LawofthePeople'sRepublicofChinaonLaborContracts(Adoptedatthe28thsessionofthe10thNationalPeople'sCongressStandingCommitteeon29June2007TableofContentsChapterIGeneralPrinciplesChapterIIConclusionofLaborContractsChapterIIIExecutionandModificationofLaborContractsChapterIVDissolutionandTerminationofLaborContractsChapterVSpecialProvisionsSectionICollectiveContractsSectionIIStaffingServicesSectionIIIPart-TimeLaborChapterVISupervisionandInspectionsChapterVIILegalLiabilityChapterVIIISupplementaryArticlesChapterIGeneralPrinciplesArticle1Thislawhasbeenformulatedinordertoimprovethelaborcontractsystem,definetherightsandobligationsofthepartiestolaborcontracts,protectthelawfulrightsandinterestsofworkers,andbuildanddevelopharmoniousandstablelaborrelationships.Article2Thislawappliestotheestablishmentoflaborrelationshipsbetweenorganizationssuchasenterprises,individualeconomicorganizations,andprivatenon-enterpriseunits(hereinafterreferredtoas"employerunits"ontheonehandandworkersontheotherhandwithinthePRCterritory,aswellastotheconclusion,execution,modification,dissolution,orterminationoflaborcontracts.Theconclusion,execution,modification,dissolution,orterminationoflaborcontractsbetweenstateagencies,publicinstitutions,orsocialorganizationsandtheworkerswithwhomtheyestablishlaborrelationshipsshallbehandledpursuanttothislaw.Article3Theconclusionoflaborcontractsshallcomplywiththeprinciplesoflawfulness,fairness,equality,freevolition,consensusthroughnegotiations,honesty,andgoodfaith.Alawfullyconcludedlaborcontractisbinding,andboththeemployerunitandtheworkershallperformtheirobligationsstipulatedinthelaborcontract.Article4Employerunitsshallestablishandimprovelaborrulesandregulationsinaccordancewiththelawtoensurethatworkersenjoylaborrightsanddischargetheirlaborobligations.Employerunitsseekingtoformulate,revise,ordecideonrulesandregulationsorsignificantmattersthathaveadirectbearingontheimmediateinterestsoftheirworkers,suchasthoseconcerningremuneration,workhours,rest,leave,worksafetyandhygiene,insurance,benefits,employeetraining,labordiscipline,andworkquotamanagement,shalldeterminethemattersthroughnegotiationssconductedonanequalfootingwithtradeunionsoremployeerepresentatives,afteremployeerepresentatives'conferencesoralltheemployeeshavehelddiscussionsandputforwardproposalsandcomments.Iftradeunionsoremployeesdeemtherulesandregulationsordecisionsonsignificantmattersinappropriateduringthecourseofimplementation,theyareentitledtoraisethematterwithemployerunitsandseektomodifyorimprovethemthroughnegotiationss.Employerunitsshallmakepublicrulesandregulationsordecisionsonsignificantmattersthathaveadirectbearingontheimmediateinterestsoftheirworkersorinformtheworkersthereof.Article5Thelaboradministrativedepartmentsofpeople'sgovernmentsatorabovethecountylevelshall,togetherwithtradeunionandenterpriserepresentatives,establishasoundtripartitemechanismforcoordinatinglaborrelationshipsandjointlystudyandresolvemajorissuesconcerninglaborrelationships.Article6Alaborunionshallassistandguideworkersintheconclusionandexecutionoflaborcontractswiththeiremployerunitsinaccordancewiththelawandestablishacollectivebargainingmechanismwithemployerunitsinordertosafeguardthelawfulrightsandinterestsofworkers.ChapterIIConclusionofLaborContractsArticle7Anemployerunit'slaborrelationshipwithaworkerisestablishedonthedatetheworkerisputtowork.Anemployerunitshallkeeparegisterofemployeesforreferencepurposes.Article8Whenanemployerunithiresaworker,itshalltruthfullyinformhimorherofthejobdescription,workingconditions,theplaceofwork,occupationalhazards,productionsafetyconditions,remuneration,andothermatterswhichtheworkerrequeststobeinformedabout.Theemployerunithastherighttolearnfromtheworkerbasicinformationdirectlyrelatingtothelaborcontract,andtheworkershalltruthfullyprovidesaidinformation.Article9Whenhiringaworker,anemployerunitmaynotretaintheworker'sresidentidentitycardorcardorotherpapers,normayitrequiretheworkertoprovidesuretyorcollectpropertyfromtheworkerundersomeotherguise.Article10Toestablishalaborrelationship,awrittenlaborcontractshallbeconcluded.Intheeventthatnowrittenlaborcontractisconcludedatthetimeoftheestablishmentofalaborrelationship,awrittenlaborcontractshallbeconcludedwithinonemonthafterthedateonwhichtheworkerisputtowork.Whereanemployerunitandaworkerconcludealaborcontractbeforetheworkerisputtowork,thelaborrelationshipshallbeestablishedonthedateonwhichtheworkerisputtowork.Article11Whereanemployerunitfailstoconcludeawrittenlaborcontractwithaworkeratthetimeitsputstheworkertowork,anditisnotclearwhattheremunerationisagreeduponwiththeworker,theremunerationofthenewlyrecruitedworkershallbedecidedpursuanttotheratespecifiedinthecollectivecontract;wherethereisnocollectivecontractorthecollectivecontractdoesnotprovideforthesame,equalpayshallbegivenforequalwork.Article12Laborcontractsaredividedintofixed-termlaborcontracts,open-endedlaborcontracts,andlaborcontractsthatexpireuponthecompletionofaspecificjob.Article13Afixed-termlaborcontractisalaborcontractwhoseexpirationdateisagreeduponbytheemployerunitandtheworker.Anemployerunitandaworkermayconcludeafixed-termlaborcontractiftheyagreetodosoafternegotiations.Article14Anopen-endedlaborcontractisalaborcontractforwhichtheemployerunitandtheworkerhaveagreednottosetadefiniteexpirationdate.Anemployerunitandaworkermayconcludeanopen-endedlaborcontractiftheyagreetodosoafternegotiations.Ifaworkerproposesoragreestorenewhisorherlaborcontractorconcludealaborcontractinanyofthefollowingcircumstances,anopen-endedlaborcontractshallbeconcluded,unlesstheworkerrequeststheconclusionofafixed-termlaborcontract:(1Wheretheworkerhasbeenworkingattheemployerunitcontinuouslyfornotlessthan10years;(2Wheretheemployerunitimplementsthelaborcontractsystemforthefirsttimeorthestate-ownedenterpriseemploystheworkerlaborcontractsanewasaresultofrestructuring,andtheworkerhasbeenworkingattheemployerunitcontinuouslyfornotlessthan10yearsandislessthan10yearsawayfromhisorherlegalretirementage;or(3Wherealaborcontractisrenewed,withafixed-termlaborcontracthavingbeenconcludedontwoconsecutiveoccasionsearlier,andthereisnotanyofthecircumstancesprovidedforinitems(1and(2ofArticle39andArticle40ofthislaw.Ifanemployerunitfailstoconcludeawrittenlaborcontractwithaworkerwithinoneyearfromthedateonwhichitbeginsputtingtheworkertowork,theemployerunitandtheworkershallbedeemedtohaveconcludedanopen-endedlaborcontract.Article15Alaborcontractthatissettoexpireuponthecompletionofaspecificjobisalaborcontractinwhichtheemployerunitandtheworkerhaveagreedthatthecompletionofaspecificjobistheperiodofthelaborcontract.Anemployerunitandaworkermay,uponagreeingtodosoafternegotiations,concludealaborcontractthatissettoexpireuponthecompletionofaspecificjob.Article16Alaborcontractshallbecomeeffectivewhentheemployerunitandtheworkeragreeuponitafternegotiations,andbothofthemhaveaffixedtheirsignaturesorsealstothetextofthelaborcontract.Theemployerunitandtheworkershalleachholdacopyofthelaborcontract.Article17Alaborcontractshallspecifythefollowingmatters:(1Thename,address,andlegalrepresentativeortheprincipalpersoninchargeoftheemployerunit;(2Thename,address,andresidentidentitycardnumberorthenumberofsomeothervalididentitydocumentoftheworker;(3Theperiodofthelaborcontract;(4Thejobdescriptionandplaceofwork;(5Workhours,rest,andleave;(6Remuneration;(7Socialinsurance;(8Laborprotection,workingconditions,andprotectionagainstoccupationalhazards;and(9Othermatterswhichshallbeincludedinlaborcontractsasrequiredbylawsandregulations.Inadditiontotheaforementionedrequisiteterms,anemployerunitandaworkermayagreetostipulateothermattersinthelaborcontract,suchasprobationperiods,training,confidentiality,supplementaryinsurance,andbenefits.Article18Ifadisputearisesduetoalackofclarityinalaborcontractregardingstandardssuchasremunerationorworkingconditions,theemployerunitandtheworkermayrenegotiate.Ifthenegotiationsareunsuccessful,theprovisionsofthecollectivecontractshallapply.Ifthereisnocollectivecontractorthecollectivecontractdoesnotprovideforremuneration,equalpayshallbegivenforequalwork.Ifthereisnocollectivecontractorthecollectivecontractdoesnotspecifysuchstandardsasworkingconditions,relevantstateregulationsshallapply.Article19Ifalaborcontracthasaperiodofnotlessthanthreemonthsbutnotmorethanayear,theprobationperiodmaynotexceedamonth.Ifalaborcontracthasaperiodofnotlessthanayearbutnotmorethanthreeyears,theprobationperiodmaynotexceedtwomonths.Ifalaborcontracthasaperiodofnotlessthanthreeyearsorisopen-ended,theprobationperiodmaynotexceedsixmonths.Anemployerunitmayspecifyonlyoneprobationperiodwithanygivenworker.Noprobationperiodmaybespecifiedinalaborcontractthatissettoexpireuponthecompletionofaspecificjoborifalaborcontracthasaperiodoflessthanthreemonths.Theprobationperiodshallbeincludedintheperiodofalaborcontract.Ifalaborcontractonlystipulatesaprobationperiod,thereshallbenoprobationperiod,andtheperiodinquestionshallbetheperiodofthelaborcontract.Article20Thewagesofaworkeronprobationmaynotbelessthanthelowestpayforthesamejobattheemployerunitorlessthan80percentofthewagesagreeduponinthelaborcontract,andmaynotbelessthantheminimumwagesintheplacewheretheemployerunitislocated.Article21Anemployerunitmaynotdissolvealaborcontractduringtheprobationperiodunlessanyofthecircumstancesprovidedforinitems(1and(2ofArticle39andArticle40ofthislawoccurwiththeworker.Ifanemployerunitdissolvesalaborcontractduringtheprobationperiod,itshallexplainthereasonstotheworker.Article22Ifanemployerunitprovidesspecialfundingforaworker'strainingandgiveshimprofessionalandtechnicaltraining,itmayconcludeanagreementspecifyingtheperiodofservicewiththeworker.Iftheworkerviolatestheagreementontheperiodofservice,heorsheshallpayapenaltyfeetotheemployerunitasstipulated.Thepenaltyfeemaynotexceedthetrainingexpensespaidbytheemployerunit.Thepenaltyfeethattheemployerunitrequirestheworkertopaymaynotexceedthetrainingexpensesthatshallbeallocatedfortheunfulfilledportionoftheperiodofservice.Wheretheemployerunitandtheworkerhaveagreeduponaperiodofservice,thesameshallnotaffectanincreaseintheworker'sremunerationduringtheperiodofserviceunderthemechanismofnormalwageadjustments.Article23Anemployerunitandaworkermaystipulateintheirlaborcontracttheprotectionoftheemployerunit'scommercialsecretsaswellasconfidentialitymattersrelatingtointellectualpropertyrights.Ifaworkerhasanobligationtoprotectconfidentialinformation,theemployerunitmayspecifywiththeworkerclausesrestrictingcompetitioninthelaborcontractorconfidentialityagreementandstipulatethattheworkershallbepaidfinancialcompensationonamonthlybasisduringtheperiodofrestrictionsoncompetitionafterthelaborcontractisdissolvedorterminated.Iftheworkerviolatestheclausesrestrictingcompetition,heorsheshallpayapenaltyfeetotheemployerunitasstipulated.Article24Personnelsubjecttorestrictionsoncompetitionshallbelimitedtoseniormanagementpersonnel,seniortechnicians,andotherpersonnelthathaveobligationstoprotectconfidentialinformationintheemployerunit.Thescope,geographicalareas,andtimelimitsofrestrictionsoncompetitionshallbeagreeduponbytheemployerunitandtheworker,andtheagreed-uponrestrictionsoncompetitionshallnotviolatetheprovisionsoflawsandregulations.Followingthedissolutionorterminationofthelaborcontract,theperiodforwhichapersonmentionedintheprecedingparagraphissubjecttorestrictionsoncompetitionintermsofworkingforacompetingemployerunitthatproducesordealsinthesametypeofproductsorengagesinthesametypeofbusinessashisorhercurrentemployerunit,orintermsofestablishinghisorherownbusinesstoproduceordealinthesametypeofproductsorengageinthesametypeofbusinessshallnotexceedtwoyears.Article25WiththeexceptionofthecircumstancesspecifiedinArticle22andArticle23ofthislaw,anemployerunitmaynotenterintoanagreementwithaworkerthattheworkershallbearpenaltyfees.Article26Alaborcontractshallbeinvalidorpartiallyinvalidif:(1Apartyusesthemeansofdeceptionorcoercion,ortakesadvantageoftheotherparty'sdifficulties,tocausetheotherpartytoconcludeormodifyalaborcontractthatiscontrarytothatparty'srealintentions;(2Theemployerunitdisavowsitslegalliabilityordeniestheworkerhisorherrights;or(3Itviolatesthemandatoryprovisionsoflawsoradministrativestatutes.Iftheinvalidityorpartialinvalidityofalaborcontractisdisputed,itshallbeconfirmedbyalabordisputearbitrationorganorapeople'scourt.Article27Ifalaborcontractispartiallyinvalid,thevalidityofotherportionsshallnotbeaffected,andsaidportionsshallremainvalid.Article28Ifalaborcontractisconfirmedasinvalidandtheworkerhasalreadyprovidedlaborservice,theemployerunitshallpaytheworkerremuneration.Theamountofremunerationshallbedeterminedwithreferencetotheremunerationofworkersholdingthesameorasimilarpositionattheemployerunit.ChapterIIIExecutionandModificationofLaborContractsArticle29Anemployerunitandaworkershallfullyperformtheirrespectivehisobligationsasspecifiedinthelaborcontract.Article30Anemployerunitshallpayitsworkerremunerationontimeandinfullasstipulatedinthelaborcontractandpursuanttostateregulations.Ifanemployerunitfallsbehindwiththepaymentofremunerationorfailstomakepaymentinfull,theworkermay,inaccordancewiththelaw,applytoalocalpeople'scourtforanordertomakepayment;andthepeople'scourtshallissuesaidorderinaccordancewiththelaw.Article31Anemployerunitshallstrictlyimplementworkquotastandardsandmaynotcompelorinadisguisedmannercompelworkerstoworkovertime.Ifanemployerunitarrangesforaworkertoworkovertime,itshallofferovertimepaytotheworkerpursuanttorelevantstateregulations.Article32Workersshallnotbedeemedtobeinviolationoftheirlaborcontractsiftheyrefusetoperformdangerousoperationsdirectedinviolationofrulesandregulationsorperemptorilyorderedbymanagementpersonnelattheemployerunit.Workershavetherighttocriticize,reporttotheauthorities,orfilecomplaintsagainsttheiremployerunitsoverworkingconditionsthatendangertheirlivesorhealth.Article33Whereanemployerunitmodifiesmatterssuchasitsname,legalrepresentativeorprincipalpersonincharge,orinvestor(s,thesameshallnotaffecttheexecutionofalaborcontract.Article34Ifanemployerunitismergedorsplitup,itsexistinglaborcontractsshallremainvalidandshallcontinuetobefulfilledbytheemployerunit(sinheritingitsrightsandobligations.Article35Anemployerunitandaworkermaymodifytheprovisionsoftheirlaborcontractiftheyagreetodosoafternegotiations.Modificationsofalaborcontractshallbemadeinwriting.Theemployerunitandtheworkershalleachholdacopyofthemodifiedlaborcontract.ChapterIVDissolutionandTerminationofLaborContractsArticle36Anemployerunitandaworkermaydissolvetheirlaborcontractiftheyagreetodosoafternegotiations.Article37Aworkermaydissolvealaborcontractbygiving30days'priornoticeinwritingtohisorheremployerunit.Duringtheprobationperiod,aworkermaydissolvethelaborcontractbygivingtheemployerunitthreedays'priornotice.Article38Aworkermaydissolvethelaborcontractifanyofthefollowingcircumstancesariseswithrespecttotheemployerunit:(1Failuretoprovidelaborprotectionorworkingconditionsasspecifiedinthelaborcontract;(2Failuretopayremunerationinfullandontime;(3Failuretopaysocialinsurancepremiumsfortheworkerinaccordancewiththelaw;(4Wheretheemployerunit'srulesandregulationsviolatetheprovisionsoflawsorregulationstothedetrimentoftheworker'srightsandinterests;(5WherethelaborcontractisrenderedinvalidduetothecircumstancesspecifiedinthefirstparagraphofArticle26ofthislaw;or(6Othercircumstanceinwhichlawsoradministrativestatutespermitaworkertoterminatethelaborcontract.Ifanemployerunitusesthemeansofviolence,threats,orunlawfulrestrictionsonpersonalfreedomtoforceaworkertowork,orifaworkerisinstructedinviolationofrulesandregulationsorperemptorilyorderedbytheemployerunittoperformdangerousoperationswhichthreatenhisorherpersonalsafety,theworkermaydissolvethelaborcontractimmediatelywithouthavingtogivetheemployerunitpriornotice.Article39Anemployerunitmaydissolvealaborcontractifanyofthefollowingcircumstancesariseswithrespecttoaworker:(1Beingproventobeunabletomeettheconditionsforemploymentduringtheprobationperiod;(2Gravelyviolatetheemployerunit'srulesandregulations;(3Committingseriousderelictionofdutyorseekingprivategainthroughfraudulentandunlawfulpractices,therebycausingsubstantialdamagetotheemployerunit;(4Wheretheworkerhasestablishedalaborrelationshipwithanotheremployerunitsimultaneously,therebygravelyaffectingthecompletionofhisorhertaskatthefirstemployerunit,orwheretheworkerrefusestotakecorrectiveactionafterthefirstemployerunithasraisedthematter;(5Wherethelaborcontractisrenderedinvalidduetothecircumstancesspecifiedinitem(1ofthefirstparagraphofArticle26ofthislaw;or(6Wherecriminalliabilityispursuedinaccordancewiththelaw.Article40Anemployerunitmaydissolvealaborcontractbygivingtheworker30days'priornoticeinwritingoranadditionalmonthofwagesinanyofthefollowingcircumstances:(1Wheretheworkercannotengageinhisorheroriginalworkoranyotherworkarrangedbytheemployerunitaftertheprescribedperiodofmedicalcareforanillnessornon-work-relatedinjuryhasended;(2Wheretheworkerisincompetentandremainsincompetentaftertrainingortheadjustmentofhisorherposition;or(3Whereamajorchangeintheobjectivecircumstancesuponwhichtheconclusionofthelaborcontractisbasedrendersthelaborcontractnon-executable,and,afternegotiations,theemployerunitandtheworkercannotreachanagreementonmodifyingthelaborcontract.Article41Ifanyofthefollowingcircumstancesmakesitnecessarytoreducetheworkforceby20personsormoreorbyfewerthan20personsbutbyaproportionthataccountsfor10percentormoreofthetotalnumberofemployeesinanenterprise,theemployerunitmayreducetheworkforceafterithasexplainedthecircumstancestothetradeunionortoallofitsemployees30daysinadvance,consideredtheopinionsofthetradeunionortheemployees,andreportedtheworkforcereductionplantothelaboradministrativedepartment:(1RestructuringcarriedoutpursuanttotheprovisionsoftheEnterpriseBankruptcyLaw;(2Seriousdifficultiesinproductionorbusinessoperations;(3Wheretheenterpriseswitchesproduction,introducesmajortechnologicalinnovations,oradjustsitsoperationalmode,and,aftermodifyingitslaborcontracts,stillneedstoreduceitsworkforce;or(4Whereothermajorchangesintheobjectiveeconomiccircumstancesuponwhichtheconclusionofthelaborcontractsisbasedrenderthelaborcontractsnon-executable.Intheeventofaworkforcereduction,priorityshallbegiventoretainingthefollowingpersonnel:(1Thosewhohaveconcludedwiththeemployerunitfixed-termlaborcontractswithrelativelylongperiods;(2Thosewhohaveconcludedopen-endedlaborcontractswiththeemployerunit;or(3Thosewhoaretheonlyonesintheirfamiliestobeemployedandwhosefamilieshaveaseniorcitizenoraminorwhoneedstoprovidedfor.Ifanemployerunitthathasreduceditsworkforcepursuanttothefirstparagraphofthisarticlehiresagainwithinsixmonths,itshallnotifyitsdismissedpersonnelandgiveprecedencetotheminhiringwhentheconditionsareequal.Article42AnemployerunitmaynotdissolvealaborcontractpursuanttotheprovisionsofArticle40andArticle41ofthislawifanyofthefollowingcircumstancesoccursinrespectofaworker:(1Wheretheworkerengagesinhazardousoperationsthatexposehimorhertooccupationaldiseasesandhasnotundergoneapre-departureoccupationalhealthexamination,orwhereheorsheisbeingdiagnosedorisundermedicalobservationasapatientsuspectedofhavingcontractedanoccupationaldisease;(2Beingconfirmedashavinglostorpartiallylostthecapacitytoworkduetoanoccupationaldiseasecontractedorawork-relatedinjurysustainedattheemployerunit;(3Undergoingtheprescribedperiodofmedicalcareforanillnessoranon-work-relatedinjury;(4Whereafemaleemployeeispregnant,isinconfinement,ornursing;(5Havingworkedcontinuouslyattheemployerunitfornotlessthan15yearsandislessthanfiveyearsawayfromthelegalretirementage;or(6Othercircumstancesspecifiedinlawsandadministrativestatutes.Article43Whereanemployerunitplanstodissolvealaborcontractunilaterally,itshallgivethetradeunionadvancenoticeofthereasons.Iftheemployerunitviolatestheprovisionsoflawsandadministrativestatutesorthelaborcontract,thetradeunionhastherighttodemandthattheemployerunittakecorrectiveaction.Theemployerunitshallstudythetradeunion'sopinionsandnotifythetradeunioninwritingoftheoutcomeofitshandlingofthematter.Article44Alaborcontractshallbeterminatedinanyofthefollowingcircumstances:(1Wheretheperiodofthelaborcontractexpires;(2Wheretheworkerhasbegundrawinghisorherbasicold-ageinsurancebenefitsinaccordancewiththelaw;(3Wheretheworkerdiesorisdeclareddeadormissingbyapeople'scourt;(4Wheretheemployerunitisdeclaredbankruptinaccordancewiththelaw;(5Wheretheemployerunithasitsbusinesslicenserevoked,isorderedtocloseorhasitsqualificationsrevoked,ordecidestodisbandaheadoftime;or(6Othercircumstancesspecifiedinlawsoradministrativestatutes.Article45IfalaborcontractexpiresandanyofthecircumstancesspecifiedinArticle42ofthislawapplies,thelaborcontractshallbeextendeduntiltherelevantcircumstanceceasestoexist,atwhichpointthecontractshallend.However,mattersrelatingtotheterminationofthelaborcontractofaworkerwhohaslostorpartiallylostthecapacitytoworkasspecifiedinitem(2ofArticle42ofthislawshallbehandledpursuanttostateregulationsconcerningwork-relatedinjuryinsurance.Article46Inanyofthefollowingcircumstances,anemployerunitshallpayaworkerfinancialcompensation:(1WherethelaborcontractisdissolvedbytheworkerpursuanttotheprovisionsofArticle38ofthislaw;(2WherethelaborcontractisdissolvedafterthedissolutionisproposedtotheworkerbytheemployerunitpursuanttotheprovisionsofArticle36ofthislawandthepartieshavereachedanagreementafternegotiations;(3WherethelaborcontractisdissolvedbytheemployerunitpursuanttotheprovisionsofArticle40ofthislaw;(4WherethelaborcontractisdissolvedbytheemployerunitpursuanttotheprovisionsofthefirstparagraphofArticle41ofthislaw;(5Wherethelaborcontractisafixed-termcontractthatisterminatedpursuanttotheprovisionsofitem(1ofArticle44ofthislaw,unlesstheworkerdoesnotagreetorenewthecontracteventhoughtheconditionsofferedbytheemployerunitforrenewalarethesameasorbetterthanthosestipulatedinthecurrentlaborcontract;(6Wherethelaborcontractisterminatedpursuanttoitems(4and(5ofArticle44ofthislaw;or(7Othercircumstancesspecifiedinlawsoradministrativestatutes.Article47Aworkershallbepaidfinancialcompensationbaseduponthenumberofyearsworkedattheemployerunit,attherateofonemonth'swagesforeachfullyearworked.Anyperiodofnotlessthansixmonthsbutnotmorethanayearshallbecountedasayear.Thefinancialcompensationpayabletoaworkerforaperiodoflessthansixmonthsshallbeone-halfofhisorhermonthlywages.Ifthemonthlywagesofaworkerarehigherthanthreetimestheaveragemonthlywagesofemployeesinthelocalareafortheprecedingyearaspublishedbythepeople'sgovernmentofthemunicipalitydirectlyunderthecentralgovernmentorofthecitydividedintodistrictswheretheemployerunitislocated,therateatwhichfinancial勞動(dòng)合同法LawofthePeople'sRepublicofChinaonLaborContractscompensationistobepaidshallbethreetimestheaveragemonthlywagesofemployees.Themaximumperiodoffinancialcompensationshallnotexceed12years.Themonthlywagesreferredtointhisarticledenotetheworker'saveragemonthlywagesinthe12monthspriortothedissolutionorterminationofthelaborcontract.Article48Ifan
