農(nóng)村土地流轉(zhuǎn)的制度優(yōu)化研究,法律碩士論文本篇論文目錄導(dǎo)航：【第1部分】農(nóng)村土地流轉(zhuǎn)的制度優(yōu)化研究【第2部分】【第3部分】【第4部分】【第5部分】摘要農(nóng)村、農(nóng)業(yè)、農(nóng)民即三農(nóng)問題一直是我們國家社會(huì)發(fā)展的關(guān)鍵，它直接關(guān)系到國家的長治久安和國民經(jīng)濟(jì)健康有序發(fā)展，而土地作為農(nóng)民賴以存在的根本，是解決三農(nóng)問題的核心所在。而農(nóng)村土地制度是農(nóng)村土地問題解決的關(guān)鍵，所以對(duì)于農(nóng)村的土地制度應(yīng)該進(jìn)行契合時(shí)代要求的革新。農(nóng)村土地使用權(quán)利的自由流轉(zhuǎn)已經(jīng)是現(xiàn)代農(nóng)業(yè)發(fā)展的趨向，因此完善我們國家農(nóng)村土地流轉(zhuǎn)制度是完善農(nóng)村土地制度的必要之舉。新中國成立至今，我們國家土地制度經(jīng)歷了三次重大變革，即新中國成立初期的土地改革、合作化運(yùn)動(dòng)與人民公社化運(yùn)動(dòng)、家庭聯(lián)產(chǎn)承包責(zé)任制。自此以后，農(nóng)村土地承包經(jīng)營權(quán)流轉(zhuǎn)的規(guī)模和速度超過以往任何一個(gè)時(shí)期，農(nóng)民們的生產(chǎn)熱情被極大的調(diào)動(dòng)起來，也極大地促進(jìn)了三農(nóng)經(jīng)濟(jì)的快速發(fā)展。但是，我們國家現(xiàn)有農(nóng)村土地承包經(jīng)營權(quán)流轉(zhuǎn)制度還很不完善，存在眾多缺陷和缺乏，無法知足農(nóng)村土地承包經(jīng)營權(quán)流轉(zhuǎn)的現(xiàn)實(shí)需要。這樣的現(xiàn)實(shí)狀況，對(duì)于我們國家農(nóng)業(yè)的當(dāng)代化發(fā)展是不利的。尤其是對(duì)農(nóng)民的親身利益的保障是無法得到有效保衛(wèi)。對(duì)于農(nóng)村土地流轉(zhuǎn)經(jīng)過中產(chǎn)生的問題，本文就怎樣完善和改良現(xiàn)行農(nóng)村土地承包經(jīng)營權(quán)相關(guān)法律制度，在闡述農(nóng)村土地流轉(zhuǎn)的制度現(xiàn)在狀況和現(xiàn)實(shí)窘境的前提下，提出一些合理化設(shè)想，為我們國家土地承包經(jīng)營權(quán)流轉(zhuǎn)法律制度的完善提供一些新的思路。全文共劃分為三個(gè)部分，華而不實(shí)不包含引言和結(jié)論部分。第一部分，主要闡述土地承包經(jīng)營權(quán)流轉(zhuǎn)的制度現(xiàn)在狀況和現(xiàn)實(shí)窘境?，F(xiàn)實(shí)是制度的前提基礎(chǔ)，只要在闡述現(xiàn)實(shí)情況的前提下，才能完善相關(guān)制度。本部分從我們國家現(xiàn)行的關(guān)于土地承包經(jīng)營權(quán)流轉(zhuǎn)的制度開場著手，闡述關(guān)于土地的制度現(xiàn)在狀況，進(jìn)而分析關(guān)于農(nóng)村土地流轉(zhuǎn)的現(xiàn)實(shí)窘境。這是研究流轉(zhuǎn)制度的前提鋪墊。第二部分，闡述土地承包經(jīng)營權(quán)流轉(zhuǎn)的意義。這一部分以農(nóng)村土地流轉(zhuǎn)的實(shí)際影響功用作為前提基礎(chǔ)，闡述了土地流轉(zhuǎn)的現(xiàn)實(shí)價(jià)值。本部分主要從土地承包經(jīng)營權(quán)的流轉(zhuǎn)有利于農(nóng)業(yè)發(fā)展、有利于土地資源優(yōu)化配置、有利于土地的規(guī)模化經(jīng)營、有利于發(fā)揮土地效益、有利于保障農(nóng)民利益和有利于維護(hù)土地和諧發(fā)展等六個(gè)方面進(jìn)行了分析，為研究農(nóng)村土地承包經(jīng)營權(quán)流轉(zhuǎn)制度打下了理論前提。第三部分，主要闡述農(nóng)村土地承包經(jīng)營權(quán)流轉(zhuǎn)制度的完善。以我們國家農(nóng)村土地承包經(jīng)營權(quán)流轉(zhuǎn)的制度現(xiàn)在狀況和現(xiàn)實(shí)窘境為基礎(chǔ)，進(jìn)而闡述農(nóng)村土地承包經(jīng)營權(quán)流轉(zhuǎn)方式的完善、流轉(zhuǎn)程序的完善、救濟(jì)方式的完善、登記制度的完善、相關(guān)配套制度的完善及農(nóng)民權(quán)益的保障等方面，繼而對(duì)我們國家的農(nóng)村土地承包經(jīng)營權(quán)流轉(zhuǎn)制度的完善略盡綿薄之力。本文關(guān)鍵詞語：土地承包經(jīng)營權(quán)，流轉(zhuǎn)，制度完善AbstractTherural,agricultureandfarmerproblem,namelythethreeruralissuesisthekeyaspectofChinesesocialdevelopmentandithasadirectbearingonthelastingpoliticalstabilityofthestateandthehealthyandorderlydevelopmentofnationaleconomy;besides,sincethelandiswhatthefarmersneedtosurvive,itisthekeyaspectforsolvingthethreeruralissues.Inaddition,therurallandsystemisthekeyaspectforsolvingtherurallandissues;therefore,therurallandsystemshouldbereformedaccordingtothedemandsofthetime.ThefreecirculationofrurallanduserighthasbecamethetendencyofmodernagriculturaldevelopmentandthustheimprovementofChineserurallandcirculationsystemisnecessaryfortheimprovementofrurallandsystem.SincethefoundationofnewChina,thelandsystemhasexperiencedthreemajorrevolutions,includingthelandreformintheearlyPRC,thecooperationmovementandmovementtoformruralpeoplescommunesandthehouseholdcontractresponsibilitysystem.Sincethen,thecirculationscaleandspeedoftherurallardcontractingrightshasexceededthatatanyotherhistoricalperiodoftimeandthefarmersenthusiasmforproductionisaroused,whichgreatlypromotestherapidexpansionofthreeruraleconomies.However,theexistingcirculationsystemofrurallandcontractingrightsisnotperfectandhasmanydefectsanddefcienciesandthuscantsatisfythepracticalneedsofthecirculationofrurallandcontractingrights.Suchrealisticconditionisdisadvantageousforthemodernizeddevelopmentofagricultureinourcountry.Inparticular,theimmediateinterestsofthefarmerscannotbeprotectedeffectively.Fortheproblemsarisingduringtherurallandcirculationprocess,somereasonableconceptionsareputforwardforperfectingandimprovingtherelevantlegalsystemsoftherurallandcontractingrightsinforceunderthepremisethatthepresentsituationandrealisticdifficultpositionofrurallandcirculationareexpoundedsoastoprovidesomenewideasfortheimprovementofthelegalsystemsofcirculationoflandcontractingrightsinChina.Thethesiscanbedividedintothreeparts,notincludingtheintroductionandconclusionparts.Inthefirstpart,thepresentsituationandrealisticdifficultpositionofcirculationoflandcontractingrightsareelaborated.Realityistheprerequisiteforthesystemandonlyunderthepremisethatthecurrentstateisexpounded,therelevantsystemcanheimproved.Inthispart,startingfromtheexistingsystemsonthecirculationoflandcontractingrights,thepresentsituationoflandsystemisstatedinordertoanalyzetherealisticdifficultpositionofrurallandcirculation,hesecondpart,thesignificanceofcirculationoflandcontractingrightsisexpounded.WiththeactualinfluenceofrEUallandcirculationasthepremise,therealisticvalueoflandcirculationisdiscussed.Thispartisanalyzedfromtheaspectsthatthecirculationoflandcontractingrightsisbeneficialtotheagriculturaldevelopment,theoptimizationoflandresource,thescaleoperationofland,theproductionoflandefficiency,theguaranteeoffarmersinterestsandthemaintenanceoft
