1、房屋租賃合同出租方(甲方):XXX有限公司Lessor (Party A): XXXMan ageme nt Co.,ltd承租方(乙方):Lessee (Party B):根據(jù)中華人民共和國合同法、上海市房屋租賃條例等相關(guān)法律法規(guī) 的規(guī)定,甲、乙雙方經(jīng)丙方居間介紹,在平等、自愿、公平和誠信的基礎(chǔ)上,經(jīng)協(xié) 商一致,就乙方承租甲方的房屋事宜,簽訂本合同,以資共同遵守:This Con tract is madeby Party C and betwee n both parties after n egotiati on on an equal, volun tary, fair and goo

2、d-faith basis in accorda nee with“ Con tract Lawof the People' s Republic of Chi na ” ,“ Shan ghai Muni cipalityRegulatio ns on the Leas ing of Build ing Premises” and other releva nt lawsand regulations, with regard to the issue that Party B will rent the house of Party A:一、出租房屋基本情況:(下稱“該房屋”,實際

3、情況以權(quán)屬證明或相關(guān)法律文書 的記載內(nèi)容為準)I. Usage of the ren ted premises乙方向甲方承諾,租賃該房屋作為 使用,并遵守國家和本市有關(guān)于房 地產(chǎn)使用和物業(yè)管理的規(guī)定。Party B shall make commitment to Party A that the premises shall be usedas

5、and shall abide by the regulati ons of real estate use and property man ageme nt in China and Shan ghai Muni cipality.三、交付日期和租賃期限III. Date of delivery and term of leasing3.1 甲乙雙方約定,甲方應(yīng)于_年月_日之前向乙方交付該房屋。交付時甲、乙雙方在丙方見證下簽訂本合同之附件二房屋交接書。3.1 Both parties have agreed that Party A shall hand over the premises

Rent, method and time of payme nt4.1 甲乙雙方約定,該房屋每月租金為(人民幣)元(大寫 元整)4.1 Both p

7、arties have agreed that the rent of the premises per month is (RMB) .4.2 租金以個月為一期支付。乙方應(yīng)于每期提前 _日前向甲方支付租金。逾期支付的,每逾期一日,則乙方需按月租金的支付逾期違約金。4.2 The rent shall be paid with mon ths as a payme nt period. Party B shall pay the rent before the day in the first month of every payme ntperiod. In case of payment

8、delay, the penalty shall be collected at the daily rate of %.4.3 乙方支付租金的方式如下:甲方收取租金的賬戶如下:戶名:XX有限公司開戶行:XXX銀行賬號:4.3 Party B shall pay the rent by the follow ing means: bank tran sfer. 9、 The above rent in cludes五、保證金(押金)和其他費用V. Guara ntee deposit (security deposit) and other fees5.1甲乙雙方約定,在簽訂本合同時,乙方應(yīng)向甲方支付房屋租賃保證金(押金), 保證金(押金)為人民幣 元(大寫_元整)。甲方收取該保證金(押金)后應(yīng)向乙方出具收款憑證。租賃關(guān)系終止時,甲方收取的房屋租賃保證金(押金) 除用于抵充本合同約定由乙方承擔(dān)的費用外,剩余部分無息歸還乙方。5.1 Both parties have agreed that at the time of ( han dover of th

Upon receiving the guarantee deposit (security deposit), Party Ashall issue the receipt voucher to Par

At the time of the term in atio nof leas ingrelati on, the guara ntee deposit (security deposit) collected byParty A shall be used to offset the fees undertaken by Party B as agreed in this Con tract and the remai ning porti on shall be returned to Party B without in terest.5.2 租賃期間內(nèi)發(fā)生的電費、電話(通

12、訊)費等房屋使用費用由乙方承擔(dān);物業(yè)管理費由甲方承擔(dān)。5.2 The cost aris ing from water, electricity, gas, teleph one call(com muni catio n) and TV and so on( etc.) duri ng the leas ing period shall beun dertake n by Party B; property man ageme nt fee shall be un dertake n by (Party A Party B).六、房屋使用要求和維修責(zé)任VI. House use requir

13、eme nts and maintenance resp on sibility6.1 租賃期間,乙方發(fā)現(xiàn)該房屋及其附屬設(shè)施有損壞或故障時,應(yīng)及時通知甲方修復(fù);甲方應(yīng)在接到乙方通知后的 日內(nèi)進行維修。逾期不維修的,乙方可代為維 修,費用由甲方承擔(dān)。6.1 During the leas ing period, if Party B discovers any damage or troublewith the premises and the accessory facilities, Party B shall timely notify Party A for repair; Party

14、A shall carry out the repair within day(s) after receiving the notification. In case of delay of repair, Party B may make the repair in place of Party A at the cost of Party A.6.2 租賃期間,乙方應(yīng)合理使用并愛護該房屋及其附屬設(shè)施。因乙方使用不當或 不合理使用,致使該房屋及其附屬設(shè)施損壞或發(fā)生故障的,乙方應(yīng)負責(zé)維修。乙方 拒不維修的,甲方可代為維修,費用由乙方承擔(dān)。6.2 During the leas ing per

15、iod, Party B shall make reas on able use of the premises and the accessory facilities. Any damage or trouble aris ing from improper use or un reas on able use of the premises and accessory facilities shall be repaired by Party B. In the eve nt that Party B refuses the repair, Party A may carry out t

16、he repair in place of Party B at the cost of PartyB.6.3 租賃期間,甲方應(yīng)保證該房屋及其附屬設(shè)施處于正常的可使用和安全的狀態(tài)。甲方對該房屋進行檢查、養(yǎng)護,應(yīng)提前日通知乙方。檢查養(yǎng)護時,乙方應(yīng)予以配合。甲方應(yīng)減少對乙方使用該房屋的影響。6.3 During the leasing period, Party A shall ensure normal availabilityand safe status of the premises and accessory facilities. If Party A intends to carry

17、 out inspection and maintenance on the premises, Party A shall notify Party B days in advanee. During the inspection and maintenance, Party B shall provide coord in ati on. Party A shall mini mize the in flue nce on the use of the premises.6.4 乙方需裝修或者增設(shè)附屬設(shè)施和設(shè)備的,應(yīng)事先征得甲方的書面同意,按規(guī) 定須向有關(guān)部門報批的,則應(yīng)由甲方報請有關(guān)部門

18、批準后,方可進行。乙方增設(shè)的 附屬設(shè)施和設(shè)備的歸屬及其維修責(zé)任由甲、乙雙方另行書面約定。6.4 In case that Party B intends to decorate the premises or add accessory facilities and equipments, Party B shall obtain written permission fromParty A in adva nee; if it is required so, ( Party A Party B en trustedby Party A) shall submit such behavior

19、to the compete nt departme nt for approval before the impleme ntatio n. The own ership and maintenance of the accessory facilities and equipme nts added by Party B shall be additi on ally agreed by both parties in written form.七、房屋返還與續(xù)租VII. House retur n and renting ren ewal7.1 乙方應(yīng)在本合同的租賃期限屆滿之后的 _日內(nèi)

20、返還該房屋,未經(jīng)甲方同意逾 期返還該房屋的,每逾期一日,乙方應(yīng)以日租金 向甲方支付該房屋占用期間的 使用費。7.1 Party B shall return the premises within days after thetermination of the leasing period, and in case of any delay for the return of the premises without permission of Party A, Party B shall pay Party A the use fee of the premises at the dail

21、y rate equivale nt to % of daily rent duri ng the occupati on of the premises.7.2 乙方如果需要續(xù)租的,應(yīng)在租賃期限屆滿兩個月之前向甲方提出,甲方同意 的,雙方另行簽訂相關(guān)續(xù)租文書。乙方在同等條件下享有優(yōu)先承租權(quán)。7.2 In case that Party B wan ts to renew the Con tract, Party B shall raise the ren ewal inten ti on to Party A two mon ths before the term in ati on of

22、theleas ing period, and with the approval of Party A, the ren ewal con tract will be additi on ally sig ned betwee n both parties. Un der the equivale nt con diti on, Party B shall have the priority for obtaining the lease.7.3 租賃期限屆滿,甲乙雙方未續(xù)簽租賃合同,乙方繼續(xù)支付租金,甲方未表示拒絕的,則按法律相關(guān)規(guī)定,雙方之間成立不定期租賃關(guān)系。在不定期租賃關(guān)系中, 甲方

23、有權(quán)提前一個月通知乙方租賃關(guān)系終止。7.3 After the term in ati onof the leas ing period, if no ren ewal con tract issig ned by both parties and Party B continues pay ing the rent, which is notrefused by Party A, the non- fixed-term leas ing relati ons are established betwee n both parties accordi ng to releva nt laws

24、and regulati ons. During such non- fixed-termleasing relations,Party A shall have the right to terminatethe leas ing relati ons by no tify ing Party B one (1) mon th in adva nee.7.4 乙方返還該房屋應(yīng)符合正常使用后的狀態(tài)。返還時,應(yīng)經(jīng)甲方驗收認可,并 相互結(jié)清各自應(yīng)當承擔(dān)的費用。7.4 The premises returned by Party B shall be con siste nt with the st

25、atus after normal use of the premises. Upon return of the premises, Party B shall in spect the premises before its accepta nee and the releva nt fees for respective parties shall be settled.八、轉(zhuǎn)租與轉(zhuǎn)讓VIII. Sublease and tran sfer8.1 除甲方已經(jīng)在本合同中同意乙方轉(zhuǎn)租外,乙方在租賃期限內(nèi),不可將該房屋部分或全部轉(zhuǎn)租給他人。8.1 Except that Party A agr

26、ees in this Con tract that the premises may be subleased by Party B, Party B shall not sublease part or all of the premises to any other person within the leasing period, without written permissionof Party A. An yhow one liv ing room in the orig inal household type shall not be separated for subleas

27、 ing.九、解除合同的條件IX. Con diti ons for con tract can celati on9.1 甲乙雙方同意在租賃期限內(nèi),有下列情形之一的,本合同終止,雙方互不承 擔(dān)責(zé)任:9.1 Both parties agree that duri ng the leas ing period, this Con tract shall be term in ated n either party n eedi ng to assu ming any resp on sibility in caseof any of the follow ing situati ons;(一)

28、 該房地產(chǎn)占用范圍內(nèi)的土地使用權(quán)依法提前收回的;(1) The use right of the land occupied by the real estate has bee n legally retrieved;(二) 該房地產(chǎn)因社會公共利益被依法征用的;(2) The premises are occupied by means of legal requisiti on due to social and public in terests;(三) 該房地產(chǎn)因城市建設(shè)需要被依法列入房屋拆遷許可范圍內(nèi)的;(3) This real estate has to be legally p

29、ut into the disma ntl ing range due to urba n con struct ion;(四) 該房屋毀損、滅失或者被鑒定為危險房屋的;(4) The premises are damaged, destroyed or verified as dan gerous house;(五) 甲方已告知乙方該房屋出租前已設(shè)定抵押,現(xiàn)被處分的;(5) Party A has notified Party B that the premises have been pledged before leas ing and now has bee n disposed;9.

30、2 甲乙雙方同意,有下列情形之一的,一方可書面通知另一方解除本合同。違反合同的一方,應(yīng)向另一方按月租金的 倍支付違約金,給對方造成損失的,支付的違約金不足以抵付損失的,還應(yīng)賠償造成的損失與違約金的差額部分:9.2 Both parties agree that either party maynotify the other party to cancel this Con tract in writte n form in case of any of the followi ng situati on, and the party that breaches this Con tract

31、shall pay the other party the liquidated damages equivale nt to time(s) of the mon thly rent, and in case that the losses in curred to both parties cannot be offset by the liquidated damages paid by the breach ing party, the breachi ng party shall pay the differe nee betwee n the in curred losses an

32、d the liquidated damages;(一) 甲方未按時交付該房屋,經(jīng)乙方催告后日仍未交付的;(I) Party A fails to hand over the premises on time, and eve ndays after exige nt no tice of Party B;(二) 甲方交付的該房屋不符合本合同的約定,致使不能實現(xiàn)租賃目的的;或甲方 交付的房屋存在缺陷,危及乙方安全的;(II) The premises han ded over by Party A do not comply with the agreeme ntin this Con tra

33、ct, which therefore makes it impossible to realize the leas ing purpose; or the premises handed over by Party A have the defects endangering the safety of Party B;(三) 乙方在甲方按時交付該房屋的情形下,未能配合辦理交房手續(xù),經(jīng)甲方催告后日仍未配合辦理交房手續(xù)的;(III) In spite of the timely han dover of the premises by Party A, PartyB fails to coo

34、perate to go through the procedures for the han dover of the premises days after the exige nt no tice of Party A;(四) 乙方未征得甲方書面同意改變該房屋用途,致使該房屋損壞的;(IV) Party B cha nged the use of the premises without writte n permissi on ofParty A and therefore in curred the damage of the premises;(五) 因乙方原因造成該房屋主體結(jié)構(gòu)損

35、壞的;(V) The main structure of the premises is damageddue to the reasons of Party B;(六) 乙方擅自轉(zhuǎn)租該房屋或轉(zhuǎn)讓該房屋承租權(quán)的;(VI) Party B subleases the premises or transfers the leasing right of thepremises without permissi on of Party A;(七) 乙方逾期不支付租金累計超過 天的;(VII) Party fails to pay the rent up to more tha ndays; 十、違約

36、責(zé)任X. Breaching liability10.1該房屋交付時存在缺陷的,甲方應(yīng)自交付日起 日內(nèi)進行修復(fù),逾期不修復(fù)的,甲方同意減少租金并變更有關(guān)租金條款。10.1 In case of any defect with the premises at the time of handover, Party A shall makethe repair with in days after the han dover, and if no repair is made even after the stipulated period, Party A agrees to reduce th

37、e rent and cha nge the clause related to the rent.10.2 租賃期間,甲方不及時履行本合同約定的維修與養(yǎng)護責(zé)任,致使該房屋損壞,造成乙方財產(chǎn)損失或人身傷害的,甲方應(yīng)承擔(dān)賠償責(zé)任。10.2 During the leasing period, Party A fails to timely perform themaintenance resp on sibilityof the premises as agreed in the Con tract, whichtherefore has in curred the damage of the

38、premises, the n any property loss or pers onal injury in curred upon Party B shall be compe nsated by Party A.10.3 租賃期間,非本合同規(guī)定的情況,甲方擅自解除本合同,提前收回該房屋的, 甲方應(yīng)按月租金的倍向乙方支付違約金。若違約金不足以抵付乙方損失的,甲 方還應(yīng)負責(zé)賠償。10.3 During the leas ing period, Party A un laterally can celled thisCon tract and took back the premises i

39、n adva nce in case of the situati ons other tha n those stipulated in the Con tract, Party A shall pay Party B the liquidated damages equivale nt to times of m on thly ren t. If the liquidated damages cannot compe nsate for the loss in curred upon Party B, Party A shall provide further compe nsati o

40、n.10.4 乙方未征得甲方書面同意或者超出甲方書面同意的范圍和要求裝修房屋或者增設(shè)附屬設(shè)施和設(shè)備的,甲方可以要求乙方恢復(fù)房屋原狀或賠償損失。10.4 If Party B decorates the premises or adds the accessory facilities or equipme nts without writte n permissi on of Party A or bey ond the scope and requireme nts agreed in writte n permissi on of Party A, Party A may require

41、Party B to recover the premises to the original state, or compensate for the loss.10.5 租賃期間,非本合同規(guī)定的情況,乙方中途擅自退租的,乙方應(yīng)按月 租金的倍向甲方支付違約金。若違約金不足以抵付甲方損失的,乙方還應(yīng)負責(zé)賠償。10.5 During the leasing period, in case of the situation other than those stipulated in the Con tract, Party B stops the renting. Party B shall p

42、ay Party A the liquidated damagesequivale nt totime(s) of mon thlyren t. If the rent is not eno ugh to offset the loss in curred upon Party A, Party B shall provide further compe nsati on.十一、其他條款XI. Others11.1 本合同及附件一自甲、乙雙方于本合同簽章處簽字或簽章后立即生效。11.1 This Con tract and its Appe ndix I shall come into effect upon thesig natures or seal stampi ng of Parties A and B .11.2 本合同空格處填寫文字與鉛印文字具有同等法律效力,若填寫文字與鉛印文 字相沖突,以填寫文字為準。若有未盡事宜,可簽訂補充協(xié)議進行約定,若補充協(xié) 議與本協(xié)議相沖突,以補充協(xié)議為準。11.2 The words filled and prin ted in the bla nk part of this Con tract shallhave
