1、SAFEDRINKINGWATERANDTOXICENFORCEMENTACTOF1986(Chapter6.6addedbyProposition651986GeneralElection)ProhibitionOnContaminatingDrinkingWaterWithChemicalsKnowntoCauseCancerorReproductiveToxicity.Nopersoninthecourseofdoingbusinessshallknowinglydischargeorreleaseachemicalknowntothestatetocausecancerorreprod

2、uctivetoxicityintowaterorontoorintolandwheresuchchemicalpassesorprobablywillpassintoanysourceofdrinkingwater,notwithstandinganyotherprovisionorauthorizationoflawexceptasprovidedinSection25249.9.RequiredWarningBeforeExposureToChemicalsKnowntoCauseCancerOrReproductiveToxicity.Nopersoninthecourseofdoin

3、gbusinessshallknowinglyandintentionallyexposeanyindividualtoachemicalknowntothestatetocausecancerorreproductivetoxicitywithoutfirstgivingclearandreasonablewarningtosuchindividual,exceptasprovidedinSection25249.10.Enforcement.AnypersonthatviolatesorthreatenstoviolateSection25249.5or25249.6maybeenjoin

4、edinanycourtofcompetentjurisdiction.(1)AnypersonwhohasviolatedSection25249.5or25249.6shallbeliableforacivilpenaltynottoexceedtwothousandfivehundreddollars($2500)perdayforeachviolationinadditiontoanyotherpenaltyestablishedbylaw.Thatcivilpenaltymaybeassessedandrecoveredinacivilactionbroughtinanycourto

5、fcompetentjurisdiction.Inassessingtheamountofacivilpenaltyforaviolationofthischapter,thecourtshallconsiderallofthefollowing:Thenatureandextentoftheviolation.Thenumberof,andseverityof,theviolations.Theeconomiceffectofthepenaltyontheviolator.Whethertheviolatortookgoodfaithmeasurestocomplywiththischapt

6、erandthetimethesemeasuresweretaken.Thewillfulnessoftheviolatorsmisconduct.Thedeterrenteffectthattheimpositionofthepenaltywouldhaveonboththeviolatorandtheregulatedcommunityasawhole.Anyotherfactorthatjusticemayrequire.ActionspursuanttothissectionmaybebroughtbytheAttorneyGeneralinthenameofthepeopleofth

7、eStateofCalifornia,byanydistrictattorney,byanycityattorneyofacityhavingapopulationinexcessof750,000,or,withtheconsentofthedistrictattorney,byacityprosecutorinanycityorcityandcountyhavingafull-timecityprosecutor,orasprovidedinsubdivision(d).Actionspursuanttothissectionmaybebroughtbyanypersoninthepubl

8、icinterestifbothofthefollowingrequirementsaremet:Theprivateactioniscommencedmorethan60daysfromthedatethatthepersonhasgivennoticeofanallegedviolationofSection25249.5or25249.6thatisthesubjectoftheprivateactiontotheAttorneyGeneralandthedistrictattorney,cityattorney,orprosecutorinwhosejurisdictionthevio

9、lationisallegedtohaveoccurred,andtotheallegedviolator.IfthenoticeallegesaviolationofSection25249.6,thenoticeoftheallegedviolationshallincludeacertificateofmeritexecutedbytheattorneyforthenoticingparty,orbythenoticingparty,ifthenoticingpartyisnotrepresentedbyanattorney.Thecertificateofmeritshallstate

10、thatthepersonexecutingthecertificatehasconsultedwithoneormorepersonswithrelevantandappropriateexperienceorexpertisewhohasreviewedfacts,studies,orotherdataregardingtheexposuretothelistedchemicalthatisthesubjectoftheaction,andthat,basedonthatinformation,thepersonexecutingthecertificatebelievesthereisa

11、reasonableandmeritoriouscasefortheprivateaction.Factualinformationsufficienttoestablishthebasisofthecertificateofmerit,includingtheinformationidentifiedinparagraph(2)ofsubdivision(h),shallbeattachedtothecertificateofmeritthatisservedontheAttorneyGeneral.NeithertheAttorneyGeneral,anydistrictattorney,

12、anycityattorneynoranyprosecutorhascommencedandisdiligentlyprosecutinganactionagainsttheviolation.Anypersonbringinganactioninthepublicinterestpursuanttosubdivision(d)andanypersonfilinganyactioninwhichaviolationofthischapterisallegedshallnotifytheAttorneyGeneralthattheactionhasbeenfiled.Neitherthissub

13、divisionnortheproceduresprovidedinsubdivisions(f)to(j),inclusive,shallaffecttherequirementsimposedbythestatuteoracourtdecisioninexistenceonJanuary1,2002concerningwhetheranypersonfilinganyactioninwhichaviolationofthischapterisallegedisrequiredtocomplywiththerequirementsofsubdivision(d).(1)Anypersonbr

14、inginganactioninthepublicinterestpursuanttosubdivision(d),anypersonfilinganyactioninwhichaviolationofthischapterisalleged,oranyprivatepersonsettlinganyviolationofthischapterallegedinanoticegivenpursuanttoparagraph(1)ofsubdivision(d),shall,aftertheactionorviolationiseithersubjecttoasettlementortoajud

15、gment,submittotheAttorneyGeneralareportingformthatincludestheresultsofthatsettlementorjudgmentandthefinaldispositionofthecase,evenifdismissed.Atthetimeofthefilingofanyjudgmentpursuanttoanactionbroughtinthepublicinterestpursuanttosubdivision(d),oranyactionbroughtbyaprivatepersoninwhichaviolationofthi

16、schapterisalleged,theplaintiffshallfileanaffidavitverifyingthatthereportrequiredbythissubdivisionhasbeenaccuratelycompletedandsubmittedtotheAttorneyGeneral.(2)Anypersonbringinganactioninthepublicinterestpursuanttosubdivisionoranyprivatepersonbringinganactioninwhichaviolationofthischapterisalleged,sh

17、all,aftertheactioniseithersubjecttoasettlement,withorwithoutcourtapproval,ortoajudgment,submittotheAttorneyGeneralareportthatincludesinformationonanycorrectiveactionbeingtakenasapartofthesettlementorresolutionoftheaction.TheAttorneyGeneralshalldevelopareportingformthatspecifiestheinformationthatshal

18、lbereported,including,butnotlimitedto,forpurposesofsubdivision(e),thedatetheactionwasfiled,thenatureofthereliefsought,andforpurposesofthissubdivision,theamountofthesettlementorcivilpenaltyassessed,otherfinancialtermsofthesettlement,andanyotherinformationtheAttorneyGeneraldeemsappropriate.Ifthereisas

19、ettlementofanactionbroughtbyapersoninthepublicinterestundersubdivision(d),theplaintiffshallsubmitthesettlement,otherthanavoluntarydismissalinwhichnoconsiderationisreceivedfromthedefendant,tothecourtforapprovaluponnoticedmotion,andthecourtmayapprovethesettlementonlyifthecourtmakesallofthefollowingfin

20、dings:Anywarningthatisrequiredbythesettlementcomplieswiththischapter.AnyawardofattorneysfeesisreasonableunderCalifornialaw.Anypenaltyamountisreasonablebasedonthecriteriasetforthinparagraph(2)ofsubdivision(b).Theplaintiffsubjecttoparagraph(4)hastheburdenofproducingevidencesufficienttosustaineachrequi

21、redfinding.TheplaintiffshallservethemotionandallsupportingpapersontheAttorneyGeneral,whomayappearandparticipateinanyproceedingwithoutinterveninginthecase.Neitherthissubdivisionnortheproceduresprovidedinsubdivision(e)andsubdivisions(g)to(j),inclusive,shallaffecttherequirementsimposedbystatuteoracourt

22、decisioninexistenceontheJanuary1,2002concerningwhetherclaimsraisedbyanypersonorpublicprosecutornotapartytotheactionareprecludedbyasettlementapprovedbythecourt.TheAttorneyGeneralshallmaintainarecordoftheinformationsubmittedpursuanttosubdivisions(e)and(f)andshallmakethisinformationavailabletothepublic

23、.(1)Exceptasprovidedinparagraph(2),thebasisforthecertificateofmeritrequiredbysubdivision(d)isnotdiscoverable.However,nothinginthissubdivisionshallprecludethediscoveryofinformationrelatedtothecertificateofmeritifthatinformationisrelevanttothesubjectmatteroftheactionandisotherwisediscoverable,solelyon

24、thegroundthatitwasusedinsupportofthecertificateofmerit.(2)Upontheconclusionofanactionbroughtpursuanttosubdivision(d)withrespecttoanydefendant,ifthetrialcourtdeterminesthattherewasnoactualorthreatenedexposuretoalistedchemical,thecourtmay,uponthemotionofthatallegedviolatororuponthecourtsownmotion,revi

25、ewthebasisforthebeliefofthepersonexecutingthecertificateofmerit,expressedinthecertificateofmerit,thatanexposuretoalistedchemicalhadoccurredorwasthreatened.Theinformationinthecertificateofmerit,includingtheidentityofthepersonsconsultedwithandreliedonbythecertifier,andthefacts,studies,orotherdatarevie

26、wedbythosepersons,shallbedisclosedtothecourtinanin-cameraproceedingatwhichthemovingpartyshallnotbepresent.Ifthecourtfindsthattherewasnocrediblefactualbasisforthecertifiersbeliefthatanexposuretoalistedchemicalhasoccurredorwasthreatened,thentheactionshallbedeemedfrivolouswithinthemeaningofSection128.6

27、or128.7oftheCodeofCivilProcedure,whicheverprovisionisapplicabletotheaction.ThecourtshallnotfindafactualbasiscredibleonthebasisofalegaltheoryofliabilitythatisfrivolouswithinthemeaningofSection128.6or128.7oftheCodeofCivilProcedure,whicheverprovisionisapplicabletotheaction.TheAttorneyGeneralmayprovidet

28、hefactualinformationsubmittedtoestablishthebasisofthecertificateofmeritonrequesttoanydistrictattorney,cityattorney,orprosecutorwithinwhosejurisdictiontheviolationisallegedtohaveoccurred,ortoanyotherstateorfederalgovernmentagency,butinallotherrespectstheAttorneyGeneralshallmaintain,andensurethatallre

29、cipientsmaintain,thesubmittedinformationasconfidentialofficialinformationtothefullextentauthorizedinSection1040oftheEvidenceCode.InanyactionbroughtbytheAttorneyGeneral,adistrictattorney,acityattorney,oraprosecutorpursuanttothischapter,theAttorneyGeneral,districtattorney,cityattorney,orprosecutormays

30、eekandrecovercostsandattorneysfeesonbehalfofanypartywhoprovidesanoticepursuanttosubdivision(d)andwhorendersassistanceinthataction.ListOfChemicalsKnowntoCauseCancerOrReproductiveToxicity.OnorbeforeMarch1,1987,theGovernorshallcausetobepublishedalistofthosechemicalsknowntothestatetocausecancerorreprodu

31、ctivetoxicitywithinthemeaningofthischapter,andheshallcausesuchlisttoberevisedandrepublishedinlightofadditionalknowledgeatleastonceperyearthereafter.SuchlistshallincludeataminimumthosesubstancesidentifiedbyreferenceinLaborCodeSection6382(b)(1)andthosesubstancesidentifiedadditionallybyreferenceinLabor

32、CodeSection6382(d).Achemicalisknowntothestatetocausecancerorreproductivetoxicitywithinthemeaningofthischapterifintheopinionofthestatesqualifiedexpertsithasbeenclearlyshownthroughscientificallyvalidtestingaccordingtogenerallyacceptedprinciplestocausecancerorreproductivetoxicity,orifabodyconsideredtob

33、eauthoritativebysuchexpertshasformallyidentifieditascausingcancerorreproductivetoxicity,orifanagencyofthestateorfederalgovernmenthasformallyrequiredittobelabeledoridentifiedascausingcancerorreproductivetoxicity.OnorbeforeJanuary1,1989,andatleastonceperyearthereafter,theGovernorshallcausetobepublishe

34、daseparatelistofthosechemicalsthatatthetimeofpublicationarerequiredbystateorfederallawtohavebeentestedforpotentialtocausecancerorreproductivetoxicitybutthatthestatesqualifiedexpertshavenotfoundtohavebeenadequatelytestedasrequired.TheGovernorshallidentifyandconsultwiththestatesqualifiedexpertsasneces

35、sarytocarryouthisdutiesunderthissection.IncarryingoutthedutiesoftheGovernorunderthissection,theGovernorandhisdesignatesshallnotbeconsideredtobeadoptingoramendingaregulationwithinthemeaningoftheAdministrativeProcedureActasdefinedinGovernmentCodeSection11370.ExemptionsfromDischargeProhibition.Section2

36、5249.5shallnotapplytoanydischargeorreleasethattakesplaceslessthantwentymonthssubsequenttothelistingofthechemicalinquestiononthelistrequiredtobepublishedundersubdivision(a)ofSection25249.8.Section25249.5shallnotapplytoanydischargeorreleasethatmeetsbothofthefollowingcriteria:(1)Thedischargeorreleasewi

37、llnotcauseanysignificantamountofthedischargedorreleasedchemicaltoenteranysourceofdrinkingwater.(2)Thedischargeorreleaseisinconformitywithallotherlawsandwitheveryapplicableregulation,permit,requirement,andorder.InanyactionbroughttoenforceSection25249.5,theburdenofshowingthatadischargeorreleasemeetsth

38、ecriteriaofthissubdivisionshallbeonthedefendant.ExemptionsfromWarningRequirement.Section25249.6shallnotapplytoanyofthefollowing:Anexposureforwhichfederallawgovernswarninginamannerthatpreemptsstateauthority.Anexposurethattakesplacelessthantwelvemonthssubsequenttothelistingofthechemicalinquestiononthe

39、listrequiredtobepublishedundersubdivision(a)ofSection25249.8.Anexposureforwhichthepersonresponsiblecanshowthattheexposureposesnosignificantriskassuminglifetimeexposureatthelevelinquestionforsubstancesknowntothestatetocausecancer,andthattheexposurewillhavenoobservableeffectassumingexposureatonethousa

40、nd(1000)timesthelevelinquestionforsubstancesknowntothestatetocausereproductivetoxicity,basedonevidenceandstandardsofcomparablescientificvaliditytotheevidenceandstandardswhichformthescientificbasisforthelistingofsuchchemicalpursuanttosubdivision(a)ofSection25249.8.InanyactionbroughttoenforceSection25

41、249.6,theburdenofshowingthatanexposuremeetsthecriteriaofthissubdivisionshallbeonthedefendant.Definitions.Forpurposesofthischapter:Personmeansanindividual,trust,firm,jointstockcompany,corporation,company,partnership,limitedliabilitycompany,andassociation.Personinthecourseofdoingbusinessdoesnotinclude

42、anypersonemployingfewerthan10employeesinhisorherbusiness;anycity,county,ordistrictoranydepartmentoragencythereoforthestateoranydepartmentoragencythereoforthefederalgovernmentoranydepartmentoragencythereof;oranyentityinitsoperationofapublicwatersystemasdefinedinSection4010.1.Significantamountmeansany

43、detectableamountexceptanamountwhichwouldmeettheexemptiontestinsubdivision(c)ofSection25249.10ifanindividualwereexposedtosuchanamountindrinkingwater.Sourceofdrinkingwatermeanseitherapresentsourceofdrinkingwaterorwaterwhichisidentifiedordesignatedinawaterqualitycontrolplanadoptedbyaregionalboardasbein

44、gsuitablefordomesticormunicipaluses.Threatentoviolatemeanstocreateaconditioninwhichthereisasubstantialprobabilitythataviolationwilloccur.WarningwithinthemeaningofSection25249.6neednotbeprovidedseparatelytoeachexposedindividualandmaybeprovidedbygeneralmethodssuchaslabelsonconsumerproducts,inclusionof

45、noticesinmailingstowatercustomers,postingofnotices,placingnoticesinpublicnewsmedia,andthelike,providedthatthewarningaccomplishedisclearandreasonable.Inordertominimizetheburdenonretailsellersofconsumerproductsincludingfoods,regulationsimplementingSection25249.6shalltotheextentpracticableplacetheoblig

46、ationtoprovideanywarningmaterialssuchaslabelsontheproducerorpackagerratherthanontheretailseller,exceptwheretheretailselleritselfisresponsibleforintroducingachemicalknowntothestatetocausecancerorreproductivetoxicityintotheconsumerproductinquestion.(a)TheGovernorshalldesignatealeadagencyandotheragenci

47、esthatmayberequiredtoimplementthischapter,includingthissection.Eachagencysodesignatedmayadoptandmodifyregulations,standards,andpermitsasnecessarytoconformwithandimplementthischapterandtofurtheritspurposes.(b)TheSafeDrinkingWaterandToxicEnforcementFundisherebyestablishedintheStateTreasury.Thedirector

48、oftheleadagencydesignatedbytheGovernortoimplementthischaptermayexpendthefundsintheSafeDrinkingWaterandToxicEnforcementFund,uponappropriationbytheLegislature,toimplementandadministerthischapter.InadditiontoanyothermoneythatmaybedepositedintheSafeDrinkingWaterandToxicEnforcementFund,allofthefollowinga

49、mountsshallbedepositedinthefund:(1)Seventy-fivepercentofallcivilandcriminalpenaltiescollectedpursuanttothischapter.(2)AnyinterestearneduponthemoneydepositedintotheSafeDrinkingWaterandToxicEnforcementFund.Twenty-fivepercentofallcivilandcriminalpenaltiescollectedpursuanttothischaptershallbepaidtotheof

50、ficeofthecityattorney,cityprosecutor,districtattorney,orAttorneyGeneral,whicheverofficebroughttheaction,orinthecaseofanactionbroughtbyapersonundersubdivision(d)ofSection25249.7,tothatperson.PreservationOfExistingRights,Obligations,andPenalties.Nothinginthischaptershallalterordiminishanylegalobligati

51、onotherwiserequiredincommonlaworbystatuteorregulation,andnothinginthischaptershallcreateorenlargeanydefenseinanyactiontoenforcesuchlegalobligation.Penaltiesandsanctionsimposedunderthischaptershallbeinadditiontoanypenaltiesorsanctionsotherwiseprescribedbylaw.25180.7.(a)Withinthemeaningofthissection,a

52、designatedgovernmentemployeeisanypersondefinedasadesignatedemployeebyGovernmentCodeSection82019,asamended.(b)Anydesignatedgovernmentemployeewhoobtainsinformationinthecourseofhisofficialdutiesrevealingtheillegaldischargeorthreatenedillegaldischargeofahazardouswastewithinthegeographicalareaofhisjurisd

53、ictionandwhoknowsthatsuchdischargeorthreateneddischargeislikelytocausesubstantialinjurytothepublichealthorsafetymust,withinseventy-twohours,disclosesuchinformationtothelocalBoardofSupervisorsandtothelocalhealthofficer.Nodisclosureofinformationisrequiredunderthissubdivisionwhenotherwiseprohibitedbyla

54、w,orwhenlawenforcementpersonnelhavedeterminedthatsuchdisclosurewouldadverselyaffectanongoingcriminalinvestigation,orwhentheinformationisalreadygeneralpublicknowledgewithinthelocalityaffectedbythedischargeorthreateneddischarge.(c)Anydesignatedgovernmentemployeewhoknowinglyandintentionallyfailstodiscloseinformationrequiredtobedisclosedunder
