size。3.lease termthe lease termwill be frommonthdayyearto_month_day_year。party a will clear the premises and provide it to party b for use before _month_day_year。四、租金1.數(shù)
4、額:雙方商定租金為每月_元整含管理費(fèi)。乙方以_形式支付給甲方.2.租金按_月為壹期支付;第一期租金于_年_月_日以前付清;以后每期租金于每月的_日以前繳納,先付后住假設(shè)乙方以匯款形式支付租金,那么以匯出日為支付日,匯費(fèi)由匯出方擔(dān)當(dāng);甲方收到租金后予書面簽收。3.如乙方逾期支付租金超過七天,那么每天以月租金的0.3支付滯納金;如乙方逾期支付租金超過十天,那么視為乙方自動退租,構(gòu)成違約,甲方有權(quán)收回房屋,并追究乙方違約責(zé)任。4.rental1amount:the rental will be_per monthincluding management fees。party b will pay t

7、monthly rental as overdue fine every day,if the rental be paid10days overdue,party b will be deemed to have withdrawn from the premises and breach the contract.in this situation,party a has the right to take back the premises and take actions against party bs breach.五、押金1.為確保房屋及其附屬設(shè)施之平安與完好,及租賃期內(nèi)相關(guān)費(fèi)用
8、之如期結(jié)算,乙方同意于_年_月_日前支付給甲方押金_元整,甲方在收到押金后予以書面簽收。2.除合同另有商定外,甲方應(yīng)于租賃關(guān)系消退且乙方遷空、點(diǎn)清并付清全部應(yīng)付費(fèi)用后的當(dāng)天將押金全額無息退還乙方。3.因乙方違背本合同的規(guī)定而產(chǎn)生的違約金、損壞賠償金和其它相關(guān)費(fèi)用,甲方可在押金中抵扣,缺乏局部乙方必需在接到甲方付款通知后十日內(nèi)補(bǔ)足。4.因甲方緣由導(dǎo)致乙方無法在租賃期內(nèi)正常租用該物業(yè),甲方應(yīng)馬上全額無息退還押金予乙方,且乙方有權(quán)追究甲方的違約責(zé)任。5.deposit1guarantying the safety and good conditions of the premises and att

10、 the deposit without interest on the day when this contract expires and party b clears the premises and has paid all due rental and other expenses.a.a.六、甲方義務(wù)1.甲方須按時(shí)將房屋及附屬設(shè)施詳見附件交付乙方用法。2.房屋設(shè)施如因質(zhì)量緣由、自然損耗、不行抗力或意外大事而受到損壞,甲方有修繕并擔(dān)當(dāng)相關(guān)費(fèi)用的責(zé)任。如甲方未在兩周內(nèi)修復(fù)該損壞物,以致乙方無法正常用法房屋設(shè)施,乙方有權(quán)終止該合約,并要求退還押金。3.甲方應(yīng)確保出租的房屋享有出租的權(quán)利,
11、如租賃期內(nèi)該房屋發(fā)生全部權(quán)全部或局部轉(zhuǎn)移、設(shè)定他項(xiàng)物權(quán)或其他影響乙方權(quán)益的大事,甲方應(yīng)保證全部權(quán)人、他項(xiàng)權(quán)利人或其他影響乙方權(quán)益的第三者能連續(xù)遵守本合同全部條款,反之如乙方權(quán)益因此患病損害,甲方應(yīng)負(fù)賠償責(zé)任。4.甲方應(yīng)為本合同辦理登記備案手續(xù),如因未辦理相關(guān)登記手續(xù)致該合同無效或損害乙方租賃權(quán)利,應(yīng)由甲方負(fù)責(zé)賠償,且甲方應(yīng)擔(dān)當(dāng)該合同相關(guān)的全部稅費(fèi)。6.obligations of party a1party a will provide the premises and attached facilities see the appendix of furniture list for det
12、ailon schedule to party b for using.2in case the premise and attached facilities are damaged by quality problems,natural damages or accidents,party a will be responsible to repair andpay the relevant expenses.if party a cant repair the damaged facilities in two weeks so that party b cant use the fac
13、ilities normally,party b has the right to terminate the contract and party a must return the deposit.4party a must register this contract with the relevant government authority if not doing so resulting that this contract is inv alid or party bs right of leasing may be damaged ,party a should take t
14、he all responsibilities.party a should also bear the all the relevant taxes.七、乙方義務(wù)1.乙方應(yīng)按合同的規(guī)定按時(shí)支付租金及押金。2.乙方經(jīng)甲方同意,可在房屋內(nèi)添置設(shè)備。租賃期滿后,乙方將添置的設(shè)備搬走,并保證不影響房屋的完好及正常用法。3.未經(jīng)甲方同意,乙方不得將承租的房屋轉(zhuǎn)租或分租,并愛惜用法該房屋如因乙方過失或過錯(cuò)致使房屋及設(shè)施受損,乙方應(yīng)擔(dān)當(dāng)賠償責(zé)任。4.乙方應(yīng)按本合同規(guī)定合法用法該房屋,不得擅自轉(zhuǎn)變用法性質(zhì)。乙方不得在該房屋內(nèi)存放危急物品。否那么,如該房屋及附屬設(shè)施因此受損,乙方應(yīng)擔(dān)當(dāng)全部責(zé)任。5.乙方應(yīng)擔(dān)當(dāng)
15、租賃期內(nèi)的水、電、煤氣、電話費(fèi)、收視費(fèi)、一切因?qū)嶋H用法而產(chǎn)生的費(fèi)用,并按單如期繳納。7.obligations of party b1party b will pay the rental and the deposit on time.2party b ma y add new facilities with party as approval.when this contract expires,party b may take away the added facilities without changing the good conditions of the premises.4p
16、arty b will use the premises lawfully according to this contract without changing the nature of the premises and storing hazardous materials init.otherwise,party b will beresponsible for the damages caused by it八、合同終止及解除的規(guī)定1.乙方在租賃期滿后如需續(xù)租,應(yīng)提早一個(gè)月通知甲方,由雙方另行協(xié)商續(xù)租事宜。在同等條件下乙方享有優(yōu)先續(xù)租權(quán)。2.租賃期滿后,乙方應(yīng)在日內(nèi)將房屋交還甲方;任
17、何滯留物,如未獲得甲方諒解,均視為放棄,聽?wèi){甲方處置,乙方?jīng)Q無異議。3.本合同一經(jīng)雙方簽字后馬上生效;未經(jīng)雙方同意,不得任意終止,如有未盡事宜,甲、乙雙方可另行協(xié)商。8.termination and dissolution of the contract1within one month beforethe contract expires,party b will notify party a if it intends to extend the lease.in this situation,two parties will discuss matters over the exten
18、sion.under the same terms party b has the priority to lease the premises.2when the lease termexpires,party b will return the premises and attached facilities to party a within days.any belongings left in it without party as previous understanding will be deemed to be abandoned by partyb.in this situ
19、ation,party a has the right to dispose of it andparty a will raise no objection.3this contract will be effective after being signed by both parties.any party has no right to terminate this contract without another partys agreement.anything not covered in this contract will be discussed separately by
20、 both parties.九、違約及處理1.甲、乙雙方任何一方在未征得對方諒解的狀況下,不履行本合同規(guī)定條款,導(dǎo)致本合同中途終止,那么視為該方違約,雙方同意違約金為元整,假設(shè)違約金缺乏彌補(bǔ)無過錯(cuò)方之損失,那么違約方還需就缺乏局部支付賠償金。2.假設(shè)雙方在執(zhí)行本合同或與本合同有關(guān)的事情時(shí)發(fā)生爭議,應(yīng)首先友好協(xié)商;協(xié)商不成,可向有管轄權(quán)的人民法院提起訴訟。3.本合同一經(jīng)雙方簽字后馬上生效;未經(jīng)雙方同意,不得任意終止,如有未盡事宜,甲、乙雙方可另行協(xié)商。9.breach of the contract2both parties will solve the disputes arising from execution of the contract or in connection with the contract thr
