理評(píng)估您保證提供給的信息是真實(shí)可靠的，其中包括您提供給的文件和其他信息。如果信息有變，請(qǐng)您以形式告知。文件副本如果是通過(guò)電郵，電傳等電子傳輸方式提供給，意味著您保證該種傳輸方式提供的檔是忠實(shí)于原文件的。如果違返該保證，則意味著您默認(rèn)允許I關(guān)閉所有未平倉(cāng)交易，并根據(jù).3條款關(guān)閉賬戶(hù)。您屬于由FINMA條例中定義的散戶(hù)類(lèi)型API和客戶(hù)之間達(dá)成的協(xié)議如“該協(xié)議”指API商業(yè)條款，客戶(hù)協(xié)議以及附件為一體的文件，包括但不僅限于風(fēng)險(xiǎn)警告提示，適用于特定交易的條款術(shù)語(yǔ)以及包括適用于不同交易平臺(tái)的止損訂單在內(nèi)的附件。API可以根據(jù)條款15.2修改該協(xié)議該協(xié)議中所有由大寫(xiě)字母形式標(biāo)出但未進(jìn)行定義的條款在附件賬TheClientherebyinstructsAPItoestablishtheAccountonAPI’sbooksinthenameoftheClient.TheClientacknowledgesandacceptsthattheAccountwillbemaintainedinUSDollars,unlessotherwiseagreedbetweenusinwriting.TheClientrepresents,warrantsandundertakesthattheClientisactingfortheClient'ssolebenefitandnotfororonbehalfofanyother orentityandallTransactionsareandwillbecarriedoutforthesolebenefitoftheClient.TheClientistheonly orentityauthorizedorpermittedtoenterintoTransactionsfortheaccount.IftheClientappointsanagent,theClientherebyacknowledgesandagreesthatheshallbesolelyresponsbleforallactsand/oromissionsoftheagent,andneitherAPInoranyofitsaffiliatesnortheofficers,directors,managers,agentsoremployeesofAPIoranyAPIaffiliateshallbeliabilitytotheClientforanysuchactionsoromissions,whetherornotwithinthescopeoftheagent’sIftheClientismorethanone ,allsuch sshallbejointlyandseverallyliableforallobligationsoftheClientunderthisAgreement.Insuchevent(unlessotherwiseagreedinwritingbetweentheClientandAPI)thesole orentityauthorizedtoenterintoorcloseoutTransactionsfortheAccountisthefirstofsuch smentioned.WithdrawalsfromtheAccount(inaccordancewithClause5.1)mayrequirethesignaturesofsidentifiedastheTheClientisrequiredtosubmitacopyofidentification(frontandbackforIdentificationcard)eitherbypostorinlinesubmissionwithin30daysfromthedateofaccountYouwillbeauserofAPI’sTradingPlatformandthespecifictermsapplicabletoeachplatformaresetoutinSchedule3.YoumayenterintoTransactionsfortheAccountbyephone(subjecttoClause20),throughtheTradingPlatform,orthroughothermobileplatformsthatmay eavailablefromtimetotime,inaccordancewithAPI’sstandardpracticesandproceduresineffectfromtimetotimeandnotifiedtotheClientthroughtheTradingPlatformand/orinSchedule3asapplicable.AllTransactionsareenteredintobytheClientasprincipal,attheClient'ssoleresponsibility,riskandexpenseandsubjecttothetermsandconditionssetoutinthisAgreementasamendedfromtimetotime.APIdoesnotguaranteethatanyTransactionorTransactionscanbeenteredintoatanygivenpriceoratallbutshalluseitsreasonableeffortstoeffectTransactions.WemayinourabsolutediscretionandwithoutfurtherexplanationtoyourefuseanyTransactionandinparticularwewilldosoifweconsideringoodfaiththattheTransactionwouldbreachanycreditorpositionlimitsimposedbyAPIwithrespecttotheAccountorthattheresultingTransactionwouldbeinbreachofthisAgreementoranylaw,regulationorruleapplicabletoAPI,theClient,theAccountortheTransaction.TheClientherebyacknowledgesandagreesthat(i)APIwillenterintoTransactionsatitssolediscretionandwillactasprincipalwithrespecttoallTransactions;and(ii)APIwillnotanddoesnotprovideanyadvice,consultingorintermediaryservicestotheClient;(iii)HYMarketsmayatitssolediscretioncoveranyTransaction,inwholeorinpart,inanymanneritconsidersappropriate,whetherbywayofset-offwithaTransactionwithorforanotherofitsClientsorotherwise;and(iv)excepttotheextentrequiredunderanylaworregulationapplicabletoAPIortheAccount,nothinginthisAgreementorintherelationshipbetweenAPIandtheClientshallorshallbedeemedtocreateanyagencyorfiduciaryrelationshipbetweenAPIandtheClient.IfanyspotforexTransactionisnotclosed-outbythe

I權(quán)在不通知客戶(hù)的情況下改變點(diǎn)差。API的報(bào)價(jià)是由API經(jīng)過(guò)審慎斟酌之后訂立的?？蛻?hù)只能夠按照API的當(dāng)前定價(jià)進(jìn)行交易。在報(bào)價(jià)之后，客戶(hù)接受價(jià)格并進(jìn)行交易時(shí)，價(jià)格可能隨時(shí)發(fā)生變化。請(qǐng)參見(jiàn)以下條款12.2.2和12.2.3。API通過(guò)慎重的考慮，在給出通知后可能向您提供“市場(chǎng)客戶(hù)進(jìn)行的交易設(shè)有最大限制，由API經(jīng)過(guò)深思熟慮后設(shè)置API將通過(guò)交易平臺(tái)給出通知告示我們根據(jù)您或由您的個(gè)人給出的指示，要求和通知（不管是否面或其它方式）進(jìn)行活動(dòng)。我們的報(bào)價(jià)可能會(huì)遇到錯(cuò)誤。在不損害我們或sufficientmarginasdeterminedbyAPIinitssolediscretionfromtimetotimeandofwhichtheClientwillbegivenNoticefromtimetotime(a“MarginCall”).MarginCallswillnotnormallybemadebyephonebutwereservetherighttodosoifinourabsolutediscretionthecircumstancessowarrant.WhentheAccountisopened,theClientwilltransferintotheAccountafirstmargindepositofnotlessthansuchminimumamountasmaybeestablishedbyAPIfromtimetotimeandnotifiedtotheClient.SuchfirstdepositmaybemadebybanktransferorcreditcardpaymentorsuchothermethodasmaybeagreedbetweenAPIandtheClient.SuchfirstdeposittogetherwithsubsequentmargindepositsmadebytheClientfromtimetotimeandanyprofitsandlossesfromexistingopenandclosedTransactions,creditsanddebitsfromdailyrollovers,andchargesfromcommissions,ifapplicable,shallserveastheguaranteefortheperformanceofTransactionsintheAccount.APImay,initsabsolutediscretionatanytimechangetheminimummarginrequirementormakeaMarginCallrequiringtheClienttomakefurthermargindepositsintheAccount.TheClientshallifrequestedbyAPI,makefurthermargindeposit.Pleasenotewewillnotacceptanythirdpartypaymentsmadeinrespectoffundingyouraccount.Similarlywewillnotpayoutanyfundsfromyouraccounttoanythirdparty.Iftheclientfailstoprovideanymargin,depositorothersumdueinrespectofanytransactionAPImaycloseallopencontractswithoutpriornotice.WithdrawalfromandClosingoftheAccountbytheTheClientmayrequestAPItopermitwithdrawalfromtheAccountofanysuminexcessofClientinitialdepositfromtimetotimebyprovidingAPIwithawritteninstructioninaformacceptabletousfromtimetotime.WithoutprejudicetoanyrightsofAPIunderthisAgreement,APIshalltransfersuchexcessAccountamounts(ifany,andasdeterminedbyAPIinitssolediscretion),lessanyapplicableBankorothertransferfees,accordingtotheClient'sinstructionswithinseven(7)BusinessDaysfromthedateofreceiptoftheapplicablewritteninstruction.FortheavoidanceofdoubtanysuchtransferbyAPIissubjectto(i)applicablelawsandregulationsincludingbutnotlimitedtoanti-moneylaundering,taxauthorities’requirementsfordeductionatsourceandexchangecontrolforeigncurrencytransferrestrictions,and(ii)theClientprovidingfullidentificationationasrequiredbyAPI.5.3IftheClientwishestowithdrawallexcessfundsfromtheAccountandclosetheAccount,theClientshallsonotifyAPItheirinstructionstoAPI,andfollowingthetransfer(ifany)madebyAPIpursuanttosuchrequest,APIshallclosetheAccountinaccordancewithClause11.Charges&Chargesandcommissionsapplicabletoyouraccountwillbeagreedwithyoubeforeenteringintoanytransactionandwillbeshownonthestatementsenttoyou.Insuchanevent,theCommissionswillbechargedtotheAccount.Commissionsandchargesmaybechangedfromtimetotimewithoutpriornoticetoyou.(PleaserefertoSchedule5fordetailspertainingtofeesandWewillmakeavailabletoyouthroughtheTradingPlatform,thefollowingreportsrelatingtotheAccountandTransactions.DailystatementssettingoutdetailsofeachTransaction(includingvalueandexchangerate)executedpriorto4:00pmEasternStandardTimeonanybusinessdaywillbesentnolaterthanthenextbusinessdayafterthedayanyTransactionisenteredintoorremainsopen.
