1、雇傭合同(兼職)Employment Contract甲方因工作需要,需聘用乙方。根據(jù)雙方協(xié)商,特簽訂本協(xié)議,以便共同遵守執(zhí)行。第一條 用人單位基本T青況:Base on the needs of first party, hire second party. In accordancewith negotiation of two parties, hereby draw up this compact with the terms and conditions as follows甲方first party(用人單位employer)名稱:法定代表人 legal representativ

3、cy contact phone number : 第三條 本協(xié)議自 年 月 日起至 年 月 日止。This compact applyduring the period commencing on the date of and ending on the date of . 第四條根據(jù)甲方工作需要及任職要求,乙方同意以兼職形式為甲方提供如下服務:Base on the needs and requirement of first party, second party provide part-time service as follows:1,與甲方指定客戶進行約見和面談,依甲方要求、協(xié)

4、助甲方處理相關事宜;meet appointed costumers, according to the requirement from first party, provide correlative assistance.2,根據(jù)甲方要求協(xié)助甲方處理緊急事件;Base on the needs of first party, provide assistanceon emergency.3,第五條 甲方每月 日(公歷,遇節(jié)假日順延)支付乙方上月服務報酬,乙方服務報酬(稅前),乙方 的報酬為稅前 ,大寫:By the th day of each month(the Gregorian c

5、alendar, postpone in the case of holidays )Party B s salary isin the probationary period.第六條甲方制定的勞動紀律和規(guī)章制度應當符合法律、法規(guī)的規(guī)定,并向乙方公示,乙方應當在確認后遵照執(zhí)行。 Labor disciplines and regulations which made by first party should fulfill the legal and regulatory requirement, and public notice second party who should act o

6、n this compact after confirming.第七條甲方有權根據(jù)規(guī)章制度對乙方進行獎懲,當乙方嚴重違反甲方的規(guī)章制度時,甲方有權解除本協(xié)議并不給予乙方任何經(jīng)濟 1 卜償。First party has the right to reward or punish second partyaccording to regulations, if second party committed a serious breach of regulations, first party has the right to make dissolution of compact withou

7、t economic compensation to second party.第八條由于雙方的勞動聘用關系,乙方將有機會了解并使用甲方的有關商業(yè)秘密(包括但不限于經(jīng)營策略、軟件系統(tǒng)、薪酬系統(tǒng)、營銷渠道、員工或客戶資料、供應商、價格系統(tǒng)、知識產(chǎn)權等所有資料及文 件),乙方有在協(xié)議期內(nèi)及協(xié)議解除后保守甲方商業(yè)秘密不對外泄露的義務,也不能用于為自己謀取利益的經(jīng)營活動中。乙方不得將涉及甲方商業(yè)秘密的實物、文字材料、電子文檔等以竊取、摘抄、復制、傳真、 拍照、電子郵件等方式占有、傳播、出售、使用或允許他人使用甲方的商業(yè)秘密。本條款所規(guī)定行為,乙 方如有違反,應向甲方支付違約金。Because of t

9、f materials and documents),second party is in duty bound to not disclose the trade secret of first party, nortake advantage of company s trust to seek profit for one s own. Second party must not occupy 、 spread、 sale、 use、or let other people use the article、 written materials 、electronic documentby

10、stealing 、extracting 、copying、faxing、photographing 、emailing and other methods. All the actions under this clause, if second party committed the breach, should pay penal sum of .第九條 乙方有下列情形之一的,甲方可以解除本協(xié)議,但是應當提前十日以書面形式通知乙方:First party could carry out rescission of compact in any of the following circu

11、mstances, however, should notice second party by written form 10 days early.患病或者非因工負傷,醫(yī)療期滿后,不能從事原工作也不能從事由甲方另行安排的工作的;In the case of fall ill or wound in line of duty, when the medical treatment expires, if not be able to participate former work or other appointed work from first party;不能勝任工作,經(jīng)過培訓或調崗,

12、仍不能勝任工作的;Incompetent, after training or transfer-position, still incompetent; 本協(xié)議訂立時所依據(jù)的客觀情況發(fā)生重大變化,致使協(xié)議無法履行,經(jīng)甲乙雙方協(xié)商不能就變更 協(xié)議內(nèi)容達成致的 ;Due to objective reasons, unable to fulfill compact,moreover, can not reach to an agreement with variation on contract.法律、行政法規(guī)規(guī)定可以解除協(xié)議的。Rescission of compact is in accor

13、d with law and administrative regulation.第十條乙方有下列情形之一的,甲方可以單方面隨時解除協(xié)議,并對乙方不作任何經(jīng)濟補償;乙方因下列行為給公司造成損害的,甲方有權要求乙方賠償損失:First party could carry outrescission of compact in the following circumstances at any time, withoutmaking any compensation; first party has the right to let the second party compensate for

14、 loss in any of the following circumstances.(1)在應聘過程中提供的個人證件、體檢、簡歷等個人資料有欺詐行為的;If there were fraud actson personal papers 、 medical certificates 、resume;按公司獎懲的有關規(guī)定,嚴重失職,工作不負責任,玩忽職守、消極懈怠給公司利益造成損害的;In accordance with correlative provision of reward/punish, gross neglect of duty,irresponsible, listless

15、during work, result loss to profit of company. 乙方盜竊公司、員工或客戶財物的; 報銷費用時有虛報或假報金額等行為的 乙方盜竊公司、員工或客戶財物的; 報銷費用時有虛報或假報金額等行為的; Second party stealproperty from company or employees; deception during the process of applying for reimbursement. 泄露公司商業(yè)秘密; 利用職務以權謀私、損公肥私的;Breach of confidence; take advantage ofduty

16、 to seek person profit. 欺詐客戶、公司,謀取私利的,私下從事同業(yè)工作的;Sting client 、 company to seek personalprofit, participate same type of work in secret 結黨營私、破壞員工關系,生活作風不端正的;Form cliques, wreck relationships Betweenemployees, bad lifestyle(immoral love). 違法行為或不良社會行為而給甲方形象造成巨大傷害的;unlawful act or bad behavior whichdimi

17、nish the reputation of Talent. 有賭博、吸毒等不良行為的;gamble 、 drug taking or other bad behavior 被依法追究刑事責任或違法被處罰的;Being undertaken for criminal responsibility orpunished for breaking the law. 嚴重違反公司的勞動紀律、規(guī)章制度的; 法律規(guī)定或雙方約定的其它情形。Committing a serious breach of discipline 、 regulation or other agreement between tw

18、o parties.第十一條乙方解除協(xié)議,應當提前三十日以書面形式通知甲方。Second party makeearly rescissionof compact , should provide 30 days prior notice to first party.第十二條甲乙雙方約定無論何種情形解除協(xié)議,乙方都對工作交接負有責任,須按甲方規(guī)定的程序進行工作交接。乙方不按甲方的規(guī)定交接工作的,甲方有權扣發(fā)乙方服務費; 乙方不按規(guī)定交接工作致使甲方遭受損失時,甲方將依法向乙方索賠。No matter what type the rescission of compact is, second

20、n-fulfillment of second party led to economic losses of first party.第十三條特別約定:special compact 由于乙方為兼職人員,故甲方不需為乙方繳納社會保險。Second party is part-time Job, no needto pay social insurance for. 乙方因病或非因工負傷醫(yī)療費用自行解決,醫(yī)療期內(nèi)甲方不支付報酬。Second party get sick orget wounded not in the line of duty, second party should pay himself. 雙方解除、終止本協(xié)議,甲方無需支付乙方任何經(jīng)濟補
